Аннотация: Convention for the Protection of Human Rights and Fundamental Freedoms simultaneously complements the content of European public order, introducing human rights as a new component and providing two powerful mechanisms for implementing and guaranteeing this order, namely the Convention and a judicial body - the ECtHR. The results obtained allow us to formulate new concepts of unification of terms and approaches to the public order in Europe, which will integrate this region even more into the common legal space and provide the protection of human rights and freedoms at a new, higher level.

Аннотация: Переговоры о вступлении Великобритании были успешными в начале 1970-х годов только после того, как де Голль оставил свою позицию на посту президента Франции. Французская блокада британского присоединения была снята только после того, как британский премьер заверил своих французских коллег в отношении британских обязательств перед Европой и обеспечил уступки по конкретным проблемам со стороны Франции. Расширение Великобритании, Ирландии, Дании и Норвегии стало сложной задачей для всех вовлеченных сторон. Финансовый вклад в Европейский бюджет также был большой проблемой в ходе переговоров. Официальной причиной референдума 1975 года было то, что гражданам Великобритании необходимо было высказать свое мнение и принять решение по такой важной проблеме, связанной с их индивидуальными и коллективными свободами. Аннотация: INTRODUCTION: Some countries have already tried and tested mechanisms of regulating distance sales as form of distribution of medicines that have been used more or less effectively for a fairly long time. Herewith, so far, the approach of the competent authorities of some countries including Ukraine can be called prevailing in quantitative terms under which the official prohibition on distance sales of medicines is set. AIM: The aim of this study is a detailed examination of the nature of the prohibition of the medicines distance selling in Ukraine, namely the an analysis of advantages and disadvantages of this form of distribution of medicines and identification of appropriate ways for gradual repeal of the prohibition in terms of regulatory reform in Ukraine in the sphere of circulation of medicines due to the process of adaptation of statutory regulation in this area to the EU legislation. MATERIAL AND METHODS: This study is based on Ukrainian regulation acts, Council Directives 97/7/EC, 2000/31/EC, 2001/83/EC, scientific works and opinions of progressiveminded people in this sphere. Such methods as dialectical, comparative, analytic, synthetic and comprehensive have been used in the article. CONCLUSION: Reception of the described experience of regulation in EU will allow a further review of the principles of regulation in Ukraine in the sphere of medicines with a shift in the main emphasis in the direction of ensuring adequate consumer rights in this area and preventing the risks of patients' and public health.

Аннотация: It has been emphasized that the norms of the Constitution of Ukraine and the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms are correlated in structure, form of action and features of application that allows determining the conceptual features for the formation of the mechanism of realizing and applying the Constitution of Ukraine as norms of direct effect. It has been emphasized that the central idea is the uneventful application of the norms of the Constitution of Ukraine and the Convention for the Protection of Human Rights and Fundamental Freedoms at the stages of realizing human rights and their protection due to the similar nature and legal structure of their norms. It has been noted that the use of such an approach creates an objective opportunity to establish whether there were violations of any requirements at the stages of: protecting such a right (existence and application of preventive measures), implementing the right (obstacles to achieving a certain good by a person) and protecting human right (taking sufficient and effective measures aimed at restoring the person’s status). It has been stated that the norms of the Constitution of Ukraine, given their legal properties, can be applied similarly to the way how the European Court applies the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms. Considering the provisions of the current procedural legislation of Ukraine on the powers of courts, it has been proved that human rights are realized and protected in out-of-court and judicial manner exclusively and directly on the basis of the norms of the Basic Law. It has been noted that the forms of applying the Convention for the Protection of Human Rights and Fundamental Freedoms should be understood as methods of applying the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms by the authorized subjects to certain legal relations that is expressed in the relevant acts, namely: literal application – carrying out law-enforcement activities on the basis of the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms without their interpretation; expanding application – the implementation of law-enforcement activities on the basis of the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms as a result of their interpretation.

