Аннотация: Regulatory acts of the European Union play a significant role in regulating land relations in the EU member states. Thus, according to the draft Treaty on the Introduction of the Constitution for Europe (2003/C169/01), adopted by the consensus of the European Convention on June 13 and July 10, 2003, the Council of Ministers unanimously adopts European laws, European framework laws, implements land use measures, excluding the organization of waste collection and disposal (Sulyagina, 2012; Kokanovska, 2016). According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States of June 14, 1994, Ukraine has undertaken to take measures to gradually bring national legislation into line with the legislation of the European Community, that is, to adapt national legislation to the EU legislation requirements. Among the spheres of adaptation there is, in particular, the institution of legal responsibility as an important way of protecting the environment, including lands, as follows from the provisions of the Law of Ukraine "On the State Program for Adaptation of Ukrainian Legislation to the Legislation of the European Union" of March 18, 2004. The implementation of the course on the European integration necessitates the adaptation of the national land legislation to the EU requirements. According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States (Agreement on partnership and cooperation between Ukraine and the European Communities…, 1994) an important condition for strengthening economic ties between Ukraine and the Community is the convergence of the existing and future legislation of Ukraine with Community legislation. Ukraine will take measures to ensure the gradual harmonization of legislation with the legislation of the Community. Adaptation of land legislation is the process of bringing the laws of Ukraine and other regulatory legal acts that are sources of land law of Ukraine, as well as the step-by-step adoption and implementation of Ukrainian regulations, developed in accordance with EU legislation, conformably with the acquis communautaire. Acquis communautaire (acquis) the legal system of the European Union, which includes, but is not limited to, acts of European Union legislation adopted within the framework of the European Community, the Common Foreign and Security Policy and the Co-operation in the Field of Justice and Home Affairs. At the same time, it is necessary to take into account that in the EU operates the principle of the EU rule of law over national law, which found its confirmation in the decisions of the Court of Justice of the EU. Thus, in the judgments of the Court of Justice of the European Communities in case 26/62, Algemene Transporten Expeditie Ondernemingvan Gend v. Nederlandse Administratieder Belastingen, in case 6/64, Flaminio Costa v. ENEL and in case Variola v. S. P. Administatione Italianadelle Finanze there is entrenched: • The principle of priority of EU law over the national law of member states (Supremacy of European law principle). • The principle of direct application of EU law (the principle of direct application of EU law). The scale of the influence of EU law is evidenced by the fact that approximately 80% of laws and other legal acts in the economic and social spheres that in the past belonged to the competence of states are produced by Union bodies and are unified for all its members (Magnovsky, 2005). The purpose of adapting the land legislation of Ukraine to the EU legislation is to achieve compliance with the legal system of the country acquis communautaire, taking into account the criteria set by the European Union to the states that intend to join it. The development of Ukrainian legislation in the direction of its approximation to the legislation of the European Union is a priority component of the process of Ukraine's integration to the European Union, which in turn is a priority direction of Ukrainian foreign policy.

Аннотация: The work represents a problem, which is defined by complex decision. The work shows that land recultivation and protection are usually offered as accompanying expenses for land exploitation. The authors demonstrate that the solution to the problem should be of eco-economic character. It is suggested to use not only legislative measures to enforce land users to restore land fund, but also to stimulate it. The work determines economic, legal and administrative solutions, which are aimed to enable the state to stimulate the principles or rational use of Ukrainian land resources. The work states that necessary measures have already been represented in Ukraine on the legislative level. It is suggested to be more oriented towards environmental constituent and to determine the direction of the formation of integrated perception of the state incentives mechanism. The novelty of study lies in the statement that incentives bring about not only a direct economic effect, but also ecological understanding of the improvement of human environment. The work represents aspects of the formation of economic tools of eco-economic measures, and there is calculated the economic effect. The authors of work concluded that the prospective direction is an economic approach as the basis of synergetic approach in conditions of the integration of Ukraine in the world space. © 2018, ASERS Publishing. Аннотация: The experience of European organizations managing land cadaster system is analyzed with examples of land relations development given for different spheres: legal, technical, and economic. The peculiarities in adoption and application of the 3D land cadasters by different countries of the world is viewed. It is stated that a cadaster of the future is to be a multi-purpose one in the 3D or 4D format.The need in modernizing current land legislation to improve the procedures of collecting, preserving, restoring, and utilizing land resources in Ukraine pertaining to implementation of the principle of the State land cadaster keeping is accentuated on.Advantages of account-and-registration systems are analyzed; the legal nature of social relations arising in this sphere is clarified. Recommendations concerning establishing the 3D cadaster in Ukraine are offered.

