Аннотация: The article is devoted to the study of the peculiarities of the origin, implementation and functioning of electronic medicine as a modern way of providing medical services in Ukraine and the world, by studying and summarizing the existing array of leading, domestic and foreign scientists and scientists. The diversity of concepts of e-medicine, e-government and e-document management system is analyzed, on the basis of which the author's definition of these concepts is given, based on own understanding of this term, from the standpoint of theoretical and legal analysis and modern challenges of society. The main electronic medical systems of Ukraine are researched and analyzed. Identified the top 10 benefits of implementing electronic medicine. It is concluded that e-medicine will allow in a relatively short time to achieve a significant increase in the efficiency of health care facilities, improve the quality of treatment and diagnosis.

Аннотация: The purpose of this article is to analyze the main medical, legal, and ethical issues and challenges of euthanasia in the digital age. The methods that were used in this study are historical, logical, empirical, as well as comparative legal method for comparison of laws and practices of the EU and post-Soviet countries, including Ukraine. This choice determined by the fact that both groups of countries have common features and relations, while the features of their development affect approaches to regulating such sensitive and potentially open to abuse problems as euthanasia. There is no final legal answer as to whether to legalize, decriminalize or prohibit euthanasia in any of its forms. The features and legal terms of active and passive, voluntary and non-voluntary euthanasia and assisted suicide, especially for psychiatric and minor patients were researched, as well as conflicting arguments, which include individual autonomy, right to choose, the opportunity to get rid of suffering, as well as undermining the practice of palliative care, abuse in cases of vulnerable and dependent patients, moral burden on the doctors. The issue of control of the practice of euthanasia is complicated, given the extent to which it is possible to obtain informed consent, establish criteria for suffering and hopelessness, check the persistence, conviction and validity of requests for euthanasia, especially in the digital era. The potential legislation and judicial practice should provide for strict and effective guarantees, respect for the beliefs of each person and the right not to participate in any contentious practices, the balance of human rights and social values.

Аннотация: The aim is a comparative and legal study of liability in the health care sector in the EU countries and Ukraine. Materials of the research are the EU legislation, laws of the EU countries, Ukraine, statistical information. The authors of the study have used the systematization method, comparative and legal method, analysis and generalization of statistical data. Ensuring an adequate level of health care, providing affordable health care service and medical care to citizens is one of the main tasks of any country, including Ukraine. It is the reason why the state controls this sector through the institution of liability, which does not fully meet the standards of the present day existing in the EU Member States, and therefore needs to be improved. The authors of the article have summarized the experience of the EU countries and Ukraine in regard to liability in the health care sector and have determined some ways to improve Ukrainian legislation. The authors have established the necessity to borrow the experience of certain EU countries in regulating financial (France, Germany, Italy, Poland), civil (Italy), criminal (Germany), administrative liability (Latvia) in the health care sector

Аннотация: The purpose of the research is to analyze specific problems of the realization of the right to protect the health of people who take narcotic drugs or psychotropic substances. To achieve this goal, statistics have been analyzed on the number of people using narcotic drugs or psychotropic substances (including drug-addicted children) placed on medical records and the number of their applications for medical care. It has been found out that people in this category often face a denial of medical care that causes extremely strong physical and mental suffering. The analysis of the understanding of the legal design of the right to health care in the scientific literature, national legislation and international legal documents was made. State institutions and local authorities providing the right to health care of people taking narcotic or psychotropic drugs are singled out. The absence of grounds for restricting the right to protect the health of people who take narcotic or psychotropic drugs who are not registered is justified. In the course of the research, it was found out that people who take narcotic drugs or psychotropic substances are more likely than other patients to need medical assistance and, when requesting the right to health care, face a number of problems that require immediate solution: incomplete provision of quality free medical care; unimplementation of rehabilitation programs for such categories of patients; the lack of the right of children who take narcotic drugs or psychotropic substances to make their own decisions at the age of 14 and apply to public health institutions for the treatment of drug addiction; violations of the continuity of SMT programs and their absence in penal institutions for drug dependent people. It was proposed to introduce a number of changes in the relevant normative legal acts.

