Аннотация: Due to the insufficient level of regulation of the institute of commercial secrets in Ukrainian legislation, the article attempts to study foreign and international experience in the context of this issue. In particular, labor laws of some countries, as well as a series of international agreements and directives were examined; their main statements, advantages and disadvantages were defined. Based on collected and analyzed data, the authors outlined directions of adapting Ukrainian legislation to the highest standards of the EU, as well as developed recommendations for amending the Labor Code of Ukraine, paying special attention to the obligations of the employee in preserving commercial secrets. The suggestion was made to adopt at the enterprise level a local normative act that would determine the list of information constituting a commercial secret and would reflect the procedure for its use, storage and distribution, as well as the responsibility of employees for its unauthorized distribution-the Commercial Secrets Regulation.

Аннотация: Given the insufficient level of regulation of the health insurance institute in Ukrainian legislation, the article attempts to investigate global experience in the context of this issue. In particular, a number of international documents were investigated, their content was characterized and the main provisions were highlighted. Based on collected and analyzed data, the authors outlined the areas of adaptation of Ukrainian legislation to the highest standards of the EU, made a proposal for the ratification of the conventions of the International Labor Organization. Supported a proposal for the development and adoption of a separate special law on general-compulsory state health insurance, which would regulate issues related to health insurance.

Аннотация: Civil relations are one of the fundamental topics of the civil law being the subject of the research attention of civil law scientists for many decades, both in Ukraine and abroad. Modern tendencies of social and economic transformations of the society, shifts in value and globalization challenges made topical the issue of delineation of civil and labor legal relations arguing the necessity in comparative analysis of their essence and content, definition of further perspective of interaction of civil and labor law branches. In the process of the study, the essence and content of civil relation have been revealed; the problem of replacement of labor relations with civil law, as well as the established judicial practice in this area on the territory of Ukraine has been analysed; risks and perspective of delineation of civil and labor relations have been determined; generalized author principles to delineate relations under the investigation have been proposed; the necessity to use the conceptual and categorical framework of a specific law branch regulating certain legal relations as a guarantee of a business entity against the claims of the controlling authorities has been substantiated.

Аннотация: In modern transformational Europe-oriented conditions of Ukraine development, the peculiarities of property civil law liability and material liability according to labor law as well as comprehensive comparative analysis are very topical in connection with the lack of a one unified approach to this issue, both among representatives of the doctrine and practices. The authors of this article conducted study involving: (1) the notion, content and features of property civil law liability of properties in corresponding legal relations have been analysed; (2) the authors’ definition of the notion “property civil law liability” has been proposed; (3) criteria of delineation between property civil law liability and material liability in labor relations have been disclosed and unified; (4) the characteristics of case law in the field of bringing to property civil liability have been analyzed, the substitution of labor civil liability, as well as prosecution without guilt have been emphasised; (5) a discussion position regarding the existence of professional responsibility as a form of civil liability has been considered, and (6) the necessity of specifying nature and characteristics of property civil liability, as well as the circumstances of exemption from it, at the legislative level, with subsequent detailing in the case-law of the Supreme Court of Ukraine state has been substantiated.

Аннотация: Taking into account the general historical past (up to the 1990s), the paper examines current issues of codification and improvement of labour legislation in Belarus and Ukraine. The first part of the article briefly analyzes three global reforms of the Labour code of Belarus that took place in 2007-2008, 2014 and 2019-2020. Based on the generalization of legal and technical features of these three reforms, both negative trends in the development of labour law in Belarus and positive features associated with increased flexibility in regulating labour relations were identified. The second part of the paper examines the current situation of labour legislation in Ukraine, its non-compliance with the realities of the market economy. Special attention is paid to the analysis of the draft of law "On labour", submitted by the Government to the Verkhovna Rada of Ukraine in 2019.

Аннотация: Today, the successful competition of any domestic enterprise in the market of goods and services is conditioned on the use of new technologies and production processes. Such activity is innovative and plays a leading role in its life. Exacerbation of competition and decrease of competitiveness of domestic enterprises necessitate their innovative development. Information, intelligence, knowledge and innovation, which are the backbone of the country's human resources, are of particular importance in this context today. Therefore, the driving factors in the way of formation of personnel component of innovative development of the state economy are the training of innovative personnel – skilled workers, capable of creative work, professional development, introduction of high-tech technologies on the basis of development of the system of lifelong learning. The issues of professional development of employees are becoming especially relevant in the context of globalization, as well as the European and innovative integration of Ukraine. The author investigates the peculiarities of transformations of modern theoretical and legal approaches to professional development of employees in the context of European integration, human-centered and innovative approaches to doing business, in particular, the following tasks are solved: (1) the essence of the concepts of ‘professional development’, ‘functions of professional development of employees’, ‘professional training’ as legal categories is revealed; (2) leading functions of professional development of employees are generalized; (3) the vectors for further reform of the legal regulation of professional development of employees are determined; (4) the prospects and problems of influence of professional development of employees on the innovative development of individual enterprise and Ukraine as a whole are established. The author substantiates that the professional development of employees produces its direct impact both on individual enterprises and on the state as a whole in the sphere of innovative transformations. Undoubtedly, the gradual introduction of European standards and requirements, the adaptation of foreign legal regulation to the domestic realities and features of the legal system will allow to increase the economic potential, innovative component and competitiveness of Ukraine in the world market, as well as to bring the prospects of gradual accession into the European Union.

