Аннотация: OBJECTIVE: The aim: To develop an algorithm of legal support of the system that guarantees safe working conditions of medical workers at medical institutions during the COVID-19 outbreak. PATIENTS AND METHODS: Materials and methods: The following materials were used in the paper: Interim Recommendations of the World Health Organization, documents of The World Medical Association, international human rights instruments, international labour protection acts, European health legislation, the decision of the European Court of Human Rights, judicial practiceand survey of 60 specialists. The following methods were used in the paper: system method, comparative method, the method of questionnaires and formal logical method. RESULTS: Results: The survey of physicians allowed to state the need to create local protocols or technological maps of the use of personal protective equipment and the development and approval of the relevant results of their use - standards to ensure safe working conditions. CONCLUSION: Conclusions: Proposals for legal support of the system of guaranteeing safe working conditions for medical workers at the local level have been formulated. Every medical enterprise should have a system of guaranteeing safe working conditions for medical workers by: distribution of responsibilities between the heads of medical enterprises, issuing departmental and local acts on ensuring their work and acquainting medical workers with them, ensuring proper quality and quantity of personal protective equipment and, accordingly, monitoring their use and the functioning of the system of guaranteeing safe conditions.

Аннотация: Introduction: According to the decisions of the European Court of Human Rights and the regulations of the World Health Organization, the right to health and the right to life are interconnected. However, the right to life may be a starting point in the context of the right to health. The issue of ensuring the right to life and health protection of certain sections of society, in particular, children working in agriculture, is on the agenda. The aim: To analyze the provisions of international law and scientific literature on the effects of workplace factors on the health of children working in agriculture and to examine the existing limitations of such effects. Materials and methods: International acts, data of international organizations and conclusions of scientists have been examined and used in the study. The study also summarizes information from scientific journals and monographs from a medical and legal point of view with scientific methods. The article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. Conclusions: In the context of preserving the right to health and the right to life, children are the most vulnerable categories of agricultural workers. Working conditions and workplace safety in agriculture for minors have to be properly organized. The level of traumatization, occupational morbidity and above all, the standard of health of child labourers in agriculture depend on the level of proper organization of occupational safety. In many countries, the state of the working environment and safety for child labourers in agriculture and, accordingly, the standard of their health remain unsatisfactory.

Аннотация: Taking into account the general historical past (up to the 1990s), the paper examines current issues of codification and improvement of labour legislation in Belarus and Ukraine. The first part of the article briefly analyzes three global reforms of the Labour code of Belarus that took place in 2007-2008, 2014 and 2019-2020. Based on the generalization of legal and technical features of these three reforms, both negative trends in the development of labour law in Belarus and positive features associated with increased flexibility in regulating labour relations were identified. The second part of the paper examines the current situation of labour legislation in Ukraine, its non-compliance with the realities of the market economy. Special attention is paid to the analysis of the draft of law "On labour", submitted by the Government to the Verkhovna Rada of Ukraine in 2019.

Аннотация: Due to the insufficient level of regulation of the institute of commercial secrets in Ukrainian legislation, the article attempts to study foreign and international experience in the context of this issue. In particular, labor laws of some countries, as well as a series of international agreements and directives were examined; their main statements, advantages and disadvantages were defined. Based on collected and analyzed data, the authors outlined directions of adapting Ukrainian legislation to the highest standards of the EU, as well as developed recommendations for amending the Labor Code of Ukraine, paying special attention to the obligations of the employee in preserving commercial secrets. The suggestion was made to adopt at the enterprise level a local normative act that would determine the list of information constituting a commercial secret and would reflect the procedure for its use, storage and distribution, as well as the responsibility of employees for its unauthorized distribution-the Commercial Secrets Regulation.

Аннотация: The article presents a brief analysis of the situation in Belarus and Ukraine with the spread of coronavirus COVID-19 and measures taken by employers to optimise labour and social security relations during 2020. A brief overview of the decisions taken by Presidents, Parliaments, Governments and Ministry of Healthcare of both countries aimed at containment of coronavirus infection is presented. The latest changes in the Labour Code of Belarus and Labour Code of Ukraine, which regulated remote work since 2020, were touched upon. Attention is paid to the concept of self-isolation under the legislation of Belarus and Ukraine, restrictive measures that must be observed when self-isolating citizens in connection with COVID-19 infection, as well as level 1st and 2nd contacts. The authors analyse the new legislative provisions governing home and remote work, introduced into the labour legislation in Belarus in 2020, in Ukraine in 2020 and 2021. The article presents the specific experience of Belarus, where the presidential decree extended the rights of employers to temporarily transfer employees without their consent, as well as to change essential working conditions, and without making changes to the Labour Code. The authors give an assessment of such legislative innovations. The article deals with some issues of social support for employees who find themselves in a situation of downtime due to the suspension of the activities of organisations that are idle, as well as self-isolation. At the end of the article, some suggestions and recommendations are made for further adaptation of labour and social security legislation in Belarus and Ukraine in the context of the COVID-19 pandemic.

Аннотация: The study analyses the question of the essence and structure of statutory regulation of occupational health and safety in the Republic of Poland. The relevance of the subject under study is primarily explained by the fact that in Poland, against the background of undoubted economic success, there is an intensive process of improving the legal and organisational foundations of the corresponding range of social and labour relations. The study of this issue is of paramount importance for those countries that had approximately the same “starting conditions” with Poland – the recurrence of state socialism, which devalued the principles of a market economy and the possibility of full protection of working people. The purpose of this study is to present and substantiate the systemic features of occupational health and safety in the Republic of Poland in difficult present-day conditions. The study is based on understanding the methodology as a complex integrated system of perception of reality and scientific cognition, and conducted based on the necessary scope of methods, namely: method of system analysis, historical legal method, structural-functional method, comparison method, special comparative legal method, and cross-temporal analysis. The authors of the present paper noted that the statutory regulation of occupational health and safety in the Republic of Poland has all the features of systemic nature. Most importantly, this is explained by the harmonious correlation of two components: purely statutory and legal support of the corresponding share of social and labour relations. Notably, the statutory regulation of occupational health and safety is undergoing continuous improvement depending on current challenges and threats. For countries that have been united with Poland in the recent past in the form of state socialism, the experience of establishing the work of tripartite participants in social dialogue (government agencies, employers' and workers' representatives) is also important. The scientific value of the present paper primarily lies in the necessity and feasibility of analysing the systemic features of statutory regulation of occupational health and safety. In this case, it is important to use both the method of system analysis and a clear distinction between the concepts “system research” and “research of systems” (the latter in this case appears both as a system of legal regulation of occupational health and safety and as a complex set of public authorities and other organisations involved in the important task of ensuring due occupational health and safety).
