Аннотация: INTRODUCTION: Agricultural workers' health depends on many factors: working conditions, security arrangements, medicine, quality of drugs, the environment, etc. Occupational injuries and diseases are also among the factors that can negatively affect their health. THE AIM: To analyze provisions of the international legislation and scientific literature concerning existence of restrictions on impact of occupational injuries and diseases on agricultural workers' health. MATERIALS AND METHODS: International acts, data of international organizations and conclusions of scientists have been examined and used in the study. The article also integrates information from scientific journals and monographs from a medical and legal point of view with scientific methods. This article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. Impact of occupational injuries and diseases on agricultural workers' health has been studied within the system approach, as well as analysis and synthesis. CONCLUSIONS: The level of occupational morbidity, traumatism and above all standard of agricultural workers' health depends on the way of occupational safety organization. Working conditions and safety in agricultural industry and therefore the appropriate standard of health remain unsatisfactory in many countries.

Аннотация: Due to the insufficient level of regulation of the institute of commercial secrets in Ukrainian legislation, the article attempts to study foreign and international experience in the context of this issue. In particular, labor laws of some countries, as well as a series of international agreements and directives were examined; their main statements, advantages and disadvantages were defined. Based on collected and analyzed data, the authors outlined directions of adapting Ukrainian legislation to the highest standards of the EU, as well as developed recommendations for amending the Labor Code of Ukraine, paying special attention to the obligations of the employee in preserving commercial secrets. The suggestion was made to adopt at the enterprise level a local normative act that would determine the list of information constituting a commercial secret and would reflect the procedure for its use, storage and distribution, as well as the responsibility of employees for its unauthorized distribution-the Commercial Secrets Regulation.

Аннотация: Given the insufficient level of regulation of the health insurance institute in Ukrainian legislation, the article attempts to investigate global experience in the context of this issue. In particular, a number of international documents were investigated, their content was characterized and the main provisions were highlighted. Based on collected and analyzed data, the authors outlined the areas of adaptation of Ukrainian legislation to the highest standards of the EU, made a proposal for the ratification of the conventions of the International Labor Organization. Supported a proposal for the development and adoption of a separate special law on general-compulsory state health insurance, which would regulate issues related to health insurance.

Аннотация: In modern transformational Europe-oriented conditions of Ukraine development, the peculiarities of property civil law liability and material liability according to labor law as well as comprehensive comparative analysis are very topical in connection with the lack of a one unified approach to this issue, both among representatives of the doctrine and practices. The authors of this article conducted study involving: (1) the notion, content and features of property civil law liability of properties in corresponding legal relations have been analysed; (2) the authors’ definition of the notion “property civil law liability” has been proposed; (3) criteria of delineation between property civil law liability and material liability in labor relations have been disclosed and unified; (4) the characteristics of case law in the field of bringing to property civil liability have been analyzed, the substitution of labor civil liability, as well as prosecution without guilt have been emphasised; (5) a discussion position regarding the existence of professional responsibility as a form of civil liability has been considered, and (6) the necessity of specifying nature and characteristics of property civil liability, as well as the circumstances of exemption from it, at the legislative level, with subsequent detailing in the case-law of the Supreme Court of Ukraine state has been substantiated.

Аннотация: The article covers issues related to provision of electronic services by state employment agencies to citizens and employers regarding employment and recruitment. In particular, peculiarities of online services implementation by workforce development agencies in different countries, such as Germany, France and Spain, were investigated. It also reveals the essence of the worldwide renowned indices EGDI and EPI, which determine the level of electronic government in any country in the world and provide relevant data of the last report on the level of e-government among the states. The content of the norms of the current Ukrainian legislation covering e-government issues, as well as modernization and development of the State Employment Service, including provision of innovative electronic services to the public and business is revealed. Main advantages of electronic services provided for jobseekers and employers by employment agencies of different countries are outlined. As a result of the undertaken analysis of contemporary approaches to provision of electronic services by employment agencies of foreign countries the possibility of introducing online services aimed at improving quality and minimizing time for customer service are suggested.

