Аннотация: The unprecedented impact of the COVID-19 pandemic on the realization of human rights has disproportionately affected vulnerable groups and created a global gap injustice, a gap in human rights from discrimination and poverty in access to social protection and basic services, insufficient or no access to justice, lack of access to justice. Legal aid. This article deals with current issues of access to justice and legal aid for the vulnerable during thepandemic of COVID-19. It is concluded that no country will be able to ensure the implementation of goal 16.3 of the United Nations Sustainable Development Goals on 2030 on equal access to justice for all until has not focused on closing the global justice gap, increasing access to justice, providing legal aid to the most vulnerable groups. For the implementation of the policy of access to justice for vulnerable states must have a different approach to justice – a people-centered approach to justice that puts consideration of the individual at the heart of justice responses by providing access to information, programs and policies. Ensuring equal access to justice, access to legal aid, an increased level of legal awareness among vulnerable groups, and a vibrant strong civil society, that contribute to access to justice, are key criteria for ensuring access to justice for vulnerable people. Providing equal access to justice through access to legal aid is key to ensuring access to justice in any state. Today it is important to overcome barriers to access to justice, such as the digital barrier, barriers related to financial costs, complexity, lack of information and access to services, and lack of access to legal aid or representation. States should be effective, must guarantee credible commitment, support coordination, and promote cooperation. States, justice systems must collaborate with public organizations and civil society to address the root causes of disputes and avert violence, conflict, and human rights abuses.

Аннотация: This article examines relevant issues of criminal proceedings in the context of the COVID-19 pandemic in Ukraine. In the wake of the COVID-19 pandemic, many governments have focused their efforts on protecting democratic values and ensuring not only the rights and legitimate interests of their people, but also their lives and health. At the same time, the pandemic has affected not only the economies of countries, but also their democratic development and fundamental rights, which have always been a priority of any democratic society. Courts and law enforcement authorities have faced challenges that have been and still are adequately addressed in order to ensure that the rights and legitimate interests of those seeking judicial protection are respected. Each state independently assessed the degree of risks and the extent of permissible restrictions on the rights and freedoms of persons involved in the proceedings, so the present study analyses the different approaches that have been applied. At the same time, documents of the Council of Europe for the Efficiency of Justice (CEPEJ) have gained high importance, because they, among others, have developed tools for Council of Europe member states to address the problems of ensuring access to justice in the pandemic. The generalization and widespread discussion of such experiences is important, because it will be useful for states to further improve existing legislation, taking into account best practices. Based on a study of changes introduced in the Ukrainian legislation to prevent the spread of the coronavirus disease, conclusions are proposed about the nature and extent of the restrictions, as well as the principles on which they should be based and the guarantees to be provided. Recommendations that will contribute to improving the regulation of access to justice in criminal matters in a pandemic are also proposed.

Аннотация: The article describes changes in imposing administrative restrictions for crew rotations in ports worldwide under the ongoing pandemic COVID-19 situation. The first part of the article provides a brief overview of the impact of the COVID-19 pandemic on seafarers’ well-being, considering the key role of seafarers in providing international trade, maritime security, and protection of the environment. The second part of the article describes the national and regional experience in addressing COVID-19 under crew rotations; highlights the main tendencies of strengthening/easing restrictions in seaports. The most typical restrictive administrative measures in crew rotations include dockage during the crew change off the port, ensuring social distancing, strict health monitoring, and the negative coronavirus test result, proof of being quarantined or staying on board given period. Furthermore, international organizations were considered efforts to minimize the impact of the pandemic on the stability of crew changes in ports. The recommended measures primarily focus on simplifying and stabilizing the crew changes procedures, including the unification of rotation procedures, adopting multilateral global management in the sphere, effective information exchange, etc. Lack of consolidated information about all administrative restrictions world’s largest ports has become a complex issue. In that regard, the non-state actors play an essential role in the information support of seafarers. However, such efforts can be enhanced by adding imperative rules, like daily updating of information by governments and implementing the control system with a possibility of sanctions implementation in ship detentions under Port State Control procedures.

Аннотация: The important topic of cybersecurity relative to the fight against corruption in the context of global challenges in the pandemic and post-pandemic world requires further research. The purpose of this article is to identify and analyze current and prospective cybersecurity issues in this context by applying general-scientific and special-legal methods of cogni-tion. Using the dialectical method, theoretical background, and contempo-rary views on ensuring cybersecurity served to investigate the key current challenges. Formal-legal and comparative methods allowed to recommend measures to enhance cybersecurity in view of the massive digitalization and social transformations. The authors emphasize the need to establish a national cybersecurity policy based on society’s information literacy and culture, combining respect to traditional and historical values with a mod-ern understanding of multicultural communication and well-being.

Аннотация: Infectio us diseases is the subject of increased attention, which causes concern in society throughout the world. In this context, and in order to implement preventive measures, democratisation and protection of human rights are increasingly combined with measures of state coercion. The new challenge today is the COVID-19 pandemic, recognised by the World Health Organisation. Today is pandemic has forced a qualitative rethink of approaches to responding to the health challenges of both individuals and nations. States have gradually begun to use a variety of health measures, including policy and legal instruments, to control the spread and effects of COVID-19. Some states have resorted to criminal law to apply it to health care to prevent infection with COVID-19. A comparative analysis of the features of criminal liability for violating the quarantine regime in the European Union and Ukraine showed the variability of the structures of crimes, however, the unity of difficulties in qualifying socially dangerous acts and, as a result, the impossibility of effective prosecution. It was stated that there was an urgent need for States to recognise that the new coronavirus was a serious health emergency, but that the criminalisation related to COVID-19 was a worrying trend towards prolonging human rights restrictions. Experts are increasingly questioning, in particular, the feasibility and effectiveness of existing criminal law measures on health care and their fragmentary compliance with internationally declared human rights standards, which in the long run will be the basis for the abolition of new criminalised components of crimes.

