Аннотация: OBJECTIVE: Introduction: In accordance with Resolution on Cancer Control WHA58.22 Cancer prevention and control The Fifty-eighth World Health Assembly it is obvious technology for diagnosis and treatment of cancer is mature, and that many cases of cancer may be cured, especially if detected earlier Some key points on concept of legal regulation of abovementioned sphere is a base of this study. However, the problems of using an effective mechanism for protecting the rights of patients in certain types of disease, in particular cancer patients, by providing early diagnosis, are not fully developed by medical law specialists. The aim of the article is to determine the means of ensuring the right to health and life of cancer patients in particular through early diagnosis. PATIENTS AND METHODS: Material and Methods: This study is based on regulation acts, World health report (2013), The Fifty-eighth World Health Assembly, WHA58.22 Cancer prevention and control, Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, International Covenant on Economic, Social and Cultural Rights, European Convention for the Protection of Human Rights and Fundamental Freedoms, Charter of Fundamental Rights of the European Union, research papers and views of progressive-minded people in this sphere. Article is grounded on dialectical, comparative, analytic, synthetic and comprehensive research methods. RESULTS: Review: Most countries have declared a compliance of their national legislation with international standards regarding the right to life and health. The analysis of the abovementioned international acts in context of protection of the rights of patients with cancer leads to the conclusion that countries that have undertaken international legal obligations to protect the right to life are required to take the necessary measures to ensure the effective treatment of cancer patients. Taking into account that the lack of such treatment due to the specificity of the disease entails the death of the patient, the state inaction in this area should be regarded as a violation of a human right for life. Absence of state's policy in terms of early detection of cancer brings a huge problem of human rights violation and providing the standards of fundamentally different approach of the European Union countries could become a great solution. CONCLUSION: Conclusions: Individual states do not pay sufficient attention to the need of effective public health policy. In today's world, there are objective prerequisites for changing the system of protection of patients' rights and, consequently, for changing views on health protection in general, especially in the part of functioning of diagnostic procedures system. Formation of a state policy on ensuring the rights of citizens to health and life, taking into account the various consequences of such a policy, cannot be narrowed down only to the proclamation of such rights, but also requires planning and development of relevant state programs. Failure by the state to provide the proper organization of health care through the establishment of early diagnosis for cancer patients, considering wide incidence and mortal danger of cancer in case of late diagnosis, should be considered as a violation of human rights. It also does not conform to ECHR practice in terms of provisions of Articles 2, 3 and 8 of European Convention.

Аннотация: INTRODUCTION: the current state of patenting legal regulation of medical treatment in Ukraine and in the world is analyzed, the directions for the further development are determined. The author defines "non-industrial medical" and socio-ethical theories in the field of medical treatment patent protection. The existence of exclusively formal "monopoly" of the patent owner is noted, as well as the inapplicability of the majority of the patented achievements in this field in Ukraine. AIM: the purpose of this article is to investigate the current state of patenting legal regulation of medical treatment in Ukraine and in the world, to analyze the limitation of patent protection basic conception in the medical field and to determine the tendencies and perspectives of the legal protection mechanism of further development in this field in Ukraine, considering the European and world regulation experience. MATERIAL AND METHODS: this study is based on Ukrainian regulation acts, The European Patent Convention, The Code of Laws of the United States of America, judgments, scientific works and opinions of progressive-minded people in this sphere. Such methods as dialectical, comparative, analytic, synthetic and comprehensive are used in the article. CONCLUSION: The experience analysis of the medical treatment patenting regulation in EU and in other countries of the word made it possible to substantiate the tendencies of development the patenting legal regulation of treatment methods mechanism, based on the needs of creation conditions for the availability of the recent treatment developments and technics for citizens, without increasing the cost of such treatment through license fees.

