Заглавие : Conflict of law regulation in cross-border copyright inheritance
Параллельн. заглавия :Колізійне регулювання транскордонного спадкування авторських прав
Место публикации : Journal of the National Academy of Legal Sciences of Ukraine. - 2020. - Vol. 27, Iss. 2. - P.49-63
УДК : 347.65/.68
Ключевые слова (''Своб.индексиров.''): міжнародне приватне право--международное частное право--спадкування--спадкування авторських прав--наследование авторских прав--inheritance statute--international private law
Аннотация: Inheritance is one of the legal means that ensure the effective implementation of copyright, therefore the protection of the interests of testators and their successors in cross-border matters is an important task of international private law. Modern national systems of inheritance and copyright operate independently. Due to the influence of economic, political and socio-cultural factors, the unification of substantive law of these industries is unlikely, so the conflict of law method of regulation remains dominant in this area. The paper highlights the main problems of conflict of law regulation of cross-border copyright inheritance and offers approaches to overcoming them. The authors address such issues as forms of manifestation of a foreign element in the relations of copyright inheritance; problems of distinguishing between intellectual and inheritance statutes; features of the application of the point of contact lex loci protectionis; the principle of territoriality, etc. Based on the analysis, it is concluded that the subordination of key issues of copyright inheritance to the conflict rules of the intellectual statute extends the principle of territoriality to these relations and necessitates multinational protection of these relations. The paper supports the opinion of scholars who criticise the concept of territoriality in matters of copyright protection, proving its ineffectiveness. Ultimately, the authors suggest that the tools of private international law allow for flexible approaches and do not equate copyright, which is more related to personal status, and industrial property rights, aimed at achieving commercial interests. It is proposed to achieve greater flexibility by detailing the scope of the conflict of law rules and establishing a system of conflict bindings, which will allow to choose the law that is more related to the circumstances of the case.

Заглавие : COVID 19-related stigmatization: a human rights-based approach
Место публикации : Wiadomosci lekarskie. - 2021. - Vol. 74, Iss. 11, cz. 2. - P.2972-2977
УДК : 342.7
Ключевые слова (''Своб.индексиров.''): stigmatization--стигматизація--стигматизация--covid-19--human right--право людини--право человека--dignity--достоинство--гідність--right to private life--право на приватне життя--право на частную жизнь--discrimination--дискриминация--дискримінація
Аннотация: ABSTRACT The aim: The article attempts to analyze what are legal responses to such Covid-19 related challenge like stigmatization. Materials and methods: Given the specifics of the topic and goals, during the writing of the article were used methods of terminological research of the phenomena “stigma”, “stigmatization”, comparative method, formal-legal method (in the study of international documents). The following materials were used to reveal the topic: scientific papers (articles, book chapters, analytical materials, reports, etc.), international legal acts, court decisions (decisions of the European Court of Human Rights, decisions of the US Supreme Court, decisions of national courts of different countries). Conclusions: More than a year after the spread start of Covid-19, it has become clear that in addition to the extremely catastrophic impact on human health and life, the pandemic, as well as the resulting quarantine restrictions, have profound and sometimes radical social consequences. Stigmatization of based on their infection with Covid-19 (including possible) has become one of these. The current international human rights framework allows for the assessment of such processes according to its standards. Implications of dignity and privacy as the highest social values pave the way to finding legal mechanisms to protect people who are carriers of a disease from being stigmatized. This is demonstrated by the legal justifications developed by the courts – the ECtHR as supranational and national Supreme and federal courts, which have been the subject of analysis within this article.

