Аннотация: OBJECTIVE: Introduction: The state policy in the field of medicinal products supply and import adjustment is aimed at steady assurance of quality throughout all stages of medicinal products circulation, starting with production and import to the stage of their medical application. The aim:of the article is to study the existing permitting and restrictive legal mechanisms of importing medicinal products at international, regional and national levels. PATIENTS AND METHODS: Materials and methods: This research is based on empirical and analytical data from the WHO, EU, EU customs and medical legislation, national legislation of Ukraine and Republic of Poland, Eurostat statistics, European Court of Justice (hereinafter referred to as ECJ) rulings. CONCLUSION: Conclusions: Customs regime prohibitions and restrictions are of particular importance when it comes to importing medicinal products. That specificity is in the procedures of licensing, certification, quality control, packaging, marking etc. A proper mechanism for carrying out such procedures requires standardization at international and regional levels. At the level of regional cooperation the issue of parallel import of medicinal products is urgent. Associated risks should be minimized by means of the instruments of international, European law through the adaptation of the national licensing procedures of medicinal products import to the EU requirements, including those defined in the Association Agreements.

Аннотация: The purpose of this study is to advance a better insight into the history of Sokolstvo (Sokol movement) in the Ukraine within the territorial borders of the Russian Empire, and the variety of reasons for its origin and downfall. Slavic origin of Sokolstvo, the activity of supporters of Sokol gymnastics (SG) in the popularization of Sokol idea and, a gradual rapprochement of supporters of the two opposing areas of reforming Russia for further development began (“Slavophiles” and “Westerners”) contributed to the emergence and rapid development of the Sokol movement in the Ukrainian regions of Russia. In the 90s of the 19th century, SG began to be cultivated in the Sokol units of gymnastic societies, since 1907 independent institutions began to open. By World War I, Sokol gymnastic societies (SGS) in Ukraine were the largest group. SGS constantly trained instructors, but the majority of SG teachers were foreigners, Czech by nationality. SG was officially introduced into the military training of the army and the curricula of secondary schools and cadet corps. Sokol events were a significant part of the public life of many Ukrainian cities. Representatives of Ukrainian regional societies became members of the Board of the Union of the Russian Sokol, founded in 1910. The crisis of the Sokolstvo began in the years of the World War I due to the growth of xenophobic attitudes. During the years of Soviet power, the Sokol were accused of a bourgeois orientation, recognized as the “hotbed of counter-revolution” and banned in 1923.

Аннотация: The article addresses the issue of standards of proof from a comparative perspective. The author sketches the conventional distinction between common law and civil law countries in this regard, as well as some approaches that query the validity of the rigid division. The main purpose of the article is to characterise the Ukrainian approach to the standards of proof against the background of comparative analysis. The author concludes that recent developments in Ukrainian law have paved the way for a distinction between criminal and civil standards of proof However, the doctrine is not yet elaborate enough to warrant a coherent application of the two different standards.

Аннотация: Nowadays, one of the reasons for the ineffective fight against corruption in the budget system is certain discrepancies and inconsistencies between the legal components of the mechanism for countering this anti-social phenomenon. The lack of a clear definition of the limits of competence of participants in the budget process, discretionary powers in the distribution and expenditure of budget funds, conflicts in budget legislation, and the lack of real competition in the field of public procurement clearly form the main corruption risks for all participants in these legal relations. The purpose of the study was to analyse the international legal mechanisms for combating corruption and find ways to implement them in Ukrainian legislation. The development of the national anti-corruption policy of Ukraine in the public sector as a subject of international anti-corruption law is determined by a number of the following national and external factors: 1) Ukraine's accession to the universal and regional conventions on combating corruption, compliance with which constitutes the main prerequisite for Ukraine's entry into the global space; 2) Ukraine's implementation in national legislation of anti-corruption international standards developed by international intergovernmental and non-governmental organisations; 3) adaptation of national legislation to European standards within the framework of the signed association agreement between Ukraine and the EU of 2014; 4) cooperation of Ukraine with international organisations, within which the international anti-corruption policy is developed and formed; 5) activities in the field of combating corruption of international non-governmental organisations, among which Transparency International constitutes an important element of the legal mechanism of the international anti-corruption legal order; 6) Ukraine’s international anti-corruption obligations to international financial institutions; 7) Ukraine's participation in international conferences and summits on anti-corruption issues; 8) Ukraine's cooperation with other states in providing relevant bodies of foreign states and receiving information on preventing and combating corruption; 9) national historical and political factors.