Аннотация: The article reviews standards of state policies in terms of the national security of the European Union countries. The authors provide a comprehensive analysis of the theory and practice of providing national security in the EU countries. In addition to that, the article provides for a deep analysis of the major methodological approaches in regards to establishing national security in the EU. The authors make a systematic review of the development and implementation of the EU security doctrines. The aim of this research article is to analyze the development of the idea of developing a European defense policy to find an effective way of incorporating our state into European security structures. Also, the research question may be posed as discussion on the way the national security is guaranteed in the EU countries. The novelty of the study is in the way how the past, current and future national security setup is implemented in the EU countries and what may the ways of its development. Materials and methods used in studying this problem, researches and publications of such domestic and foreign researchers were used. At the same time, processes of global and European security need constant analysis and study. The results showed that the problem of the formation of the European security and defense system that emerged shortly after the end of the Second World War prompted European countries to work more closely together, particularly in the defense sector. After the Cold War and the emergence of new challenges for stability on the continent, the EU has embarked on a path towards greater consolidation and greater awareness of own defense and security interests. Conclusion of the article is that an analysis of the approaches to the national security in the EU convincingly demonstrates that the level of security depends on many factors. The successful provision of national security strategy and approach depends on the sustainability and strength of their national economies. Only a strong economy allows successfully defending national interests in growing global competition and world economic disparities. Therefore, a country shall not only develop a national security concept, relying on world experience, but, above all, to reform its domestic and foreign policies with a view to protecting all actors.

Аннотация: OBJECTIVE: Introduction: Currently, there is little attention paid to studying the characteristic features of the protection of patients' rights in the European Court of Human Rights, which is the fact determining the relevance of the scientific research in this area. The aim: To define the basic rights of patients and summarize the practice of the European Court of Human Rights with regard to protection of patients' rights in order to formulate proposals as to the ways of the current legislation improvement. PATIENTS AND METHODS: Materials and methods: In the research, the practice of the European Court of Human Rights, international standards of justice, scientific publications of leading experts in the field of medical law, current and prospective Ukrainian and international laws were used. The research is based on the organic combination of philosophic approaches, general scientific and special legal research methods. RESULTS: Review: The standards and mechanisms of ensuring the rights of patients were singled out from a whole number of international legal acts. In the Ukrainian legislation, the list of patients' rights corresponds to the main provisions of the Declaration of Lisbon on the Rights of the Patient and other international legal acts. The protection of patients' rights in different countries varies based on differences in the laws, organization of the healthcare service as well as economic, social, cultural, religious and moral values. Simultaneously, there are common features in the legal protection of patients' rights, in particular appealing to the ECHR. While considering the cases involving protection of patients' rights based on the Articles of the Convention, the Court has developed a number of positive obligations of the state and minimum guarantees, which should be enshrined in national legislations to protect the rights of patients. CONCLUSION: Conclusions: The absence in the national legislation of clearly defined concepts of medical law limits the potential of legal protection of the rights of patients and necessitates the development and adoption of a single legal act to efficiently regulate the rights and obligations of the physician and the patient, provide classification of healthcare services, procedures and conditions of the services provision, quality criteria, etc. The prospective Medical Code of Ukraine shall become such a normative legal act, since the need for its development provides prospects for further research in this area. The ECHR practice affects national legal practices, primarily in the information, social and educational aspects, contributes to development and adoption of new concepts, court legal culture and a new reference system to comply with the Convention and Court practices.

Аннотация: OBJECTIVE: Introduction: Public health is an important concept, which is continually being globalized and integrated into today's society. It helps to improve and prolong the quality of life of people and prevent the spread of epidemics and serious incurable diseases. The components of public health include protection, prevention, and promotion. Prevention, the measures taken to prevent disease as opposed to treatment consist of screening and periodical medical examinations. There are two types of screening- universal screening and case finding (individual screening). Universal screening and periodical medical examination are identical concepts; the terms dispensary and individual screening (case finding) have similar meanings and can be used interchangeably. These concepts and their importance are analyzed in this research. The aim: A research on the legal regulation of periodic health examinations and screening as a two systems, which provides the implementation of prevention within the public health. Analysis of foreign experience such countries as: Great Britain, USA, Austria, Germany, Australia, France, Italy and others. PATIENTS AND METHODS: Materials and methods: The research based on: Ukrainian legislation, European Union's Law Acts, decisions of the ECHR, EU's member-states law, WHO Acts and Recommendations, scientific articles. The research is also based on general scientific and special research methods (such as dialectical, comparative, analytic, synthetic). RESULTS: Review: In Europe (except Germany and Austria) is happening the transition from the system of mandatory periodical medical examination to new screening system. However, despite this, periodical medical examinations of Europeans held in connection with exist system health insurance (both voluntary and mandatory). CONCLUSION: Conclusions: Screening and periodical medical examinations are two of the most important aspects of public health as they help to diagnose diseases at an early stage, even before showing any symptoms. Screening and periodical medical examinations ensures the safety and health of the entire population as opposed to certain individuals and therefore be mandatory procedure in today's society.

