Аннотация: The article contains the studied issues of abuse of rights in labor relations: the concept of "abuse of rights in labor relations" has been defined, its motives, and beneficial and adverse consequences have been analyzed. The authors emphasize that "abuse of rights" as a legal fact arisen in specific life circumstances may have both beneficial and adverse social content. All this resulted from the fact that legislative practice does not keep up with real conditions of changing labor relations affected by dynamic circumstances of modern social and economic development of society. To develop new approaches to definition of the fundamental principles of labor law to ensure the rights of all participants in labor relations on the principles of equality before the law seems now to be very important. The solution to this problem is in formulation of a universal definition of the concept "abuse of rights in labor relations" like actions or inactions in the legal environment of labor law, based on antisocial motives of these actions (inactions), which do not coincide with motives officially indicated, resulting in adverse social consequences such as discrimination, oppression of labor rights of citizens and stateless persons, violation of the requirements for safe and healthy working conditions. In turn, according to the authors, actions or inactions beyond labor law, but based on positive social motives, resulting in beneficial social consequences such as labor rights of citizens and stateless persons for safe and healthy working conditions, production safety, environmental society, etc., shall not be considered as "abuse of rights" (but as "beneficial abuse of rights").

Аннотация: The purpose of the article is to substantiate an alternative methodology for assessing the competitiveness of young people in the labor market, based on the categories of transit from training to decent employment in the context of transformational change. The article explores the School-to- Work Transition Survey (SWTS), which provides an opportunity to analyze the peculiarities of young people's transit to the labor market. The study was conducted within the framework of the "Work4Youth" project, which aimed to identify ways to obtain information concerning the labor market, namely its youth segment. The main purpose of the SWTS was to gather detailed information on the issues, attitudes and conditions in which young people aged 15-29 was entering and securing their jobs in the labor market. The competitiveness of young people in the labor market has been evaluated and the regions have been investigated according to the characteristics of the workplaces, where the state of completion of the transition from school to employment by the young person have been determined. In addition, clusters that are close in characteristics to the group of regions were distinguished.

Аннотация: The aim of the study is a comprehensive analysis of the legislation on the fight against illegal employment both at the supranational level of the European Union and at the EU Member States level, inter alia, in Poland, France, and Germany. The leading method in the study was the comparative-legal method. It helped to com-pare the peculiarities of the practice of European countries in the field of combating illegal employment in the EU Member States, as well as to identify how this issue is regulated. The results demonstrate that illegal employment destroys legal jobs, leads to the increase in unemployment and deprives the state of revenues such as tax and social contributions, etc. That is why international declarations and conven-tions should guarantee the right to work in the European Union for the citizens of non-European states.

Аннотация: The present article deals with the legislation on labor protection in the construction of the European Union and compares it with the law ofUkraineandAzerbaijan. The main focus of the paper is on Council Directive 92/57/EEC of 24 June 1992 on the implementation of minimum safety and health requirements at temporary or mobile construction sites. Comparing its content with the legislation on labor protection at the construction sites ofUkraineandAzerbaijan, the authors conclude that the guarantees of the right to labor protection in the EU cover a much wider range of subjects than in other states. This is due to the fact that the term «worker», in accordance with the case-law of the Court of Justice, covers persons who performs services for and under the direction of another person; pursues real, genuine activities, to the exclusion of activities on such a small scale as to be regarded as purely marginal and ancillary; in return for which he receives remuneration. In addition, guarantees of labor protection in the EU extend to the self-employed person, whose professional activity contributes to the completion of a project. Proposed ways to adapt Ukrainian and Azerbaijani legislation to EU law.

Аннотация: The relevance of the study of the legal regulation of dismissal of employees for improper performance of labour duties is due to the fundamental changes and reforms in labour legislation which require a more detailed study of the social and legal aspects of labour relations. The purpose of this study is to get acquainted with the procedure for dismissing employees, especially in the form of disciplinary proceedings for improper performance of duties. The study used a theoretical methodological approach, the method of legal hermeneutics, a formal legal, methodological approach, the method of deduction, the method of induction. In the course of the study, the characteristic aspects of labour relations in general, the specific features of the employment contract, and the procedures for dismissal for violation of relevant labour obligations in the framework of disciplinary proceedings were analysed. Modern judicial practice was considered, which provides an opportunity to analyse theoretical provisions in their reflection in the real practice of law enforcement in Ukraine to describe this particular procedure for dismissing an employee more thoroughly. The results of the study also identified certain problems in this area that may interfere with its effective functioning. These problems are related to the contradictory interpretation of legal norms regulating the procedure for dismissing an employee for improper performance of official duties. Therefore, to resolve this conflict of laws issue, the practice of the Supreme Court was considered, and the current legislation was analysed, which helps to provide explanations on all the features of the procedure for dismissing an employee legally. The study provides practical guidance for Ukrainian employers on how to properly dismiss employees for non-performance, ensuring compliance with the law, clear criteria for decision-making and the necessary documentation.

