Аннотация: This article examines relevant issues of criminal proceedings in the context of the COVID-19 pandemic in Ukraine. In the wake of the COVID-19 pandemic, many governments have focused their efforts on protecting democratic values and ensuring not only the rights and legitimate interests of their people, but also their lives and health. At the same time, the pandemic has affected not only the economies of countries, but also their democratic development and fundamental rights, which have always been a priority of any democratic society. Courts and law enforcement authorities have faced challenges that have been and still are adequately addressed in order to ensure that the rights and legitimate interests of those seeking judicial protection are respected. Each state independently assessed the degree of risks and the extent of permissible restrictions on the rights and freedoms of persons involved in the proceedings, so the present study analyses the different approaches that have been applied. At the same time, documents of the Council of Europe for the Efficiency of Justice (CEPEJ) have gained high importance, because they, among others, have developed tools for Council of Europe member states to address the problems of ensuring access to justice in the pandemic. The generalization and widespread discussion of such experiences is important, because it will be useful for states to further improve existing legislation, taking into account best practices. Based on a study of changes introduced in the Ukrainian legislation to prevent the spread of the coronavirus disease, conclusions are proposed about the nature and extent of the restrictions, as well as the principles on which they should be based and the guarantees to be provided. Recommendations that will contribute to improving the regulation of access to justice in criminal matters in a pandemic are also proposed.

Аннотация: The phenomenon of “raiding,” i.e., the unlawful establishment of control over the property or governing boards of an enterprise, as well as the seizure of its shares, has been reported in all countries of the world for many decades. This phenomenon has the most dangerous forms in the states with the underdeveloped economy and legal system, particularly in Ukraine. The paper aims to determine the areas for counteracting and overcoming corporate raiding in Ukraine and to provide proposals for improving the legislative framework for reliable protection against attacks on the enterprises’ property. The information in the paper, including the geography of raider attacks, indicates a greater vulnerability of enterprises in the most economically developed regions, with extensive transport infrastructure and the prospects for various industries and sectors of the economy development. The state should take some steps to increase the level of enterprises protection against raider attacks. Thus, to improve the quality of preventing and combating corporate raiding, this paper argues the need to develop and adopt the Corporate Property Protection Code of Ukraine. The introduction of the raider attacks register will be an effective measure to warn potential investors and counterparties about the dangers of cooperation with certain companies. The state register should be bilingual (Ukrainian and English) and contain information on the attempts and cases of raider attacks on property and corporate business rights. Аннотация: The article is devoted to the study of the features of administrative and legal regulation in the field of subsoil use. The essence of the category of administrative and legal regulation, as well as the mechanism of administrative and legal regulation in the field of subsoil use, is revealed. The legal basis of state regulation in the field of subsoil use in some foreign countries, in particular, in North America (for example, USA, Canada), European countries (for example, France, Germany) and CIS countries (for example, Kyrgyzstan and the Republic of Kazakhstan) are determined. Given the study of foreign practice of administrative and legal regulation in the field of subsoil use, the experience of the Republic of Kazakhstan has been recognized as positive, in particular, on the normative enshrinement in the Subsoil Code and subsoil use of basic principles in the field of subsoil use. Administrative and legal regulation in the field of subsoil use in Ukraine has been investigated by studying the legislative and organizational components. In the context of the above, it has been found that the regulatory framework for the implementation of state regulation in the field of subsoil use in Ukraine has a large number of regulations (both legal and substatutory). The system of state regulatory bodies in the field of subsoil use is represented by bodies of state power and local self-government, whose powers to use subsoil are determined by the norms of current Ukrainian legislation. The author's definition of the essence of the concept “administrative and legal regulation in the field of subsoil use” is given.

Аннотация: The article investigates the underlying challenges of administrative and legal support of environmental safety under globalization. The current globalization conditions and factors affecting the transition of environmental safety from local to a global level, which is due to globalization processes in the world and a number of global anthropogenic challenges, are analyzed. The emphasis is focused on the impact of globalization on the adoption of international treaties in the field of environmental safety. The importance of administrative and legal environmental safety at the state level for the implementation of the executed international treaties is substantiated. The obsolescence and underperformance of the current state of administrative and legal support of environmental safety in Ukraine is grounded, the necessity for its optimization is proved, the weaknesses are highlighted and the need for introducing a number of improvement directions, including propaganda of a careful attitude to the environment, is substantiated; regulatory support for the effective distribution of functions and viable mechanism for management of central and local executive authorities, local government institutions on the formation and implementation of state policy components in the field of climate change in accordance with their competence; regulatory actions of joint events and cooperation of domestic government bodies in the area of environmental safety with similar bodies of neighboring countries; implementation ensuring of the provisions of the Association Agreement between Ukraine and the European Union, the European Atomic Energy Community and their member states related to climate change; ensuring the fulfillment of Ukraine’s obligations regarding reporting on international agreements in the field of climate change, etc.

