Аннотация: The author discusses the relationship between two legal orders: international law and European Union (EU) law. The main provisions of this relationship have been established through the precedential practice of the Court of Justice of the European Union – the EU’s main judicial body. This kind of research seems important because of the gap in the theory of international law caused by the immutable dogma of the supremacy of international law. However, modern legal practice demonstrates a certain fragmentation of the international legal order because of the impact of the existence and development of regional supranational legal orders. The EU legal order, with its own special nature (sui generis), is undoubtedly one of the most developed among them. The Court of Justice of the European Union performs a crucial role in the EU legal system concerning application and interpretation of EU law. It provides auniform interpretation of this law for the purposes of development of supranational integration. In this context the Court of Justice the European Union establishes the status of European law and its relationship with the national legal systems and international law. The Court acts as protector of the EU legal order against the influence of other legal orders. The Court’s precedential practice reveals EU law’s tendency towards its constitutionalization and the development of its autonomy. The latest practice indicates the Court’s powers to review the EU institutions’ acts in relation to the implementation of UN Security Council resolutions. This proves the Court’s ability to establish indirect control even over UN acts.

Аннотация: The article focuses on the right to be forgotten, which is at the center of changes in the concept of human rights in the digital age. The origins of the right to be forgotten in European legal doctrine and judicial practice, as well as its relationship with autonomy and identity, are analyzed. The article also examines the significance of the new understanding of "time" and "data" for the adoption of this right, considering the influence of two key cases of the Court of Justice of the European union, such as Google v. Spain [2014] and Google v. CNIL [2019] on the concept of the right to be forgotten. The place of this right, its connection with privacy and European data protection law is debated. The article focuses on jurisdictional issues, paying particular attention to both the right to be forgotten and the understanding of the relationship between privacy and freedom of expression in the European union and the united States, and possible jurisdictional disputes around the world. The article also addresses the issue of balancing rights and legitimate interests, as well as the proportionality for applying the right to be forgotten, both in the European and global contexts.

Аннотация: The relevance of the study is conditioned by the necessity of establishing the degree of interaction of universal rights and freedoms of the individual in civil and international law, as well as the possibility of limiting state sovereignty in the implementation of international obligations to ensure and protect human rights. The purpose of the paper is to investigate the international experience of legal regulation of universal human rights in order to develop ideas for their implementation in the legal framework of countries in transformation, including Ukraine. The leading methods of the study included the analysis of international and European practices of consolidating universal human and civil rights, modelling of legal structures acceptable to Ukraine. As a result of the study, it was concluded that the restriction of state sovereignty is possible only in favour of the individual based on the priority of human rights. The research materials can be useful for lawyers and government officials performing draft law activities, teachers of law schools, as well as officials and public administration officials who seek to apply the standards and practices of international regulation of universal human and civil rights in individual management cases.

Аннотация: This article provides an overview of the key principles of the state's fulfilmentt of the positive obligation to protect human rights from violations by business during the crisis caused by COVID 19: balancing the need to ensure public health and human rights protection; balancing the competing rights of non-state actors with taking into account the concept of the right to security as freedom from fear and freedom from want; implementation of the international human rights law requirement on restriction of human rights, including the derogation from international human rights obligations. The second part of the article is an overview of the results of a survey on the implementation by various countries around the world of the obligation to protect human rights from business violations during COVID 19. The purpose of the survey was to summarize the information about different countries obtained according to the proposed criteria to identify the main regulatory models that states use to fulfil their obligation to protect human rights from business violations in time of COVID 19.

Аннотация: The article is devoted to the content of legal instruments in terms of tourism business, namely the problems of legal regulation of the contract for the provision of tourist services. The analysis of the state of development of this problem shows that the issue of legal regulation of contractual relations in general and the contract in tourist services in general is insufficiently studied. This is due to various factors, including the fact that constant integration processes to the international community force Ukraine to adjust its domestic legislation in accordance with international requirements, but these measures are often inconsistent or incomplete, so there are many contradictions in modern Ukrainian civil law. The author's vision of the content of the package of measures that can positively influence not only the development of the tourism industry in general, but primarily to help identify those legal segments that need improvement in the future.

