Аннотация: This work deals with the evolution of adversarial princtple in civil process under the conditions of post-socialist regression and post-reform civil justice as well as the introduction of the principles of case management and cooperation between the court and the parties in the process. In particular, it analyses the main provisions of such new guarantees of realization of the right to a fair trial, which were introduced in the CPC of Ukraine in 2017-2018 as a court's right to prevent abuse of procedural rights, as well as the exchange of competitive documents between the parties. The authors argue that effective protection of the rights today is to be based on the adversarial principles that shall be supplemented by the security of the balance of rights of the parties and the authority of the court on the examination of civil matters.

Аннотация: The aim of this paper is to reveal and examine law-making elements in the jurisprudence of the Constitutional Court of Ukraine. It should be noted that the Constitutional Court has no direct powers to establish new legal norms under national legislation. However, in the process of constitutional interpretation, the case law of the Court demonstrates de facto the presence of law-making activity, that leads to the extension of its discretionary power on the formation of law. The paper will focus on the analysis of the practice of the Constitutional Court of Ukraine with regard to the ‘creative interpretation’ of law. A review of selected case law leads to a conclusion that the Constitutional Court often uses the dynamic interpretation of the Constitution. Moreover, the Court may change its own legal position in order to protect constitutional rights. Thus, the Constitutional Court of Ukraine has the right to ‘develop’ the law through evolutive interpretation of the Constitution. It can also be concluded that the Constitutional Court enjoys a wide ‘margin of appreciation’ in its interpreting of the Constitution.

Аннотация: Der Beitrag zeigt die Entwicklung der Kriminalistik über den deutschsprachigen Raum hinaus. Er beschreibt aktuelle gesellschaftliche Aktivitäten zu ihrer Entwicklung, insbesondere in den osteuropäischen EU-Staaten. Ausgangspunkt sind Empfehlungen der Europäischen Union zur Kriminalitätsbekämpfung. Dazu verabschiedete der Rat der EU u. a. einen Rechtsakt zur „Schaffung eines einheitlichen europäischen kriminalistischen Raumes“. Im Beitrag wird am Beispiel kriminalistischer Organisationen in Litauen, der Ukraine und Deutschland diskutiert, wie öffentliche nichtstaatliche Organisationen durch wissenschaftlich-praktische Zusammenarbeit diesen Prozess fördern können. In einem „Palanga-Memorandum“ wurde die Gründung einer „Europäischen Föderation nationaler kriminalistischer Organisationen“ beschlossen und nationale europäische kriminalistische Organisationen/Vereine aufgerufen, darin mitzuwirken.

Аннотация: The current stage of criminalistics’ development is characterized by the active formation of its general theory, the definition of the object-matter area of research in this field of knowledge. The relevance of the issues studied in the paper is due to the need of a modern scientific concept of the matter of criminalistics development, identifying the range of patterns studied. The paper is aimed at analysing modern scientific approaches to understanding the crime mechanism as a structural element of the matter of criminalistics science. To achieve this goal, general and special research methods such as dialectical, historical, formal-logical, system-structural, legal forecasting, system and semantic analysis were used. It is proved that the crime mechanism as a holistic system of circumstances, processes, factors that determine the emergence of material and other information carriers about the crime event itself, its participants, provides the opportunity to put forward working investigative versions, investigation planning, targeted search for the consequences of the crime, offender’s identification, victim’s identification, contributes to the criminal legal qualification of the offense, and therefore undoubtedly acts as an object of criminalistics’ cognition. It is emphasized that the crime mechanism only determines the occurrence of traces (material and ideal), and therefore traces as consequences and as a result of the reflective process go beyond its internal structure (building). Therefore, the process of reflecting the crime mechanism in the environment, and hence the emergence of information about a crime and its participants should be considered as a separate aspect of the matter of criminalistics. It is noted that the criminalistics teaching on the crime mechanism studies the nature, essence and content of the functional side of criminal activity, patterns of interaction of participants of a criminal event with each other and with the surrounding material situation (environment), as well as patterns that determine the sources of criminalistics’ significant information on the crime itself and its participants. The process of direct formation of material and ideal traces, the patterns of reflection of the necessary information in them should be studied by another separate criminalistics teaching on the mechanism of trace formation. Attention is paid to the fact that the crime mechanism has connections with other categories of criminalistics and, above all, with the crimes’ criminalistics characteristics. It is stated that crimes’ criminalistics characteristics is a scientific abstract category, which reflects the qualitative and quantitative information of retrospective orientation as a result of cognition of the mechanism of certain types of crimes, i.e. that the crime mechanism is a reflected object, and criminalistics characteristics is a form of its reflection.

Аннотация: This article deals with the study of Ukraine’s measures of non-tariff barriers during the armed conflict in eastern Ukraine and under the conditions of the COVID-19 pandemic. The first part of the article identifies the reasons for the establishment and genesis of non-tariff barriers to foreign trade. The modern international legal basis of non-tariff regulation and its application in Ukraine is also outlined. Moreover, the impact of the EU-Ukraine Association Agreement 2014 on the mechanisms for setting non-tariff barriers is described. The second part of the article focuses on the characteristics of modern approaches to the classification of measures of non-tariff barriers to trade. Their diversity and lack of a definitive, orderly list in international agreements and national legislation are emphasized. The third part of the article is devoted to the analysis of measures of non-tariff barriers to trade, which were applied by Ukraine in relations with the Russian Federation and under the conditions of the COVID-19 pandemic. Their adequacy to the current crises in Ukraine was stated, but their untimeliness contributed to a significant reduction in efficiency in minimizing the negative impact of crises caused by the aggression of the Russian Federation and the COVID pandemic.