Аннотация: The relevance of the study is determined by the need to establish corporate responsibility for breach of legislation. In this regard, this paper is aimed at identifying features of competition and corporate responsibility for breach of competition law. Particular attention is drawn to the case when corporations become monopolists and, in fact, dictate market rules. Consideration of the development aspect of competition law suggests that it largely limits the growth of corporate business and forces corporations to formulate strategies for splitting the business, thereby determining the conduct of business. In the modern world, where business is in many respects globalised, such measures can lead to a decrease in market indicators and form a dependence on the operations of certain corporations in the local market. The leading method to the study of this issue is the modelling method, which allows to consider this problem as a targeted and organised procedure related to the improvement and application of competition law, as well as the protection and development of competition. The novelty of the study lies in the possibility of limiting the activities of a corporation in a market that is occupied by it and where there is no practical competition. The authors consider the mechanism of self-regulation as a source of domestic competition law. The paper determines that self-regulation processes are also subject to state supervision and thus corporate self-regulation becomes an aspect of the regulation of competition enforcement by the state at large. The practical significance of the study is determined by the structural feature of the corporation as a quasi-state mechanism and the regulation of external relations between the state and corporations as tax residents on this basis.

Аннотация: Today, Ukraine is at the stage of forming a social and civil society. The main direction of state activity in the field of reforming Ukraine is the study, analysis and reform of the existing system of social services. The purpose of the study is to substantiate and summarise the main directions for the development of the system of financing social protection; to consider concepts such as “social protection”, “social insurance” and “social assistance”. To form and generalise knowledge about the existing system of financial and legal relations between the state and the population. To reveal the peculiarities of financing and directions of budget use in state and non-state social funds in a market economy. During the writing of the article, specific and general scientific methods of cognition were used to study and analyse the proposed topic. The method of generalisation, synthesis and analysis, observation, comparison and the method of scientific abstraction were used to evaluate and study the system of social funds in Ukraine. The system of social services in Ukraine was analysed. The existing system was analysed, weak points were revealed. Information on the foreign experience of developed countries in the field of providing social services to the population was considered. The current normative legal acts and laws were considered. Recommendations for the introduction of foreign experience in the existing system of social services have been developed. The study and analysis of the financing and functioning of the system of social protection and assistance to citizens provide an opportunity to understand how effectively it works. Assessing the effectiveness of state and non-state social funds should help identify weaknesses in the system and suggest a number of actions to improve their performance.

Аннотация: The fundamental and fundamental human right that is central to the system of non-proprietary rights aimed at ensuring the natural existence of an individual is the human right to life. The development of a civilized world leads to a new subjective perception of people about the origin of man, his place in the ecosystem and outer space in general and the scope of human rights and their transformation in particular. Complications of social life in the modern world leads not only to the transformation of social relations and the rapid renewal of the entire legal framework, but also to a significant acceleration and deepening of the formation of new branches of national law. In the current legal reality, it is separately necessary to separate medical law. The creation of medical law as a new branch of law is a necessity of our time, which will allow us to more effectively regulate legal relations in the medical field. The Institute of Euthanasia, in turn, should take its place precisely in the framework of medical law, and should be considered as a system of legal norms aimed at regulating social relations arising from the deliberate deprivation of life of a patient in order to alleviate his suffering, establishing the subjective composition and special methods of legal regulation. A look at the institution of euthanasia as an integral element of medical law will provide an effective and differentiated legal regulation of the procedure for its implementation.

Аннотация: Ensuring equal rights and opportunities in modern society allows us to ensure its development without involving additional regulatory functions of the state. In this regard, it is relevant to determine the limits of discrimination, to isolate them from personal rights and to identify potential state regulation in this area. The authors of the article consider the issue not only as the basis for building mandatory functions in the field of social security, but also as a tool for the uniform distribution of social security factors. For this, an analysis was performed, which uses the mechanism of the initial analysis of equality and on this basis the limits that require legislative consolidation are determined for the use of restrictive mechanisms. The article discusses the definition of equality and, accordingly, the restriction of rights in the generic concept and highlights the foundations of regulation and the restriction of inequality at the level of fundamental documents of the state. Social protection is presented as a component of a developed society that can provide its members with basic needs, starting with material basic benefits and ending with the ability to freely achieve well-being. The authors also consider compensation mechanisms. Practical significance is determined by the fact that mechanisms for ensuring equal opportunities are identified and principles for regulating the sufficiency of social security are formed for citizens who experience discriminatory influence both from the state and from individual citizens.