Аннотация: OBJECTIVE: Introduction: The problem of medical errors is always relevant in medical literature and law. Meanwhile, it is understood diametrically opposite by doctors, patients, and lawyers. This has a negative impact on patients' trust in medical professionals, and sometimes leads to criminal prosecution for a so-called "medical error", which in fact is conscientious deception, not a crime, and should exclude criminal liability. The aim: The aim of this work is the illustration of diametrically opposed approaches to understanding the essence of the concept of "medical error" from patients', doctors', and lawyers' views that are often generated by subjective approaches and results in distrust between doctors and patients, medical professionals and lawyers. The aim of the article is also to realize the ECHR's approach to understanding the essence of a medical error and distinguishing it from the negligence that should lead to liability of the medical professionals. PATIENTS AND METHODS: Materials and methods: In this research a legal doctrine, scientific works, provisions of international legal acts, in particular, the Convention for the Protection of Human Rights and Fundamental Freedoms were used, as well as the practice of the ECHR (12 relevant ECHR decisions), where the Court considered cases related to "medical errors" and formulated positive obligations of the state in the field of health care were analyzed. A complex set of general and special methods of cognition was used to achieve the aim, they are comparative legal method, systemic and structural method, methods of generalization, analysis and synthesis, sociological method, hermeneutical method, etc. RESULTS: Results: A survey of patients, medical professionals and lawyers conducted by the authors (300 persons), analysis of doctrinal approaches are illustrated the gap between the doctrinal approaches existing in the understanding of the essence of the "medical error" phenomenon and the perceptions of the medical services recipients, which indicates the need of understanding the essence of the phenomenon of medical error in order to increase the confidence in the medical profession, the inadmissibility of doctors liability for a medical error. CONCLUSION: Conclusions: The research gave the authors a reason to conclude that both medical and legal sciences are still far from the unity of views on the concept of "medical error". Medical errors significantly affect the authority of a medical institution, a particular doctor, or the state as a whole, and have severe consequences for patients. An analysis of the medical literature and ECHR practices has led to the conclusion that a medical error occurs when it is possible to completely exclude the guilt of medical professionals in the form of intent or negligence. In case of a medical error the criminal liability of the doctor is excluded.

Аннотация: OBJECTIVE: Introduction: The state policy in the field of medicinal products supply and import adjustment is aimed at steady assurance of quality throughout all stages of medicinal products circulation, starting with production and import to the stage of their medical application. The aim:of the article is to study the existing permitting and restrictive legal mechanisms of importing medicinal products at international, regional and national levels. PATIENTS AND METHODS: Materials and methods: This research is based on empirical and analytical data from the WHO, EU, EU customs and medical legislation, national legislation of Ukraine and Republic of Poland, Eurostat statistics, European Court of Justice (hereinafter referred to as ECJ) rulings. CONCLUSION: Conclusions: Customs regime prohibitions and restrictions are of particular importance when it comes to importing medicinal products. That specificity is in the procedures of licensing, certification, quality control, packaging, marking etc. A proper mechanism for carrying out such procedures requires standardization at international and regional levels. At the level of regional cooperation the issue of parallel import of medicinal products is urgent. Associated risks should be minimized by means of the instruments of international, European law through the adaptation of the national licensing procedures of medicinal products import to the EU requirements, including those defined in the Association Agreements.