Аннотация: The paper investigates the legal regulation of land lease in Ukraine. The expediency of strengthening the role and responsibility of the state in the field of conservation of leased land is substantiated. The current legislative provisions governing the legal issues of leasing land plots in Ukraine are provided. The main issues of legal regulation of land lease in Ukraine are formulated from the standpoint of the current legislative acts. The relevance of the issue is determined by the urgent need to resolve all issues arising between the parties upon handover (acceptance) of land for lease in Ukraine within the framework of the current legislation. Legal regulation of all issues related to the lease of land in Ukraine helps to prevent and resolve disputes between the parties related to ignorance, or failure to perform obligations of lease agreements, which are consolidated by the provisions of the current legislation, by any of the parties. Relations between lessees and lessors acquire a legislative framework, which greatly facilitates the resolution of all possible disputes. The practical significance of the study lies in identification and statement of the main regulations of current legislation, which objectively govern the issues of lease relations between the parties in Ukraine, from a legal position. The results of the paper, the conclusions and opinions contained therein, can be used in practical activities by organizations and individuals concluding lease agreements with each other for the right to use land plots in order to settle their lease obligations from the standpoint of the law. Of particular importance is the ability to facilitate the successful resolution of disputes between parties entering into lease relations, or to completely avoid them. © 2020, by ASERS® Publishing. Аннотация: OBJECTIVE: The aim: The purpose of the study is to assess the impact of recreational lands on human health and determine the priority forms of their use and protection. PATIENTS AND METHODS: Materials and methods: International acts, data of international organizations and findings of scientists have been examined and used in the study. The article also summarizes information from scientific journals and monographs from a medical and legal point of view on the basis of scientific methods. This article is based on dialectical, comparative, analytic, synthetic, and comprehensive research methods. CONCLUSION: Conclusions: Recreational lands positively influence human health through a powerful effect of natural healing resources in combination with health-improving and therapeutic procedures on the body, which is becoming increasingly popular, and in some cases, it is the most effective treatment of all. Recreational lands are an independent category of land with a special legal regime of use, characterized by a developed or undeveloped natural area containing natural resources for treatment, recovery, rehabilitation, and prevention of diseases, which are under the special protection of the state and territorial communities. Special protection of the state in today's conditions is extremely important because there has been a negative trend in Ukraine regarding raider attacks. The objects of such attacks are exclusively those companies that are competitive in the market, have achieved significant profits, and continue to develop their activities by creating new branches and introducing new technologies. In particular, attacks on the property of agricultural enterprises and business entities that carry out activities in the field of IT services have become frequent inrecent years [1, p. 172]. The main target of attacks by raiders on agricultural enterprises is their land. Similarly, without state support and protection, recreational land can be the object of raider attacks. The priority form of using recreational land is the placement of resorts and sanatoriums that provide recreational services. Recreational lands can also be used for health improvement in the "wellness" form or within the framework of health tourism.

Аннотация: A study of land reforms in Central and Eastern Europe, which, in fact, was launched simultaneously in the late twentieth century in Bulgaria, Romania, Russia, Moldova, Estonia, Latvia, Lithuania, the Czech Republic, Germany, Slovenia, Ukraine and so far hasn’t been finished in any of these countries, is a relevant issue not only in terms of a comparative analysis of the land market reforming rate, its transparency, but also from the perspective of the peculiarities of support of such reforms by banking financial institutions, which were being created in these countries on the move of reforms. Land banks, cooperative banks, credit unions had, in fact, become the financial locomotives that led to the reforms of the entire agro-industrial complex in these countries. Ownership, the price of rent and its area, a reasonable balance between private and public interests - these and other issues have been the subject of this article.

