Аннотация: If a national enterprise successfully enters the world market and takes a place in the world system of labor differentiation (or in international business), this fact is likely to guarantee sustainable development to the company, and taken in a large scale, to the national economy as a whole. This is confirmed by the experience of a number of countries, both indisputable long-standing leaders, such as the United States, the EU, and Japan, and new economic leaders, i.e. China, South Korea, Singapore, and Taiwan. We believe that this experience can be useful for Ukraine, as well. Using ample statistical material and research papers on the problem as a basis for our research, we have studied a number of issues of the world market development, and especially those of the market of machine-building products, namely: some tendencies prevailing in these markets, the main risks associated with entering and functioning in these markets, some possible directions of their development, and the development of enterprises and business entities operating in them. Some requirements to the enterprises functioning in the environment in question are defined, first of all, in the following spheres: labor productivity; capacity utilization; the technical level, quality and cost of production; the level, quality, content and scope of research and development work; the whole set of issues related to the development, production and promotion of products in the national and world markets. The paper identifies some priority areas, or segments, in which Ukrainian machine-building enterprises can succeed in the world market. The paper studies the role and place of accounting, internal control, and internal audit in the management system at an enterprise, as well as their influence on the results of financial and economic activity of business entities, and on their success in the world market, in the system of international business. The paper examines some of the most significant, from our point of view, current realities in which Ukrainian enterprises, together with their management and management systems, will have to work. The authors believe that the results of the study, after some adjustment, can be extended to enterprises in other sectors of the economy.

Аннотация: The article is devoted to the problem of criminal liability for violation of labor rights. Based on the analysis of statistical data and examples of case law, it is concluded that it is necessary to leave the norms on criminal liability for violations of labor rights in the national legislation. The aim of the research is to establish the need for the criminalization of violation of labor rights. The task of the research is to analyze the statistical data on violations in the field of labor relations and develop proposals for criminal liability of employers for violations of the labor rights of employees.

Аннотация: The Covid-19 coronavirus pandemic forced the administrative staff of agricultural enterprises to work from home, thus raising the issue of remote workforce motivation. Whenever employees are working from home, their activity needs coordination and control over the fulfillment of job responsibilities. The study proposes that efficient functioning and motivation of remote workforce be achieved through the creation of team, which will fully use the potential of every employee and coordinate their joint efforts for the sake of attainment of company goals and objectives. The coaching method is suggested as the way to build a team. Such team will possess a relevant intellectual potential and troubleshooting flexibility. An efficient team is capable of raising labor productivity, which will improve the company’s position on the market and will generate additional revenue for financial motivation of employees.

Аннотация: Civil relations are one of the fundamental topics of the civil law being the subject of the research attention of civil law scientists for many decades, both in Ukraine and abroad. Modern tendencies of social and economic transformations of the society, shifts in value and globalization challenges made topical the issue of delineation of civil and labor legal relations arguing the necessity in comparative analysis of their essence and content, definition of further perspective of interaction of civil and labor law branches. In the process of the study, the essence and content of civil relation have been revealed; the problem of replacement of labor relations with civil law, as well as the established judicial practice in this area on the territory of Ukraine has been analysed; risks and perspective of delineation of civil and labor relations have been determined; generalized author principles to delineate relations under the investigation have been proposed; the necessity to use the conceptual and categorical framework of a specific law branch regulating certain legal relations as a guarantee of a business entity against the claims of the controlling authorities has been substantiated.

Аннотация: The purpose of the article is to identify and evaluate the main measures of migration policy and legal regulation in the field of combating the effects of the economic crisis, effective ways to regulate the situation on the labor market and employment and measures to address the economic crisis in the country of destination and origin. Methods of analysis and synthesis, theoretical generalization, historical, scientific-analytical, systematization and classification were used to identify scientific and theoretical bases of labor migration. The practical significance of the obtained results lies in the possibility of using the results of the study to overcome the socio-economic consequences of the coronary crisis by countries; to improve the activities of migration services.