Аннотация: OBJECTIVE: Introduction: Occupational risks affecting each healthcare professional are diverse and significantly affect their physical and psychological condition. They can conditionally be divided into risks resulting from: 1) the impact of the work process and pose a risk to the life and health of healthcare professionals; 2) the activities of healthcare professionals and pose a potential risk to the patients lives and health. The latter group poses a threat of criminal liability for the healthcare professional. It is the task of each state to ensure safe working conditions for the effective performance of their duties by healthcare specialists. However, according to the study, the analyzed Eastern European countries lack accurate statistics on occupational diseases of healthcare professionals, while the latter often do not seek specialized care and are treated on their own. The aim: to identify the types and causes of occupational risks for healthcare professionals working in the countries of Eastern Europe; to investigate the legislation of these countries under which medical professionals may be prosecuted/held guilty and, thus, criminally liable for causing harm to their patients. PATIENTS AND METHODS: Materials and methods: Legislation of the Republic of Belarus, Republic of Moldova, Russian Federation and Ukraine, international declarations and conventions, research papers, case law of the European Court of Human Rights, national court decisions of some East European countries. CONCLUSION: Conclusions: Occupational risks to the healthcare professionals are risks to his or her life and health and risks of criminal liability for causing harm to the patient. The causes of the first type risk are: a significant prevalence proportion of infectious diseases; the use of faulty medical equipment; unregulated working day and low salaries; medical attendance of patients prone to aggression, etc. The healthcare professional shall be criminally responsible only if he/she is found guilty for infliction of harm to the life and health of the patient and the presence of the obligatory signs of a specific crime in his/her actions.

Аннотация: OBJECTIVE: Introduction: The core of physician's non-compete agreements problematics lies in complex system of controversial interests, rights and goals of subjects involved. On the one hand non-compete restrictions and their enforceability is an obvious part of employer's legitimate business interest based on the freedom of contract, on the other - free unrestricted market, preventing of monopolization, availability of medical assistance and healthcare, right to choose a doctor are social standards and thus - a part of public interest, in addition to this - non-compete restrictions impact physician's right to work. Balance between these components is pretty sensitive and hard to achieve. We can find enforceability of physician's non-compete provisions in different types of relations: employment contracts, partnership agreements, sale of medical practice. But complexity of mixing law, ethical, social issues along with different approaches of legal regulations rises the relevance of research. PATIENTS AND METHODS: Material and methods: This study is based on German, British, Spain, Swiss, USA regulation acts, scientific researches and opinions of progressive-minded people in this sphere. The article is based on dialectical, comparative, analytic, synthetic and comprehensive methods. RESULTS: Results: Non-compete agreements may have social benefits in some situations: serve as an instrument to protect trade secrets thus stimulate innovation; reducing of worker's exit probability could increase quality of medical services due to training of employees etc. But also, there are some serious risks to employee, to employer and to society as a whole. Analyzing the sense of non-compete clause in general we can assume that it includes seven main points: the subject; the form; the time; the territory; the scope and type of restrictions; "buy out" of the clause and the compensation. These characteristics are the core of non-compete clause, and, taking into account the principle of freedom in terms of agreement conclusion, it is up to law enforcement practice to determine minimal and maximal limits of such restrictions. US legal concept is clearly based on implementing of legally prescribed restrictions for non-compete with physicians (along with other categories). European practice being pretty similar in view on what non-compete agreement is and what principles it is based on however is obviously different in approach chosen because of absence of special legal provisions for physicians' non-compete regulation. CONCLUSION: Conclusion: Lack of legal regulation and law enforcement practice in this sphere worldwide is obvious, so the starting point in resolving of physician's non-compete enforceability issue will be choosing of suitable concept. Analyzing of proposed concepts, we came to the conclusion that the most perspective will be an approach of specification and clarification of "reasonability" meaning in terms of evaluation physicians' non-compete agreement validity and their impact on public interest.

Аннотация: The Covid-19 coronavirus pandemic forced the administrative staff of agricultural enterprises to work from home, thus raising the issue of remote workforce motivation. Whenever employees are working from home, their activity needs coordination and control over the fulfillment of job responsibilities. The study proposes that efficient functioning and motivation of remote workforce be achieved through the creation of team, which will fully use the potential of every employee and coordinate their joint efforts for the sake of attainment of company goals and objectives. The coaching method is suggested as the way to build a team. Such team will possess a relevant intellectual potential and troubleshooting flexibility. An efficient team is capable of raising labor productivity, which will improve the company’s position on the market and will generate additional revenue for financial motivation of employees.