Аннотация: The authors researched the peculiarities of the legal protection of inventions in the field of biotechnologies based on the legislation of European countries and Ukraine. They determined the legal framework regarding the legal protection of biotechnologies at the international level. They identified the fundamentals related to the peculiarities of judicial control and protection of biotechnological inventions in the European countries (Germany, the United Kingdom, France, and Italy) and the resolution of these issues at the legislative level in Ukraine. Particular attention was put to the provisions of Directive 98/44/EC of the European Parliament and the Council on the legal protection of biotechnological inventions. One determined the content of the rules of the current patent legislation in Ukraine, which regulates the protection of biotechnological inventions, and highlighted the key aspects of the Agreement between Ukraine and the European Union in the context of the conducted research. The authors provided a systematic overview of the main requirements applied to the biotechnological innovations to determine their patentability. The main problematic aspects of the Directive 98/44/EC were highlighted based on the research findings. They lead to an ambiguous interpretation of the document's rules and the existence of considerable differences in the patent legislation available in the member countries of the European Union. ©

Аннотация: The relevance of the research is the contract provisions for private medical services have been thoroughly developed in scientific-legal doctrine; many studies analyze their content, classification, application. The legal essence of contracts on State (public) medical services in the current legislation of Ukraine, is not sufficiently researched that makes the issue in this area relevant. The purpose of the study is aimed at defining the concept and legal nature of contract provision for public medical services; generalization and critical understanding of the legislator's approaches to determining the role and significance of public medical service contracts in the system of contracts in Ukraine. The research main methods are dialectical, formal-logical, systemic. In particular, the systemic method was used to determine the place of the contract in the contract system as a whole. Special mention should be made of the specific scientific methods (comparative-legal, formal-legal) which were utilized to find out the legal nature of the public medical service contracts. The relevance of the research: the provisions on contract for provision private medical services are thoroughly developed in scientific-legal doctrine; many studies analyze their content, classification, application. The legal essence of the contract on public medical services in the current legislation of Ukraine, has not been sufficiently researched that that requires further examination. The research results are based on the analysis of regulatory material. It is concluded that there is no single agreed approach regarding the procedure for concluding these contracts, determining their legal nature and contract conditions in Ukraine. The authors emphasize on the recognition of the health of an individual as the highest social value of the European community, necessity of effective mechanisms for regulating health care relationships in order to achieve the highest level of health standards for all human beings, and improvement of the quality of life in general and health care in particular. The authors note that further expansion of public-private partnerships in the medical field is useful and necessary for all countries in the world. The medical services provision by public health institutions may be provided on the basis of private civil contracts. Practical significance is evident from the analysis of the normative material. The authors outline the main problematic issues regarding the legislative regulation of state medical contract and make specific proposals for improvement of the existing legislation in the medical service field. The worldwide pandemic COVID-19 has shown that effective mechanisms to regulate health care delivery relations in order to achieve the highest standard of health for all humanity and improve the quality of life in general, and health care in particular is a pressing issue for both developed countries and those seeking it. The conclusions and suggestions made can be used in the research sphere for further elaboration of problems of contract law, in the sphere of practical activity, in particular to develop contract forms.

Аннотация: This work deals with the evolution of adversarial princtple in civil process under the conditions of post-socialist regression and post-reform civil justice as well as the introduction of the principles of case management and cooperation between the court and the parties in the process. In particular, it analyses the main provisions of such new guarantees of realization of the right to a fair trial, which were introduced in the CPC of Ukraine in 2017-2018 as a court's right to prevent abuse of procedural rights, as well as the exchange of competitive documents between the parties. The authors argue that effective protection of the rights today is to be based on the adversarial principles that shall be supplemented by the security of the balance of rights of the parties and the authority of the court on the examination of civil matters.

Аннотация: Introduction: The spread of infectious diseases, the increasing number of people who refuse immunization, the study of international standards of patient’s rights during immunization in modern conditions are relevant in modern medical law. The aim: The aim of this research is clarification of patient’s rights international standards for vaccination against infectious diseases and ways of their further implementation in Ukraine. Materials and methods: The research is conducted using general and special scientific methods (philosophical-dogmatic, dialectical, logical-normative, system-functional and comparative-legal analysis, statistical and others). The analysis of documents and statistics of international institutions, in particular, the United Nations (UN), the Council of Europe (CE), the World Medical Association (WMA), legal acts of different countries, the judgments and decisions of the European Court of Human Rights (ECHR) and other courts on human (patient) rights and their compliance with immunization (86 court decisions), and questionnaires is conducted. The views of V. Pashkov [1−3], L. Udovyka [2], N. Gutorova [3] and other researchers are studied. Conclusions: International standards of patient’s rights for vaccination against infectious diseases and standards when compulsory of vaccination is not violation of international standards of patient’s rights are identified in the study. Suggestions are made regarding the future implementation of such standards in health care system of Ukraine.