Аннотация: Increasing the power of computer technology, combined with the rapid spread of the Internet, large databases, etc., significantly changes the nature of work. Innovation in the labor process boosts productiveness and decreases costs. By increasing overall productivity, innovations in ICT allow enterprises, institutions, and organizations to produce a certain number of goods and services resorting to fewer employees, which leads to the technological lack of jobs. To carry out a rigorous analysis of this issue, obtain trustworthy results, and draw relevant conclusions, the authors applied general and special research methods. It has been found that the processes of digitalization affect the labor market, in particular, the emergence of new and the disappearance of «old» professions. In Ukraine, digitalization processes significantly affect the course of labor relations and the organization of labor at enterprises, institutions, and organizations. The authors note that it is still a matter of concern to ensure the security of such information and to determine the range of persons who will have access to such information, such as who will be the owners and managers of such information. The authors of this article argue that innovations in labor legislation make sense in today’s information society.

Аннотация: In recent decades, the world community has paid considerable attention to the task of ensuring the protection of persons who, due to violent conflicts, massive violations of human rights, or other unpredictable and tragic events, are forced to leave their homes against their will. In 2014, Ukraine faced such an extraordinary problem. The war in eastern Ukraine and the occupation and annexation of Crimea by Russia led to the fact that many people were forced to leave their homes and move to safer places in the country or to other states. As a result of such internal migration activity, Ukraine entered the top ten countries in terms of the number of internally displaced persons. Russia’s open military invasion of Ukraine in February 2022 caused a new surge in the mass internal displacement of the population. That is why there is an urgent need to study the issue of social protection of internally displaced persons and the problematic aspects arising in this area. The purpose of the article is to identify problems that arise when ensuring the rights of internally displaced persons and to develop ways to solve them. The methodological basis of the research is general scientific and special scientific methods, such as system-structural, structural-functional, analysis and synthesis, comparative, and formal-legal.

Аннотация: Today in the context of the formation of a new historical phase of social development of civilization-post-industrial society-there is a de-standardization of employment, i.e. the spread of flexible and variable forms of employment, which are called non-standard. It is the modification of traditional and the emergence of completely new forms of employment that actively influence the main parameters of the labor market (demand, supply, labor price, etc.). Therefore, today, personnel leasing, outsourcing, outstaffing, remote employment, non-standard working hours, etc. can be considered fundamental innovations in the field of employment. The following methods were used during the study: analysis, synthesis, induction, deduction, dialectical approach, analytical thinking, abstraction, and generalization. The purpose of the study is to define the essence of precarious forms of labor, their impact on the economy and social protection of the employee, advantages, and disadvantages. Also, to investigate problematic theoretical and practical issues related to the right to remuneration in Ukraine in the context of precarious employment, in particular, to summarize the main directions of reforming legal regulation in this area.

Аннотация: The norms of labor law that regulate the relevant relationship between the employee and the employer are constantly evolving under the influence of various factors, including society and the State. Labor law trends have become especially prominent over the past several years, particularly during the COVID-19 pandemic. Lockdown restrictions have dealt a serious blow to the labor field and have required urgent action from both companies and governments. In view of this, a number of relevant subtopics have been formed in labor relations, the study of which is of interest to the entire scientific community. The purpose of the research paper is to study the main trends that have emerged in modern labor law and their impact on the formation of the labor legislation system in Ukraine and the European Union (EU) from a comparative perspective. The article analyzes the main directions that the authors have identified as especially relevant in the development of labor relations and the legal regulation of such issues. Considering that some trends have arisen spontaneously under the influence of the COVID-19 pandemic, and many States were not ready for them, we have analyzed how the legislator settled such issues. The laws of Ukraine, the EU, and individual EU member States are examined here in a comparative perspective to draw upon and understand a complete picture of the modern development of labor relations in Europe and to identify the most beneficial approaches to regulating topical issues of labor law. The information obtained as a result of the study can be used to improve Ukraine’s national legislation, bring it in line with European standards, further study the issue of the modern development of labor relations, and teach and develop methodological support for educational disciplines related to labor law and social security law.

