Аннотация: The authors ascertain the correlation between the freedom of information use and both the freedom of speech and the right to information. There was applied the entire toolbox of interrelated and complementary universal scientific and specific methods inherent to philosophic research. The research methodology rests on the system and structure-functional analysis principles. The notions of information, freedom, justice and law are closely interlinked. When exercising freedom one inevitably makes his or her choice from among the available actions while relying on the previously obtained information. The human information rights that are, in their turn, a part of the overall notion of the law enjoys an exceptional role within the freedom of information. Far from being exhausted by the freedom of speech and the right to information, the freedom of information also includes various other aspects. It concerns the entire information and communication sphere at large. The freedom of information is not reduced to any certain type of socially-oriented information. The notion of the right to information goes beyond the right to access information while both of them take on the same social roles and are often terminologically interchangeable.

Аннотация: OBJECTIVE: Introduction: Currently, there is little attention paid to studying the characteristic features of the protection of patients' rights in the European Court of Human Rights, which is the fact determining the relevance of the scientific research in this area. The aim: To define the basic rights of patients and summarize the practice of the European Court of Human Rights with regard to protection of patients' rights in order to formulate proposals as to the ways of the current legislation improvement. PATIENTS AND METHODS: Materials and methods: In the research, the practice of the European Court of Human Rights, international standards of justice, scientific publications of leading experts in the field of medical law, current and prospective Ukrainian and international laws were used. The research is based on the organic combination of philosophic approaches, general scientific and special legal research methods. RESULTS: Review: The standards and mechanisms of ensuring the rights of patients were singled out from a whole number of international legal acts. In the Ukrainian legislation, the list of patients' rights corresponds to the main provisions of the Declaration of Lisbon on the Rights of the Patient and other international legal acts. The protection of patients' rights in different countries varies based on differences in the laws, organization of the healthcare service as well as economic, social, cultural, religious and moral values. Simultaneously, there are common features in the legal protection of patients' rights, in particular appealing to the ECHR. While considering the cases involving protection of patients' rights based on the Articles of the Convention, the Court has developed a number of positive obligations of the state and minimum guarantees, which should be enshrined in national legislations to protect the rights of patients. CONCLUSION: Conclusions: The absence in the national legislation of clearly defined concepts of medical law limits the potential of legal protection of the rights of patients and necessitates the development and adoption of a single legal act to efficiently regulate the rights and obligations of the physician and the patient, provide classification of healthcare services, procedures and conditions of the services provision, quality criteria, etc. The prospective Medical Code of Ukraine shall become such a normative legal act, since the need for its development provides prospects for further research in this area. The ECHR practice affects national legal practices, primarily in the information, social and educational aspects, contributes to development and adoption of new concepts, court legal culture and a new reference system to comply with the Convention and Court practices.

Аннотация: Freedom of expression is one of the prerequisites for the formation and existence of a democratic society; it belongs among the universal values of paramount importance, because it allows not only to freely express own views, but also reveal the potential of the individual. In addition, it is considered (and it is justified) as one of the main and unconditional achievements of the political reform that is being carried out in Ukraine. The guarantee of freedom of expression, which has the highest political normative content, is, on the one hand, the most important asset of an organic constitution, and on the other hand, serves as the main function of the constitution as a legal source that reflects and responds to the interests of civil society. However, the real challenge for the unsustainable constitutional tradition that still retains some signs of the post-Soviet model of regulation is the need to balance freedom qf expression under the conditions of threats to national security. What should be the proper mechanism for guaranteeing freedom of expression at the constitutional level? How strong is the danger that the state violates the requirement of constitutionality in the case of restrictions on freedom of expression for the sake of national security? How does the post-Soviet tradition of legal regulation manifest itself in deciding which model of guaranteeing freedom of expression is chosen by the state? What is the role qf the tradition of respect for personal autonomy and the value of tolerance of a society in guaranteeing freedom of expression? The article is devoted to finding answers to these questions.

