Аннотация: INTRODUCTION: Agricultural workers' health depends on many factors: working conditions, security arrangements, medicine, quality of drugs, the environment, etc. Occupational injuries and diseases are also among the factors that can negatively affect their health. THE AIM: To analyze provisions of the international legislation and scientific literature concerning existence of restrictions on impact of occupational injuries and diseases on agricultural workers' health. MATERIALS AND METHODS: International acts, data of international organizations and conclusions of scientists have been examined and used in the study. The article also integrates information from scientific journals and monographs from a medical and legal point of view with scientific methods. This article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. Impact of occupational injuries and diseases on agricultural workers' health has been studied within the system approach, as well as analysis and synthesis. CONCLUSIONS: The level of occupational morbidity, traumatism and above all standard of agricultural workers' health depends on the way of occupational safety organization. Working conditions and safety in agricultural industry and therefore the appropriate standard of health remain unsatisfactory in many countries.

Аннотация: Today, the successful competition of any domestic enterprise in the market of goods and services is conditioned on the use of new technologies and production processes. Such activity is innovative and plays a leading role in its life. Exacerbation of competition and decrease of competitiveness of domestic enterprises necessitate their innovative development. Information, intelligence, knowledge and innovation, which are the backbone of the country's human resources, are of particular importance in this context today. Therefore, the driving factors in the way of formation of personnel component of innovative development of the state economy are the training of innovative personnel – skilled workers, capable of creative work, professional development, introduction of high-tech technologies on the basis of development of the system of lifelong learning. The issues of professional development of employees are becoming especially relevant in the context of globalization, as well as the European and innovative integration of Ukraine. The author investigates the peculiarities of transformations of modern theoretical and legal approaches to professional development of employees in the context of European integration, human-centered and innovative approaches to doing business, in particular, the following tasks are solved: (1) the essence of the concepts of ‘professional development’, ‘functions of professional development of employees’, ‘professional training’ as legal categories is revealed; (2) leading functions of professional development of employees are generalized; (3) the vectors for further reform of the legal regulation of professional development of employees are determined; (4) the prospects and problems of influence of professional development of employees on the innovative development of individual enterprise and Ukraine as a whole are established. The author substantiates that the professional development of employees produces its direct impact both on individual enterprises and on the state as a whole in the sphere of innovative transformations. Undoubtedly, the gradual introduction of European standards and requirements, the adaptation of foreign legal regulation to the domestic realities and features of the legal system will allow to increase the economic potential, innovative component and competitiveness of Ukraine in the world market, as well as to bring the prospects of gradual accession into the European Union.

Аннотация: The Covid-19 coronavirus pandemic forced the administrative staff of agricultural enterprises to work from home, thus raising the issue of remote workforce motivation. Whenever employees are working from home, their activity needs coordination and control over the fulfillment of job responsibilities. The study proposes that efficient functioning and motivation of remote workforce be achieved through the creation of team, which will fully use the potential of every employee and coordinate their joint efforts for the sake of attainment of company goals and objectives. The coaching method is suggested as the way to build a team. Such team will possess a relevant intellectual potential and troubleshooting flexibility. An efficient team is capable of raising labor productivity, which will improve the company’s position on the market and will generate additional revenue for financial motivation of employees.

Аннотация: The article presents a brief analysis of the situation in Belarus and Ukraine with the spread of coronavirus COVID-19 and measures taken by employers to optimise labour and social security relations during 2020. A brief overview of the decisions taken by Presidents, Parliaments, Governments and Ministry of Healthcare of both countries aimed at containment of coronavirus infection is presented. The latest changes in the Labour Code of Belarus and Labour Code of Ukraine, which regulated remote work since 2020, were touched upon. Attention is paid to the concept of self-isolation under the legislation of Belarus and Ukraine, restrictive measures that must be observed when self-isolating citizens in connection with COVID-19 infection, as well as level 1st and 2nd contacts. The authors analyse the new legislative provisions governing home and remote work, introduced into the labour legislation in Belarus in 2020, in Ukraine in 2020 and 2021. The article presents the specific experience of Belarus, where the presidential decree extended the rights of employers to temporarily transfer employees without their consent, as well as to change essential working conditions, and without making changes to the Labour Code. The authors give an assessment of such legislative innovations. The article deals with some issues of social support for employees who find themselves in a situation of downtime due to the suspension of the activities of organisations that are idle, as well as self-isolation. At the end of the article, some suggestions and recommendations are made for further adaptation of labour and social security legislation in Belarus and Ukraine in the context of the COVID-19 pandemic.