Аннотация: The relevance of the study is based on the development of scientific and technological progress and the expansion of the labor market, including in the framework of international cooperation. Moreover, the introduction of quarantine due to the spread of Covid-19 has led to increased attention to remote work. The aim of the study is to analyze the legal aspects of remote work in accordance with the labor legislation of Ukraine and the European Union, focusing on the concept of remote work, the rights and obligations of remote workers. In our study, we determined that in the European Union, the key points in relation to the rights granted to teleworkers, which the countries parties to the agreement have undertaken to incorporate into their national legislation and collective agreements, are data protection; the voluntary nature of telecommuting; equipment; organization of working time; privacy. The originality of the study is based on more effective ways to improve labor productivity in Ukraine, labor discipline, compliance with labor guarantees for remote work. It is necessary to revise and legislatively regulate the key principles of compliance by employees with labor discipline, providing the employee with proper working conditions, supporting the employer in search of new opportunities to provide employees with work, improving the technical aspects of ensuring the relationship between business and government, responsibility for results and the labor process.

Аннотация: According to the norms of modern international human rights law, the concept of equality of all people in the exercise of their natural rights is approved. Ensuring the rights of persons with disability directly indicates the country development level. The purpose of this scientific article is to determine the theoretical and legal norms that directly derive from the legislative acts of national and international law on the protection of labor rights of persons with disabilities. In addition, the analysis of legal approaches of the EU and Member States to the employment of persons with disabilities is also the purpose of this article. The author analyzes Ukrainian legislation in this area and identifies legal and practical shortcomings, providing his own recommendations for their improvement. Moreover, the article analyzes European approaches to solving the relevant issue; substantiates the opinion that the approaches of other European countries are more advanced than Ukrainian ones.

Аннотация: The development of globalization processes in the world economy allows reconciling supply and demand for staff regardless of the employee's country of origin and leads to international labor migration. The experience of highly developed countries shows that a country's economy and its subsequent growth largely depend on the effective recruitment and use of skilled labor. The COVID-19 pandemic has led to a drastic restriction on population mobility and, consequently, worsened the economic and social situations in countries where labor migration was a widespread phenomenon. The ensuing economic crisis has not only altered trends in labor migration but has also brought new challenges to its legal regulation. The article aims to determine the features of migration trends and policy in the COVID-19 environment, examine them in the context of new regulations adopted to protect the labor rights of migrants under the current circumstances, suggest effective measures to regulate the situation in the labor market, and address the economic crises in the countries of destination and origin. The examination of this issue involved a complex methodological framework where the general scientific dialectical method was central to the research. The conducted research provides a foundation for overcoming the social and economic crises caused by COVID-19, which contributes to its practical significance.

Аннотация: The aim of the study is a comprehensive analysis of the legislation on the fight against illegal employment both at the supranational level of the European Union and at the EU Member States level, inter alia, in Poland, France, and Germany. The leading method in the study was the comparative-legal method. It helped to com-pare the peculiarities of the practice of European countries in the field of combating illegal employment in the EU Member States, as well as to identify how this issue is regulated. The results demonstrate that illegal employment destroys legal jobs, leads to the increase in unemployment and deprives the state of revenues such as tax and social contributions, etc. That is why international declarations and conven-tions should guarantee the right to work in the European Union for the citizens of non-European states.

Аннотация: The relevance of the problem of protection of the rights of persons granted refugee status is due, in particular, to the fact that the increase in the number of refugees and related political, economic, and social problems confirms the need to reassess and rethink the legal status of this category of persons and to develop a new approach to the analysis and solution of the refugee problem at both international and regional levels. The situation in Ukraine also confirms the fact that not all states are ready to cooperate within the framework of international law and prevent human rights violations, which, in turn, can lead to an increase in the number of refugees. Therefore, the issue of protecting their rights does not lose relevance in scientific research. The purpose of the article is to study the general features of obtaining refugee status and the exercise of the right to work by such persons. The author analyzes the normative sources of international and national law on the relevant topics. In addition, the author examines the practical aspects of the exercise of the right to work by refugees, in particular the problems faced by such persons and suggests possible solutions to existing problems. The leading method used for the study is the formal legal method. Its application determined the feasibility and validity of the study. This method was used in the analysis of legal acts regulating the protection of labor rights of refugees, namely: acts of international law, legislation of the EU member states, Asian countries, as well as national law of Ukraine.