Аннотация: The article deals with a complex study of the peculiarities of administrative and legal support for functioning of the agro-industrial complex of Ukraine. In particular, according to the results of the analysis of doctrinal sources in the context of the investigated problems, the author offers definition of the concept of "administrative and legal support for functioning of the agro-industrial complex of Ukraine". The legal documents regulating peculiarities of the agricultural policy of the state within the framework of the European integration processes in general, including strategic directions and certain types of legal relations in the agro-industrial sphere, have been determined. Attention is paid to explaining the content of certain provisions of the Strategy for the Development of the Agrarian Sector of the Economy for the period up to 2020 and the Concept of the State Target Program for the Development of the Agricultural Sector for the Period until 2022. The basic principles according to which administrative and legal support of functioning of the agro-industrial complex is carried out are highlighted. Emphasis is placed on the need to resolve the problematic issues of regulating legal relations in the agro-industrial sphere.

Аннотация: The relevance of the scientific article is due to the necessity to search for models of legal regulation of public relations that arise in public administration with a private person, which would meet the European standards of administrative procedure. The purpose of the article is to study the European experience of administrative and procedural ordering of public relations in order to form ideas of implementation in the legal field of Ukraine. The leading methods of research were the analysis of European practices of administrative procedure, modelling of legal structures acceptable to Ukraine. As a result of the research, proposals for legislative initiatives on the procedure for adopting administrative acts were formed. Research can be helpful to law-abiding lawyers and law enforcement officials, law school educators, and public administration officials and officials seeking to apply good administration standards and practices to individual management matters.

Аннотация: The article deals with the possible directions of the administrative-territorial reform in Ukraine in present conditions. The main objective of the study is to develop practical recommendations for carrying out an administrative-territorial reform in Ukraine based on the experience of Western European countries. In this paper the authors applied the method of legal modeling, the prognostic method, which enabled to give scientifically based forecasts on the prospects of the administrative-territorial reform in Ukraine and the implementation of efficient administrative and territorial management. Scientific novelty of the paper includes outlining the essence of the administrative and territorial reform in modern Ukraine, complex and hierarchical national conditions and reform factors. The article also states the necessity of broad decentralization and deconcentration of power, which would enable to stabilize the social situation in the country and to promote the democracy. The undertaken analysis allowed identifying a new form of government, which cannot be considered either unitary or federal. This form of government can be found in Western European countries and is characterized by the indivisibility of the state, which acknowledges local autonomies and implies the most extensive administrative decentralization. The authors propose to improve Ukraine’s control mechanisms according to this form of state structure and taking into account the status of the regions. The article makes a distinction between the concepts ‘the territorial structure of the state’ and ‘the administrative-territorial structure of the state’, the original author’s definitions provided. Practical conclusions and recommendations on carrying out the administrative-territorial reform in Ukraine and proposals for optimization of the control mechanism can be used by Western European countries facing administrative and territorial challenges.

Аннотация: This work deals with the evolution of adversarial princtple in civil process under the conditions of post-socialist regression and post-reform civil justice as well as the introduction of the principles of case management and cooperation between the court and the parties in the process. In particular, it analyses the main provisions of such new guarantees of realization of the right to a fair trial, which were introduced in the CPC of Ukraine in 2017-2018 as a court's right to prevent abuse of procedural rights, as well as the exchange of competitive documents between the parties. The authors argue that effective protection of the rights today is to be based on the adversarial principles that shall be supplemented by the security of the balance of rights of the parties and the authority of the court on the examination of civil matters.

