Аннотация: OBJECTIVE: Introduction: From January 1, 2019, the Law of Ukraine "On application of the transplantation of anatomical materials to a human being" dated May 17, 2018, № 2427-VIII (hereinafter referred to as Law № 2427), which defined a new system of legal relationship in the field of transplantation and related activities. Simultaneously the validity of the Law of Ukraine "On transplantation of organs and other anatomical materials to a human being" adopted in July 16, 1999. № 1007-XIV was canceled. The development of medical science overlooks the prospect of humanity's salvation from many incurable diseases. One of the directions of medical advancing is the development of transplantation, which is special method of treatment that involves the transplantation of anatomical human material from a donor to a recipient and a focuses on the restoration of human health. Admitting the fact that life or health can be saved for hundreds of thousands of people with its' usage today and the need for it is growing relentlessly. Therefore, research and improvement of legislation on the transplantation of human anatomical materials is well-grounded and timely. The aim: To establish and specify the problematic issues of legal regulation that arise in the transplantation of human anatomical materials sphere. PATIENTS AND METHODS: Materials and methods: During the study, international acts, national legislation and Conclusions of scientists were used. The article is based on dialectical, legal comparative, systemic, historical and complex methods of research. RESULTS: Review: In this paper the main problems of legal regulation of transplantation of human anatomical materials according to the Ukrainian legislation are analyzed and specific suggestions for their solution are proposed. CONCLUSION: Conclusions: The solution to this problem is to create a legislative framework and provide an effective and effective mechanism for regulating and implementing transplantation of human anatomical materials.

Аннотация: OBJECTIVE: Introduction: Infliction of harm to life and health due to medical errors is common for the whole world and post-Soviet countries, in particular. The problem of these errors is one of the most important in medical law, although there is no unified concept of it. A small number of sentences in cases of criminal negligence of medical professionals indicates a high latency and often unprovability of this crime in a number of post-Soviet countries. The aim: To disclose the objective and subjective prerequisites of a medical error, reasons for its occurrence, to establish the grounds for criminal liability of medical professionals in case they commit an error and to examine the judicial practice in this regard. Also, to define the concept and types of circumstances exempting criminal liability and their impact on criminal liability issues concerning medical professionals. PATIENTS AND METHODS: Materials and methods: The study is based on the Belarusian, Kazakh, Moldavian and Ukrainian statutory acts as well as international acts, the European Convention for the Protection of Human Rights and Fundamental Freedoms, case law of the European Court of Human Rights (ECHR), national court judgments. Such methods as dialectical, comparative, analytic, synthetic and comprehensive have been used in the paper. RESULTS: Review: On the basis of the study, it has been established that there is no unified concept of a medical error, medical personnel are fairly brought to criminal liability only if they commit an unjustifiable error in the presence of all the mandatory elements of a crime provided for in the relevant article of the Criminal Code. At the same time, it is extremely difficult to prove existence of such an error. Besides, at the state levels, causes and mechanisms of occurring errors have not been revealed, they are not even discussed, which makes it impossible to outline measures to prevent them or reduce their frequency and degree of danger. CONCLUSION: Conclusions: The struggle against medical errors should encompass a number of such activities as standardization of clinical treatment protocols, further education of medical professionals and lawyers in regard to patient safety, thorough investigation of each incident in order to exclude a justifiable error or circumstances exempting criminal liability. Equitable, severe and uncompromising punishments for perpetrators should be an effective means preventing commission of crimes in medicine.

Аннотация: Introduction: The spread of infectious diseases, the increasing number of people who refuse immunization, the study of international standards of patient’s rights during immunization in modern conditions are relevant in modern medical law. The aim: The aim of this research is clarification of patient’s rights international standards for vaccination against infectious diseases and ways of their further implementation in Ukraine. Materials and methods: The research is conducted using general and special scientific methods (philosophical-dogmatic, dialectical, logical-normative, system-functional and comparative-legal analysis, statistical and others). The analysis of documents and statistics of international institutions, in particular, the United Nations (UN), the Council of Europe (CE), the World Medical Association (WMA), legal acts of different countries, the judgments and decisions of the European Court of Human Rights (ECHR) and other courts on human (patient) rights and their compliance with immunization (86 court decisions), and questionnaires is conducted. The views of V. Pashkov [1−3], L. Udovyka [2], N. Gutorova [3] and other researchers are studied. Conclusions: International standards of patient’s rights for vaccination against infectious diseases and standards when compulsory of vaccination is not violation of international standards of patient’s rights are identified in the study. Suggestions are made regarding the future implementation of such standards in health care system of Ukraine.