Аннотация: OBJECTIVE: The aim of the research is to study the peculiarities of the legislative consolidation of criminal and disciplinary liability for offenses of health care professionals in Ukraine and other states. PATIENTS AND METHODS: Materials and methods: Criminal legislation of Ukraine, international acts, decisions of the European Court of Human Rights (hereinafter - ECHR), data of the Integrated State Register of Judgments, as well as criminal legislation of Germany, the French Republic, the Kingdom of Denmark, the Republic of Belarus, Kazakhstan and many other countries. A set of general and special scientific methods of scientific knowledge was the methodological basis. The use of the comparative law method has become useful in the analysis of Ukrainian legislation and the legislation of other states. CONCLUSION: Conclusions: the article examined the features of the legislative consolidation of criminal and disciplinary liability for offenses of health care professionals in Ukraine and other countries. A comparative legal analysis of the legal enshrinement of the corpus delicti in the form of non-performance or misconduct of professional duties by a health care or pharmaceutical worker was carried out on the example of Ukraine and many other countries; types of penalties for medical crimes, which are established for this type of offense, were identified; sanctions for committing a disciplinary misconduct by a health care professional were determined on the example of the legislation of different countries.

Аннотация: OBJECTIVE: The aim: To develop an algorithm of legal support of the system that guarantees safe working conditions of medical workers at medical institutions during the COVID-19 outbreak. PATIENTS AND METHODS: Materials and methods: The following materials were used in the paper: Interim Recommendations of the World Health Organization, documents of The World Medical Association, international human rights instruments, international labour protection acts, European health legislation, the decision of the European Court of Human Rights, judicial practiceand survey of 60 specialists. The following methods were used in the paper: system method, comparative method, the method of questionnaires and formal logical method. RESULTS: Results: The survey of physicians allowed to state the need to create local protocols or technological maps of the use of personal protective equipment and the development and approval of the relevant results of their use - standards to ensure safe working conditions. CONCLUSION: Conclusions: Proposals for legal support of the system of guaranteeing safe working conditions for medical workers at the local level have been formulated. Every medical enterprise should have a system of guaranteeing safe working conditions for medical workers by: distribution of responsibilities between the heads of medical enterprises, issuing departmental and local acts on ensuring their work and acquainting medical workers with them, ensuring proper quality and quantity of personal protective equipment and, accordingly, monitoring their use and the functioning of the system of guaranteeing safe conditions.

Аннотация: The problems of the correlation of private and public interests while implementing the freedom of will of the parties to the employment contract in Ukraine in terms of the COVID-19 pandemic have been studied in the article; and propositions for their solution have been substantiated. Having studied the statistic data that demonstrates the negative consequences from the COVID-19 pandemic in the world for the realization of labor rights, the authors have characterized the potential threats to the labor rights of employees and employers in Ukraine and indicate the ways of their origin. The authors have substantiated the opinion that the legislation of Ukraine was not ready for effective regulation of labor rights and their implementation in these conditions. It has been concluded that: the parties to the employment contract have become dependent on government measures to curb the spread of the pandemic; the social dialogue in the context of the COVID-19 pandemic is the legal construction that is able to balance private and public interests, to find a point of their intersection that would suit both the state and a particular entity on the legal regulation of relations in the field of hired labor.

Аннотация: The article presents a brief analysis of the situation in Belarus and Ukraine with the spread of coronavirus COVID-19 and measures taken by employers to optimise labour and social security relations during 2020. A brief overview of the decisions taken by Presidents, Parliaments, Governments and Ministry of Healthcare of both countries aimed at containment of coronavirus infection is presented. The latest changes in the Labour Code of Belarus and Labour Code of Ukraine, which regulated remote work since 2020, were touched upon. Attention is paid to the concept of self-isolation under the legislation of Belarus and Ukraine, restrictive measures that must be observed when self-isolating citizens in connection with COVID-19 infection, as well as level 1st and 2nd contacts. The authors analyse the new legislative provisions governing home and remote work, introduced into the labour legislation in Belarus in 2020, in Ukraine in 2020 and 2021. The article presents the specific experience of Belarus, where the presidential decree extended the rights of employers to temporarily transfer employees without their consent, as well as to change essential working conditions, and without making changes to the Labour Code. The authors give an assessment of such legislative innovations. The article deals with some issues of social support for employees who find themselves in a situation of downtime due to the suspension of the activities of organisations that are idle, as well as self-isolation. At the end of the article, some suggestions and recommendations are made for further adaptation of labour and social security legislation in Belarus and Ukraine in the context of the COVID-19 pandemic.