Аннотация: Purpose – the purpose of article should assess the main factors affecting the development of trade in high-tech products of Ukraine in the context of association with the EU and the spread of a new industrial revolution. Research methodology – the scheme of research of trade of high-tech products of Ukraine from the EU on the basis of qualitative and quantitative economic-statistical analysis, analysis of comparative advantages and correlation-regression analysis. Findings – the results of the analysis show that the main factors determining the low presence of Ukraine in the world market of high-tech products are the outdated structure of production, a low level of R&D costs, and a decrease in the innovative activity of Ukrainian enterprises. The article presents the author’s recommendations on improving the effectiveness of foreign trade in high-tech products of Ukraine in the EU market. Research limitations – the absence of a state development strategy for the production of hightech products does not make it possible to accurately determine indicators of scientific research of the potential of Ukraine. Practical implications – correlation-regression analysis results can be used in the private and state sectors of the economy of Ukraine. Originality/Value – the original combination of schemes and methods allowed us to identify new critical places for export development in the context of the association of Ukraine with the EU.

Аннотация: Background. The jurisdictional immunity of a state means that the state cannot be involved as a defendant in a case considered by a foreign court. In Ukraine, the rule on the jurisdictional immunity of a foreign state is enshrined in Art. 79 of the Law of Ukraine ‘On Private International Law’. Until 14 April 2022, the Ukrainian Supreme Court rigidly applied the provisions of the said article and recognised the Russian Federation’s immunity with regard to claims brought by Ukrainian citizens seeking compensation for harm caused by the armed conflict that commenced in 2014. Yet shortly after 24 February 2022, when Russia’s aggression against Ukraine entered a new phase, i.e., the phase of full-scale war, the Supreme Court changed its mind. Methods. This note addresses the ruling of the Ukrainian Supreme Court of 14 April 2022 in case no. 308/9708/19, where the Court held that the Russian Federation could not plead immunity with regard to tort claims brought by the victims of the Russia-Ukraine war. In reaching this conclusion, the Court relied on the territorial tort exception enshrined in the European Convention on State Immunity (Basel, 16 May 1972) and the UN Convention on Jurisdictional Immunities of States and Their Property. Though neither of the two conventions has been ratified by either Ukraine or the Russian Federation, the Court found that these conventions indicate a general tendency in international customary law towards limiting the jurisdictional immunity of the states. T he reasoning of the Supreme Court is examined by scrutinising the authorities the Court adduced in support of its ruling, as well as by putting the ruling in the broader context of the jurisprudence of the International Court of Justice (ICJ) and European Court of Human Rights (ECtHR). Results and Conclusions. It is concluded that what the Supreme Court utilised is not the territorial tort exception but rather the ‘human rights/jus cogens’ exception. Further, the case before the Ukrainian Supreme Court is distinguishable from the ICJ and the ECtHR cases, where it was held that notwithstanding gross violations of human rights, the respondent state should nevertheless enjoy immunity. Unlike those cases, the Ukrainian case was tried amid the ongoing war, when no reparation agreements had been concluded, the legitimate aim of ‘promoting comity and good relations between states’ had been frustrated, and it was no longer possible to justify the restriction of the plaintiff’s right of access to a fair trial.

Аннотация: The academic paper provides a comprehensive analysis of the content of the right to work in the context of Ukraine's European integration. Special attention is paid to the issue of compliance with the morality of the current legislation of Ukraine and the morality of transnational law. The possibility of borrowing transnational experience in the legal regulation of the right to work and adaptation has been studied. The labor legislation of Ukraine should be adapted to European norms, which will clearly contribute to protecting the employees' rights, their income and social well-being. Therefore, the purpose of writing an academic paper is to study the issue of the right to work in the conditions of Ukraine's European integration, the possibility of borrowing European experience and enshrining it in the legislation of Ukraine. he research methods were analysis, synthesis, generalization, explanation and data qualification. The primary sources for comprehending the present research were the fundamental scientific provisions highlighted in the works of famous scientists. Theoretical developments and abstract shortcomings of legal issues regarding the implementation of labor law have been worked out for centuries. This issue requires a new vision from the perspective of the criteria of necessity, reasonableness and wisdom, and most importantly, taking into account the conditions of Ukraine's European integration into the European Union and its legislation.

