Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: The authors contribute to the national reform discussion to improve Ukrainian society's banking system confidence, approaching the European standards of financial services. Public confidence in banks focuses on performance, necessary for financial institutions, but negative feedback from the media, relatives, acquaintances regarding banks has bred significant mistrust. Among the root causes of an unflattering bank, image engenders the financial institution's inability to ensure customer information confidentiality regarding the banking secrecy. This article reviews the protection and illegal disclosure risks of banking secrecy, access to it within criminal proceedings, legal uncertainty of the Laws of Ukraine 'On Banks and Banking' and 'On Currency and Foreign Exchange Transactions, and proposed elimination method. Also provided are particular risks and recommendations for dealing with bank secrecy's apparent risks to continue improving adequate bank secrecy disclosure compliance with the FATCA Agreement.

Аннотация: Background: Maintaining prosecution in criminal cases in court is a specific function of the prosecutor, which is enshrined in both the Constitution of Ukraine and the provisions of the Criminal Procedure Code of Ukraine. This function should meet not only the objectives of criminal justice but also international standards in the field of criminal justice. Criminal proceedings are divided into public and private, depending on the type of socially dangerous act. And depending on the type of accusation, the functions of the prosecutor in the exercise of their powers are different. Thus, in cases of private prosecution, the participation of the victim is crucial, and his/her refusal to prosecute may be grounds for closing the criminal proceedings. This note related to the study of the innovative approach of the Supreme Court's law enforcement practice shows the active role of the prosecutor in considering these categories of criminal cases in court. Methods: We thoroughly analysed the case-law of the Supreme Court of Ukraine, as well as the provisions of the Criminal Procedure Code of Ukraine and other legislative acts. We also generalised and studied the case-law of Ukrainian courts, as well as recommendations of the CoE and the doctrine of the criminal procedural law of Ukraine. Results and Conclusions: The authors drew several conclusions about various forms of private prosecution with their own specifics, which are manifested in the aspects mentioned in this note.

Аннотация: The purpose of this research was to develop a distant programme of educating parents of primary school children and experimentally check its efficiency in developing educational competencies in parents of primary school children. The study consisted of four consecutive stages: planning, diagnostic experiment, implementing the distant educational programme, and result evaluation. The participants of the research were 37 parents of pupils who went to the first grade of primary school in September 2018. All the participants gave their written consent to participate in the research. The diagnostic stage of the experiment showed that most of the surveyed parents possessed educational competences at a very low level. To provide the parents with pedagogical education, a distant educational course was developed. The course consisted of 12 online classes and lasted for 6 weeks. The online course provided for the parents’ participation in webinars and online conferences. On completing the course, the parents were asked to undergo a control questionnaire survey. The results of the control questioning showed that during the distant course, the parents obtained a sufficient and high level of pedagogical competence. The experiment showed the necessity and rationale for implementing the developed distant educational course for parents with the purpose of developing their pedagogical competence, as well as improving cooperation between teachers, parents and pupils.

Аннотация: The editors provide a general overview of the religious dimensions of the Russian-Ukrainian conflict. The introduction explores the ways that religion plays a role as an identity and marker for the conflict’s parties and discusses how religion has also served as both an accelerant and decelerant in the clash. It identifies significant threats to religious freedom from the conflict, particularly in the Donbas and sketch out the religious impact of the conflict in major church-state reconfigurations, particularly in the creation of the new Orthodox Church of Ukraine. Finally, the introduction provides a brief description of the chapters and interviews in the book, outlining the book’s content and organizational structure.

Аннотация: This book investigates how the military conflict between Russia and Ukraine has affected the religious situation in these countries. It considers threats to and violations of religious freedom, including those arising in annexed Crimea and in the eastern part of Ukraine, where fighting between Ukrainian government forces and separatist paramilitary groups backed and controlled by Russia is still going on, as well as in Russia and Ukraine more generally. It also assesses the impact of the conflict on church-state relations and national religion policy in each country and explores the role religion has played in the military conflict and the ideology surrounding it, focusing especially on the role of the Ukrainian and Russian Orthodox churches, as well as on the consequences for inter-church relations and dialogue.

