Аннотация: INTRODUCTION: Achieved level of technical progress moves us closer and closer to practical use of 3-d bioprinting technologies in real life. Such perspective raise a wide variety of crucial legal issues from the acceptable model of regulation of the science and its' societal effects to problems of the commercialization of the technology and potential restrictions of its use. Some key points on concept of legal regulation of abovementioned sphere is a base of this study. MATERIAL AND METHODS: Scientific discussion on 3-D bioprinting, European Union`s and US experience in patenting of 3-D bioprinting technologies, European Medicine Agency (EMA) or the US Food and Drug Administration (FDA) regulations, European Medical Technology Industry Association (EUCOMED) Acts. Article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. DISCUSSION: General debate of last few years comes down to an attempt to resolve hesitation between legal attempts for regulation of 3-D biobrinting and concept of complete prohibition of such activities. An adequate response to the mentioned challenge is a reasonable position between some aspects of prohibition and self-regulation, resulting in a moderate number of regulations and standards for developing and marketing. Such regulations may concern an intellectual property (IP) rights, regulation of distribution, premarket restrictions, control mechanism etc. CONCLUSION: Scientific approach and regulatory settlement of 3-D bioprinting sphere must unite to achieve a fair balance between the interests of humanity and of individuals - on the one hand, and development of science and business benefits for stakeholders - on the other. The main instruments for this must be balanced regulation of intellectual property (IP) rights, regulation of access and distribution, premarket restrictions, control mechanism etc.

Аннотация: OBJECTIVE: The aim: The article analyzes the impact of abortion on human rights and women's health in the light of medical and technological advances of the digital age. PATIENTS AND METHODS: Materials and methods: The methods of research were dialectic approach and general analysis of normative and scientific sources, analysis of the results of studies of women's mental health after abortions, analysis of judicial practice, especially decisions of the European Court of Human Rights, the results of author's own empirical studies, the formal legal method, the comparative legal method and the historical method. It has been established that there is no strong evidence that abortion negatively affects a woman's mental health, including no evidence that the emotional consequences aredeeply personal, or are rather the result of societal pressure. Arguments were refuted about extending the protection of human rights regarding abortion to unborn children and their fathers. CONCLUSION: Conclusions: The article emphasizes that the ethical burden on medical workers, especially in jurisdictions that require the approval of a doctor to legally terminate a pregnancy,increases significantly due to information flows and community expectations dictated by new medical advances.

Аннотация: The article contains the studied issues of abuse of rights in labor relations: the concept of "abuse of rights in labor relations" has been defined, its motives, and beneficial and adverse consequences have been analyzed. The authors emphasize that "abuse of rights" as a legal fact arisen in specific life circumstances may have both beneficial and adverse social content. All this resulted from the fact that legislative practice does not keep up with real conditions of changing labor relations affected by dynamic circumstances of modern social and economic development of society. To develop new approaches to definition of the fundamental principles of labor law to ensure the rights of all participants in labor relations on the principles of equality before the law seems now to be very important. The solution to this problem is in formulation of a universal definition of the concept "abuse of rights in labor relations" like actions or inactions in the legal environment of labor law, based on antisocial motives of these actions (inactions), which do not coincide with motives officially indicated, resulting in adverse social consequences such as discrimination, oppression of labor rights of citizens and stateless persons, violation of the requirements for safe and healthy working conditions. In turn, according to the authors, actions or inactions beyond labor law, but based on positive social motives, resulting in beneficial social consequences such as labor rights of citizens and stateless persons for safe and healthy working conditions, production safety, environmental society, etc., shall not be considered as "abuse of rights" (but as "beneficial abuse of rights").