Аннотация: Introduction: The article deals with the issues of international law concerning defense of the right to health of involuntarily displaced persons. As a result of the study, it has been demonstrated that providing of the right to health is essential as a requirement for countries, which, in turn, stem from consensus on international cooperation and general support for migrants. The latter are undeniably protected in accordance with documents proclaiming human rights, but for the sake of a more detailed explanation of their rights and the substance of the states obligations towards such persons, the international community has created a solid foundation in the form of specialized refugee documents that further emphasize the need protection of the latter as persons who, as a result of their movement, are vulnerable. The aim: To elucidate the international mechanisms for the protection of the right to health of involuntarily displaced persons. Material and methods: The study used a set of general-philosophical and special-legal methods of scientific research, in particular, dialectical, historical, socio-political, formal-legal and comparative legal methods of scientific research. The historical method of scientific research has been used in the analysis of tendencies of the regulation of the refugee problem from the beginning of the 20th century. The comparative legal method is used in the analysis of the legal regulation of involuntarily displaced persons rights by international treaties and conventions, rules of national legislation of Ukraine and foreign legislation. Review: Authors analyze the issue of a migrants (social, medical etc.) rights under the principle of equality of refugees and citizens rights. Reviewing the mechanisms of guarding such rights under treaties it is obvious that these mechanisms have legislative and institutional features. Closer look is taken on the Council of Europes mechanism for protecting the rights of refugees with its own normative and institutional features. Conclusions: As a result of the study, it has been demonstrated that migrants rights, including right to health, stem from consensus on international cooperation and general support for migrants. The latter are undeniably protected in accordance with the documents proclaiming human rights. In order to provide a more detailed explanation of their rights and the nature of the states obligations towards such persons, the international community has created a solid foundation in the form of specialized refugee documents, which further emphasize the need to protect the latter as persons who, as a result of their displacement, are vulnerable.

Аннотация: Introduction: The right to health is one of the most important human rights and its proper exercising allows for the exercise of other rights. One of the guarantees of this right is the safe natural environment, which, on the one hand, allows to maintain the health at the proper level without worsening it, and, on the other hand, to improve and prevent negative consequences concerning it. The proper state of the natural environment is reflected through the relevant qualitative characteristics of each of the natural resources that are included in it, and in aggregate, reflected in the corresponding natural interactions between them. The aim: The study is aimed at inquiring into the right to health and importance of the safe natural environment in order to provide it. Material and methods: Statutory regulation and scientific positions of scholars in the field of the above-mentioned issue are studied in this article. The study analyzes generalized information from scientific journals by means of scientific methods from a medical and legal point of view. This article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. Within the framework of the systematic approach, as well as analysis and synthesis, the concept of the right to health and its place in the provision of the safe natural environment is researched. Review: The right to health is regarded as a persons awareness of the existence of appropriate ways, means and conditions that enable them to take care of their physical and psychological state by carrying out appropriate actions or refraining from doing so, thereby preventing or eliminating negative consequences that may threaten or do threaten their proper state of health. Along with others, the safe natural environment is a prerequisite that allows their full enjoyment of the right to health. Conclusions: The right to health is regarded as a persons awareness of the existence of appropriate ways, means and conditions that enable them to take care of their physical and psychological state by carrying out appropriate actions or refraining from doing so, thereby preventing or eliminating negative consequences that may threaten or do threaten their proper state of health. Share Art. 52 of the Law of Ukraine "Fundamentals of the legislation of Ukraine on health care" the following wording: "Medical workers are allowed to euthanize - intentionally accelerating the death or death of a terminally ill patient in order to end his or her suffering, subject to his consent and the conclusion of the commission, which is not less than of three doctors on the incurability of a disease that causes significant physical pain (suffering) for the patient".

Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: The current stage of development of public relations is described by a rapid increase in digital technologies. Intensive development of science and active technological progress have become the main characteristic features of modern society. This has affected the specific features of people’s lives in society, the exercise of their rights and freedoms, and has become a catalyst for the development of a new category of human rights - “digital” rights. The purpose of the study is to analyse the main threats and challenges facing human rights and freedoms in the context of digitalisation, and to develop proposals on promising ways to protect against these threats. The study conducts a theoretical and legal research of problematic issues of the implementation of human rights in the context of mass digitalisation of public relations, indicates that the era of digital technologies provides completely new and qualitatively different opportunities for their implementation, but at the same time it creates new challenges and threats to ensure these rights and freedoms. It is noted that classical human rights and freedoms are being transformed, filled with new aspects and content, and branched out into those that are related to the digitalisation process. The results of digitalisation of many spheres of life require comprehension and adequate formulation of the legal mechanism for regulating, implementing, protecting the already existing and emerging human rights for the purpose of sustainable socio-economic development, ensuring the implementation and protection of constitutional human and civil rights and freedoms. The study focuses on new rights such as the right to be forgotten, the right to anonymity, the right to protect personal data, the right to digital education and access to digital knowledge; rights related to the protection of genetic information; rights to take part in property turnover in the digital sphere.

Аннотация: The study investigates the main approaches to understanding such legal categories as “legal regimes” and “special legal regime”, and provides their classification. Special legal regimes serve as the legal basis for restricting human and civil rights and freedoms; therefore, the relevance of the study of the concept, types, and main features of special legal regimes is beyond doubt. The authors of the study consider the relationship between the categories of special legal regime of a state of emergency and martial law, and describe the main grounds for their imposition. The authors noted a need for a clear, consistent legal regulation of the model of behaviour aimed at overcoming and eliminating negative consequences of an emergency and military nature. Attention is focused on the fact that in Ukraine, the regulation of public relations arising in connection with emergencies and military situations has become particularly important after the emergence of a military conflict on the territory of Ukraine and the spread of the COVID-19 virus. The study provides the author’s vision of the categories “legal regimes” and “special legal regimes”. it is proposed to interpret the legal regimes as the regulatory procedure, which is expressed in a set of legal means that describe a special combination of interacting permits, prohibitions, and obligations, while implementing a special focus of regulation. The latter should be interpreted as a form of public administration that makes provision for the restriction of the legal personality of individuals and legal entities, introduced as a temporary measure provided by means of administrative and legal nature, and aimed at ensuring the security of the individual, society, and the state. The study provides the classification of special legal regimes and contains proposals to distinguish them according to the content and basis of occurrence as follows: state of emergency, martial law, state of siege, state of war, state of public danger, state of tension, state of defence, state of threat, state of readiness, state of vigilance.

A significant difference in the criminal law protection of privacy of citizens and officials has been established. Аннотация: The study investigates the foreign experience of constitutional and legal regulation of restrictions on human rights in conditions of emergency and martial law in Macedonia, Armenia, Belarus, Moldova, Georgia, Latvia, Lithuania, Albania, Azerbaijan, which is relevant in modern conditions, based on the presence of local military conflicts, emergencies, or the possibility of their existence in many countries of the world. The purpose of this study was to analyse the text and content of the constitutions of foreign countries to clarify and explain the grounds for restricting human and civil rights and freedoms in conditions of emergency and martial law. To achieve this purpose, the study employed a system of methods of scientific cognition, namely general scientific (analysis, synthesis), particular (comparative, quantitative and qualitative analysis, approximation), as well as special legal (formal legal, comparative legal) methods. The practical value of the study lies in the identification of four prevailing trends in the constitutions of foreign states to the procedure for determining the scope of restrictions on human rights under special regimes: 1) consolidation of an exhaustive list of rights and freedoms in the constitutions, which cannot be restricted during the period of emergency and martial law; 2) consolidation of an exhaustive list of rights and freedoms in the constitution, which can be restricted to protect human rights, the democratic structure of the state, public safety, the well-being of the population and morals; 3) combining the first two options for consolidating restrictions in the text of the constitutions; 4) consolidation of the possibility of limiting the rights and freedoms of the individual in the texts of constitutions by state authorities under special legal regimes in the interests of national security without specifying partiular rights and freedoms that may (or may not) be restricted.

