Аннотация: Abstract INTRODUCTION: In Ukraine differentiated VAT rates is a matter of debate. Today the Cabinet approved a list of medical products that has been changed three times resulting in changed VAT rates for specific products. European Union provides another method of regulation of VAT rates on medical devices. The abovementioned demonstrates the relevance of this study. MATERIAL AND METHODS: Comparative analysis of Ukrainian and European Union legislation based on dialectical, comparative, analytic, synthetic and comprehensive research methods were used in this article. DISCUSSION: In Ukraine general rate of VAT for all business activities is 20 %. But for medical devices, Tax Code of Ukraine provides special rules. VAT rate of 7% for transactions supplies into Ukraine and imported into the customs territory of Ukraine of medical products on the list approved by the Cabinet. The list generated by the medical product name and nomenclature code that does not correspond to European experience and Council Directive 2006/112/EC. CONCLUSION: In our opinion, reduced VAT rates should to be established for all medical devices that are in a stream of commerce, have all necessary documents, that proved their quality and safety and fall under definition of medical devices.

Аннотация: The study is devoted to the decision-making theory, its philosophical foundations and certain algorithms of practical activities. The paper is focused on activities in the field of nuclear industry. The functioning of a technologically complex and large enterprise, for example, a nuclear power plant, is impossible without a complex management system, and the decision-making process is one of its elements. This paper is the primary description of the topic and its goal is to formulate approaches to several questions: why do we need a decision-making theory in general, how do we evaluate the correctness of an already made decision. The significance of mathematical calculations in decision-making theory is described. The paper defines the basic terms that are used or will be used in the future, such as: methodology, technology, process, risk, human factor. The theoretical (philosophical) foundations that formed the basis of the decision-making doctrine are described, an attempt is made to answer the question why it is needed and by whom this theory is used and for what purpose. The connection between decision-making with the human factor is formulated. The distinction between the concepts of "decision" (as already existing) and "making decision" (as a complex process, a system of management actions, forecasting options and choosing between them) is described. Certain procedures are presented in the implementation of the decisionmaking process in order to show possible approaches, stages and decisionmaking techniques, as well as the readiness to implement a specific solution. The dependence (efficiency) of the management organization on the decisions made and their implementation is indicated. Besides, the paper sets forth the logic of making the "right" decisions based on "information". The authors conclude about the importance of applying the decisionmaking theory during the safety analysis and predicting the likely extreme situations at nuclear power facilities and the need to continuously improve the management structures.

Аннотация: The work represents a problem, which is defined by complex decision. The work shows that land recultivation and protection are usually offered as accompanying expenses for land exploitation. The authors demonstrate that the solution to the problem should be of eco-economic character. It is suggested to use not only legislative measures to enforce land users to restore land fund, but also to stimulate it. The work determines economic, legal and administrative solutions, which are aimed to enable the state to stimulate the principles or rational use of Ukrainian land resources. The work states that necessary measures have already been represented in Ukraine on the legislative level. It is suggested to be more oriented towards environmental constituent and to determine the direction of the formation of integrated perception of the state incentives mechanism. The novelty of study lies in the statement that incentives bring about not only a direct economic effect, but also ecological understanding of the improvement of human environment. The work represents aspects of the formation of economic tools of eco-economic measures, and there is calculated the economic effect. The authors of work concluded that the prospective direction is an economic approach as the basis of synergetic approach in conditions of the integration of Ukraine in the world space. © 2018, ASERS Publishing. Аннотация: The author raises an issue of ecological and socio-economic consequences of Chernobyl catastrophe as well as the current state of Exclusion Zone. The scale of contamination of the environment is unveiled; there have also been mentioned scientific facts of ecological restoration processes. It is emphasized that the most important consequences of the accident in Chernobyl was the socioecological damage which needs adequate juridical assessment and perfection in the sphere of labor relations in the Exclusion Zone. On the basis of drawn conclusions it is suggested to adopt special and individual Regulatory Legal Act on labor issues in the Exclusive Zone and to establish a single state authority on the Exclusive Zone affairs which will contribute to strengthening the environmental safety as well as anthropogenic restoration of natural resources