Аннотация: The present article deals with the legislation on labor protection in the construction of the European Union and compares it with the law ofUkraineandAzerbaijan. The main focus of the paper is on Council Directive 92/57/EEC of 24 June 1992 on the implementation of minimum safety and health requirements at temporary or mobile construction sites. Comparing its content with the legislation on labor protection at the construction sites ofUkraineandAzerbaijan, the authors conclude that the guarantees of the right to labor protection in the EU cover a much wider range of subjects than in other states. This is due to the fact that the term «worker», in accordance with the case-law of the Court of Justice, covers persons who performs services for and under the direction of another person; pursues real, genuine activities, to the exclusion of activities on such a small scale as to be regarded as purely marginal and ancillary; in return for which he receives remuneration. In addition, guarantees of labor protection in the EU extend to the self-employed person, whose professional activity contributes to the completion of a project. Proposed ways to adapt Ukrainian and Azerbaijani legislation to EU law.

Аннотация: The study analyses the question of the essence and structure of statutory regulation of occupational health and safety in the Republic of Poland. The relevance of the subject under study is primarily explained by the fact that in Poland, against the background of undoubted economic success, there is an intensive process of improving the legal and organisational foundations of the corresponding range of social and labour relations. The study of this issue is of paramount importance for those countries that had approximately the same “starting conditions” with Poland – the recurrence of state socialism, which devalued the principles of a market economy and the possibility of full protection of working people. The purpose of this study is to present and substantiate the systemic features of occupational health and safety in the Republic of Poland in difficult present-day conditions. The study is based on understanding the methodology as a complex integrated system of perception of reality and scientific cognition, and conducted based on the necessary scope of methods, namely: method of system analysis, historical legal method, structural-functional method, comparison method, special comparative legal method, and cross-temporal analysis. The authors of the present paper noted that the statutory regulation of occupational health and safety in the Republic of Poland has all the features of systemic nature. Most importantly, this is explained by the harmonious correlation of two components: purely statutory and legal support of the corresponding share of social and labour relations. Notably, the statutory regulation of occupational health and safety is undergoing continuous improvement depending on current challenges and threats. For countries that have been united with Poland in the recent past in the form of state socialism, the experience of establishing the work of tripartite participants in social dialogue (government agencies, employers' and workers' representatives) is also important. The scientific value of the present paper primarily lies in the necessity and feasibility of analysing the systemic features of statutory regulation of occupational health and safety. In this case, it is important to use both the method of system analysis and a clear distinction between the concepts “system research” and “research of systems” (the latter in this case appears both as a system of legal regulation of occupational health and safety and as a complex set of public authorities and other organisations involved in the important task of ensuring due occupational health and safety).

Аннотация: At the stage of the development of a new social welfare system in Ukraine, it is important to investigate all possible models and develop recommendations for the implementation of the most effective ones. The relevance of this paper lies in the study of the legal framework that operates in Ukraine and the possibilities of its improvement and consolidation into a more specific regulation. The purpose of the research was to study the principles of the social welfare system in Ukraine and to study foreign practices of the social welfare system. Within the framework of this study, the existing systems and models of social welfare systems in different countries were analyzed. The study identifies the most positive examples of social welfare policy for implementation in the current legal framework to improve and enhance the quality of social services in Ukraine. The analyzed foreign practices helped to identify the most effective models of social security. It was concluded that with the successful redistribution of funds, the introduction of a system of audit and control of social assistance financing, as well as being guided by foreign experience, Ukraine will be able to build a social welfare system that would satisfy all of the existing social needs of citizens.