Аннотация: Legal support of human security in the, field of health care includes the guarantee, protection and protection of rights and freedoms in the, field of health care, which is the main function, as well as the goal and duty of the state. This paper describes certain aspects of the legal regulation of the implementation of the "human right to security in the health sector" and the problems of its enforcement. The research methodology is based on a system of methods of the philosophical, general scientific and special scientific level. The main goal of this scientific article is to define the concept,principles, types and directions of implementation of the "human right to safety" in the concept of "the right to health protection". The general principles of the implementation of the "human right to security in the health sector" are disclosed. It is emphasized that the legal mechanism for the implementation of the "human right to security in the healthcare sector" is the activity of legal entities, lawmaking and law enforcement agencies, and the existing legal norms governing their activities in the healthcare sector. The investigated human right to safety should be understood as a complex of rights related to the protection of the patient's legitimate interests in the healthcare sector from unlawful encroachments and threats. The author's understanding of the definition of "patients' right to safety". It is argued that human security in the field of health care belongs to the basic needs of a person - the implementation of this need is determined by the level of development of a country, its economic and cultural components, the level and quality of life of a person living in this country, an effective health care system. It is concluded that the main goal of legal ensuring human security in the healthcare sector is to create the minimum necessary (safe) conditions for the implementation of these rights and obligations when receiving medical services.

Аннотация: ABSTRACT The aim: To study the legal and regulatory framework for ensuring the right to health of patients depending on the legal status of coronavirus vaccines in different countries as an essential element influencing the right to public health and other rights of citizens. Materials and methods: In this paper, we study the legal norms and scientific positions on the above issue using generalized information from scientific journals that use scientific methods from a medical and legal point of view. This article is based on dialectical, comparative, analytical, synthetic, and complex research methods. Using the above methods, we studied the attitudes of different categories of citizens to vaccination against coronavirus disease through questionnaires on the following issues: attitudes to vaccination in general; motivation for vaccination, in case of consent to vaccination; reasons for refusal of vaccination. The case-law of the European Court of Human Rights on vaccination and ensuring the rights of citizens to health care was also analyzed. Results: Proper legal regulation of the right to health depending on the legal status of the vaccines is important in order to implement restrictive measures to combat COVID-19 and, accordingly, to prevent the possible spread of a pandemic in the public health system. Conclusions: Ensuring the right to health and applying restrictive measures to prevent the spread of a pandemic is an essential element of the public health system. However, the question of the legal status of vaccines is crucial to prevent the spread of the disease. That is, it is essential to go through all the stages of clinical trials for the vaccines used. Their safety and effectiveness and proving the fact that the harm of vaccination is much less than the harm of the spread of coronavirus disease. In the process of ensuring the right to health, including by making compulsory vaccination against COVID-19, legal framework and practice are critical components that aim to minimize the potential hazards that threaten the health and lives of the population.

Аннотация: ABSTRACT The aim: The article attempts to analyze what are legal responses to such Covid-19 related challenge like stigmatization. Materials and methods: Given the specifics of the topic and goals, during the writing of the article were used methods of terminological research of the phenomena “stigma”, “stigmatization”, comparative method, formal-legal method (in the study of international documents). The following materials were used to reveal the topic: scientific papers (articles, book chapters, analytical materials, reports, etc.), international legal acts, court decisions (decisions of the European Court of Human Rights, decisions of the US Supreme Court, decisions of national courts of different countries). Conclusions: More than a year after the spread start of Covid-19, it has become clear that in addition to the extremely catastrophic impact on human health and life, the pandemic, as well as the resulting quarantine restrictions, have profound and sometimes radical social consequences. Stigmatization of based on their infection with Covid-19 (including possible) has become one of these. The current international human rights framework allows for the assessment of such processes according to its standards. Implications of dignity and privacy as the highest social values pave the way to finding legal mechanisms to protect people who are carriers of a disease from being stigmatized. This is demonstrated by the legal justifications developed by the courts – the ECtHR as supranational and national Supreme and federal courts, which have been the subject of analysis within this article.