Аннотация: The purpose of the study is to analyze specific problems of legal regulation of the procurement of narcotic drugs in Ukraine with the involvement of international specialized organizations. To achieve this goal, statistics have been analyzed concerning the number of people who receive narcotic drugs for the SMT program, the number of their treatment applications, the quantity of drugs purchased for them from the state budget. It is proposed to divide the regulatory legal acts regulating the purchase of narcotic drugs, general and special, and analyze them. The understanding of legal constructions "state procurement" and "public procurement" in scientific literature, national legislation and international legal documents is analyzed. Two groups of subjects of legal relations in the field of procurement of narcotic drugs with the involvement of international specialized organizations have been distinguished out. In the course of the study, a number of problems have been identified that require urgent solutions: insufficient budget financing of drug provision for SMT programs; absence of control over the use of methadone and buprenorphine for SMT programs at the legislative level, as well as the differentiation of the terms "narcotic drugs", "psychotropic substances" and "drugs containing narcotic drugs, psychotropic substances and precursors"; absence of the price of the drug in the selection criteria of international organizations, the lack of economic competition in this field, existence of prepayment for SMT drugs for more than one year, which affects the efficiency of using budgetary funds. It is proposed to make a number of changes to the relevant legal acts.

Аннотация: The purpose of the study was to identify the most optimal sign of a victim of non-violent sexual intercourse with a minor based on the analysis of approaches to the definition of such a sign in the criminal legislation of different countries, as well as the doctrinal provisions of medicine and jurisprudence. In the process of research, such methods of scientific knowledge were used as: a dialectical approach, a comparative law method, general logical methods (analysis, synthesis, induction, deduction, generalization), as well as a dogmatic method. The study of criminal legislation of a number of foreign countries and proposals expressed in criminal law science allowed to identify the main approaches to the definition of the sign of a victim, the presence or absence of which should have criminal law significance for qualifying the act as non-violent sexual intercourse with a minor. Such approaches are: 1) the age approach, according to which a person who has not attained a certain age is recognized as a victim; 2) the medical-physiological approach, which involves reaching a victim of puberty; 3) the mixed approaches: a) cumulative, providing for a person to reach puberty and a certain age; b) alternative, providing for a person to reach puberty or a certain age. The advantages and disadvantages of each approach are analyzed. It was concluded that there is no universal approach to determining the most optimal sign of a victim of non-violent sexual intercourse with a minor, since all the considered approaches have both advantages and disadvantages. A legislator in each particular state should independently determine which approach to use, the age of sexual consent to establish, taking into account the peculiarities of the mentality, traditions, culture, priorities of criminal law protection. Moreover, when choosing an age or one of the mixed approaches, it would be advisable to raise the issue of differentiating the age of sexual consent of boys and girls.

Аннотация: The aim of the study is to analyze individual legal problems of the implementation of the human right to palliative care. To achieve this goal, statistical data on the number of palliative patients, their access to medical services were analyzed. The absence of reasons for limiting the patient's right to receive palliative care, as such a right is a fundamental human right, is substantiated. An analysis of the understanding of the legal construction of "palliative care" in the scientific literature, national and international legal documents was carried out. It was revealed that the terms "hospice care", "end-of-life-care", "respite care" are components of a precise definition - "palliative care". Two groups of subjects that ensure the human right to this type of medical care are identified, their powers are indicated. In the course of the research it was established that palliative patients, more often than other patients, need medical care, including children. This category of patients faces the following problems: incomplete providing of high-quality free medical palliative care; insufficient number of palliative and hospice departments for such patients; palliative care does not meet international standards (logistical support for palliative departments, there are no specialists of a multidisciplinary team); there is no special training for medical personnel working with incurable patients; painkillers (non-narcotic and narcotic) drugs for relieving pain syndrome of such patients are not provided in full volume; there is no cooperation of state authorities in the field of palliative care with public and charitable organizations; palliative patients do not have access to free legal services (pensions, inheritance).

Аннотация: The aim of the study is to identify the features and to determine the relationship between medical and legal (investigative & judicial) practice on detection of the torture effects. It is emphasized that the paper is a continuation of the thesis study on the criminal law problems of torture, which were prepared by the Department of Criminal Law No. 1, Yaroslav Mudryi National Law University, Kharkiv, Ukraine. During the preparation of this article, the following material were used: the publications issued by the centers for rehabilitation of torture victims, specialized medical journals, manuals for physicians, publications by the IASP and the Ukrainian Association for the Study of Pain, explanations by leading specialists of Bogomolets National Medical University, Kyiv, Ukraine, Danylo Halytsky Lviv National Medical University, Lviv, Ukraine, UN reports, OHCHR official explanations, international treaties on prohibition of torture, criminal codes of post-Soviet countries. The empirical basis of the study was provided by 41 final decisions of the court on torture cases of taken since 2014 till 2019. To achieve the aim of the study the analysis and induction methods, as well as statistical and systemic methods were applied. According to the results of the study, it is concluded that only the joint medical and legal detection of severe pain and suffering is the key to the correct solution of the issue of presence or absence of the torture effects. It is noted that neither medical nor law enforcement assessments are self-sufficient and require addition of the mutual contexts. Attention is drawn to the fact that development of the guidelines on the joint medical and legal detection of severe pain and suffering is one of the main tasks for the scientific community. It is proved that the peculiarity of medical practice on detecting the effects of torture consist of is the need to determine both statutory (severe pain and suffering) and "remote" (physical, psychosomatic and mental) effects of this crime. The reasonable arguments are put forward that the specificity of legal (investigative & judicial) practice in detection of severe pain and suffering (as effects of torture) is associated with the need to use a wide range of tools: scientific and legal methods used for determination of severe pain and suffering, medical reports on intensity of pain and suffering, medical documentation on fixation of "remote" effects of torture, reports on forensic, psychological and psychiatric examinations, testimonies and protocols of interrogation of the victim and witnesses, protocols of inspection of crime-committing scene, search, investigative experiment, inspection of material evidence, etc.