Аннотация: When there is a lack of energy resources in the EU and it has to look for suppliers from other countries, Russia provides the world with most of the oil and gas. Diversification of energy resources is one of the objectives for the EU. The majority of international participants are interested in discovering the potential of the sea. However, the development of the region’s resources still faces many obstacles, such as lack of export pipelines, difficulties due to security of supply considerations, transit complications, political and legal considerations and market uncertainties. This study focuses on the countries of the former Soviet Union such as Uzbekistan, Kazakhstan and Turkmenistan in Central Asia, and Azerbaijan in Transcaucasia. One of the six priority areas of the EU in the energy infrastructure of - the Southern Energy Corridor (SEC), the purpose of which is to link the Caspian basin and potentially Middle Eastern gas to Europe. In the article, we analyzed the potential of the Caspian basin in terms of energy and its impact on the energy security of the European Union

Аннотация: At the moment, two mechanisms for protecting human rights can be distinguished in Ukraine: an appeal to the European Court of Human Rights at the international level and an appeal to the Commissioner for Human Rights at the national level. Therewith, the activity of the ombudsman constitutes the state’s performance of its obligations at the international level to ensure the national mechanism for the protection of human rights. In Ukraine, the Ombudsman acts according to the model of the classic parliamentary Commissioner for Human Rights. In addition, along with the parliamentary Commissioner for Human Rights, which has a constitutional status, there are government commissioners (“quasi-ombudsmen”) in Ukraine, whose activities do not have a special status and can be terminated at the will of the government at any time. Considering the above, the purpose of this study lies in a comprehensive analysis of modern challenges to international security and the impact of these factors on the observance of human rights in Ukraine (using the methods of both international law and classical legal methodology), as well as studying the role of the ombudsman in this process. The analysis allowed to conclude that the causes of human rights violations lie not only in the country’s problems, but are also the consequences of global processes. A huge challenge to the rights and freedoms in Ukraine is the intensifying poverty of the population, which in itself is a violation of human rights and allows to exercise all other rights. Furthermore, the hostilities in the Donbas region led to gross, massive, and systematic violations of human rights: residents of the front-line territories were faced with two challenges at once – the danger that arises due to the impossibility of ensuring security in the immediate vicinity of the war zone and the increasing risks of poverty.

Аннотация: The article reviews standards of state policies in terms of the national security of the European Union countries. The authors provide a comprehensive analysis of the theory and practice of providing national security in the EU countries. In addition to that, the article provides for a deep analysis of the major methodological approaches in regards to establishing national security in the EU. The authors make a systematic review of the development and implementation of the EU security doctrines. The aim of this research article is to analyze the development of the idea of developing a European defense policy to find an effective way of incorporating our state into European security structures. Also, the research question may be posed as discussion on the way the national security is guaranteed in the EU countries. The novelty of the study is in the way how the past, current and future national security setup is implemented in the EU countries and what may the ways of its development. Materials and methods used in studying this problem, researches and publications of such domestic and foreign researchers were used. At the same time, processes of global and European security need constant analysis and study. The results showed that the problem of the formation of the European security and defense system that emerged shortly after the end of the Second World War prompted European countries to work more closely together, particularly in the defense sector. After the Cold War and the emergence of new challenges for stability on the continent, the EU has embarked on a path towards greater consolidation and greater awareness of own defense and security interests. Conclusion of the article is that an analysis of the approaches to the national security in the EU convincingly demonstrates that the level of security depends on many factors. The successful provision of national security strategy and approach depends on the sustainability and strength of their national economies. Only a strong economy allows successfully defending national interests in growing global competition and world economic disparities. Therefore, a country shall not only develop a national security concept, relying on world experience, but, above all, to reform its domestic and foreign policies with a view to protecting all actors.