Аннотация: The article analyzes the historical, legal, cultural and mental origins of the legal consciousness of the Ukrainian people. Historical examples of law-making and law enforcement in Ukraine testified to the tendencies of formation of democratic legal consciousness of the Ukrainian people. The constants of this type of legal consciousness are the desire for freedom, rejection of injustice, the struggle for legal equality in the national community and so on. At the same time, the legal consciousness of Ukrainians is characterized by "moderate anarchism", the orientation in public relations is more on customs and traditions than on the rules of law. The Lithuanian Statute, Magdeburg Law, Cossack (corporate) law, and the adoption of Pylyp Orlyk's Constitution played an important role in the development of the institutional legal consciousness of the Ukrainian people.

Аннотация: This article reveals the influence of historical traditions and events on the formation of public legal consciousness of the Ukrainian people. The genesis of institutional and non-institutional forms of legal consciousness in Ukraine in different historical periods is traced. In particular, the characteristic features of public legal consciousness during the times of Kievan Rus, the Lithuanian-Polish era and the Russian Empire were identified. The peculiarities of the development of customary law as a basis for non-institutional legal consciousness of Ukrainians are revealed. It is noted that the customary legal situation in Ukraine is geographically and chronologically heterogeneous. However, despite all the differences in the historical development of Volyn, Polissya, Podillya, Dnieper, Slobozhanshchina, Southern Ukraine, customary property relations are identical in basic respects.

Аннотация: Contract formation by electronic means nowadays is a widespread phenomenon. Although electronic contracting has been thoroughly analyzed by scholars, there still remain some issues which need to be addressed. In our view, the most essential question raised by electronic contracting is whether there is a need to amend substantial contract law provisions with regard to peculiarities of contracts formed by electronic means. Seeking the answer to this question the UNCITRAL developed several basic approaches which come down to the idea that there is no need to amend substantial contract law provisions and create a special regulation for electronic contracting. However, a lot of countries have deviated from this approach and amended some special rules. In this article the latest amendments of contract law provisions in the CIS countries as well as the provisions on contract formation which remained untouched are critically analyzed. Based on this analysis the following conclusion is made: the principles of functional equivalence and technology neutrality are still applicable to practice of electronic contracting. However, the ‘contract law neutrality’ approach should be carefully rethought since in some cases there is a need to adapt current contract law provisions to the new realm and new practices of contract formation

Аннотация: The article notes that Ukrainian historians and jurists have the opportunity to study the rich creative heritage and new current aspects of the history of state and law-making in the works of MS Hrushevsky since the time of Gorbachev’s “perestroika”. Attention is drawn to the fact that Ukrainian historians and legal scientists have the opportunity to study the rich creative heritage and new current aspects of the history of state and law-making in the works of M.S. Hrushevsky. The study proves that modern Ukrainian researchers pay attention to the concept of “national idea”, state building of Kyivan Rus, the Cossack Republic of B.Khmelnytsky, the constitutional process of the period of the Ukrainian People’s Republic, theorganisation of the constitutional process in the works of prominent statesman, which is relevantto this day. It is emphasised that without studying this concept it is impossible to explore not onlythe history of the Ukrainian People’s Republic, but also the history of national statehood. Thestudy places emphasis on the importance of current issues of constitutional reform in Ukraine,making provision for continuity, taking into account the traditions and historical experience ofthe organisation and functioning of state power, the conceptual foundations of the exercise ofconstituent power. It is proved that the historical absence of legally regulated composition,competences, and procedures of the General, regimental and hundreds of Cossack councils gavethe tsarist government grounds to take over the right to allow or prohibit their convening,recognition or non-recognition of their decisions. Therefore, M. Hrushevsky defined thesupremacy of the people and its constituent power as the decisive factor in state formation.Hrushevsky was convinced that the “increased general material standard of living” of the people,spiritual culture, “a certain moral rigor is absolutely necessary for the success, development andfirmness of democracy… Only when the state, the community becomes not an empty sign, but areal centre of thought and will, the object of worship, religion, which it was for the ancientGreeks or Romans; only then the Great Ukraine will be built”.