Аннотация: The task of this paper is to study the role of international human rights organizations in response to the conflict taking place in eastern Ukraine. The study is based on recent reports from the Office of the UN High Commissioner for Human Rights and the OSCE on Ukraine. The relevance of the stated topic is determined by the situation with human rights violations in the armed conflict in Ukraine and the significant role of international human rights organizations, making active efforts to resolve it. The purpose of this study is to determine the main aspects of the role that international organizations play in resolving this range of issues. This will help to identify potential opportunities to tackle the problem with human rights violations in the Ukrainian territories. The study combines quantitative and qualitative research of the entire spectrum of issues brought into the subject. The main results obtained are: analysis of the role and place of international human rights organizations in assessing the situation with the conflict in the Ukrainian territories and obtaining statistical information on the current status of human rights violations in these territories. The value of this paper lies in obtaining practical recommendations for finding ways to peacefully resolve the conflict in the East of Ukraine and implementing comprehensive measures to create conditions for the protection of human rights in this region. © 2021, National Academy of Legal Sciences of Ukraine.

Аннотация: This article studies specifics of Islamic understanding of freedom of expression and significant differences between Islamic and European understanding of that concept. Freedom of expression is recognized in Islam; however, it has significant and deeply-rooted peculiarities. In particular, Islam strictly prohibits imaging Prophet Muhammad, let alone making cartoons of him. For instance, from the perspective of Muslims, imaging Prophet Muhammad as a dog is extremely cynical, since a dog in Islam is an unclean animal inadvisable to contact with. Also, there is long-established perception of humour and its admissibility in Islam. For example, under Islamic law one shall not tell lies or scare another person; one shall not joke with an older person, a teacher, a scientist, a manager, a person who does not understand jokes, an unknown man or woman; a joke shall not be offensive or degrading a man or a family; one shall not joke about prohibited issues, tell dirty stories, disclose intimate details, resort to insults or slander. The article points out that Europeans perceive drawing cartoons of the Prophet as freedom of expression. However, in the eyes of Muslims such cartoons constitute violation of a number of prohibitions existing in Islam and therefore deeply insult their religious and cultural feelings. Such insults may cause religious conflicts with many victims, like the one that happened in the January of 2015 in the office of Charlie Hebdo French satirical weekly newspaper. To prevent similar and even more terrible tragedies in the future and release tension between Europeans and Muslims, primarily in Europe, the article explores the legal framework and conditions for restriction of freedom of expression set out in universal international law, the European Convention on Human Rights and relevant case-law of the ECHR. The set of the general and specific scientific methods of research were used by the authors according to the subject and scope of the study: sociological, statistical, dialectical, formal stylistic, axiological, hermeneutic, systemic, comparative legal method etc.

Аннотация: The article provides insights on the current mechanisms for regulating relations in the field of global health and international interaction in the world, holding the States of the world internationally responsible for internationally wrongful acts in the field of health, including consideration of the nature of the COVID-19 pandemic. Significant attention is paid to find the response to the question of what COVID-19 pandemic a health emergency is or bioterrorism. It analyses the current international norms governing the field of the production and use of biological weapons, with particular emphasis on standards of regulation and international responsibility in this field. The findings of this study suggest that biosafety worldwide is a key dimension of global security and ensuring world peace. This study also recommended the establishment of the strong global norm that would provide for verification of disarmament and compliance with the Biological Weapons Convention, the responsibility of States to develop, manufacture, and accumulate of biological weapons should be adapted to that end. Furthermore, it is noted that the world community should reconsider the position on the mechanism of investigations by the United Nations Security Council, as well as the procedure for the use of the veto of the five permanent members of the Security Council in any decision concerning the maintenance of international peace and security.

Аннотация: Ukraine is one of the largest countries in Europe and there is a significant Muslim minority here, among which there are several Shia communities. Aspects of the life and activities of the Shia community in Ukraine are almost unexplored. Although at the same time a number of studies were devoted to the Shiite minorities of Western European countries, therefore in this paper, we examined the characteristics of the life of the Shia community in Ukraine and compared it with the characteristics of the Shia communities in Western Europe. Special attention was paid to the peculiarities of the mentality of the indigenous Shiites, represented by Azerbaijanis. The features of the institutionalization of the Shia communities of Ukraine, the features of conducting divine services and mourning events of Ashura were considered. After analyzing the above problems, we came to the conclusion that the Shiites of Ukraine are more passive, so we tried to identify the reasons for such passivity, among which the most important are the Soviet "atheistic" past; cultural, national and linguistic diversity of representatives of the Shiite minority of Ukraine, which prevents larger gatherings of Shiites from being held. We consider the article as a basis for further research in this region, therefore, the purpose of the study was to highlight all possible problematic aspects of the life of Shiite minorities in Ukraine.

