Аннотация: Introduction: The use of modern advances in medicine to investigate crimes has caused a number of problems that require scientific reflection. In particular, today there are quite acute questions: medical intervention without the persons consent; forced sampling of human biological materials; clinical methods, the use of which in the biological samples taking will not be regarded as violation of international standards of human rights protection; the correlation of the need for the formation of DNA profile databases and the right of the person to non-disclosure of medical information. The aim: The aim of this work is to identify and analyze the key points of the European Court of Human Rights (hereinafter referred to as the ECHR) regarding the peculiarities of retention and use of human biological material samples in the investigation of crimes, and the retention of such materials after the completion of the investigation and trial. Material and methods: In the preparation of the article, scientific works, the provisions of international normative acts regulating the use of human biological materials as well as the practice of the ECHR concerning the use of human biological materials in the investigation of crimes were used (8 decisions were analyzed in which the ECHR concerned the use of biological samples or related issues). In the research process to achieve the goal, a complex of general scientific and special methods of cognition was used, in particular, the comparative legal method, the system and structural method, the method of generalization, the method of analysis and synthesis, etc. Review: The positions of the ECHR concerning the following were distinguished and generalized: a) the criteria for the permissibility of compulsory medical intervention for taking of human biological material within the framework of the crime investigation; b) the possibilities of spreading the right not to incriminate oneself on the compulsory taking of human biological materials samples; c) the retention features of cell samples and DNA information in the context of respect for the right to non-interference in the persons private life. Conclusions: Obtaining and using the human material for the investigation of crimes are not a violation of the European Convention on Human Rights (hereinafter - the Convention), subject to the requirements stated in the practice of the ECHR. Аннотация: OBJECTIVE: Introduction: The problem of medical errors is always relevant in medical literature and law. Meanwhile, it is understood diametrically opposite by doctors, patients, and lawyers. This has a negative impact on patients' trust in medical professionals, and sometimes leads to criminal prosecution for a so-called "medical error", which in fact is conscientious deception, not a crime, and should exclude criminal liability. The aim: The aim of this work is the illustration of diametrically opposed approaches to understanding the essence of the concept of "medical error" from patients', doctors', and lawyers' views that are often generated by subjective approaches and results in distrust between doctors and patients, medical professionals and lawyers. The aim of the article is also to realize the ECHR's approach to understanding the essence of a medical error and distinguishing it from the negligence that should lead to liability of the medical professionals. PATIENTS AND METHODS: Materials and methods: In this research a legal doctrine, scientific works, provisions of international legal acts, in particular, the Convention for the Protection of Human Rights and Fundamental Freedoms were used, as well as the practice of the ECHR (12 relevant ECHR decisions), where the Court considered cases related to "medical errors" and formulated positive obligations of the state in the field of health care were analyzed. A complex set of general and special methods of cognition was used to achieve the aim, they are comparative legal method, systemic and structural method, methods of generalization, analysis and synthesis, sociological method, hermeneutical method, etc. RESULTS: Results: A survey of patients, medical professionals and lawyers conducted by the authors (300 persons), analysis of doctrinal approaches are illustrated the gap between the doctrinal approaches existing in the understanding of the essence of the "medical error" phenomenon and the perceptions of the medical services recipients, which indicates the need of understanding the essence of the phenomenon of medical error in order to increase the confidence in the medical profession, the inadmissibility of doctors liability for a medical error. CONCLUSION: Conclusions: The research gave the authors a reason to conclude that both medical and legal sciences are still far from the unity of views on the concept of "medical error". Medical errors significantly affect the authority of a medical institution, a particular doctor, or the state as a whole, and have severe consequences for patients. An analysis of the medical literature and ECHR practices has led to the conclusion that a medical error occurs when it is possible to completely exclude the guilt of medical professionals in the form of intent or negligence. In case of a medical error the criminal liability of the doctor is excluded.

Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: OBJECTIVE: The aim: The aim of this work is to identify the compliance level of modern practice of placement of a person in a medical institution in order to conduct the FPE to international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person; formulation of scientifically substantiated proposals on the synchronization directions of national practices with the specified international standards. PATIENTS AND METHODS: Materials and methods: During the preparation of the article the following was processed: scientific research on ensuring the rights of persons suffering from mental disorders in criminal proceedings; provisions of international agreements on the provision of psychiatric care; legal positions of the ECHR on the observance of persons' rights suffering from mental disorders (15 judgments on this topic); criminal procedural legislation of individual states; results of generalization of national law enforcement practice; the results of a survey conducted by the authors of 18 psychiatrists who practice in the field of forensic psychiatric examinations (psychiatrists working in state psychiatric clinics in Odesa, Poltava, Kharkiv were interviewed). In the process of research a set of general scientific and special methods of cognition was used (comparative-legal method, system-structural method, generalization method, method of analysis and synthesis, method of sociological research, method of expert assessments, etc.). RESULTS: Results: According to the research results: a) legal positions of the ECHR on the observance of the rights of persons suffering from mental disorders are identified and generalized; b) the compliance level of modern practice of placing a person in a medical institution in order to conduct the FPE with international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person ( 1 of Article 5 of the Convention); c) the degree of extrapolation of these positions to the activities of psychiatrists is analyzed; d) the optimal ways of solving the existing problems in the aspect of ensuring the rights of a person when placing them in a medical institution for an inpatient FPE are proposed. CONCLUSION: Conclusions: The current national practice of placing a person in a medical institution for an inpatient FPE does not fully comply with the legal positions of the ECHR in terms of ensuring the right to liberty and security of person (in particular, there are deviations from the positions of the ECHR on: determining the documentary basis for the appointment of an inpatient FPE; interaction of police and medical workers in the field of psychiatry during the detention of a person with a mental disorder). Аннотация: Der Beitrag zeigt die Entwicklung der Kriminalistik über den deutschsprachigen Raum hinaus. Er beschreibt aktuelle gesellschaftliche Aktivitäten zu ihrer Entwicklung, insbesondere in den osteuropäischen EU-Staaten. Ausgangspunkt sind Empfehlungen der Europäischen Union zur Kriminalitätsbekämpfung. Dazu verabschiedete der Rat der EU u. a. einen Rechtsakt zur „Schaffung eines einheitlichen europäischen kriminalistischen Raumes“. Im Beitrag wird am Beispiel kriminalistischer Organisationen in Litauen, der Ukraine und Deutschland diskutiert, wie öffentliche nichtstaatliche Organisationen durch wissenschaftlich-praktische Zusammenarbeit diesen Prozess fördern können. In einem „Palanga-Memorandum“ wurde die Gründung einer „Europäischen Föderation nationaler kriminalistischer Organisationen“ beschlossen und nationale europäische kriminalistische Organisationen/Vereine aufgerufen, darin mitzuwirken.

Аннотация: The article deals with the problems of the development of property law in the legislation of Ukraine considering the experience of the countries of the European Union (EU). It is emphasised that the development of property law of Ukraine is determined primarily by the European tendencies of harmonisation, convergence and Europeanisation of the rights of EU Member States. The scientific doctrine of EU countries in the field of development and improvement of property law has been researched. The authors extrapolate the experience of regulation of property law in the EU countries on the development of the legal system of Ukraine. The principles of European property law are analysed: these are the principles of specificity, openness and transparency. It is concluded that recognising the existence of an EU system of substantive law will allow introducing appropriate substantive remedies that can successfully exist in addition to legal obligations.

Аннотация: The article is devoted to the problem of non-implementation of the decisions of the ECtHR in Ukraine in the context of the rule of law. The relevance of the subject matter is substantiated by the critical situation regarding Ukraine's compliance with its international obligations. The objective of the study is to develop a set of principles and policies to be implemented in Ukraine to strengthen the rule of law (as a fundamental democratic institute), as an essential factor for ensuring human rights in the context of re-establishing a proper international cooperation with the key European institution in the field of human rights. According to the analysis of the degree of coverage of the issue, the existing papers on the mentioned problem are rather described by point-by-point recommendations aimed at “damage control”, rather than at an in-depth resolution of the situation. The methodological basis of the research consists of the complex of general and special research methods, while philosophical methods were used to ensure the understanding of the essence, characteristics, and features of the phenomena under study. The research resulted in the development of a set of theses that demonstrate the depth of the problem under study that manifests through untimely and inconsistent normative-legal regulation, lack of tangible means of protection of human rights in Ukraine, inappropriate approach to the adoption and execution of international obligations. The authors argue in favour of the need to ensure three key aspects of the implementation of the rule of law – guaranteeing consistency of state policies and actions of officials; the formation of a stable system of administrative management; accountability, and responsibility of decision-makers. The practical relevance of the study is manifested through a set of recommendations, including the creation of a system to assess the effectiveness of reforms in terms of the rule of law; the formation of a mechanism for implementing the responsibility of decision-makers; the revision of procedures for the adoption of legal acts; the need to restart and complete the reform of the justice system, to involve NGOs in the processes of forming such; to create rules of cooperation between the state and the elites.