Аннотация: Regulatory acts of the European Union play a significant role in regulating land relations in the EU member states. Thus, according to the draft Treaty on the Introduction of the Constitution for Europe (2003/C169/01), adopted by the consensus of the European Convention on June 13 and July 10, 2003, the Council of Ministers unanimously adopts European laws, European framework laws, implements land use measures, excluding the organization of waste collection and disposal (Sulyagina, 2012; Kokanovska, 2016). According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States of June 14, 1994, Ukraine has undertaken to take measures to gradually bring national legislation into line with the legislation of the European Community, that is, to adapt national legislation to the EU legislation requirements. Among the spheres of adaptation there is, in particular, the institution of legal responsibility as an important way of protecting the environment, including lands, as follows from the provisions of the Law of Ukraine "On the State Program for Adaptation of Ukrainian Legislation to the Legislation of the European Union" of March 18, 2004. The implementation of the course on the European integration necessitates the adaptation of the national land legislation to the EU requirements. According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States (Agreement on partnership and cooperation between Ukraine and the European Communities…, 1994) an important condition for strengthening economic ties between Ukraine and the Community is the convergence of the existing and future legislation of Ukraine with Community legislation. Ukraine will take measures to ensure the gradual harmonization of legislation with the legislation of the Community. Adaptation of land legislation is the process of bringing the laws of Ukraine and other regulatory legal acts that are sources of land law of Ukraine, as well as the step-by-step adoption and implementation of Ukrainian regulations, developed in accordance with EU legislation, conformably with the acquis communautaire. Acquis communautaire (acquis) the legal system of the European Union, which includes, but is not limited to, acts of European Union legislation adopted within the framework of the European Community, the Common Foreign and Security Policy and the Co-operation in the Field of Justice and Home Affairs. At the same time, it is necessary to take into account that in the EU operates the principle of the EU rule of law over national law, which found its confirmation in the decisions of the Court of Justice of the EU. Thus, in the judgments of the Court of Justice of the European Communities in case 26/62, Algemene Transporten Expeditie Ondernemingvan Gend v. Nederlandse Administratieder Belastingen, in case 6/64, Flaminio Costa v. ENEL and in case Variola v. S. P. Administatione Italianadelle Finanze there is entrenched: • The principle of priority of EU law over the national law of member states (Supremacy of European law principle). • The principle of direct application of EU law (the principle of direct application of EU law). The scale of the influence of EU law is evidenced by the fact that approximately 80% of laws and other legal acts in the economic and social spheres that in the past belonged to the competence of states are produced by Union bodies and are unified for all its members (Magnovsky, 2005). The purpose of adapting the land legislation of Ukraine to the EU legislation is to achieve compliance with the legal system of the country acquis communautaire, taking into account the criteria set by the European Union to the states that intend to join it. The development of Ukrainian legislation in the direction of its approximation to the legislation of the European Union is a priority component of the process of Ukraine's integration to the European Union, which in turn is a priority direction of Ukrainian foreign policy.

Аннотация: Legal protection is an essential tool for enabling whistleblowers in Ukraine to report on corruption crimes. Most people are still afraid to publicize abuses of the law at their workplaces or in educational institutions because they fear losing their jobs or destroying their careers. This article briefly analyzes international and domestic legislation on these issues, as well as the positions of the Council of Europe and the European Union. It also discusses the efforts of the civil society organizations that united to form the "Initiative 11" group, which works to draft better whistleblower-protection laws and rally support for these laws. The article concludes that there remains a great need for a comprehensive whistleblower-protection law in Ukraine to facilitate the discovery and prosecution of corruption crimes.

Аннотация: In modern transformational Europe-oriented conditions of Ukraine development, the peculiarities of property civil law liability and material liability according to labor law as well as comprehensive comparative analysis are very topical in connection with the lack of a one unified approach to this issue, both among representatives of the doctrine and practices. The authors of this article conducted study involving: (1) the notion, content and features of property civil law liability of properties in corresponding legal relations have been analysed; (2) the authors’ definition of the notion “property civil law liability” has been proposed; (3) criteria of delineation between property civil law liability and material liability in labor relations have been disclosed and unified; (4) the characteristics of case law in the field of bringing to property civil liability have been analyzed, the substitution of labor civil liability, as well as prosecution without guilt have been emphasised; (5) a discussion position regarding the existence of professional responsibility as a form of civil liability has been considered, and (6) the necessity of specifying nature and characteristics of property civil liability, as well as the circumstances of exemption from it, at the legislative level, with subsequent detailing in the case-law of the Supreme Court of Ukraine state has been substantiated.