Аннотация: Ensuring the sustainable development of agricultural production, in particular by legal means, becomes especially important for both Ukraine and other countries. The article considers the legal framework aimed at ensuring the effective conduct of modern agricultural production. Proposals for improving land and agrarian legislation in this area have been developed. In particular, it is proposed to develop a standard model of sustainable development of rural areas and the adoption of the Law of Ukraine “On sustainable development of rural areas”. It should contain criteria for distinguishing the production, social and environmental components of sustainable development of rural areas, in particular, enshrine their definitions, contain special rules and regulations in separate sections. From the analysis of the provisions of national and European legal documents and the situation that exists within rural areas, the conclusion is made that it is expedient to introduce into the practice of agrarian legislation compliance with the principles accompanying the process of sustainable development of rural areas, namely: clear demarcation basic concepts and principles of conducting activities in rural areas, market orientation, balance, adaptability of rural development, taking into account regional features of rural development, local partnership, isolation, quality priority.

Аннотация: Purpose. To determine a legally established mechanism of criminal-legal protection of forest and land resources on the territory of Ukraine where illegal amber mining is carried out. Methodology. The methodological basis of the study is a system of general and special methods of cognition: the dialectical method was used to learn the essence of such a phenomenon as the protection of public relations for environmental protection and rational use of natural resources during amber mining; system-structural method - when separating the social relations of the constituent elements protected by the law within the specified structure; when analyzing the forms of socially dangerous acts of crimes under Articles 240-1, 239 and 245 of the Criminal Code of Ukraine; logical-dogmatic method - during the interpretation of certain terms used in the sciences of geology, administrative and criminal law, contained in the provisions of current legislation; comparative law method - in the study of the relationship of objective signs of acts under Articles 201-1, 239 and 245 of the Criminal Code of Ukraine. Findings. It is established that the criminal law protection of Article 240-1 of the Criminal Code of Ukraine covers public relations for the protection and rational use of amber resources, forest and land resources. The former ones are the main direct object of the crime, the latter ones are the direct additional objects of this crime. The range of objects of this crime is established - amber, forest and land resources. The collision of norms of Articles 240-1 and 245 and Articles 240-1 and 239 of the Criminal Code of Ukraine. Originality. It is established that the object of the crime under Article 240-1 of the Criminal Code includes the main direct object - public relations for the protection and rational use of amber resources and two direct additional objects of crime: public relations for the protection and rational use of forest and land resources. It is determined that damage to forests due to illegal amber mining must be further qualified under Part 1 of Article 245 of the Criminal Code of Ukraine if illegal mining is carried out in a generally dangerous manner. This crime must be further qualified under Part 1 of Article 239 of the Criminal code of Ukraine if illegal extraction of amber is carried out with violation of special rules of treatment of substances, waste or other materials. Practical value. From a practical point of view, the results of the study will contribute to the correct qualification of practitioners of illegal amber mining in Ukraine.

Аннотация: The study investigates the problems of compliance with the legislative requirements in the use of agricultural land in Ukraine, depending on who directly extracts useful properties from such land plots: employees of agricultural enterprises, or the owners of these lands - farmers, members of agricultural cooperatives, citizens who engaging in agricultural production activities individually. The article provides examples of the impact of the activities of workers and the labour of agricultural landowners on the state of land use, compliance with environmental safety requirements, deterioration, and improvement of the quality of land plots. Research of legal issues of targeted, rational, and efficient use of land plots, ensuring the requirements for the preservation of the natural environment, biological diversity and ecosystems contained in the study, provide an opportunity to draw certain conclusions, the essence of which comes down to the fact that the current state of legal relations concerning the use of land plots by employees and landowners needs to be reformed. This is conditioned upon the fact that employees are not motivated to improve the quality of land and its soils, comply with environmental safety requirements, and preserve biological diversity in ecosystems that include the corresponding land plots. Since the main motivation is to obtain a certain benefit, and sanctions for non-compliance with the requirements of legislation in the field of land protection are inefficient, the use of hired labour in agriculture is often described as a negligent and mindless attitude towards land use and ensuring environmental safety. But the owner or user of a land plot that uses it as a farmer, cooperative member, entrepreneur, etc., is motivated not only to make a profit at a given time, but also to improve its quality characteristics, ensure environmental safety, and preserve ecosystem biological diversity, since this is a factor in the stability of obtaining profits from agricultural activities performed on a certain site and in the future.

