The right to life from the point of view of personal autonomy in decision-making on euthanasia (review of the ECHR practice and the legislation of selected countries) [Текст] / N. M. Akhtyrska, Y. V. Grodetskiy // Wiadomosci lekarskie. - 2021. - Vol. 74, Iss. 11, cz. 2. - P. 3108-3112

Аннотация: ABSTRACT The aim: To analyze law enforcement practice on the basis of the national legislation of foreign states to single out features of legal regulation of the right to euthanasia realization and to outline the Ukrainian prospects of euthanasia legalization. Materials and methods: The empirical basis of the research is the legislation of some European countries (Belgium, Spain, Italy, Portugal, and the Netherlands) and Canada; decisions of the European Court of Human Rights on the right to voluntary death and the obligations of states; the results of a survey of 750 respondents conducted by the authors. The methodological basis of the study were philosophical views on life, death, and the right to certainty, formal-logical method (analysis, synthesis, induction, deduction, etc.), comparative, analytical, statistical, sociological methods of cognition, as well as a synergetic approach. Conclusions: The issue of legal regulation of euthanasia is multifactorial, socially conditioned, and requires a positive action of the state both in terms of regulation and/or prohibition, and the proper provision of citizens with health care. Legislative support for the human right to a “dignified death” is dictated, to some extent, by society’s demand, which must be finally resulted in the draft law. As for Ukraine, the adoption of such a law is obviously premature. Although according to a survey of citizens on euthanasia and the feasibility of introducing such a law in Ukraine, 57% are positive about the experience of other countries, and 41% were in favor of adopting a law in Ukraine, it is not possible to assess their opinion due to ignorance of legislation where euthanasia is allowed.

Аннотация: The peculiarities of protection of environmental law and order derive from the interplay of international and national law in the field of protection of Ukraine's unique ecosystem, compliance with which is a must for accession to the European Union. The purpose of this study is to analyse the doctrinal and legal aspects of environmental protection and to identify the main trends in ensuring environmental law and order by bringing individuals to legal liability. The main methods used in the study of environmental offences and environmental protection are the method of observation, empirical description, and experimentation. Environmental legal liability is manifested in conventional forms of legal liability: Criminal, administrative, disciplinary, civil. The distinction between environmental offences and other offences involving components of the natural environment is made to the object of the infringement and its social role in various social relations, which may involve the same elements of nature. The most crucial objectives of the state authorities are to implement a set of legal, organisational measures designed to improve environmental protection activities and to increase the effectiveness of the application of criminal and legal norms to combat environmental crime in society and the state in general. The main priority is to improve environmental legislation in line with the international obligations of the state in the field of environmental protection. The material in this study is of practical value for the Ukrainian state given the reverse course of our state towards European integration.

Soviet and post-soviet law: failed transition from socialist legality to rule of law [Текст] / M. Antonov, D. Vovk // Ideology and Politics Journal. - 2021. - Iss. 2 (18). - P. 4-9

Аннотация: The question of what is to be considered as legal and antilegal is one of the central questions of legal philosophy. However, its relevance is not restricted to philosophical reasoning only—the dichotomy of legal/antilegal leads to a wide range of discussions in legal science, especially in the field of constitutional law. Political science is involved in these discussions too, since law can be instrumentalized as a means of carrying out political will. The content of this will can be evaluated as to its compliance with certain ethical principles. In this perspective, one can as well examine whether legal norms issued by holders of political power comply with such principles.

Reasonableness of notarial acts as a component of ensuring standards of latin notaries: the experience of Ukraine [Текст] / V. Аннотация: Background: This article is devoted to the study of the rules of notarial acts, the observance of which ensures the reasonableness of notarial acts as exemplified by Ukraine as a state belonging to the countries with Latin notaries. At the same time, the standardisation of Latin notary standards in Ukrainian legislation is associated with certain problems that do not fully reveal the potential of the notary and its functions as a body of undisputed civil jurisdiction. In this regard, the purpose of the work is to determine the components of the procedural mechanism to ensure the reasonableness of notarial acts, identify those shortcomings in their standardisation that lead to litigation, and formulate proposals for further improvement of notarial law on this basis. Methods: In the present research, we used the following methods: logical, systemic, specific sociological, hermeneutic, and modelling. It is established that the reasonableness of notarial acts is ensured by compliance with the rules on submission of evidence documents, requests for evidence documents by a notary, the signing of notarial documents, sending documents for examination, the compliance of documents submitted for notarial acts with statutory requests, and clarifying the will of the persons concerned. Results and Conclusions: It is proved that a notarial act issued based on the actual circumstances established within the notarial case, confirmed by the relevant evidence provided by the notarial legislation, should be considered reasonable. The grounds for exercising the powers of a notary to demand documents are determined, and the need to differentiate the order of recovery depending on the subjects in which such information is requested is emphasised. The content of the notary’s powers to request documents is clarified, and the conditions under which the exercise of such powers should be considered the notary’s duty are determined. The necessity of extending the duties of a notary to establish the will and real intentions of the persons concerned to all notarial acts and, in this regard, the standardisation of such a duty as a general rule of notarial acts is substantiated. It is concluded that the distinction between documents for which the originals are subject to preservation in the notarial file and those that are photocopied then returned to interested persons should be made, taking into account the loss or preservation of their validity and legal significance after said notarial action. The author determines the grounds and conditions for sending a document for examination, which is a procedural action of a notary that can be made only at the initiative or consent of the person who submitted the document. The proposals on the tendencies of standardisation of the content of the requirements of the validity of notarial acts and the consequences of their violation are formulated. © 2022 V Barankova.

Peculiarities of Prosecutor Participation in Private Cases: Ukrainian Experience [Текст] / V. Bazeliuk, Y. Demyanenko, O. Maslova // Access to Justice in Eastern Europe. - 2022. - Vol. 5 [не зазначено у Web of Science], Iss. 1 (13). - P. 203-211

Аннотация: Background: Maintaining prosecution in criminal cases in court is a specific function of the prosecutor, which is enshrined in both the Constitution of Ukraine and the provisions of the Criminal Procedure Code of Ukraine. This function should meet not only the objectives of criminal justice but also international standards in the field of criminal justice. Criminal proceedings are divided into public and private, depending on the type of socially dangerous act. And depending on the type of accusation, the functions of the prosecutor in the exercise of their powers are different. Thus, in cases of private prosecution, the participation of the victim is crucial, and his/her refusal to prosecute may be grounds for closing the criminal proceedings. This note related to the study of the innovative approach of the Supreme Court's law enforcement practice shows the active role of the prosecutor in considering these categories of criminal cases in court. Methods: We thoroughly analysed the case-law of the Supreme Court of Ukraine, as well as the provisions of the Criminal Procedure Code of Ukraine and other legislative acts. We also generalised and studied the case-law of Ukrainian courts, as well as recommendations of the CoE and the doctrine of the criminal procedural law of Ukraine. Results and Conclusions: The authors drew several conclusions about various forms of private prosecution with their own specifics, which are manifested in the aspects mentioned in this note.