Аннотация: The purpose of the study is to analyze certain aspects of the legal regulation of the examination of medicines containing narcotic drugs, psychotropic substances, or precursors in the field of customs. To achieve this goal, we analyzed the number of customs examinations carried out, new narcotic compounds identified for the first time. An analysis of the understanding of the definition "examination" and "customs examination" in the scientific literature. Two directions of the implementation of expert examinations of medicines containing narcotic drugs, psychotropic substances, or precursors in the field of customs were identified, its concept was defined. It is proposed to attribute the investigative examination to the methods of customs control. It was found out that this examination is not a forensic examination, and it can be attributed to a special class of examinations, since it has characteristic features inherent only in it: subject, tasks, objects, and research methods. Seven stages of the implementation of expert examinations of medicinal products containing narcotic drugs, psychotropic substances, or precursors during customs control are highlighted and their procedural order is analyzed.

Аннотация: The article focuses on the fact that 2020 has become a new point in the history of mankind, irrevocably changing the ways of life accepted in society and forcing the entire population of the earth to live in a new way. If a person's health is threatened and / or worried about the thought of a terminal illness, it is difficult to focus on something else. Over the past year, many have experienced this reality for the first time. Effective January 30, 2020, the World Health Organization has declared the coronavirus outbreak a health emergency, causing international concern. The fact that some countries (New Zealand, Australia and South Korea) quickly contained the spread of the virus, but faced new, imported cases, leads to the conclusion that the victory over COVID-19 is possible only worldwide. And if in 2020 masks and social distancing were the methods of fighting the virus, then the main method of 2021 will be the vaccination of the inhabitants of the earth. However, here, too, the key factor is the scale of vaccination, which is one of the main factors in the effectiveness of the fight against any large-scale disease. Here, every person faces a moral and legal question: participation in vaccination is the right of every person as a bearer of human dignity, which implies the impossibility of taking any action on a person without his consent, or the duty of a member of society, which implies the need for vaccination as the question of the survival of the human race as a whole. The article draws attention to the refusal to vaccinate against measles in Ukraine and the consequences of such a choice. The reason for the lack of measles vaccination at the required epidemiological level in Ukraine is not the lack of the necessary vaccines, but the conscious choice of a negative model of behavior by the citizens of the country. The refusal to vaccinate children may be due to a psychological factor caused by the death of a student who was vaccinated against measles on the eve of death. At the same time, the media thirteen years after the event, conducting numerous medical examinations, provides fundamentally contradictory information about the causal relationship between the vaccination of a student against measles and his death. Based on the analysis, it was concluded that vaccination is the most effective way to prevent infection and severe outcomes caused by viruses. Despite this vaccination coverage against viral infections, seasonal influenza in many countries around the world remains low. Even if a vaccine is available to the citizens of a particular country, but educational programs are not carried out on the need and importance of vaccination, the potential for increasing vaccination rates against viruses will continually diminish. The most common explanation for the current upsurge in vaccine uncertainty is that the Internet enables vaccine deniers to reach out to a wide audience by publicizing their beliefs. Some activists only criticize some vaccines. Such a selective stance may indicate a communication strategy used to promote a particular vaccine. Attention should also be paid to the refusal to vaccinate due to the lack of acceptance by the human mind of traditional medicine, not belief in its effectiveness, the use of alternative, alternative medicine in the treatment of diseases. The reasons for not trusting the vaccination process are highlighted. These include: lack of trust in vaccine manufacturers who are economically motivated to make a profit; not trusting medical institutions that provide vaccinations and the conditions in which vaccines are stored; lack of confidence in government agencies involved in the procurement of vaccines, the possibility of corruption in case of abuse of their powers; fear of disease and side effects due to vaccination; distortion by the media of objective data on vaccination.