Аннотация: Der Beitrag zeigt die Entwicklung der Kriminalistik über den deutschsprachigen Raum hinaus. Er beschreibt aktuelle gesellschaftliche Aktivitäten zu ihrer Entwicklung, insbesondere in den osteuropäischen EU-Staaten. Ausgangspunkt sind Empfehlungen der Europäischen Union zur Kriminalitätsbekämpfung. Dazu verabschiedete der Rat der EU u. a. einen Rechtsakt zur „Schaffung eines einheitlichen europäischen kriminalistischen Raumes“. Im Beitrag wird am Beispiel kriminalistischer Organisationen in Litauen, der Ukraine und Deutschland diskutiert, wie öffentliche nichtstaatliche Organisationen durch wissenschaftlich-praktische Zusammenarbeit diesen Prozess fördern können. In einem „Palanga-Memorandum“ wurde die Gründung einer „Europäischen Föderation nationaler kriminalistischer Organisationen“ beschlossen und nationale europäische kriminalistische Organisationen/Vereine aufgerufen, darin mitzuwirken.

Аннотация: The phenomenon of “raiding,” i.e., the unlawful establishment of control over the property or governing boards of an enterprise, as well as the seizure of its shares, has been reported in all countries of the world for many decades. This phenomenon has the most dangerous forms in the states with the underdeveloped economy and legal system, particularly in Ukraine. The paper aims to determine the areas for counteracting and overcoming corporate raiding in Ukraine and to provide proposals for improving the legislative framework for reliable protection against attacks on the enterprises’ property. The information in the paper, including the geography of raider attacks, indicates a greater vulnerability of enterprises in the most economically developed regions, with extensive transport infrastructure and the prospects for various industries and sectors of the economy development. The state should take some steps to increase the level of enterprises protection against raider attacks. Thus, to improve the quality of preventing and combating corporate raiding, this paper argues the need to develop and adopt the Corporate Property Protection Code of Ukraine. The introduction of the raider attacks register will be an effective measure to warn potential investors and counterparties about the dangers of cooperation with certain companies. The state register should be bilingual (Ukrainian and English) and contain information on the attempts and cases of raider attacks on property and corporate business rights. Аннотация: The technology of video stream closure has been developed, which is based on the detection and closure of significant structural units. This technology employs the introduction of the closure marker into the code structure of the video stream for use on unmanned aerial vehicles. This makes it possible to meet departmental requirements for the speed of transmission in conditions of increased frame rates. At the same time, the quality of the updated video data is higher than when using other concealment methods. This is since the encoding process takes into account the processing of the base video frame substantial structural units.

Аннотация: The use of project-based learning allows students to reduce their dependence on the teacher through their self-study and self-realization. The main advantage of using project-based learning is the updating of previously acquired knowledge and obtaining new ones. During the implementation of the project, students share responsibilities and roles among themselves and coordinate their actions towards achieving the final common goal. This study attempts to justify the use of project methods in the process of teaching foreign languages to students of the preparatory department of the Dnipro National University of Railway Transport named after Academician V. Lazaryan. Students show great interest when using the project methodology. In the course of project implementation, students acquire various skills that will be useful for them in their subsequent professional activities. This helps to motivate them to learn foreign languages. The difference between the project methodology and traditional teaching methods allows you to establish a partnership between the student and the teacher.

Аннотация: The article is devoted to the study of the features of administrative and legal regulation in the field of subsoil use. The essence of the category of administrative and legal regulation, as well as the mechanism of administrative and legal regulation in the field of subsoil use, is revealed. The legal basis of state regulation in the field of subsoil use in some foreign countries, in particular, in North America (for example, USA, Canada), European countries (for example, France, Germany) and CIS countries (for example, Kyrgyzstan and the Republic of Kazakhstan) are determined. Given the study of foreign practice of administrative and legal regulation in the field of subsoil use, the experience of the Republic of Kazakhstan has been recognized as positive, in particular, on the normative enshrinement in the Subsoil Code and subsoil use of basic principles in the field of subsoil use. Administrative and legal regulation in the field of subsoil use in Ukraine has been investigated by studying the legislative and organizational components. In the context of the above, it has been found that the regulatory framework for the implementation of state regulation in the field of subsoil use in Ukraine has a large number of regulations (both legal and substatutory). The system of state regulatory bodies in the field of subsoil use is represented by bodies of state power and local self-government, whose powers to use subsoil are determined by the norms of current Ukrainian legislation. The author's definition of the essence of the concept “administrative and legal regulation in the field of subsoil use” is given.