Аннотация: Today, ownership right is not only one of the main categories of legal and economic science but also the basis for the existence of the state and the private sector. The right to inviolability of private property is an inalienable right, the recognition of which indicates the level of democracy and the development of human and civil rights in the territory of a certain state. The particularities of this right and its essence taken together are recognized in the realities of today as a broad, multi-faceted and complex problem that requires its actualized development from both theoretical and practical law enforcement positions. In the context of European integration, qualitative restoration of the domestic legal system, as well as at the stage of initial reformation of Ukraine, for representatives of the doctrine and practitioners, the following issue appears to be more relevant: proper ensuring and improvement of the mechanism of ownership right protection. Besides, law enforcement practice, the variability of which is still not generalized, is considered to be an important factor in the modern updated perception of the essence of the ownership right protection. However, the introduction of so-called “model decisions” of the Supreme Court, use of the case law practice of the European Court of Human Rights by national courts and the particularities of modern legal relations in the field of ownership correct the legislative basis and the mechanism of enforcement of this right, given globalization processes and the challenges of our time. According to the results of the analysis of doctrinal approaches, legal regulation and law enforcement practice in the field under research in the publication: (1) modern essential content of the concepts “ownership right” and “ownership right protection” was revealed; (2) the tendencies of ownership right protection were analyzed; (3) particularities, admissibility and expediency of the civil claim in criminal proceeding were defined; (4) debating scientific positions on the justified restriction on the ownership right were investigated; (5) it is proposed to define the ways of protection of ownership right by the court as the statutory measures by which the court implements the protection of the violated, contested, subjective and unrecognized ownership right, freedom or interest by implementing the function of civil law in the sphere of protection, and (6) it is substantiated that with the appeal of the owner for the protection of his right, the main functions of civil law became more active (restoration, compensation, prevention) which are the key to the effective implementation of protection.

Аннотация: OBJECTIVE: Introduction: The article reviews issues of legal regulation of patients' rights in Ukraine, analyzes the patient-doctor relationship, proposes the legislative approval of new patients' rights and the need of adoption of a single legislation of these rights. The aim of this work is to conduct a detailed study of legal regulation of patients' rights in Ukraine and the EU countries, to identify the areas for further improvement of the legislative regulation of patients 'rights in Ukraine, ways of harmonization of national legislation with international standards, which regulate patients' rights. PATIENTS AND METHODS: Materials and methods: we analyzed national and international regulation of patients' rights, case law of the European Court of Human Rights (ECHR), national court judgments. We also used historical, comparative-legal methods, and instruments of analytical research and empirical study. CONCLUSION: Conclusions: In Ukrainian law many patient rights are not defined, but are applied in medical practice, therefore, they require legal regulation. In particular, they include: the right to convene a consilium; the right to refuse medical interference; the right to terminate treatment, etc. In addition, with the development of medicine, scientific and technological progress, there are some issues, which arise and need to be legally defined, among them: the rights and responsibilities of the patient during transplantation, artificial insemination, medical research, etc. When making health policy, the concept of trust and respect for patients, their autonomy or constructive partnership with them should be taken into account. Doctors need to take a more active part in discussions and debates with patients. Independence of patients in decision making processes must be provided by law, and the rights and obligations of all parties must be clearly reflected in the relevant documents.