Аннотация: This review article examines the legal support and proper state support of organic production in Ukraine, substantiation of the potential and obstacles to the development of organic production, as well as proposals for improving the current legislation. This review also analyzes the modern market of organic products, which, in terms of growing consumer demand for environmentally friendly and safe for human health, is very perspective for Ukraine. The increase in the area of agricultural land allocated for organic production, the number of domestic organic operators, and the ever-increasing volume of exports of organic products to other countries indicate a steady trend of growth and further development of this market. However, it is noted that the need to form the infrastructure of the organic products market still remains important. In addition, the problem of improving the system of standardization and certification of production, processing, storage and transportation of organic products, as well as the introduction of an effective control system over the sale of organic raw materials, are the main challenges to be solved.

Аннотация: Ukrainian agriculture remains one of the most problematic sectors of the national economy, and revolutionary processes in rural areas are today in the center of attention of national scientists, politicians, and public representatives. The article carries out a scientific study related to the search for the fundamental reasons for the low effectiveness of reform decisions and actions implemented in Ukraine with the aim of bringing the level of development of Ukrainian rural areas closer to the EU standards. Such research can become the basis for forecasting trends in the development of rural areas of Ukraine in the medium and long term. It can also serve as a reliable basis for applied mechanisms of reforming the agro-industrial complex in the post-war period and the evolution of rural areas of Ukraine in the context of European integration. It is noted that from the point of view of European integration, there is a natural, labor, technical, technological, scientific and information potential for the development of rural areas of Ukraine. At the same time, there is a need to find alternative approaches to the development of rural areas of Ukraine, in particular, focusing on those principles that ensure effective development of rural areas of EU member states. Improving the economic security of the country and transitioning to a higher level of socio-economic development is impossible without the creation of a comprehensive, scientifically based strategy for the development of rural areas on the basis of sustainability.

Аннотация: Background: The extraction and use of natural resources are reasons for environmental problems all over the world. The article examines one environmental right – the right to general water use, and its interrelation with the use of coastal protection strips (water fund lands), as well as specific problems of judicial practice in terms of protecting this right. There is a direct or indirect interrelation between utilised natural objects when confirming the environmental rights of citizens at the level of current national legislation, who are given the opportunity to use natural resources to meet their own needs and be in a harmonious state with the environment as much as possible. Such an interrelation is also reflected in cases of general water use, which is impossible without involving the use of water fund lands, namely coastal protective strips. Methods: With the help of scientific methods, the article uses and analyses international acts, data of international organizations, conclusions of scientists, and legal scientific literature. The legal regulation for using coastal protection strips as a prerequisite for exercising the right to general water use has been investigated within the framework of a systemic approach, as well as analysis and synthesis. Results and Conclusions: It is concluded that the lack of physical access to water bodies and non-compliance with the requirements regarding the proper water quality in water bodies, unfortunately, does not allow for the implementation of the right to general water use either properly or without harming the life and health of citizens. It is noted that in most instances, the result of court case consideration regarding protection of the right to general water use was the refusal to satisfy the claims due to the lack of reasoning and proper argumentation by the claimants, and to hold the decision against them. Claimants have to overcome a number of difficulties in order for their evidence to be recognised by the court as reliable and well-founded. The presence of certain deficiencies in the normative legal acts regarding the right to general water use plays a major role in this process. In order to solve the aforementioned problems and improve water legislation, appropriate proposals in the form of changes and additions to the general provisions of the Water Code of Ukraine have been argued and proposed.

Аннотация: Introduction. Clause 5 of the Law of Ukraine on the Environment Protection states that the use of environment as a total of environmental, natural and social conditions and processes, natural resources, both involved in an economic circulation and not used in economic activities in this period (earth, bowels, water, atmospheric air, forest and other vegetation, fauna, landscapes and other natural complexes) are protected and regulated by the state of Ukraine. Problem Statement. One of the major problems in the field of the innovative infrastructure is absence of the legal regulation of the efficient use and protection of lands under forest shelter belts; reduction of area of the linear-type forest shield belt as a result of illegal economic activities; reduction of financing of scholarly researches on forest amelioration, etc. Purpose. To develop new scientific approaches to the specific features of legal nature of forest shelter belts and legal arrangements in the sphere of forest economy and to form the scientifically justified suggestions on mechanisms for implementing the mentioned legal arrangements. Materials and Methods. The method of scientific generalization, as well as logical and comparative methods have been used. Results. Taking into account the norms of national and international legislation, among the basic law-regulated ways of addressing the problems related to forest shelter belts that have not been transferred for use, there are the following measures: based on decision of regional public administration, to carry out inventory of agricultural lands covered by forest shelter belts; to record information obtained as a result of the land inventory in the State Land Cadaster; and to elaborate and to approve the respective specifications, etc. Conclusions. Two options of solving the indicated problem have been offered and specific measures taking into account the norms of applicable legislation (national and foreign) have been suggested.