Аннотация: It has been emphasized that the norms of the Constitution of Ukraine and the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms are correlated in structure, form of action and features of application that allows determining the conceptual features for the formation of the mechanism of realizing and applying the Constitution of Ukraine as norms of direct effect. It has been emphasized that the central idea is the uneventful application of the norms of the Constitution of Ukraine and the Convention for the Protection of Human Rights and Fundamental Freedoms at the stages of realizing human rights and their protection due to the similar nature and legal structure of their norms. It has been noted that the use of such an approach creates an objective opportunity to establish whether there were violations of any requirements at the stages of: protecting such a right (existence and application of preventive measures), implementing the right (obstacles to achieving a certain good by a person) and protecting human right (taking sufficient and effective measures aimed at restoring the person’s status). It has been stated that the norms of the Constitution of Ukraine, given their legal properties, can be applied similarly to the way how the European Court applies the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms. Considering the provisions of the current procedural legislation of Ukraine on the powers of courts, it has been proved that human rights are realized and protected in out-of-court and judicial manner exclusively and directly on the basis of the norms of the Basic Law. It has been noted that the forms of applying the Convention for the Protection of Human Rights and Fundamental Freedoms should be understood as methods of applying the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms by the authorized subjects to certain legal relations that is expressed in the relevant acts, namely: literal application – carrying out law-enforcement activities on the basis of the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms without their interpretation; expanding application – the implementation of law-enforcement activities on the basis of the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms as a result of their interpretation.

Аннотация: Appealing to public authorities about any legal conflict leads to an overload of courts and administrative bodies. An alternative to improving access to justice and reducing the burden on the courts is to use other alternative means of resolving legal disputes, such as mediation. The article is devoted to the peculiarities of the application of the mediation procedure in administrative proceedings. Highlights the signs of administrative and legal dispute, as well as the peculiarities of the mediation procedure. The purpose of the study is to study domestic and foreign experience in the use of mediation in administrative proceedings, as well as to formulate proposals and recommendations for improving the current legislation in this area, based on the analysis of scientific papers, current legislation and law enforcement practice. The methodological basis of the study is a set of general scientific, philosophical, special methods of scientific knowledge, the use of which allowed to ensure the achievement of the stated goals and objectives of the study and comprehensive coverage of the research problem.

Ukrainian legislation on surrogacy and other ARTs has been studied. The expediency of adopting a special law to regulate the use of ART in Ukraine is substantiated. According to the monitoring data, Denmark, Belgium, Iceland, Sweden, Slovenia, the Czech Republic, Estonia, and Serbia are the leaders in the use of ART among European countries. CONCLUSION: Conclusions: The study allows us to conclude that the legislation of the studied European countries and Ukraine on the use of assisted reproductive technologies are quite different. European countries, except the United Kingdom, are very limited in allowing embryo research. It is noted that, first, not all countries allow surrogacy; second, a different maximum age is set for women to use ART; thirdly, the different shelf life of cryopreserved embryos has been established. The issue of the possible maximum number of implanted embryos into the uterine cavity using ART requires clear legal regulation both in Ukraine and in the EU.