Аннотация: The unprecedented impact of the COVID-19 pandemic on the realization of human rights has disproportionately affected vulnerable groups and created a global gap injustice, a gap in human rights from discrimination and poverty in access to social protection and basic services, insufficient or no access to justice, lack of access to justice. Legal aid. This article deals with current issues of access to justice and legal aid for the vulnerable during thepandemic of COVID-19. It is concluded that no country will be able to ensure the implementation of goal 16.3 of the United Nations Sustainable Development Goals on 2030 on equal access to justice for all until has not focused on closing the global justice gap, increasing access to justice, providing legal aid to the most vulnerable groups. For the implementation of the policy of access to justice for vulnerable states must have a different approach to justice – a people-centered approach to justice that puts consideration of the individual at the heart of justice responses by providing access to information, programs and policies. Ensuring equal access to justice, access to legal aid, an increased level of legal awareness among vulnerable groups, and a vibrant strong civil society, that contribute to access to justice, are key criteria for ensuring access to justice for vulnerable people. Providing equal access to justice through access to legal aid is key to ensuring access to justice in any state. Today it is important to overcome barriers to access to justice, such as the digital barrier, barriers related to financial costs, complexity, lack of information and access to services, and lack of access to legal aid or representation. States should be effective, must guarantee credible commitment, support coordination, and promote cooperation. States, justice systems must collaborate with public organizations and civil society to address the root causes of disputes and avert violence, conflict, and human rights abuses.

Аннотация: This article examines relevant issues of criminal proceedings in the context of the COVID-19 pandemic in Ukraine. In the wake of the COVID-19 pandemic, many governments have focused their efforts on protecting democratic values and ensuring not only the rights and legitimate interests of their people, but also their lives and health. At the same time, the pandemic has affected not only the economies of countries, but also their democratic development and fundamental rights, which have always been a priority of any democratic society. Courts and law enforcement authorities have faced challenges that have been and still are adequately addressed in order to ensure that the rights and legitimate interests of those seeking judicial protection are respected. Each state independently assessed the degree of risks and the extent of permissible restrictions on the rights and freedoms of persons involved in the proceedings, so the present study analyses the different approaches that have been applied. At the same time, documents of the Council of Europe for the Efficiency of Justice (CEPEJ) have gained high importance, because they, among others, have developed tools for Council of Europe member states to address the problems of ensuring access to justice in the pandemic. The generalization and widespread discussion of such experiences is important, because it will be useful for states to further improve existing legislation, taking into account best practices. Based on a study of changes introduced in the Ukrainian legislation to prevent the spread of the coronavirus disease, conclusions are proposed about the nature and extent of the restrictions, as well as the principles on which they should be based and the guarantees to be provided. Recommendations that will contribute to improving the regulation of access to justice in criminal matters in a pandemic are also proposed.

Аннотация: The article is devoted to the study of the features of administrative and legal regulation in the field of subsoil use. The essence of the category of administrative and legal regulation, as well as the mechanism of administrative and legal regulation in the field of subsoil use, is revealed. The legal basis of state regulation in the field of subsoil use in some foreign countries, in particular, in North America (for example, USA, Canada), European countries (for example, France, Germany) and CIS countries (for example, Kyrgyzstan and the Republic of Kazakhstan) are determined. Given the study of foreign practice of administrative and legal regulation in the field of subsoil use, the experience of the Republic of Kazakhstan has been recognized as positive, in particular, on the normative enshrinement in the Subsoil Code and subsoil use of basic principles in the field of subsoil use. Administrative and legal regulation in the field of subsoil use in Ukraine has been investigated by studying the legislative and organizational components. In the context of the above, it has been found that the regulatory framework for the implementation of state regulation in the field of subsoil use in Ukraine has a large number of regulations (both legal and substatutory). The system of state regulatory bodies in the field of subsoil use is represented by bodies of state power and local self-government, whose powers to use subsoil are determined by the norms of current Ukrainian legislation. The author's definition of the essence of the concept “administrative and legal regulation in the field of subsoil use” is given.