Аннотация: The development of globalization processes in the world economy allows reconciling supply and demand for staff regardless of the employee's country of origin and leads to international labor migration. The experience of highly developed countries shows that a country's economy and its subsequent growth largely depend on the effective recruitment and use of skilled labor. The COVID-19 pandemic has led to a drastic restriction on population mobility and, consequently, worsened the economic and social situations in countries where labor migration was a widespread phenomenon. The ensuing economic crisis has not only altered trends in labor migration but has also brought new challenges to its legal regulation. The article aims to determine the features of migration trends and policy in the COVID-19 environment, examine them in the context of new regulations adopted to protect the labor rights of migrants under the current circumstances, suggest effective measures to regulate the situation in the labor market, and address the economic crises in the countries of destination and origin. The examination of this issue involved a complex methodological framework where the general scientific dialectical method was central to the research. The conducted research provides a foundation for overcoming the social and economic crises caused by COVID-19, which contributes to its practical significance.

Аннотация: The labor market is one of the economy changing components, it is quite similar to the market for goods and services, but instead of the demand and supply of goods, there is a demand and supply of labor, knowledge, skills and abilities that are supplied by the employee. The EU, in turn, is known for its openness to immigrants and the employment of third-country nationals. This creates new opportunities and challenges for workers and employers. Labor market research helps to understand the impact of immigration on labor markets. Covid-19 has actually become that springboard on the way to changes in the economies and labor markets of countries around the world. Transformations and changes that were just emerging until 2020 (this may safely include digitalization, automation, the spread of remote employment, etc.) will further intensify under the influence of the Covid-19 pandemic and the Russian-Ukrainian war and lead to a significant redistribution of workers between sectors. In general, labor market research in the EU and Ukraine helps countries to understand and respond to various challenges and opportunities related to employment, labor migration, economic development and social policy. The purpose of our work is to identify trends and problems that exist at the present stage of development of the labor market, as well as to forecast the further development of the labor market at the level of the European Union and Ukraine.

Аннотация: The article is devoted to the problem of criminal liability for violation of labor rights. Based on the analysis of statistical data and examples of case law, it is concluded that it is necessary to leave the norms on criminal liability for violations of labor rights in the national legislation. The aim of the research is to establish the need for the criminalization of violation of labor rights. The task of the research is to analyze the statistical data on violations in the field of labor relations and develop proposals for criminal liability of employers for violations of the labor rights of employees.

Аннотация: The authors of the article have studied the problems caused by quarantine restrictions aimed at preventing the spread of the COVID-19, in particular the implementation of labor rights of the population. It has been substantiated that the situation, when the majority of persons working on the basis of an employment contract in Ukraine are directly employed at workplaces within enterprises, institutions, organizations, ceased to meet modern world challenges. It has been offered to apply distance work in Ukraine more widely based on the current global tendencies by making appropriate amendments into national labor legislation and by ensuring proper control over the employers’ observance of labor rights of the employees while introducing such work.

Аннотация: The author raises an issue of ecological and socio-economic consequences of Chernobyl catastrophe as well as the current state of Exclusion Zone. The scale of contamination of the environment is unveiled; there have also been mentioned scientific facts of ecological restoration processes. It is emphasized that the most important consequences of the accident in Chernobyl was the socioecological damage which needs adequate juridical assessment and perfection in the sphere of labor relations in the Exclusion Zone. On the basis of drawn conclusions it is suggested to adopt special and individual Regulatory Legal Act on labor issues in the Exclusive Zone and to establish a single state authority on the Exclusive Zone affairs which will contribute to strengthening the environmental safety as well as anthropogenic restoration of natural resources

Аннотация: According to the norms of modern international human rights law, the concept of equality of all people in the exercise of their natural rights is approved. Ensuring the rights of persons with disability directly indicates the country development level. The purpose of this scientific article is to determine the theoretical and legal norms that directly derive from the legislative acts of national and international law on the protection of labor rights of persons with disabilities. In addition, the analysis of legal approaches of the EU and Member States to the employment of persons with disabilities is also the purpose of this article. The author analyzes Ukrainian legislation in this area and identifies legal and practical shortcomings, providing his own recommendations for their improvement. Moreover, the article analyzes European approaches to solving the relevant issue; substantiates the opinion that the approaches of other European countries are more advanced than Ukrainian ones.