Аннотация: The aim is a comparative and legal study of liability in the health care sector in the EU countries and Ukraine. Materials of the research are the EU legislation, laws of the EU countries, Ukraine, statistical information. The authors of the study have used the systematization method, comparative and legal method, analysis and generalization of statistical data. Ensuring an adequate level of health care, providing affordable health care service and medical care to citizens is one of the main tasks of any country, including Ukraine. It is the reason why the state controls this sector through the institution of liability, which does not fully meet the standards of the present day existing in the EU Member States, and therefore needs to be improved. The authors of the article have summarized the experience of the EU countries and Ukraine in regard to liability in the health care sector and have determined some ways to improve Ukrainian legislation. The authors have established the necessity to borrow the experience of certain EU countries in regulating financial (France, Germany, Italy, Poland), civil (Italy), criminal (Germany), administrative liability (Latvia) in the health care sector

Аннотация: The objective of this article is a comprehensive analysis and study of normative and legal acts regulating the reform of financing the health care system, the introduction of the programs of state guarantees for medical care of the population and determining the perspectives for implementing the programs of state guarantees for medical care of the population in Ukraine. The authors of the study have used theoretical (analysis, generalization, systematization, etc.) and empirical (observation, classification, comparison, etc.) methods.; The conducted analysis of international experience has established that countries such as Bulgaria, Georgia, Estonia, Lithuania, Moldova, Poland, Romania, Croatia and others had already gone through the process of introducing guarantees in the health care sector. It has been concluded that the main features of the term of "guaranteed package" should include: a clear definition of the rights to receive medical services; financing from the budget; consideration of the priority of various types of medical services.; The programs of medical guarantees of Ukraine during 2018-2020 have been analyzed. Specific features of their implementation have been determined; the tariff rates and correction factors have been analyzed. The main tariff rates for financing medical services have been distinguished: capitation rate; rate for the treated case or payment for diagnostically related groups; the rate on a medical service, where a separate service is the chargeable unit; global rate; rate on the results of the implementation of medical service contracts.

Аннотация: OBJECTIVE: The aim: To identify the spheres in which it is forbidden to patent the results of medical researches and as a consequence there is no legal protection of biotechnological inventions. PATIENTS AND METHODS: Materials and methods: The research material is a modern European regulatory framework that establishes the basic principles for patentability of biotechnological inventions. The methods of information retrieval, analysis, systematization, and generalization were used in this article. CONCLUSION: Conclusions: The Court of Justice has categorically stated that inventions that use human embryonic cells cannot be used for industrial or commercial purposes and therefore cannot be patented. In connection with this prohibition, the Court of Justice provided a unified definition of "embryo" and determined that it could be considered a dividing human egg, but only if it had a real ability to develop into a human. That is, the determining factor is not the beginning of the process of cell proliferation, but their real ability to become human. These decisions have become crucial for the development of research and the use of their results in therapeutic activities in the EU.

Аннотация: The purpose of the study is to determine the subject of "medical secrecy", to characterize the subjects who are obliged to keep secret information that is the subject of medical secrecy and, based on the results of this study, to make author's proposals to clarify the name for confidential medical information in legislation in the field of medicine in the field of medicine, criminal and criminal procedural legislation. The article explores issues related to the right of every person to the confidentiality of medical information, which is legally defined as "medical privacy". Based on the analysis of international legal acts, decisions of the European Court of Human Rights, the legislation of Ukraine and Georgia on the researched subject, using the foundations of the philosophy of law, carried out a comprehensive study of the concept of "medical confidentiality", defined entities following their professional and career responsibilities, must keep it. In the given article were used such scientific methods as logical, system-structural, comparative-legal, analysis, synthesis. Based on the research, the authors make several proposals for improving certain norms governing medical activities, namely, changes to the wording of Article 40 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Protection", Article 145 of the Criminal Code of Ukraine and Article 65 of the Criminal Procedure Code of Ukraine.

Аннотация: OBJECTIVE: The aim: The purpose of the study is to assess the impact of recreational lands on human health and determine the priority forms of their use and protection. PATIENTS AND METHODS: Materials and methods: International acts, data of international organizations and findings of scientists have been examined and used in the study. The article also summarizes information from scientific journals and monographs from a medical and legal point of view on the basis of scientific methods. This article is based on dialectical, comparative, analytic, synthetic, and comprehensive research methods. CONCLUSION: Conclusions: Recreational lands positively influence human health through a powerful effect of natural healing resources in combination with health-improving and therapeutic procedures on the body, which is becoming increasingly popular, and in some cases, it is the most effective treatment of all. Recreational lands are an independent category of land with a special legal regime of use, characterized by a developed or undeveloped natural area containing natural resources for treatment, recovery, rehabilitation, and prevention of diseases, which are under the special protection of the state and territorial communities. Special protection of the state in today's conditions is extremely important because there has been a negative trend in Ukraine regarding raider attacks. The objects of such attacks are exclusively those companies that are competitive in the market, have achieved significant profits, and continue to develop their activities by creating new branches and introducing new technologies. In particular, attacks on the property of agricultural enterprises and business entities that carry out activities in the field of IT services have become frequent inrecent years [1, p. 172]. The main target of attacks by raiders on agricultural enterprises is their land. Similarly, without state support and protection, recreational land can be the object of raider attacks. The priority form of using recreational land is the placement of resorts and sanatoriums that provide recreational services. Recreational lands can also be used for health improvement in the "wellness" form or within the framework of health tourism.