Аннотация: The main purpose of this article is to hold an independent study of some international regulatory initiatives concerning the mechanism of assessment of the risk of committing new offences and the main area of up-to-date legal regulation of classification of convicts and assessment of the risk of committing new offences by convicts in Ukraine. The chosen research subject involved the application of the comparative law approach as the main method, combined with a number of general scientific (dialectical, historical, systemic, statistical) and specific scientific (formal law, specific sociological) cognition methods. The conclusion drawn by the author allowed to form a conceptual understanding of the assessment of the risks of committing new offences as a determinant of the classification of convicts. A brief overview of the implementation and evolution of this regulation obviously demonstrates that Ukraine tries to look up to borrowed progressive approaches to the work with convicts and, in particular, it introduces a system of assessment of risk and needs of convicts using automated conclusion algorithms to reduce recidivism and new crimes. The relevant legal mechanisms proposed by scientists can be implemented in the legislation of Ukraine regulating the procedure of assessment of the risks of committing new offences by convicts.

Аннотация: OBJECTIVE: The aim: The aim of the study is to generalize the established by scientists features of the legal regulation of the institute of transplantation in Ukraine and other countries. PATIENTS AND METHODS: Materials and methods: The article examines the institute of transplantation, its medico-legal character, and the problems of implementing the institute in Ukraine. In the study, the authors applied general scientific methods, which include system analysis, system modeling, dialectical method. The authors used the following materials: laws, decrees of the President of Ukraine, resolutions of the government and ministries of healthcare, dissertations and articles by scientists, assessments of leading experts in the field. CONCLUSION: Conclusions: Theoretically, the legal aspect of the study of the institute of transplantation is important for formulating the general patterns of its emergence, developing prospects for its functioning and strategic directions for its further development, building a system for protecting the rights of all participants in this legal relationship. Different aspects of transplantation can be considered separately: medical or surgical; biological; psychological. But there is an equally important aspect - the legal one, which reveals the institute of transplantation from the standpoint of the protection of human dignity.

Аннотация: The purpose of the paper is to investigate the essence of different types of witness immunity in criminal proceedings, to identify and analyse specific privileges that underlie these forms of witness immunity, and to justify the necessity of altering scientific perceptions of this institution within criminal procedural law and making changes to the current criminal procedural legislation to improve its normative regulation. The primary approach to addressing this issue involved categorising types of witness immunity and the associated privileges, presenting critical viewpoints concerning their interpretation, and proposing improvements to their regulatory framework. The paper proposes methods for enhancing and aligning criminal procedural legislation in the studied domain with European legal standards, examines foreign practices of witness protection and provision of privileges during criminal proceedings, and identifies general principles of criminal procedure that are upheld through the functioning of witness immunity mechanisms.

Аннотация: Objective. The scientific publication aims to analyze the development of open science based on international and national experience, as well as to show efforts of the National Law University in the direction of promotion of open science and management of metadata related to scientometrics indicators of scientists. Methods. To attain the indicated objective, theoretical methods of scientific research were used: literature analysis and systematic approach. Results. The result of this research is systematization of scientometrics services developed by the Scientific Library of Yaroslav Mudryi National Law University to inform scientists about their scientometric indicators that reflect publication activity in the two main international scientometric databases Scopus and Web of Science. Conclusions. It is important to promote open science in university repositories, which are one of the services that manage metadata.