Аннотация: The COVID-19 coronavirus pandemic, which has spread to all countries of the world, has posed new challenges in terms of legal, socio-economic, political, and social development. The pandemic produced a need for a mechanism of legal regulation of a special organization of the remote work, working hours, workplace, working conditions, etc. The study aims to analyze and compare the legal regulation of remote work under the introduction of restrictive measures caused by the spread of COVID-19 in Ukraine and the EU. The leading method was the method of comparative analysis. It helped to compare the specifics of the practice of EU member states in the field of legal regulation of remote work under the above conditions in Ukraine and the EU, identify how these issues are regulated in other EU countries. In Ukraine, it is necessary to improve the rules for regulating the responsibilities of the employer to compensate for the costs of a remote worker, enshrining in law the obligation of the employer to provide the employee with computer equipment, means of communication. The experience of European countries proves it is necessary to implement “right to disconnect” in Ukraine. Information and knowledge gained from the experience of different EU countries can be used as a basis for the adaptation and development of new relevant provisions in Ukraine.

Аннотация: Background: Constituent parts of the right to a fair trial, which presuppose the need for the existence of institutions in a state that are authorised to review and resolve legal conflicts and united by the concept of 'a court established by law', are identified and studied in this article. The study is based on the decisions of the European Court of Human Rights, which outlines the criteria to which any institution authorised to administer justice must correspond. The aim of the study is to verify the Ukrainian laws that determine the principles of developing and functioning administrative courts in order to enshrine in their texts the requirements arising from the content of a legal formula for a 'court established by law'. Methods: In this article, the authors use the following special legal methods: conceptual-legal, comparative-legal, formal-legal, and others. For example, with the help of the formal-legal method, it was possible to analyse the current trends in the practice of national administrative courts in compliance with the proposed requirements. Results and Conclusions: The article states that the operation of Ukrainian laws creates the right conditions for administrative courts to be perceived as institutions with 'full jurisdiction' in resolving public disputes of any kind. At the same time, the authors conclude that there are cases in which the courts violate the provisions of Art. 6 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms of 1950, despite the fact that such provisions have been implemented in the national administrative, procedural law.

The methodological basis of the study is a set of general scientific, philosophical, special methods of scientific knowledge, the use of which allowed to ensure the achievement of the stated goals and objectives of the study and comprehensive coverage of the research problem. The urgency of the work lies in the scientific and practical need to study the little-studied topic of procedural features of alternative resolution of public disputes in the administrative proceedings of Ukraine.

Аннотация: The aim of the study is a comprehensive analysis of the legislation on the fight against illegal employment both at the supranational level of the European Union and at the EU Member States level, inter alia, in Poland, France, and Germany. The leading method in the study was the comparative-legal method. It helped to com-pare the peculiarities of the practice of European countries in the field of combating illegal employment in the EU Member States, as well as to identify how this issue is regulated. The results demonstrate that illegal employment destroys legal jobs, leads to the increase in unemployment and deprives the state of revenues such as tax and social contributions, etc. That is why international declarations and conven-tions should guarantee the right to work in the European Union for the citizens of non-European states.

Аннотация: As the European case-law shows, nowadays, there are numerous problems in the social sphere. Accordingly, there appears to be a need to study international regulation of equality and current social security problems to find possible solutions to the existing shortcomings and to strengthen human rights protection. The article aims to analyse the universal international regulation of equality and gender equality, in particular, and to study the problems of gender inequality in social security based on the European Court of Human Rights (ECtHR) case law to eliminate this discrimination. The leading research method is a legalistic one. It allowed us to analyse the international legislation on gender equality and to look into the ECtHR case law in gender discrimination in social security. It was found that gender inequality in social security is often a result of prior gender-based discrimination in labour relations. Despite the fact that legal acts protect women in cases of inequality, the analysis of the ECtHR case-law permitted us to conclude that men suffer from gender discrimination as much as women. Therefore, it is suggested to adopt legal acts on the equality of men and women in social security to overcome such discriminative practices at the legislative level. It is also recommended to implement the governmental policy on counteracting gender stereotypes in society. The research results can improve national legislation and international legal acts, further research into equality issues, and develop a methodological base for teaching human rights and social security.

The social security system plays an extremely important role in this matter. Without it, it is difficult to imagine the successful construction of a welfare state. From this point of view, it is interesting to study the experience of developed democracies in social security and the application of this experience in Ukrainian political realities. The methodological basis of scientific work is a set of general and special methods and techniques of scientific knowledge, the practical application of which allowed to obtain scientifi cally sound conclusions. The purpose of this work is to characterize the main models of social policy, comparative analysis of models of social protection in European Union member states and Ukraine, identify the main positive and negative aspects of each, as well as justifications and proposals for adapting European best practices in Ukraine.