Аннотация: ABSTRACT The aim: This article aims to analyze the statistics of road accidents victims in Ukraine in general and the level of criminal offenses’ against traffic safety and transport operation victims, in particular, to consider the main victimological risks for road users and provide them with a public health approach. Materials and methods: The theoretical basis of the article is specialized literature on law, economics, and sociology. The empirical basis of the research was the materials of generalization of more than 1,000 criminal proceedings under Art. 286 of the Criminal Code of Ukraine, the results of a survey of Ukrainian citizens on the state of road safety in Ukraine. Results: According to the results of an empirical study, in terms of role, pedestrians clearly predominate among the victims (59.6%), while every fourth victim is a passenger of a vehicle. Driver victims are only 14.6% of the total number. Victimological risk on the roads is the probability of becoming a victim and suffering damage to one’s life and health from criminal offenses against traffic safety and operation of transport. For each of the categories of victims there are both general and specific victimological risks. The causes of accidents can be grouped by the source of danger in the triangle “person – mechanism – road”. Conclusions:The most dangerous and widespread victimological risks for road users in Ukraine are speeding and maneuvering, drunk driving, parking violations, poor road infrastructure, physiological and psychological characteristics of road users, low professional skills of drivers, etc.

Аннотация: Global processes touch on and affect of various spheres and braGlobal processes touch on and affect of various spheres and branches of human activity, including the health sector. Open borders facilitate the migration of people around the world. One of the goals of such migration is to obtain medical services. According to the World Health Organization, by 2022, the health and tourism sectors will jointly become one of the world's significant industries, which also will be facilitated by the global tendency of aging of the world's population. In recent years, medical tourism accounts for about 2% of world GDP. Development of the sphere of medical services gives rise to the practical need for the legal consolidation of the institution of medical tourism. Due to the fact that the number of people who want to combine rest and treatment is growing rapidly, this situation leads to the consideration of a fairly new sphere in the healthcare industry as medical tourism. The purpose of the study is to analyse the development of medical tourism in Ukraine, identify its problematic theoretical and practical aspects both in the tourist sphere of Ukraine and in the healthcare sector, as well as to search for scientifically-based ways to improve the regulatory and legal mechanism that regulates the activities of medical tourism in Ukraine. To achieve this goal have been investigated the medico-legal nature of medical tourism in Ukraine, an analysis of its implementation in the field of international medical tourism, the mechanisms of its implementation. In Ukraine, have been created public organizations to develop medical tourism as one of the most promising areas of health care, aimed at interacting with Ukrainian and international public and charitable organizations. At the same time, it should be noted that at the initial stage medical tourism needs both legal regulation and state financial support. It is necessary to highlight the subjects of such activities at the legislative level, paying special attention to medical providers, the mechanism of influence on them by the state, their functional responsibilities, which can be organization and support of the patient during travel, the search for clinics and the conclusion of contracts with them for the provision of medical services, conclusion of contracts for the provision of services for transportation, accommodation, insurance. Attracting investors and government funding will allow the restoration of unique medical resorts, clinics and hospitals in the development of reproductive health, spa and rehabilitation treatment; create more favourable conditions for attracting foreign patients

Аннотация: The application of the latest technologies in biology and medicine has brought them to a qualitatively new level of possibilities. Worldwide, biobanking is actively developing through the creation of biobanks of various types and purposes, whose resources are used to solve therapeutic or scientific problems. Legal science remains an open question concerning the boundary that runs between the right to data protection and the scope of disclosure of data needed for medical purposes. In this article, the author considers peculiarities of data processing in the context of biobanking activity on the example of Austria and its national legislation. In addition, the article reveals features of the approaches of the European Court of Human Rights (ECtHR) and the Council of Europe to the issue of biobanking in general, its characteristics in the context of data, and legal regulation of this phenomenon in the national law of states. The author devoted an important part of the study to the role of Austria's experience in the context of data processing for scientific purposes and the development of biobanking for a number of other European states. The aim of the article is to analyze the Austrian legislation on data processing for scientific research and biobanking, the attitude of the Council of Europe to this phenomenon, and the practice of the ECtHR, as well as to consider the impact of the current world situation on these activities. The leading method of research used in the article is the formal-legal method. The article analyzes the Austrian law in the context of data processing in medical research, the relationship of the specifics of personal data protection, and the need to disclose them for scientific purposes. The author pays special attention to the influence of Austrian law on the legislation of other countries, which is reflected in the conclusions to the article. In addition, based on an analysis of the application of the Austrian experience to the legislation of Poland and Ukraine, the author points out the necessary changes that should be made in the laws of these countries.