Аннотация: The theoretical principles of organic farming development in Ukraine are substantiated. The concept and features of the land for organic farming, especially the legal regime of such land are revealed. The analysis of legal forms of land use for organic farming was carried out. The main advantages of using an organic land plot on the basis of emphyteusis are analyzed. The subjects of land use for organic farming have been investigated. The prospective directions are determined and proposals on the improvement of the current legislation of Ukraine are developed. These include the development and approval of criteria for determining the suitability of agricultural land for use in the process of organic farming, resolving at the legislative level issues related to soil conservation and the protection of their fertility, the development and approval of norms of their qualitative condition that would meet the requirements of cultivation organic products of plant origin. In addition, there is a need for legal separation of agricultural land on which organic products are grown, taking into account the specific use of these lands and establishing their special legal regime.

Аннотация: The normative legal acts that define the basic guarantees and which are based on protection of foreign investments in Ukraine are analyzed. The emphasis is on the special legal regime of economic activity in the special (free) economic zones, on the territory of which are implemented preferential customs, monetary, financial, tax and other conditions of economic activity of foreign legal entities and individuals. It is determined that industrial parks are one of the most common types of special economic zones. The procedure of acquiring ownership of land plots, which is planned to be used for creation and functioning of the industrial park and subjects of the special regime of management within the industrial park, is considered.

Аннотация: Agricultural policy plays a vital role in achieving sustainable rural development. However, it requires detailed strategic planning based on regional issues and gaps in the implementation of previous sustainable development plans. This article aims to analyze the state and peculiarities of rural development in Bulgaria, the Czech Republic, and Hungary. Specifically, it examines the importance of agricultural policy strategies in achieving sustainable rural development. The research methodology is based on a comprehensive systematic analysis of the strategic plans of the Common Agricultural Policy Strategies of Bulgaria, the Czech Republic, and Hungary. Also, it includes structural indicators of regional development of the agricultural sector in these countries for 2017-2020. The results demonstrate that the Common Agricultural Policy Strategies of Bulgaria, the Czech Republic, and Hungary are aimed at stimulating sustainable rural development. In Bulgaria, the agricultural policy for achieving sustainable rural development included creating workplaces, diversifying and developing small enterprises, implementing local development strategies, developing social infrastructure, financing inputs and young farmers, and infrastructure projects (e.g., irrigation). The Czech Republic has the following policy priorities at the European level: sustainability, modernization, workplaces, innovation and quality, and diversification. Direct payments and rural development programs were the main financing mechanisms according to specific needs. The following rural development mechanisms were used in Hungary: farmland management contracts, water and land management measures, social inclusion, investment projects, and special subprograms for targeted support of young farmers. Structural indicators of regional development indicate support for the sustainability of the agricultural sector in 2017-2020.

Аннотация: Agricultural lands, like other categories of land, perform an ecological function as the main object of nature and habitat of man and all living and plant organisms, as well as an economic function as the main object of real estate and the main means of production in agriculture. In order to protect the land, landowners and users are obliged to take measures: to restore the fertility of agricultural land; to protect lands from water and wind erosion, mudslides, flooding, waterlogging, secondary salinization, drying, compaction, chemical pollution, production and consumption wastes and other negative impacts; to protect agricultural lands from overgrowing with trees and shrubs, weeds, preservation of the achieved level of reclamation. Greening of agricultural activity, observance of norms and requirements of land and ecological legislation by subjects of agricultural production are of fundamental importance. The article analyzes the current state of agricultural land use and provides suggestions for improving the efficiency of these lands.