Аннотация: The aim of the study is to analyze individual legal problems of the implementation of the human right to palliative care. To achieve this goal, statistical data on the number of palliative patients, their access to medical services were analyzed. The absence of reasons for limiting the patient's right to receive palliative care, as such a right is a fundamental human right, is substantiated. An analysis of the understanding of the legal construction of "palliative care" in the scientific literature, national and international legal documents was carried out. It was revealed that the terms "hospice care", "end-of-life-care", "respite care" are components of a precise definition - "palliative care". Two groups of subjects that ensure the human right to this type of medical care are identified, their powers are indicated. In the course of the research it was established that palliative patients, more often than other patients, need medical care, including children. This category of patients faces the following problems: incomplete providing of high-quality free medical palliative care; insufficient number of palliative and hospice departments for such patients; palliative care does not meet international standards (logistical support for palliative departments, there are no specialists of a multidisciplinary team); there is no special training for medical personnel working with incurable patients; painkillers (non-narcotic and narcotic) drugs for relieving pain syndrome of such patients are not provided in full volume; there is no cooperation of state authorities in the field of palliative care with public and charitable organizations; palliative patients do not have access to free legal services (pensions, inheritance).

Аннотация: Nowadays, shale gas is becoming an increasingly promising alternative energy source. Taking into account the significant controversial problems on the issue of shale gas development, its economic efficiency, environmental consequences, the legislative framework, it is necessary to structure and systematize the problems identified, to find optimal solutions, especially for the development of this industry in Ukraine. The hypothesis of the study is the question of whether there is an economic feasibility of extracting shale gas in Ukraine. The purpose of the study is to analyze theoretical, practical, economic, investment and legal aspects of the development of shale gas production in the world and the prospects of Ukraine in this issue. The subject of the study is the economic, legal and environmental factors in the development of the shale gas industry in Ukraine. The methodological basis of the research consists of scientific works on the main aspects of shale gas development in the context of European integration. The economic and environmental aspects of shale gas development in the United States, the European Union and China have been examined. The economic, ecological and legal aspects and prospects of shale gas development in Ukraine on the Yuzivska and Oleska gas fields have been determined. A SWOT analysis of shale gas development prospects in Ukraine has been conducted, and the risks have been identified. It was concluded that the development of shale gas production for Ukraine is ambiguous, there are many contradictions, both economic, environmental and legal.

Аннотация: The article is devoted to the experience of the application of a concept of militant democracy in modern Ukraine. This concept is relevant due to the prolonged domination of the communist totalitarian regime until 1991, and also in view of the encroachment on the principle of territorial integrity in 2014. It is argued that Ukraine, formally consolidating separate instruments of militant democracy at the level of the Constitution of Ukraine, almost did not apply such instruments until 2014. The active process of decommunization started in 2014, after the Revolution of Dignity; it was realised, in particular, in the declaration of lustration, as well as the banning of the two communist parties, but the most influential Communist Party remains officially not banned up till now. Also, the two parties, accused of infringement on territorial integrity, were banned in 2014. The issue of differentiation between aggressive words and aggressive actions of parties is analysed. It is argued that representatives of the parties, who during the twenty years of Ukrainian independence openly denied one of the key values of the constitutional order of Ukraine, its territorial integrity, became active participants of the temporary occupation.

Аннотация: OBJECTIVE: Introduction: Legal liability for medical negligence should contribute to the protection of patients' rights to life and health. At the same time, unreasonably strict sanctions against physicians should be analyzed much closely. More balanced model of such liability requires serious in-depth research. The aim of the article is to stimulate discussion about the necessity to improve the criminal legislation and judicial practice of criminal liability execution. PATIENTS AND METHODS: Materials and methods: This study is based on the analysis of international law, WHO documents, jurdicial practice and statistics, criminal and medical law legal doctrine (29 laws and papers, 97 court judgments were analyzed). Dialectical, comparative, analytic, synthetic and system analysis research methods were used, also for interpretation purposes. CONCLUSION: An effective legal mechanism should ensure the timeliness and thoroughness of the investigation and prosecution of each case of medical negligence to prevent the recurrence of such consequences in the future. Legal liability (civil, disciplinary or criminal) for medical negligence is a necessary part of this mechanism. The inevitability of criminal punishment rather than its severity should be recognized as a core for the medical negligence prevention concept. That's why the long-term imprisonment for medical negligence as a form of punishment should be recognized as socially unreasonable, it cannot improve the protection of patients' life and health but leads to significant negative social complications instead.