Аннотация: Labor relations have always been defined as a source of not only increasing of well-being for all parties, but also as a source of the formation of social problematic situations. This was allowed in cases when workers did not receive the level of income they expected and considered fair. In this case, the search for ways to protect the rights of workers, which is considered in the field of labor law, is relevant. The standard sources for the implementation of forms of protection in labor law are strikes and other forms of termination of the work process. The novelty of the paper is determined by the fact that in modern society the forms of protection of labor rights are mainly judicial forms, which guarantee that the employer cannot influence the settlement process by unofficially affecting employees. The article reveals aspects of the design of labor relations that could eliminate the negative impact on the labor process. Aspects of the formation of the branch of labor law are considered, which can provide the maximum number of decisions in the pretrial order. The practical significance of the paper is determined by the possibility of applying methods of solving collective labor disputes as a factor in the formation of the labor law industry with the formation of the principles of sustainable functioning and public control over business.

Аннотация: The relevance of the study of the legal regulation of dismissal of employees for improper performance of labour duties is due to the fundamental changes and reforms in labour legislation which require a more detailed study of the social and legal aspects of labour relations. The purpose of this study is to get acquainted with the procedure for dismissing employees, especially in the form of disciplinary proceedings for improper performance of duties. The study used a theoretical methodological approach, the method of legal hermeneutics, a formal legal, methodological approach, the method of deduction, the method of induction. In the course of the study, the characteristic aspects of labour relations in general, the specific features of the employment contract, and the procedures for dismissal for violation of relevant labour obligations in the framework of disciplinary proceedings were analysed. Modern judicial practice was considered, which provides an opportunity to analyse theoretical provisions in their reflection in the real practice of law enforcement in Ukraine to describe this particular procedure for dismissing an employee more thoroughly. The results of the study also identified certain problems in this area that may interfere with its effective functioning. These problems are related to the contradictory interpretation of legal norms regulating the procedure for dismissing an employee for improper performance of official duties. Therefore, to resolve this conflict of laws issue, the practice of the Supreme Court was considered, and the current legislation was analysed, which helps to provide explanations on all the features of the procedure for dismissing an employee legally. The study provides practical guidance for Ukrainian employers on how to properly dismiss employees for non-performance, ensuring compliance with the law, clear criteria for decision-making and the necessary documentation.

Аннотация: The problems of the correlation of private and public interests while implementing the freedom of will of the parties to the employment contract in Ukraine in terms of the COVID-19 pandemic have been studied in the article; and propositions for their solution have been substantiated. Having studied the statistic data that demonstrates the negative consequences from the COVID-19 pandemic in the world for the realization of labor rights, the authors have characterized the potential threats to the labor rights of employees and employers in Ukraine and indicate the ways of their origin. The authors have substantiated the opinion that the legislation of Ukraine was not ready for effective regulation of labor rights and their implementation in these conditions. It has been concluded that: the parties to the employment contract have become dependent on government measures to curb the spread of the pandemic; the social dialogue in the context of the COVID-19 pandemic is the legal construction that is able to balance private and public interests, to find a point of their intersection that would suit both the state and a particular entity on the legal regulation of relations in the field of hired labor.

Аннотация: The purpose of the article is to substantiate an alternative methodology for assessing the competitiveness of young people in the labor market, based on the categories of transit from training to decent employment in the context of transformational change. The article explores the School-to- Work Transition Survey (SWTS), which provides an opportunity to analyze the peculiarities of young people's transit to the labor market. The study was conducted within the framework of the "Work4Youth" project, which aimed to identify ways to obtain information concerning the labor market, namely its youth segment. The main purpose of the SWTS was to gather detailed information on the issues, attitudes and conditions in which young people aged 15-29 was entering and securing their jobs in the labor market. The competitiveness of young people in the labor market has been evaluated and the regions have been investigated according to the characteristics of the workplaces, where the state of completion of the transition from school to employment by the young person have been determined. In addition, clusters that are close in characteristics to the group of regions were distinguished.

Аннотация: The authors of the article have studied the problems caused by quarantine restrictions aimed at preventing the spread of the COVID-19, in particular the implementation of labor rights of the population. It has been substantiated that the situation, when the majority of persons working on the basis of an employment contract in Ukraine are directly employed at workplaces within enterprises, institutions, organizations, ceased to meet modern world challenges. It has been offered to apply distance work in Ukraine more widely based on the current global tendencies by making appropriate amendments into national labor legislation and by ensuring proper control over the employers’ observance of labor rights of the employees while introducing such work.