Аннотация: The relevance of the study is based on the development of scientific and technological progress and the expansion of the labor market, including in the framework of international cooperation. Moreover, the introduction of quarantine due to the spread of Covid-19 has led to increased attention to remote work. The aim of the study is to analyze the legal aspects of remote work in accordance with the labor legislation of Ukraine and the European Union, focusing on the concept of remote work, the rights and obligations of remote workers. In our study, we determined that in the European Union, the key points in relation to the rights granted to teleworkers, which the countries parties to the agreement have undertaken to incorporate into their national legislation and collective agreements, are data protection; the voluntary nature of telecommuting; equipment; organization of working time; privacy. The originality of the study is based on more effective ways to improve labor productivity in Ukraine, labor discipline, compliance with labor guarantees for remote work. It is necessary to revise and legislatively regulate the key principles of compliance by employees with labor discipline, providing the employee with proper working conditions, supporting the employer in search of new opportunities to provide employees with work, improving the technical aspects of ensuring the relationship between business and government, responsibility for results and the labor process.

Аннотация: Labor relations have always been defined as a source of not only increasing of well-being for all parties, but also as a source of the formation of social problematic situations. This was allowed in cases when workers did not receive the level of income they expected and considered fair. In this case, the search for ways to protect the rights of workers, which is considered in the field of labor law, is relevant. The standard sources for the implementation of forms of protection in labor law are strikes and other forms of termination of the work process. The novelty of the paper is determined by the fact that in modern society the forms of protection of labor rights are mainly judicial forms, which guarantee that the employer cannot influence the settlement process by unofficially affecting employees. The article reveals aspects of the design of labor relations that could eliminate the negative impact on the labor process. Aspects of the formation of the branch of labor law are considered, which can provide the maximum number of decisions in the pretrial order. The practical significance of the paper is determined by the possibility of applying methods of solving collective labor disputes as a factor in the formation of the labor law industry with the formation of the principles of sustainable functioning and public control over business.

Аннотация: The work of professional athletes is a global phenomenon with a high level of labor migration and self-regulation, which depends on international and sports organizations. Professional sports create new jobs and business opportunities, but the issue of legal regulation of the work of athletes remains insufficiently resolved. In Europe, athletes fight to expand their rights through trade unions, since their interests are not always taken into account by club owners. The main challenge is the harmonization of labor rights in the EU, given the differences in national legislation and the growth of labor migration. The study aims to provide a thorough analysis of the process of harmonization of labor rights of professional athletes within the European Union. In particular, it identifies the main obstacles to the integration of national legislation in the EU Member States and offers potential solutions to these obstacles. The purpose of the study is to create recommendations for strengthening the legal framework governing the labor relations of athletes within the EU, taking into account the unique characteristics of their professional activities and the legal framework of the participating countries.

Аннотация: The academic paper provides a comprehensive analysis of the content of the right to work in the context of Ukraine's European integration. Special attention is paid to the issue of compliance with the morality of the current legislation of Ukraine and the morality of transnational law. The possibility of borrowing transnational experience in the legal regulation of the right to work and adaptation has been studied. The labor legislation of Ukraine should be adapted to European norms, which will clearly contribute to protecting the employees' rights, their income and social well-being. Therefore, the purpose of writing an academic paper is to study the issue of the right to work in the conditions of Ukraine's European integration, the possibility of borrowing European experience and enshrining it in the legislation of Ukraine. he research methods were analysis, synthesis, generalization, explanation and data qualification. The primary sources for comprehending the present research were the fundamental scientific provisions highlighted in the works of famous scientists. Theoretical developments and abstract shortcomings of legal issues regarding the implementation of labor law have been worked out for centuries. This issue requires a new vision from the perspective of the criteria of necessity, reasonableness and wisdom, and most importantly, taking into account the conditions of Ukraine's European integration into the European Union and its legislation.

Аннотация: Introduction. Small (medium) enterprises (SMEs) are fundamental participants in economic relations within the European Union (EU). Consequently, their legal status has been continually refined to address functional challenges. At present, SMEs are classified as a unique economic and legal category that may be designated to any business entity meeting specified criteria. Problem Statement. The criteria distinguishing SMEs from other business forms - primarily maximum employee count, accumulated financial resources, and annual turnover - have been found insufficient to effectively distinguish SMEs from larger companies seeking preferential status. Purpose. This study aims to propose enhancements to the existing normative framework defining SMEs, establishing a foundation for a more effective, future-oriented legal regulation of SME status within EU law. Materials and Methods. The study examines the normative framework defining SMEs and applies formal- logical methods, including analysis and interpretation of scientific, regulatory, and economic categories. Methods of modeling, deduction, induction, and comparison have also been employed. Results. The study has analyzed the primary stages of development and effectiveness of the normative concept of SMEs in EU law. Recommendations for enhancing the innovativeness of current regulatory mechanisms have been developed. An additional criterion - engagement in commercial economic activity - has been justified as essential. Further, the study substantiates the potential benefits of replacing the SME status with a distinct, temporary organizational-legal form. Conclusions. The current regulatory framework for SMEs within EU law requires refinement. The proposed recommendations are supported by their potential to address existing regulatory challenges related to SME status effectively.