Аннотация: The relevance of the study of alimony obligations of family members in the family law of Ukraine is conditioned by both the latest approaches of the legislator to the regulation of alimony relations, and the problems of law enforcement practice in this area. The purpose of the study is to determine the features of alimony obligations of family members in the family law of Ukraine, to identify problems of legal regulation and enforcement of these obligations and to develop recommendations for their elimination. Methodologically, the study of alimony obligations of family members is divided into separate structural parts, which cover the general features of these obligations in the family law of Ukraine and the features of their individual types. The methodological basis for the study of alimony obligations of family members in the family law of Ukraine is developed at the philosophical, general scientific and special scientific levels. The study proves that the alimony obligations of family members are in essence family law monetary obligations that arise on the grounds specified by law or contract, are long-term and personal. It is proposed that one of the spouses be considered in need of financial aid if their monthly income (salary, pension, income from the use of their property, other income) is less than the minimum wage established by law. It is proposed to apply similar provisions to identify parents in need of financial aid in alimony obligations for the maintenance of disabled parents by adult children. It is argued that the change of the minimum amount of alimony to be collected from the alimony payer per child is not a basis for applying Article 192 of the Civil Code of Ukraine, but is a basis for changing the minimum amount of alimony specified in the writ of execution and alimony recovery, and is taken into account when determining the amount of alimony or alimony arrears. Other changes to the Family Code of Ukraine have been proposed to improve the procedure for collecting alimony for family members. The analysis of theoretical provisions of alimony obligations of family members and practical problems of law enforcement in this area and the development of proposals to improve family law is important for further research of family law obligations, will contribute to the development of an effective mechanism for exercising and remedy of the rights of parties in family legal relations and the establishment of the unity of judicial practice. © 2020, National Academy of Legal Sciences of Ukraine. Аннотация: OBJECTIVE: The aim: The aim of the study is to determine the state of legal regulation of surrogacy in Ukraine, Russian Federation and Belarus, to identify risks of human rights violations, to identify legal and medical mechanisms to combat the exploitation of women, and to outline a portrait of a surrogate mother. PATIENTS AND METHODS: Materials and methods: The empirical basis is the legislation of Ukraine, Russian Federation and Belarus, which regulates the service of surrogacy, information from the websites of agencies and clinics in this area, as well as personal stories of 41 surrogate mothers, set out in open sources. The following methods were used: dialectical, comparative, statistical, induction and deduction, questionnaire, analysis and synthesis, content analysis. CONCLUSION: Conclusions: The results of the study clarify both the common features of the legal regulation of surrogacy in the East Slavic countries, and the specifics of each of them; the main problems in the field of its application are outlined; the risks of violation of the rights of genetic parents, children and surrogate mothers are characterized. Legal and medical mechanisms for counteracting the exploitation of surrogate mothers have been identified.

Аннотация: OBJECTIVE: The aim: To develop an algorithm of legal support of the system that guarantees safe working conditions of medical workers at medical institutions during the COVID-19 outbreak. PATIENTS AND METHODS: Materials and methods: The following materials were used in the paper: Interim Recommendations of the World Health Organization, documents of The World Medical Association, international human rights instruments, international labour protection acts, European health legislation, the decision of the European Court of Human Rights, judicial practiceand survey of 60 specialists. The following methods were used in the paper: system method, comparative method, the method of questionnaires and formal logical method. RESULTS: Results: The survey of physicians allowed to state the need to create local protocols or technological maps of the use of personal protective equipment and the development and approval of the relevant results of their use - standards to ensure safe working conditions. CONCLUSION: Conclusions: Proposals for legal support of the system of guaranteeing safe working conditions for medical workers at the local level have been formulated. Every medical enterprise should have a system of guaranteeing safe working conditions for medical workers by: distribution of responsibilities between the heads of medical enterprises, issuing departmental and local acts on ensuring their work and acquainting medical workers with them, ensuring proper quality and quantity of personal protective equipment and, accordingly, monitoring their use and the functioning of the system of guaranteeing safe conditions.
