Аннотация: The purpose of the study is to determine the subject of "medical secrecy", to characterize the subjects who are obliged to keep secret information that is the subject of medical secrecy and, based on the results of this study, to make author's proposals to clarify the name for confidential medical information in legislation in the field of medicine in the field of medicine, criminal and criminal procedural legislation. The article explores issues related to the right of every person to the confidentiality of medical information, which is legally defined as "medical privacy". Based on the analysis of international legal acts, decisions of the European Court of Human Rights, the legislation of Ukraine and Georgia on the researched subject, using the foundations of the philosophy of law, carried out a comprehensive study of the concept of "medical confidentiality", defined entities following their professional and career responsibilities, must keep it. In the given article were used such scientific methods as logical, system-structural, comparative-legal, analysis, synthesis. Based on the research, the authors make several proposals for improving certain norms governing medical activities, namely, changes to the wording of Article 40 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Protection", Article 145 of the Criminal Code of Ukraine and Article 65 of the Criminal Procedure Code of Ukraine.

Аннотация: This book investigates how the military conflict between Russia and Ukraine has affected the religious situation in these countries. It considers threats to and violations of religious freedom, including those arising in annexed Crimea and in the eastern part of Ukraine, where fighting between Ukrainian government forces and separatist paramilitary groups backed and controlled by Russia is still going on, as well as in Russia and Ukraine more generally. It also assesses the impact of the conflict on church-state relations and national religion policy in each country and explores the role religion has played in the military conflict and the ideology surrounding it, focusing especially on the role of the Ukrainian and Russian Orthodox churches, as well as on the consequences for inter-church relations and dialogue.

Аннотация: This article is devoted to the analysis of procedural time limits transformation under pandemic conditions implemented in the legislation of Ukraine during the coronavirus pandemic of 2020, as well as the practice of their application in national courts. It is stated that inaccuracy and incompleteness in resolving important issues related to the extension and renewal of procedural time for the administration of justice under the quarantine creates obstacles to the implementation of the main tasks of civil proceedings. Inaccuracy in the regulation by procedural legislation of certain procedural terms, the possibility of their renewal and extension can significantly affect the movement of all civil proceedings as well as significantly impede the achievement of its goals.

Аннотация: The author considers the problem of protection of the right to privacy in the activities of the media. It is concluded that the rights to freedom of expression and privacy are recognized as fundamental human rights that do not conflict with each other, but are inalienable, inherent in everyone. In the interests of society, the law provides for cases of restriction of criminal law protection of the right to privacy. A significant difference in the criminal law protection of privacy of citizens and officials has been established. The need for further implementation of the decisions of the European Court of Human Rights into national legislation has been confirmed.

Аннотация: This article is a study of the Civil Code of Ukraine as the main regulator of civil relations in civil society. The history of adoption of the Civil Code of Ukraine and its conceptual foundations were reviewed. Particular attention is paid to the problem of dualism of private law in Ukraine. The structure and content of the Civil Code of Ukraine were analysed. Attention is also paid to the main novelties of the Civil Code of Ukraine. The principal rules for the regulation of legal entities were analysed. Novelties in defining the object composition of civil legal relations are considered. Particular attention is paid to the main directions of modern scientific research in the field of the civil law of Ukraine. The study confirms the urgent need for a thorough recodification of the Ukrainian civil law, with mandatory consideration of the experience of the implementation of modern recodifications in many European countries.

Аннотация: The European Convention on Human Rights proclaims the right of everyone to privacy of information about their state of health, which is a particularly important issue during the COVID-19 pandemic. The aim of the study is to determine the essence of the ECtHR's activity as a guarantee of information culture, highlight the main elements of its activities in this aspect, and analyze the right to medical secrecy in the practice of the European Court of Human Rights. The formal-logical method was used to analyze the norms of the European Convention on Human Rights, determine the content of basic concepts, and systematize the material in order to obtain generalizing conclusions within the framework of the stated problem. The predictive method was used to determine the prospects for the development of legislation aimed at creating a system of effective legal provision for the confidentiality of patient information. The European Court of Human Rights has more than once drew attention to the enormous importance of protecting personal, in particular medical data, so that a person can enjoy his or her right to private and family life with satisfaction. That is why public authorities must ensure the confidentiality of information about the health of individuals. It should not be disclosed or processed without the prior informed consent of the person concerned. There are a lot of cases of unlawful disclosure of information about the patient's health and liability for unlawful disclosure.