Аннотация: ABSTRACT The aim: To analyze law enforcement practice on the basis of the national legislation of foreign states to single out features of legal regulation of the right to euthanasia realization and to outline the Ukrainian prospects of euthanasia legalization. Materials and methods: The empirical basis of the research is the legislation of some European countries (Belgium, Spain, Italy, Portugal, and the Netherlands) and Canada; decisions of the European Court of Human Rights on the right to voluntary death and the obligations of states; the results of a survey of 750 respondents conducted by the authors. The methodological basis of the study were philosophical views on life, death, and the right to certainty, formal-logical method (analysis, synthesis, induction, deduction, etc.), comparative, analytical, statistical, sociological methods of cognition, as well as a synergetic approach. Conclusions: The issue of legal regulation of euthanasia is multifactorial, socially conditioned, and requires a positive action of the state both in terms of regulation and/or prohibition, and the proper provision of citizens with health care. Legislative support for the human right to a “dignified death” is dictated, to some extent, by society’s demand, which must be finally resulted in the draft law. As for Ukraine, the adoption of such a law is obviously premature. Although according to a survey of citizens on euthanasia and the feasibility of introducing such a law in Ukraine, 57% are positive about the experience of other countries, and 41% were in favor of adopting a law in Ukraine, it is not possible to assess their opinion due to ignorance of legislation where euthanasia is allowed.

Besides, in the research process to achieve the goal, a complex of general scientific and special methods of cognition was used, in particular, the comparative legal method, the system and structural method, the method of generalization, the method of analysis and synthesis. CONCLUSION: Conclusions: Response measures taken by countries during the Covid-19 period, which cause changes in the legal regulation of public relations, their validity and focus on achieving the goal of protection, must be based on democratic principles, human rights restrictions must be appropriate to the threat and must be justified the limits of intervention.

Аннотация: The relevance of the research topic is due to the importance of human rights in a democratic society. Despite the fact that all natural human rights are important, the right to health care is practically in the forefront, because without its observance all other rights are leveled. Moreover, the relevance of the topic is even greater given the fact that for a long time the relevant law was not given due attention in law or in legal science. The right to health care is comprehensive and includes other human rights that derive from it. The existing case law of the European Court of Human Rights (ECtHR) confirms the importance of the human right to health care. In its judgments, the Court emphasizes the importance of this right and reaffirms the need for States to monitor its observance. The aim of the study – analysis of international legal norms and standards, as well as the practice of the ECtHR in the context of the human right to health. The leading research method used in the article is the formal-legal method, the application of which provided an effective analysis of the legal framework of international law, national legislation of Ukraine, and the case law of the ECtHR. Which, in turn, allowed to determine the importance of human rights to health and places of relevant law in the practice of the ECtHR. The article analyzes the theoretical and legal approaches to understanding the right to health care and on this basis identifies the place of relevant law in the human rights system and its main determinants. The case law of the European Court of Human Rights is analyzed and the main articles of the European Convention on Human Rights (ECHR), which the applicants applied for in violation of the right to health care, are identified. The analysis of the case law of the ECtHR provided an opportunity to identify existing shortcomings in the legislation of the member states. Based on this, it is possible to understand and distinguish ways to solve problems and methods for eliminating such violations in the future. The practical significance of the article lies in the analysis of the case law of the European Court of Human Rights, the separation of rights related to the right to protection of life, as well as the identification of the main determinants of the studied law.

Аннотация: This work reveals the features of the administrative and legal regulation of the human right to access the Internet in the “concept of the right to health”. It is emphasized that the basis of the legal regulation of the human right to access the Internet in the "concept of the right to health" should be the recognition of the principles of the priority of human rights and freedoms, adequate state control, ensuring the choice of criteria that make it possible to realize accessibility, anonymity, and minimize the collection and processing of personal data about the patient.The structure of Internet relations in relation to the healthcare sector has been established, their analysis has been carried out, their object has been established. Legal constructions have been formulated: "information", "Internet" in the norms of international and national regulatory legal acts, as well as the terms "e-Health", "electronic cabinet", "electronic medical information system", the author's definition of "the right to access the Internet in the field of health care ".It has been established that the human rights to access the Internet in the “concept of the right to health” should be attributed to the fourth generation of human rights. The concept of "telemedicine" is formulated, their forms are disclosed, the stages of the evolution of legislation are established, and the problems of their legal regulation in the context of human rights are indicated.