Аннотация: Infectio us diseases is the subject of increased attention, which causes concern in society throughout the world. In this context, and in order to implement preventive measures, democratisation and protection of human rights are increasingly combined with measures of state coercion. The new challenge today is the COVID-19 pandemic, recognised by the World Health Organisation. Today is pandemic has forced a qualitative rethink of approaches to responding to the health challenges of both individuals and nations. States have gradually begun to use a variety of health measures, including policy and legal instruments, to control the spread and effects of COVID-19. Some states have resorted to criminal law to apply it to health care to prevent infection with COVID-19. A comparative analysis of the features of criminal liability for violating the quarantine regime in the European Union and Ukraine showed the variability of the structures of crimes, however, the unity of difficulties in qualifying socially dangerous acts and, as a result, the impossibility of effective prosecution. It was stated that there was an urgent need for States to recognise that the new coronavirus was a serious health emergency, but that the criminalisation related to COVID-19 was a worrying trend towards prolonging human rights restrictions. Experts are increasingly questioning, in particular, the feasibility and effectiveness of existing criminal law measures on health care and their fragmentary compliance with internationally declared human rights standards, which in the long run will be the basis for the abolition of new criminalised components of crimes.

Аннотация: The European Convention on Human Rights proclaims the right of everyone to privacy of information about their state of health, which is a particularly important issue during the COVID-19 pandemic. The aim of the study is to determine the essence of the ECtHR's activity as a guarantee of information culture, highlight the main elements of its activities in this aspect, and analyze the right to medical secrecy in the practice of the European Court of Human Rights. The formal-logical method was used to analyze the norms of the European Convention on Human Rights, determine the content of basic concepts, and systematize the material in order to obtain generalizing conclusions within the framework of the stated problem. The predictive method was used to determine the prospects for the development of legislation aimed at creating a system of effective legal provision for the confidentiality of patient information. The European Court of Human Rights has more than once drew attention to the enormous importance of protecting personal, in particular medical data, so that a person can enjoy his or her right to private and family life with satisfaction. That is why public authorities must ensure the confidentiality of information about the health of individuals. It should not be disclosed or processed without the prior informed consent of the person concerned. There are a lot of cases of unlawful disclosure of information about the patient's health and liability for unlawful disclosure.

Аннотация: The author considers the problem of protection of the right to privacy in the activities of the media. It is concluded that the rights to freedom of expression and privacy are recognized as fundamental human rights that do not conflict with each other, but are inalienable, inherent in everyone. In the interests of society, the law provides for cases of restriction of criminal law protection of the right to privacy. A significant difference in the criminal law protection of privacy of citizens and officials has been established. The need for further implementation of the decisions of the European Court of Human Rights into national legislation has been confirmed.

Аннотация: The article is devoted to the content of legal instruments in terms of tourism business, namely the problems of legal regulation of the contract for the provision of tourist services. The analysis of the state of development of this problem shows that the issue of legal regulation of contractual relations in general and the contract in tourist services in general is insufficiently studied. This is due to various factors, including the fact that constant integration processes to the international community force Ukraine to adjust its domestic legislation in accordance with international requirements, but these measures are often inconsistent or incomplete, so there are many contradictions in modern Ukrainian civil law. The author's vision of the content of the package of measures that can positively influence not only the development of the tourism industry in general, but primarily to help identify those legal segments that need improvement in the future.

Аннотация: Background: Maintaining prosecution in criminal cases in court is a specific function of the prosecutor, which is enshrined in both the Constitution of Ukraine and the provisions of the Criminal Procedure Code of Ukraine. This function should meet not only the objectives of criminal justice but also international standards in the field of criminal justice. Criminal proceedings are divided into public and private, depending on the type of socially dangerous act. And depending on the type of accusation, the functions of the prosecutor in the exercise of their powers are different. Thus, in cases of private prosecution, the participation of the victim is crucial, and his/her refusal to prosecute may be grounds for closing the criminal proceedings. This note related to the study of the innovative approach of the Supreme Court's law enforcement practice shows the active role of the prosecutor in considering these categories of criminal cases in court. Methods: We thoroughly analysed the case-law of the Supreme Court of Ukraine, as well as the provisions of the Criminal Procedure Code of Ukraine and other legislative acts. We also generalised and studied the case-law of Ukrainian courts, as well as recommendations of the CoE and the doctrine of the criminal procedural law of Ukraine. Results and Conclusions: The authors drew several conclusions about various forms of private prosecution with their own specifics, which are manifested in the aspects mentioned in this note.