Аннотация: OBJECTIVE: The aim: Analyze the practice of resolving the problems of protecting the rights of children born to surrogate mothers in the context of the COVID-19 pandemic. PATIENTS AND METHODS: Materials and methods: In carrying out the study, an interdisciplinary approach was applied to the analysis of the problem of protecting the rights of children born to surrogate mothers in the context of the COVID-19 pandemic. This approach includes dialectical, comparative-legal, statistical, and systemic methods. The research used scientific developments in the field of problems of protecting the rights of children born to surrogate mothers, international acts, legislation, statistical data. It has been established that although the understanding of surrogacy is the same for all states, there is a rather different approach to the possibility of its application. The issue of providing a child born to a surrogate mother with data on his genetic origin (in the absence of a genetic link with legal parents) should be resolved on the basis of this approach: maintaining a balance of interests between parents and the child, taking into account the principle of the best interests of the child. CONCLUSION: Conclusions: It was concluded that the inadmissibility of closing borders and restricting the entry of foreigners to reunite with children born of surrogate mothers. It is proposed to create a register of persons those wishing to apply the surrogacy procedure, as well as the register of children born from surrogate mothers in Ukraine.

Аннотация: Background: Maintaining prosecution in criminal cases in court is a specific function of the prosecutor, which is enshrined in both the Constitution of Ukraine and the provisions of the Criminal Procedure Code of Ukraine. This function should meet not only the objectives of criminal justice but also international standards in the field of criminal justice. Criminal proceedings are divided into public and private, depending on the type of socially dangerous act. And depending on the type of accusation, the functions of the prosecutor in the exercise of their powers are different. Thus, in cases of private prosecution, the participation of the victim is crucial, and his/her refusal to prosecute may be grounds for closing the criminal proceedings. This note related to the study of the innovative approach of the Supreme Court's law enforcement practice shows the active role of the prosecutor in considering these categories of criminal cases in court. Methods: We thoroughly analysed the case-law of the Supreme Court of Ukraine, as well as the provisions of the Criminal Procedure Code of Ukraine and other legislative acts. We also generalised and studied the case-law of Ukrainian courts, as well as recommendations of the CoE and the doctrine of the criminal procedural law of Ukraine. Results and Conclusions: The authors drew several conclusions about various forms of private prosecution with their own specifics, which are manifested in the aspects mentioned in this note.

Аннотация: ABSTRACT The aim: The article attempts to analyze what are legal responses to such Covid-19 related challenge like stigmatization. Materials and methods: Given the specifics of the topic and goals, during the writing of the article were used methods of terminological research of the phenomena “stigma”, “stigmatization”, comparative method, formal-legal method (in the study of international documents). The following materials were used to reveal the topic: scientific papers (articles, book chapters, analytical materials, reports, etc.), international legal acts, court decisions (decisions of the European Court of Human Rights, decisions of the US Supreme Court, decisions of national courts of different countries). Conclusions: More than a year after the spread start of Covid-19, it has become clear that in addition to the extremely catastrophic impact on human health and life, the pandemic, as well as the resulting quarantine restrictions, have profound and sometimes radical social consequences. Stigmatization of based on their infection with Covid-19 (including possible) has become one of these. The current international human rights framework allows for the assessment of such processes according to its standards. Implications of dignity and privacy as the highest social values pave the way to finding legal mechanisms to protect people who are carriers of a disease from being stigmatized. This is demonstrated by the legal justifications developed by the courts – the ECtHR as supranational and national Supreme and federal courts, which have been the subject of analysis within this article.