Аннотация: INTRODUCTION: Chosen European foreign policy vector for Ukraine establishes its obligation to enforce the process of adaptation of the EU law regulations in the internal legal policy. The approximation of Ukrainian law to the European Union (EU) "acquis communautaire" is not only the instrument for deepening our economic cooperation with the European Union, but also the important measure to enhance further development of Ukraine in general. National legislation, which regulate advertising and promotion of medical devices (MD), is not an exception. Some key points on legal regulation of abovementioned sphere is a base of this study. MATERIALS AND METHODS: Ukrainian legislation, European Union`s Law Acts, EU's member-states law, WHO Acts and Recommendations, European Medical Technology Industry Association (EUCOMED) Acts. Article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. DISCUSSION: In accordance with Ukrainian legislation, there is no special law that concerns advertising on MD in Ukraine, this sphere is regulated by general law that named ≪About advertisement≫, but it doesn't take into account even main characteristics of such a special object as medical devices (MD). Moreover, the law ≪About advertisement≫ contain discrepancies in terms that are used, these contradictions, in our opinion, must be eliminated by appropriate law reforms. CONCLUSION: The advertising and promotion of MD in EU is regulated by a combination of EU and national legislation of EU Member States, national advertising and promotion of MD are not harmonized with the EU MDD for now, resulting in a fragmented legal landscape that differs from one EU Member State to the other. Practice of adopting different codes and guides that regulate advertising, including advertising of MD, is widespread in EU and EU Member States and thus must be used in Ukraine with appropriate reformation of national law.

Аннотация: The relevance of the study of alimony obligations of family members in the family law of Ukraine is conditioned by both the latest approaches of the legislator to the regulation of alimony relations, and the problems of law enforcement practice in this area. The purpose of the study is to determine the features of alimony obligations of family members in the family law of Ukraine, to identify problems of legal regulation and enforcement of these obligations and to develop recommendations for their elimination. Methodologically, the study of alimony obligations of family members is divided into separate structural parts, which cover the general features of these obligations in the family law of Ukraine and the features of their individual types. The methodological basis for the study of alimony obligations of family members in the family law of Ukraine is developed at the philosophical, general scientific and special scientific levels. The study proves that the alimony obligations of family members are in essence family law monetary obligations that arise on the grounds specified by law or contract, are long-term and personal. It is proposed that one of the spouses be considered in need of financial aid if their monthly income (salary, pension, income from the use of their property, other income) is less than the minimum wage established by law. It is proposed to apply similar provisions to identify parents in need of financial aid in alimony obligations for the maintenance of disabled parents by adult children. It is argued that the change of the minimum amount of alimony to be collected from the alimony payer per child is not a basis for applying Article 192 of the Civil Code of Ukraine, but is a basis for changing the minimum amount of alimony specified in the writ of execution and alimony recovery, and is taken into account when determining the amount of alimony or alimony arrears. Other changes to the Family Code of Ukraine have been proposed to improve the procedure for collecting alimony for family members. The analysis of theoretical provisions of alimony obligations of family members and practical problems of law enforcement in this area and the development of proposals to improve family law is important for further research of family law obligations, will contribute to the development of an effective mechanism for exercising and remedy of the rights of parties in family legal relations and the establishment of the unity of judicial practice. © 2020, National Academy of Legal Sciences of Ukraine. Аннотация: The purpose of the article is to substantiate an alternative methodology for assessing the competitiveness of young people in the labor market, based on the categories of transit from training to decent employment in the context of transformational change. The article explores the School-to- Work Transition Survey (SWTS), which provides an opportunity to analyze the peculiarities of young people's transit to the labor market. The study was conducted within the framework of the "Work4Youth" project, which aimed to identify ways to obtain information concerning the labor market, namely its youth segment. The main purpose of the SWTS was to gather detailed information on the issues, attitudes and conditions in which young people aged 15-29 was entering and securing their jobs in the labor market. The competitiveness of young people in the labor market has been evaluated and the regions have been investigated according to the characteristics of the workplaces, where the state of completion of the transition from school to employment by the young person have been determined. In addition, clusters that are close in characteristics to the group of regions were distinguished.