Аннотация: The relevance of the study is based on the development of scientific and technological progress and the expansion of the labor market, including in the framework of international cooperation. Moreover, the introduction of quarantine due to the spread of Covid-19 has led to increased attention to remote work. The aim of the study is to analyze the legal aspects of remote work in accordance with the labor legislation of Ukraine and the European Union, focusing on the concept of remote work, the rights and obligations of remote workers. In our study, we determined that in the European Union, the key points in relation to the rights granted to teleworkers, which the countries parties to the agreement have undertaken to incorporate into their national legislation and collective agreements, are data protection; the voluntary nature of telecommuting; equipment; organization of working time; privacy. The originality of the study is based on more effective ways to improve labor productivity in Ukraine, labor discipline, compliance with labor guarantees for remote work. It is necessary to revise and legislatively regulate the key principles of compliance by employees with labor discipline, providing the employee with proper working conditions, supporting the employer in search of new opportunities to provide employees with work, improving the technical aspects of ensuring the relationship between business and government, responsibility for results and the labor process.

Аннотация: The COVID-19 coronavirus pandemic, which has spread to all countries of the world, has posed new challenges in terms of legal, socio-economic, political, and social development. The pandemic produced a need for a mechanism of legal regulation of a special organization of the remote work, working hours, workplace, working conditions, etc. The study aims to analyze and compare the legal regulation of remote work under the introduction of restrictive measures caused by the spread of COVID-19 in Ukraine and the EU. The leading method was the method of comparative analysis. It helped to compare the specifics of the practice of EU member states in the field of legal regulation of remote work under the above conditions in Ukraine and the EU, identify how these issues are regulated in other EU countries. In Ukraine, it is necessary to improve the rules for regulating the responsibilities of the employer to compensate for the costs of a remote worker, enshrining in law the obligation of the employer to provide the employee with computer equipment, means of communication. The experience of European countries proves it is necessary to implement “right to disconnect” in Ukraine. Information and knowledge gained from the experience of different EU countries can be used as a basis for the adaptation and development of new relevant provisions in Ukraine.

Аннотация: The aim of the study is a comprehensive analysis of the legislation on the fight against illegal employment both at the supranational level of the European Union and at the EU Member States level, inter alia, in Poland, France, and Germany. The leading method in the study was the comparative-legal method. It helped to com-pare the peculiarities of the practice of European countries in the field of combating illegal employment in the EU Member States, as well as to identify how this issue is regulated. The results demonstrate that illegal employment destroys legal jobs, leads to the increase in unemployment and deprives the state of revenues such as tax and social contributions, etc. That is why international declarations and conven-tions should guarantee the right to work in the European Union for the citizens of non-European states.

Аннотация: Background: Maintaining labour regulations and the quality of working conditions is a considerable challenge during wartime and martial law. This paper outlines the changes that have affected the working life of employees who continued in employment, both inside and outside Ukraine, under martial law in 2022. Using a qualitative analysis of Ukrainian labour regulations, ILO and Ukrainian government statistics, and direct observation, we show how the legal regulation of labour relations and working conditions has changed under the influence of active hostilities. During the war in Ukraine, many employees started to work remotely, and some companies have relocated their production facilities to areas where there are no active hostilities and continue to operate. At the same time, the legal regulation and nature of labour relations and the quality of working conditions have changed significantly - yet regulations have failed to keep up with the levels of flexibility and timeliness required to respond effectively in the ongoing crisis. Methods: In order to achieve objective scientific results, the authors used such methods as analysis and synthesis to understand and build a logical chain of ideas. The authors used the statistical method to emphasise their positions with real data regarding the situation that developed in practice. Results and Conclusions: We draw conclusions regarding the problems of employees implementing their labour rights during wartime, identify applied aspects of labour law in wartime conditions, and propose ways to improve the situation regarding the implementation of labour rights.