Аннотация: Agricultural lands, like other categories of land, perform an ecological function as the main object of nature and habitat of man and all living and plant organisms, as well as an economic function as the main object of real estate and the main means of production in agriculture. In order to protect the land, landowners and users are obliged to take measures: to restore the fertility of agricultural land; to protect lands from water and wind erosion, mudslides, flooding, waterlogging, secondary salinization, drying, compaction, chemical pollution, production and consumption wastes and other negative impacts; to protect agricultural lands from overgrowing with trees and shrubs, weeds, preservation of the achieved level of reclamation. Greening of agricultural activity, observance of norms and requirements of land and ecological legislation by subjects of agricultural production are of fundamental importance. The article analyzes the current state of agricultural land use and provides suggestions for improving the efficiency of these lands.

Аннотация: The article aims to identify the types of transgression in courtroom discourse. The study was carried out using discourse analysis as the main method. According to the mode of expression, the explicit type of transgression and the implicit type were determined. Forms of verbal expression of transgression are words and phrases with negative emotional coloring, and the use of contextual and conceptual antonyms. In cases of implicitly represented transgression, the true interpretations of the speakers are expressed by means of Aesopian language allegories. It is proven that the use of transgression ensures the success of the speech’s impact. The influence effect of transgression in courtroom discourse increases under the following conditions: frequent use; use of accusation and refutation strategies; emotionally charged vocabulary; piling up in narrative details, even inventing; and the construction of speeches on the principle of increasing transgression.

Аннотация: The negative impact of the anthropogenic factor on water bodies, including those ones located within urban ecosystems is analyzed in this paper. The legislative support of the specific requirements for water quality in different countries is considered. The purpose of the work is to investigate the qualitative and quantitative state of water from individual sources located in an urban ecosystem and determine its suitability for the consumption. The Shatylovskу spring, the Karpovsky spring, the spring near the Nemyshlya river, located within the Kharkіv city (Ukraine), were researched. Heavy metal identification was carried out using X-ray fluorescence analysis. It was found that all samples contained basically the same set of basic elements - strontium, copper, iron and chromium. Individual differences were associated with the presence of different amounts of tungsten, zinc, gallium, selenium, bromine, etc. in all samples. It was found that in the samples, the lead content reached 0.015 mg/dm3 (Karpovsky spring), nickel 0.007 mg/dm3 (Shatylovskу spring), and manganese 0.205 mg/dm3 (the spring near the Nemyshlya river). The copper content ranged from 0.029 to 0.154 mg/dm3, iron from 0.041 to 0.456 mg/dm3, and chromium from 0.015 to 0.065 mg/dm3. The obtained results make it possible to more efficiently manage water resources within the urban systems studied and indicate the need for additional water purification of all natural sources studied before using the water from those sources for drinking purposes.

Аннотация: The paper proposes a technique for calculating the force characteristics of a radial active magnetic bearing with an eight-pole stator with a given control law. This approach is based on the application of the finite element method and a software package for a general technical analysis of physical processes. Variable data of the technique are: the bearing design parameters, the control law parameters and the initial data of a variant parametric analysis of magnetic forces depending on the position of the rotor in active magnetic bearings and control signals. Geometric and finite element calculation models are three-dimensional. They accurately reconstitute the geometry of the stator and rotor parts of magnetic circuits, pole coils, internal and external air spaces and air gaps between the rotor and the pole. The active magnetic bearing control law is control voltages on electromagnets windings. Their values depend on the instantaneous position of the bearing journal and the instantaneous values of currents in pole coils circuits. In finite element calculation models, the load is specified in the form of current density in the volumes of the coils, taking into account the direction of the turns at each point. Its value is determined in accordance with the control law and the parameters of electrical circuits. The magnetic forces are calculated from the Maxwell tension tensor in a given cloud of points of the rotor position. The force characteristics are dependences of the restoring magnetic forces on the displacement of the bearing journal in two radial directions. The results of computational studies to determine the dependences of magnetic forces on rotor displacements for the design of an active magnetic bearing used in an experimental scale model of a turbocompressor of a gas compressor unit with active magnetic bearings are presented. Validation of the approach and results was performed by comparing the calculated and experimental data.

Аннотация: The status of Ukraine as a candidate country for the European Union membership reinforces the need for comparative analysis between Ukrainian regulations and law of other EU Member States as well as European regulations. One ofthe fields of comparative law is a development of mediation for disputes covered by administrative law. It has already been a subject of interest and promotion to both - The EU and the Council of Europe, since European standards of democracy provide for state cooperate with citizens individuals. The aim of this article is, to examine the main provisions, recommendations and best practices of the CoE member states, and to analyse the current practice and existing gaps in Ukraine in order to develop a proposal for effective implementation in the light of the most recent CEPEJ Guidelines promoting mediation to resolve administrative disputes. A comparative overview of this type of mediation regulations may be considered as novum. As for methodology, the paper is dominated by the logical-linguistic and comparative method. So far-though Ukrainian legal system is quite compatibile with the examined CEPEJ gudelines and provide for inter-branch solutions - the development of administrative and court-administrative mediation is quite resilient and there is still much to be done not solely with legal regulations, but also.mediation culture'' in such field.