Аннотация: The article deals with a complex study of the peculiarities of administrative and legal support for functioning of the agro-industrial complex of Ukraine. In particular, according to the results of the analysis of doctrinal sources in the context of the investigated problems, the author offers definition of the concept of "administrative and legal support for functioning of the agro-industrial complex of Ukraine". The legal documents regulating peculiarities of the agricultural policy of the state within the framework of the European integration processes in general, including strategic directions and certain types of legal relations in the agro-industrial sphere, have been determined. Attention is paid to explaining the content of certain provisions of the Strategy for the Development of the Agrarian Sector of the Economy for the period up to 2020 and the Concept of the State Target Program for the Development of the Agricultural Sector for the Period until 2022. The basic principles according to which administrative and legal support of functioning of the agro-industrial complex is carried out are highlighted. Emphasis is placed on the need to resolve the problematic issues of regulating legal relations in the agro-industrial sphere.

Аннотация: The relevance of the scientific article is due to the necessity to search for models of legal regulation of public relations that arise in public administration with a private person, which would meet the European standards of administrative procedure. The purpose of the article is to study the European experience of administrative and procedural ordering of public relations in order to form ideas of implementation in the legal field of Ukraine. The leading methods of research were the analysis of European practices of administrative procedure, modelling of legal structures acceptable to Ukraine. As a result of the research, proposals for legislative initiatives on the procedure for adopting administrative acts were formed. Research can be helpful to law-abiding lawyers and law enforcement officials, law school educators, and public administration officials and officials seeking to apply good administration standards and practices to individual management matters.

Аннотация: The article describes changes in imposing administrative restrictions for crew rotations in ports worldwide under the ongoing pandemic COVID-19 situation. The first part of the article provides a brief overview of the impact of the COVID-19 pandemic on seafarers’ well-being, considering the key role of seafarers in providing international trade, maritime security, and protection of the environment. The second part of the article describes the national and regional experience in addressing COVID-19 under crew rotations; highlights the main tendencies of strengthening/easing restrictions in seaports. The most typical restrictive administrative measures in crew rotations include dockage during the crew change off the port, ensuring social distancing, strict health monitoring, and the negative coronavirus test result, proof of being quarantined or staying on board given period. Furthermore, international organizations were considered efforts to minimize the impact of the pandemic on the stability of crew changes in ports. The recommended measures primarily focus on simplifying and stabilizing the crew changes procedures, including the unification of rotation procedures, adopting multilateral global management in the sphere, effective information exchange, etc. Lack of consolidated information about all administrative restrictions world’s largest ports has become a complex issue. In that regard, the non-state actors play an essential role in the information support of seafarers. However, such efforts can be enhanced by adding imperative rules, like daily updating of information by governments and implementing the control system with a possibility of sanctions implementation in ship detentions under Port State Control procedures.

Аннотация: The article deals with the possible directions of the administrative-territorial reform in Ukraine in present conditions. The main objective of the study is to develop practical recommendations for carrying out an administrative-territorial reform in Ukraine based on the experience of Western European countries. In this paper the authors applied the method of legal modeling, the prognostic method, which enabled to give scientifically based forecasts on the prospects of the administrative-territorial reform in Ukraine and the implementation of efficient administrative and territorial management. Scientific novelty of the paper includes outlining the essence of the administrative and territorial reform in modern Ukraine, complex and hierarchical national conditions and reform factors. The article also states the necessity of broad decentralization and deconcentration of power, which would enable to stabilize the social situation in the country and to promote the democracy. The undertaken analysis allowed identifying a new form of government, which cannot be considered either unitary or federal. This form of government can be found in Western European countries and is characterized by the indivisibility of the state, which acknowledges local autonomies and implies the most extensive administrative decentralization. The authors propose to improve Ukraine’s control mechanisms according to this form of state structure and taking into account the status of the regions. The article makes a distinction between the concepts ‘the territorial structure of the state’ and ‘the administrative-territorial structure of the state’, the original author’s definitions provided. Practical conclusions and recommendations on carrying out the administrative-territorial reform in Ukraine and proposals for optimization of the control mechanism can be used by Western European countries facing administrative and territorial challenges.