Аннотация: The European Court of Human Rights, when interpreting the rights guaranteed by the European Convention on Human Rights, develops in its jurisprudence autonomous concepts that serve as the foundation for the effective protection of human rights and fundamental freedoms. Thus, the European Court of Human Rights establishes certain standards that are binding on all Member States of the Council of Europe. Autonomous concepts act as a kind of “safeguard” against the abuse and arbitrariness of national au-thorities. They also contribute to the unification and harmonization of different legal sys-tems, as well as the progress of a uniform judicial practice in the process of interpretation and application of law. The purpose of this article is to reveal the essence and analyse the content and key components of such autonomous concepts as criminal charge, lawfulness, penalty, person of unsound mind, and peaceful assembly in the practice of the European Court of Human Rights.

Аннотация: Every year the interest of scientists from around the world in studying sui generis of EU customs law increases. The aim of this article is to initiate a scientific discussion on the development of an alternative approach to the understanding of EU customs law sui generis. It is suggested that one should not be limited by the characteristics of the provisions of the Common Customs Tariff and the EU Customs Code when justifying the uniqueness of EU customs law. The article considers the history of the EU customs law formation within four stages and demonstrates that modern EU customs law is formed by: EU founding agreements; acts adopted by EU institutions; agreements concluded both between EU member states and with third states; national customs law of EU member states; and practice of application of EU customs legislation, in particular, judicial practice. The paper identifies priority areas for the future development of EU customs law to include the single European customs agency formation and further approximation of customs laws of EU member states.

Аннотация: This article is devoted to the study of problems related to the peculiarities of ensuring the right to freedom and personal integrity in criminal proceedings under martial law. It is noted that one of the principles of the state policy of Ukraine in the spheres of national security and defence is the protection of people and citizens, their life and dignity, and their constitutional rights and freedoms. The article analyses the conditions of admissibility of derogation, i.e., Ukraine’s right to derogate from the observance of individual rights, guaranteed, first of all, by Art. 5 of the European Convention on the Protection of Human Rights and Fundamental Freedoms (ECHR). The authors determine the constitutionality of legislative innovations caused by unprovoked Russian aggression and, as a result, the introduction of martial law in our country. The position is argued that the limitation of the right to freedom and personal integrity provided for by the Criminal Procedure Code of Ukraine (Parts 6-7 of Art. 176) only by the use of detention pursues a legitimate goal, which is to prevent persons who are reasonably suspected of committing a number of crimes from hiding from the investigation and the court, as well as perform any actions provided for in Part 1 of Art. 177 of the CPC of Ukraine, which, taking into account the difficult situation in the country associated with military aggression, can be considered fully justified. At the same time, in the future, at the stage of extending the term of detention, the suspect or the accused is actually deprived of the right to request his release from custody and the application of an alternative preventive measure to him, which does not correlate with international standards of limiting the right to freedom and personal integrity and does not comply with the legal positions of the European Court of Human Rights. The authors emphasise that the quasi-automatic extension of the term of detention of a person in custody without appropriate requests from the prosecution, without checking the presence of new or previous risks and assessing the expediency of further deprivation of liberty, introduced into the national legislation, should be considered as a violation of the conventional normsguarantees established by § 3 Art. 5 of the ECHR.

Аннотация: Ensuring security has always been an extremely important aspect of its development and existence in every country. In order to ensure internal and external security, it is necessary to clearly understand the threats that may impede the normal functioning of the state. To this end, state so relevant international organizations always identify threats in their security concepts. However, the hybrid threat definition still lacks a clear, unifying definition and its concept acquires a new meaning in the context of the Russian-Ukrainian war. The purpose of the article is to analyse the peculiarities and concept of temporary protection under EU law and the doctrinal approaches of researchers, as well as to analyse hybrid threats in the context of the European countries’ borderless policy, considering the current situation. The authors compare the characteristics of temporary protection, as well as changes in the interpretation of hybrid threats until 2022 and after.