Аннотация: A key feature of modern legal relations in the healthcare sector is the widespread use of digital technologies. This study describes certain aspects of the legal regulation of the human right to virtual reality in the healthcare sector and the problems of law enforcement. The methodology of this work is based on an interdisciplinary approach using comparative legal, dialectical and systemic methods. The main objective of this article is to determine the forms and directions of the use of virtual reality in health care in the context of human rights. It is emphasized that the introduction of smart technologies, virtual reality in the healthcare sector is the main modern trend in the development of healthcare in order to improve the provision of healthcare services. The human right to use virtual reality in healthcare is to ensure the actions of virtual reality users within the framework of virtual information relations in the healthcare sector, which are governed by the relevant legal norms. The human right to use virtual reality in healthcare is a fourth generation of human rights. These rights include all rights that have arisen as a result of scientific progress, the development of morality, namely "somatic rights", as well as information rights. The use of virtual reality in the healthcare sector is possible in the following areas, namely: (1) medical training, (2) surgical modeling, (3) rehabilitation, (4) psychotherapy and psychology, (5) ophthalmology, (6) telemedicine, etc. It is stated that user safety, privacy, freedom of expression, ethics and copyright protection in the use of virtual reality in healthcare require legislative regulation, taking into account the European experience. The virtual space in the healthcare sector provides opportunities for the realization of human rights and freedoms regarding the preservation of their health, but can be used to carry out actions that contradict the norms of law and have illegal behavior. The latter requires an improvement in the regulatory framework when using the virtual space of the healthcare sector to protect the interests of the individual, society and the state using international standards.

Аннотация: Description: The aim of the article is to analyze legislative regulation of innovative activity in Ukraine, to identify the relevant problems and to develop the proposals to overcome them based on the study of foreign experience. The Subject of Study: The subject of the study is problems of legislative regulation of innovative activity in Ukraine. Methodology: The methodological basis for the article is the following methods of scientific knowledge: normative and dogmatic method, monographic method, methods of analysis and synthesis, comparative and legal method, and statistical method, abstract and logical method. The Results of the Study: Ukrainian legal acts governing innovative activity in the country were examined. The peculiarities of State regulation of this issue in some countries were investigated. Practical Implications: The problems of legislative regulation of innovative activity in Ukraine, which are: imperfect regulatory framework, lack of public funding, lack of effective mechanisms for attracting foreign investment, were identified. Value/Originality: Based on the study of foreign experience, the ways to improve the legislation of Ukraine regulating the issue under consideration were proposed.

Аннотация: The development of innovation activities is of great importance on the path to achieving the goals of sustainable development. Success on this path is closely related to the presence of comparable information on the development of innovation activities at the regional level. The aim of the paper is to assess the development of innovation activities in the regions of Ukraine and identify differences in results. The study is performed using relative indicators for the assessment of the development of innovation activities in the regions of Ukraine. The indicators were averaged and normalized. To analyze how innovation activities change over time, the dynamic indices based on the geometric mean of the growth rate of the relative indicators were used. The obtained results have significant differences in the regions being assessed. Most regions have a heterogeneous development of innovation activities. At the same time, they are at the top and bottom of the rankings of the regions in different indicators of the development of innovation activities. Only Cherkasy and Zaporizhzhia oblasts are at the top of the rankings in at least 75% of indicators. However, in 2017-2019, all indicators improved in at least 29% of regions. In addition, 75% of indicators improved in at least 54% of regions. Therefore, over time, most regions progressed in the development of innovation activities. Management decisions for the development of innovation activities should be complex for all regions and implemented primarily in the regions where there is no improvement over time.

Аннотация: The study investigates the problems of compliance with the legislative requirements in the use of agricultural land in Ukraine, depending on who directly extracts useful properties from such land plots: employees of agricultural enterprises, or the owners of these lands - farmers, members of agricultural cooperatives, citizens who engaging in agricultural production activities individually. The article provides examples of the impact of the activities of workers and the labour of agricultural landowners on the state of land use, compliance with environmental safety requirements, deterioration, and improvement of the quality of land plots. Research of legal issues of targeted, rational, and efficient use of land plots, ensuring the requirements for the preservation of the natural environment, biological diversity and ecosystems contained in the study, provide an opportunity to draw certain conclusions, the essence of which comes down to the fact that the current state of legal relations concerning the use of land plots by employees and landowners needs to be reformed. This is conditioned upon the fact that employees are not motivated to improve the quality of land and its soils, comply with environmental safety requirements, and preserve biological diversity in ecosystems that include the corresponding land plots. Since the main motivation is to obtain a certain benefit, and sanctions for non-compliance with the requirements of legislation in the field of land protection are inefficient, the use of hired labour in agriculture is often described as a negligent and mindless attitude towards land use and ensuring environmental safety. But the owner or user of a land plot that uses it as a farmer, cooperative member, entrepreneur, etc., is motivated not only to make a profit at a given time, but also to improve its quality characteristics, ensure environmental safety, and preserve ecosystem biological diversity, since this is a factor in the stability of obtaining profits from agricultural activities performed on a certain site and in the future.

Аннотация: ABSTRACT The aim: To identify and establish the basics of organizational and legal support for military medical activities performed by the Defense Forces of France, Germany, and Ukraine, to make a comparative legal analysis of these principles in order to select the best practices that could be adopted by the forces of modern states. Materials and methods: This study is based on regulatory instruments of England, France, Germany, the United States, and Ukraine. The following methods are used in the article: comparative-legal, comprehensive and analytical ones. Conclusions: The study confirmed the importance of the legal and organizational framework of military medical activities to ensure the proper medical support of the troops. It includes 1) legal principles as key imperative requirements imposed on the operation of the military health services system; 2) legal foundations for the activities of the military medical services; 3) institutional arrangement.