Аннотация: Over the past decades and especially in recent years, each of our spheres of life has undergone transformational changes in the use of information technology. From the labour market to the social security system, the world is undergoing a transition from “traditional” models of functioning to more updated and modern ones. We are talking about blockchain technology, which is a unique tool for improving various programmes and areas of activity due to its nature, increased security and speed. This is the reason for the relevance of the study. After all, in many countries of the world, in particular in Estonia, China, Switzerland, the United Arab Emirates and many others, blockchain technology is actively being implemented in various spheres of life of the population. Accordingly, the sphere of social security also falls under this sphere. The purpose of the study is to provide a detailed analysis of the features and characteristics of blockchain technologies, to identify the specifics of integrating blockchain technologies into the social security system based on the principles of transparency and efficiency, as well as to familiarise with the problems of using blockchain in the social security sector and to provide practical recommendations for the effective integration of blockchain technologies. To achieve this goal, we used the following methods of scientific knowledge, such as the general philosophical method, the method of system analysis, synthesis, comparative legal method, dialectical method, deduction and induction. As a result of the scientific research, we have formed general theoretical conclusions about the phenomenon of blockchain technologies, as well as the peculiarities of integrating blockchain technologies into the social security system. Moreover, we have drawn practical conclusions and provided recommendations for improving the process of implementing blockchain technology in the social security system.

Аннотация: One of the key factors of any production is labor resources. Labor resources, to a greater extent than other factors of production, determine the strategic success of an enterprise, are the basis for ensuring its competitiveness, and therefore must be in sufficient quantity, of appropriate quality, and effectively managed. At the same time, HR administration becomes important in the management of an enterprise based on a comprehensive solution to personnel issues, the introduction of new and improvement of existing forms and methods of work with personnel of enterprises and organizations. And labor law regulates social relations arising in the field of labor; determines the grounds and procedure for the emergence, change, and termination of a person’s right to labor; serves as an effective guarantee for a person in the protection and realization of his/her right to labor. The overall objective of the study is to analyse the relevance of the HR profession and study global trends in HR management in order to understand possible changes in this area. The methodology of the latter is based on the general scientific dialectical method. Historical, logical-legal, logical-semantic, systemic, sociological, and comparative legal scientific methods were also used.

Аннотация: The relevance of the problem of protection of the rights of persons granted refugee status is due, in particular, to the fact that the increase in the number of refugees and related political, economic, and social problems confirms the need to reassess and rethink the legal status of this category of persons and to develop a new approach to the analysis and solution of the refugee problem at both international and regional levels. The situation in Ukraine also confirms the fact that not all states are ready to cooperate within the framework of international law and prevent human rights violations, which, in turn, can lead to an increase in the number of refugees. Therefore, the issue of protecting their rights does not lose relevance in scientific research. The purpose of the article is to study the general features of obtaining refugee status and the exercise of the right to work by such persons. The author analyzes the normative sources of international and national law on the relevant topics. In addition, the author examines the practical aspects of the exercise of the right to work by refugees, in particular the problems faced by such persons and suggests possible solutions to existing problems. The leading method used for the study is the formal legal method. Its application determined the feasibility and validity of the study. This method was used in the analysis of legal acts regulating the protection of labor rights of refugees, namely: acts of international law, legislation of the EU member states, Asian countries, as well as national law of Ukraine.

Аннотация: In the conditions of the democratization of the Ukrainian state, the reform of labor legislation is an objective necessity, about which there are many discussions. The current labor legislation was developed during the existence of strict legal regulation of labor relations, when state property was their economic basis. The relevance of the chosen research topic lies in the fact that the current legislation regulating labor relations is outdated and unbalanced, has problems, shortcomings, conflicts and gaps, and is simply not suitable for regulating this area in a market economy. The present study used a set of general and special methods of scientific knowledge. The purpose of this study is to establish the nature of problems, shortcomings and gaps in the legal regulation of labor relations in Ukraine, identify some of them and find ways to solve them, and formulate proposals to improve existing labor legislation in our country.