Аннотация: ABSTRACT The aim: To study the legal and regulatory framework for ensuring the right to health of patients depending on the legal status of coronavirus vaccines in different countries as an essential element influencing the right to public health and other rights of citizens. Materials and methods: In this paper, we study the legal norms and scientific positions on the above issue using generalized information from scientific journals that use scientific methods from a medical and legal point of view. This article is based on dialectical, comparative, analytical, synthetic, and complex research methods. Using the above methods, we studied the attitudes of different categories of citizens to vaccination against coronavirus disease through questionnaires on the following issues: attitudes to vaccination in general; motivation for vaccination, in case of consent to vaccination; reasons for refusal of vaccination. The case-law of the European Court of Human Rights on vaccination and ensuring the rights of citizens to health care was also analyzed. Results: Proper legal regulation of the right to health depending on the legal status of the vaccines is important in order to implement restrictive measures to combat COVID-19 and, accordingly, to prevent the possible spread of a pandemic in the public health system. Conclusions: Ensuring the right to health and applying restrictive measures to prevent the spread of a pandemic is an essential element of the public health system. However, the question of the legal status of vaccines is crucial to prevent the spread of the disease. That is, it is essential to go through all the stages of clinical trials for the vaccines used. Their safety and effectiveness and proving the fact that the harm of vaccination is much less than the harm of the spread of coronavirus disease. In the process of ensuring the right to health, including by making compulsory vaccination against COVID-19, legal framework and practice are critical components that aim to minimize the potential hazards that threaten the health and lives of the population.

Аннотация: ABSTRACT The aim: To study an impact of the epidemiological situation on enforcement of the rights and freedoms in global informational space at international, regional, and national levels (by the example of the Republic of Poland and Ukraine). Materials andmethods: This research isbasedon empiricalandanalyticaldataofWHO, conventional normson protection of rightsandfreedoms, anti-epidemic legislation of Ukraine andthe Republic of Poland, reports of European and international institutions on human rights. Over 100 sources of information have been discovered, including regulatory legal acts, academic papers. Dialectical, comparative, analytical, synthesis, system analysis methods have been applied. Conclusion: The priority of human rights and freedoms over the public interest in the fight against the previously unknown and rapidly spreading coronavirus while delivering medical care – is a paradigm that seems to be reconsidered under “syndemic” conditions in connection with “infodemic”. Epidemiological situation and human rights are interdependent in a globalized world. Channels of formal and informal informing, as well as objective, current, full enough information content, make a “person–state” communication effective. Аннотация: OBJECTIVE: The aim: To develop an algorithm of legal support of the system that guarantees safe working conditions of medical workers at medical institutions during the COVID-19 outbreak. PATIENTS AND METHODS: Materials and methods: The following materials were used in the paper: Interim Recommendations of the World Health Organization, documents of The World Medical Association, international human rights instruments, international labour protection acts, European health legislation, the decision of the European Court of Human Rights, judicial practiceand survey of 60 specialists. The following methods were used in the paper: system method, comparative method, the method of questionnaires and formal logical method. RESULTS: Results: The survey of physicians allowed to state the need to create local protocols or technological maps of the use of personal protective equipment and the development and approval of the relevant results of their use - standards to ensure safe working conditions. CONCLUSION: Conclusions: Proposals for legal support of the system of guaranteeing safe working conditions for medical workers at the local level have been formulated. Every medical enterprise should have a system of guaranteeing safe working conditions for medical workers by: distribution of responsibilities between the heads of medical enterprises, issuing departmental and local acts on ensuring their work and acquainting medical workers with them, ensuring proper quality and quantity of personal protective equipment and, accordingly, monitoring their use and the functioning of the system of guaranteeing safe conditions.

Аннотация: OBJECTIVE: The aim: To reveal the features of the epidemic safety and security legal regulation in Belarus, Kazakhstan, Moldova, Poland, Russia and Ukraine during the COVID-19 pandemic. PATIENTS AND METHODS: Materials and methods: This study is based on Belarusian, Kazakh, Moldavian, Polish, Russian and Ukrainian regulatory acts as well as national court judgments. Such methods as dialectical, comparative, analytic, synthetic, comprehensive, statistical and generalization approaches have been used in the article. CONCLUSION: Conclusions: the study confirmed that the direct impact on the spread and dynamics of morbidity during the COVID-19 pandemic in the countries to be analyzed is determined by: the presence of government agencies and special institutions involved in combating, preventing and monitoring the spread of infectious diseases and their readiness for effective measures in emergency situations caused, in particular, by epidemics; timeliness and duration of quarantine restrictions, their severity and scope; observance of these restrictions by the population; effectiveness of law enforcement responses to violations. The strengthening of administrative and/or criminal liability had no significant impact on the morbidity situation in the country.