Аннотация: The highest social values of any legal country are the protection of natural rights, which include life, health, dignity, freedom and inviolability of the person. Ukraine declared these rights as the basic ones in the Art. 3 and 29 of the Constitution. The number of criminal offenses is large enough and gradually increasing, but only a small number of them are really important for the life of the individual and the consequences of their actions remain until the end of the life of the victim. Such criminal offenses include articles that protect sexual freedom and immunity. Ukraine has been under martial law for 10 months, and during this period cases of sexual violent criminal offenses have taken place. The aim of the study is to analyze the statutes, declarations and conventions that should protect persons from the said criminal offenses. The study analyzed 1) the attitude of the ECHR to criminal offenses related to sexual freedom and immunity, and changes in legislation in connection with the ratification of international law; 2) conflicts and inconsistencies that exist in the law on criminal liability now and those that do not comply with international treaties that were ratified, for example, the new version of Art. 155 and 303 of the Criminal Code of Ukraine; 3) the latest changes in the legislation of Ukraine concerning Art. 156 “Child abuse for sexual purposes” of the Criminal Code of Ukraine; 4) data from the Office of the Prosecutor General of Ukraine on criminal offenses related to sexual freedom and immunity. As a result, it has been established that 40% of the analyzed difficulties do not end with the indictment in the court. There is a doubt about the determination of the same degree of social danger of rape (Art. 152 the Criminal Code of Ukraine) and sexual violence (Art. 154 the Criminal Code of Ukraine). The Art. 154 the Criminal Code of Ukraine concerning the difficulty of proving the criminal offense was analyzed, and a new version of this article was proposed. Diagrams with the data from the register of court decisions the correlation of indictments and court decisions on the recognition of persons guilty of the mentioned criminal offenses were created. The explanations of the Supreme Court concerning this category of cases were analyzed and presented. Finally, proposals were formulated to improve the current version of the criminal legislation of Ukraine.

Аннотация: The object of research is the process of determining the coordinates of aerial objects by a small-sized radars. The main hypothesis of the study assumes that combining two small-sized radars into a network could improve the accuracy of determining the coordinates of aerial objects. It was established that when determining the coordinates of an aerial object by a small-sized radars, the accuracy of determining the range is much better than the accuracy of determining the angular coordinate. To eliminate this shortcoming, a two-position network of small-sized radars and their error ellipses was considered. It is proposed to use the range-finding method in each small-sized radar station of the two-position network. A method for determining the coordinates of aerial objects in a two-position network of small-sized radars has been improved, which, unlike known ones: – enables a synchronous survey of the airspace by small-sized radars; – measures the range to the aerial object by two small-sized radars; – determines the coordinates of the aerial object by the joint processing of radar information from two small-sized radars. The accuracy of determining the coordinates of aerial objects in a two-position network of small-sized radars was evaluated. The experimental evaluation was carried out by means of simulation using the method of Monte Carlo statistical tests. Working areas of the two-position network of small-sized radars were calculated. It was established that the two-position network of small-radars works only in the area formed by the intersections of the viewing areas of small-sized radars during their autonomous operation.

Аннотация: The main purpose of the study is to rank certain threats in order to establish further costs for ensuring the protecting of information in the cybersecurity system. Research methodology is a set of methods that form a methodological approach. The main ones are the ranking method through the theory of fuzzy relations and the expert-step method. As a result, due to the ranking of the threats of the selected object, the permissible intensity of the decrease in the level of security and the costs of its provision were determined using the proposed methodology. The results obtained implied the use of modern ranking methods according to the given parameters. In our case, the results obtained allowed us to rank the existing list of threats in the cybersecurity system. The benefit of such results lies in the formation of an information basis for the adoption and implementation of management decisions.The study is limited by selecting only one socio-economic system and its information. The results obtained out in the article have practical and scientific value through a methodical approach to form requirements for the security of the cybersecurity system itself and information of a single object. In the future, more complex socio-economic systems and their cybersecurity should be chosen to apply the methodological approach proposed in the article.