Аннотация: Background: In this article, the co-authors continue exploring the observable changes in the orientation of civil procedure, moving from competitive and adversarial models towards more cooperative and consensual approaches. Specifically, this work aims to disclose the peculiarities of practically implementing the principles of mutual cooperation and consensuality in civil procedure. The research delves into court-connected settlement procedures in three European countries: Austria, Lithuania, and Ukraine. Through a comparative analysis of the legal regulations and practices in the selected countries, the article evaluates the impact of the application of settlementoriented procedures on fostering a more amicable resolution of civil disputes. Methods: Research commenced with a review of the existing scientific literature, a brief historical analysis, and a document analysis concerning the legal framework of settlementoriented procedures applied in the civil process in selected countries. This work is the continuation of the previous research of the co-authors, aiming to explore how the identified global trend of the drift towards a consensual tenet in the civil procedure was reflected in the selected countries' legal legislation and practice. The Austrian, Lithuanian, and Ukrainian legal frameworks of court-connected settlement-oriented procedures were compared to acknowledge the existing variety and specifics of national approaches towards consensuality in the civil procedure in different jurisdictions. Results and Conclusions: The ideas of a more socially oriented and consensual civil procedure are implemented in the civil procedure of Austria, Lithuania, and Ukraine through the introduction of settlement-oriented methods of dispute resolution, such as court conciliation and court mediation. Despite the wide common understanding of these amicable procedures, essential differences in the theoretical understanding of the concept and its implementation in the analysed jurisdiction were identified. This research assists dispute resolution practitioners and researchers interested in better understanding the implementation of court-connected settlement-oriented procedures in different jurisdictions.

Аннотация: Background: Russia’s invasion of Ukraine has resulted in the largest conflict in Europe since the Second World War, with estimates suggesting that hundreds of thousands of Russian soldiers are implementing the will of the aggressor state. It has long been believed that combatants are immune from criminal prosecution for their actions during hostilities, including the killing of military personnel defending the victim state unless they violate the laws of war. However, this immunity has naturally generated criticism in the Ukrainian legal community. In this article, the authors analyse the critical arguments made by opponents of combatant immunity and seek to clarify the legal and ethical grounds of the controversial doctrine. Furthermore, the well-known debate on the significance of citizenship (nationality) for recognising combatant or prisoner of war status and the liability of defectors is revisited from a new perspective. Methods: The article is based on an analysis of IHL sources, commentaries, state practices, precedents and scientific views on combatant immunity. Additionally, the article examines the practices of law enforcement agencies in Ukraine and the perspectives of Ukrainian criminal law scholars. General scientific methods of cognition (induction, deduction, analysis, synthesis), as well as historical, empirical and systemic-structural methods, are used. The article is structured into three parts. The initial section provides a comprehensive overview of the status of a combatant and their associated privileges within the context of international humanitarian law (IHL), with a particular focus on the ongoing conflict between Russia and Ukraine. The second section delves into the debate surrounding Ukraine's obligation to respect the immunity of the combatant of the aggressor state and offers the authors' conclusions on this matter. The third section addresses the liability of defectors, focusing on the implications of citizenship (nationality) for combatants and prisoners of war (POW). Results and conclusions: Several Ukrainian scholars have expressed their unreserved disagreement with Ukraine's application of the doctrine of combatant immunity to Russian soldiers. In the absence of a direct reference to this exceptional privilege in international treaties to which Ukraine is a party and in light of the a priori unlawfulness of aggression, the critical arguments are not without merit. Nevertheless, we conclude that respect for the immunity of a combatant representing the aggressor state is part of Ukraine's international obligations and has a certain justification. Concurrently, the article acknowledges that the legal and ethical grounds for this are not entirely clear. The question of whether defectors should be recognised as combatants and/or prisoners of war is similarly unclear. Nevertheless, we are convinced that regardless of the answer to this question, the criminal prosecution of defectors for high treason cannot be considered a violation of the immunity of a combatant.

Аннотация: Objective. The article examines the role of modifications in the activities of the Scientific Library of the Yaroslav Mudryi National Law University (Yaroslav Mudryi NLU) as a basis for using its innovative potential in promoting the benefits of open science among the academic community, and facilitating the consolidation (unification) of research achievements on topical issues of law. Methods. The general scientific methods (analytical, comparative, analysis and synthesis, etc.) were applied, which made it possible to determine the features of structural and functional, reorganizational, resource and service modernization of the library's activities in the implementation of the latest open science technologies. Results. The article shows the role of the library as a reliable assistant of the University in the processes of research data exchange, a guarantor of the formation and adaptation of the online environment, resources, bibliometric tools to provide systematic support for research and strengthen communication interaction during remote work in wartime. Conclusions. Attention is focused on the need for strategic use of modifications in the library's activities, which allow achieving a balanced combination of open science goals with the modification of the library system and obtaining a synergistic effect within the research infrastructure of the University.