Аннотация: At the moment, two mechanisms for protecting human rights can be distinguished in Ukraine: an appeal to the European Court of Human Rights at the international level and an appeal to the Commissioner for Human Rights at the national level. Therewith, the activity of the ombudsman constitutes the state’s performance of its obligations at the international level to ensure the national mechanism for the protection of human rights. In Ukraine, the Ombudsman acts according to the model of the classic parliamentary Commissioner for Human Rights. In addition, along with the parliamentary Commissioner for Human Rights, which has a constitutional status, there are government commissioners (“quasi-ombudsmen”) in Ukraine, whose activities do not have a special status and can be terminated at the will of the government at any time. Considering the above, the purpose of this study lies in a comprehensive analysis of modern challenges to international security and the impact of these factors on the observance of human rights in Ukraine (using the methods of both international law and classical legal methodology), as well as studying the role of the ombudsman in this process. The analysis allowed to conclude that the causes of human rights violations lie not only in the country’s problems, but are also the consequences of global processes. A huge challenge to the rights and freedoms in Ukraine is the intensifying poverty of the population, which in itself is a violation of human rights and allows to exercise all other rights. Furthermore, the hostilities in the Donbas region led to gross, massive, and systematic violations of human rights: residents of the front-line territories were faced with two challenges at once – the danger that arises due to the impossibility of ensuring security in the immediate vicinity of the war zone and the increasing risks of poverty.

Аннотация: Nowadays, active legislative reforms are being implemented in Ukraine, which are gradually introducing conceptual provisions on ensuring the right of the individual to information and aiming to effectively overcome the identified negative factors by introducing European standards in the field of the individual's right to information, however, to transform approaches to the right of the individual to information. in the context of European integration, attention is paid only fragmentarily, which in turn actualises the topic. The aim of this article is to investigate the transformation of approaches to the essence and content of a person's right to information in the context of Ukraine's European integration reforms. The outlined subject matter was explored through the approbation of the system of conceptual approaches and a set of general scientific and special scientific methods. Comparative analysis of the legal acts of Ukraine and the European Union in the research area displayed that it is now possible to refer to the imperfection of Ukrainian legal regulation in the field of securing, regulating and protecting the right of a person to information. Five urgent steps were proposed for the most prudent transformations of the person's right to information in Ukraine in the context of European integration.

Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: The main reason for dispute in international commercial arbitration is the existence of an arbitration agreement concluded between the parties to a foreign trade agreement. The procedure of dispute resolution in international commercial arbitration will depend on the extent to which this arbitration agreement is concluded correctly in accordance with the norms of international and national law. Quite often, in the law enforcement activities of both national courts and arbitrations, there are questions about the validity, effectiveness, and enforceability of an arbitration agreement. In different countries, this issue is addressed ambiguously. In one case, national law takes precedence, and, accordingly, national courts are empowered to consider the validity, effectiveness, and enforceability of an arbitration agreement. In other cases, however, the autonomy of the arbitration agreement is a priority aspect of the consideration of any procedural issues by international commercial arbitration as the only and indisputable body authorised by the parties to the foreign trade agreement to consider a particular dispute. The article analyses doctrinal and legislative approaches to this issue, in which the authors come to the logical conclusion that national courts do not consider the validity, effectiveness, and enforceability of an arbitration agreement.

Аннотация: The chapter explores the legal and political dynamics of church-state relations in Ukraine during the Russian-Ukrainian conflict since 2014. The author demonstrates that the conflict triggered several changes in relations between temporal and spiritual authorities with regard to the military and national-security-related areas and thus contributed to the general shift in Ukraine to a more cooperationist church-state system. This shift moves Ukraine closer to the church-state approaches employed by other post-Soviet Orthodox-majority countries, including de facto or de jure multi-tier system of religions and state favoritism towards the national Orthodox church. However, due to several political and social reasons, these tendencies are still significantly milder in Ukraine than in Belarus, Georgia, Moldova, and Russia.

Аннотация: Protestants are considered a tiny minority in Ukraine largely due to the stereotypes created in the past by Soviet antireligious propaganda and sustained by the mass media. Evidently, no totalitarian or authoritarian regime appreciates a large group of people who pledge allegiance not to the country’s leader, or the leader’s ideology, but to the Kingdom of God, and who are not afraid to lay down their lives for their allegiance. Religious communities and their representatives must be able to function and perform their duties in a predictable and safe environment. Protestant Christians base their daily living on the teachings of the Bible and believe that the Bible is the inspired, authoritative word of God. Several Christian ministers have not been allowed to re-enter the occupied territories. Several other Protestant ministers who live and minister in Ukraine have been given persona non grata status by the authorities of the Donetsk People’s Republic and Luhansk People’s Republic.