Аннотация: Purpose: To explore and to analyze the global experience in anticorruption compliance management and to highlight exceptional importance of the anticorruption compliance system to be implemented in Ukraine for fighting corruption; to determine necessary steps to involve workers to the local anticorruption program; to offer specific recommendations for reforming the existing anticorruption compliance system in Ukraine. Methodology: The study was conducted with general scientific (formalization, abstraction, analysis, and synthesis) and specific scientific (formal and legal, comparative and legal, and legal forecasting) cognitive methods applied. Result: Upon thorough investigation of the issue, the author concluded that the anticorruption compliance system should be approved upon discussion with public officials, offered a new form of this discussion to be effective and to function in fighting against corruption offenses in domestic practice, and noticed that compliance management should involve professional standards, powers distribution regulation, and ethics rules determination. Applications: The study is known to be innovative in Ukraine and the results might be interesting and useful for domestic legislators and public administration subjects at the building of the highly effective anticorruption compliance system. Novelty/Originality: The study is believed to cast some light on the gaps in this issue which needed to be clarified since previous poor efforts seem still contradictory. The subject of the study is considered in Ukraine for the first time. The results of the study are obtained based on the independent investigation of the current anticorruption program in the public service and might be promising for effective application.

Аннотация: In this article the author analyzes theoretical approaches which were formulated due to the appearance of complex objects of Intellectual Property Law. The attention is concentrated on the analysis of concepts that investigate the legal nature of a television format. The author considers that it is necessary to differentiate a positive approach which recognizes that a format is an object of Intellectual Property Law and negative approach which denies the possibility of television formats protection. Through the method of comparison between the scientific doctrine and judicial practice in the countries of the Romano-Germanic and Anglo-Saxon legal systems, the author classifies concepts to be developed by theoretic community. Thus, negative approach of the Romano-Germanic Legal system countries is confirmed by normative legal acts which relate to the ideas, methods and concepts. Representatives of the Anglo-Saxon Legal system make it impossible to protect a format within the doctrines: "scene a fair", "idea\expression", "merger", etc. The author prefers the positive approach which is divided into the following concepts of the analysis of a format: as a dramatic work (according to Copyright Law), as a hybrid object, as a synthetic object, as a compilation, as a complex object of IP Law. The author gives the definition to a television format, explains its legal nature, and views a format as one related to the concept of complex Intellectual Property Law objects. She analyzes judicial practice which has developed in Ukraine and abroad. Taking into consideration the fact that relations which are connected with the distribution of a format have not only national, but also global character, it is important to unify the given approaches and to use them in legislature. It is relevant to enhance and standardize the legislation in the television field which would contribute to the development of contractual relations between the countries.

Special legal regimes serve as the legal basis for restricting human and civil rights and freedoms; therefore, the relevance of the study of the concept, types, and main features of special legal regimes is beyond doubt. The authors of the study consider the relationship between the categories of special legal regime of a state of emergency and martial law, and describe the main grounds for their imposition. The authors noted a need for a clear, consistent legal regulation of the model of behaviour aimed at overcoming and eliminating negative consequences of an emergency and military nature. Attention is focused on the fact that in Ukraine, the regulation of public relations arising in connection with emergencies and military situations has become particularly important after the emergence of a military conflict on the territory of Ukraine and the spread of the COVID-19 virus. The study provides the author’s vision of the categories “legal regimes” and “special legal regimes”. it is proposed to interpret the legal regimes as the regulatory procedure, which is expressed in a set of legal means that describe a special combination of interacting permits, prohibitions, and obligations, while implementing a special focus of regulation. The latter should be interpreted as a form of public administration that makes provision for the restriction of the legal personality of individuals and legal entities, introduced as a temporary measure provided by means of administrative and legal nature, and aimed at ensuring the security of the individual, society, and the state. The study provides the classification of special legal regimes and contains proposals to distinguish them according to the content and basis of occurrence as follows: state of emergency, martial law, state of siege, state of war, state of public danger, state of tension, state of defence, state of threat, state of readiness, state of vigilance.

Аннотация: The main objectives of the research were such: to define the concept of cold chain as an object of legal regulation; to find out the content and features of the EU legislation on the safety and quality of meat and meat products during cold chain and its use in Ukraine; to characterize the legal bases of the current legislation of Ukraine on ensuring the safety and quality of meat and meat products during cold chain, to formulate proposals and recommendations aimed at improving the national legislation of Ukraine by approximating it to the EU legislation, which sets requirements for the safety and quality of meat and meat products throughout cold chain. To achieve the abovementioned objectives, the following methods were used: comparative legal, analytical, systemic, dialectical, generalizing, specific-search, structural-functional, semantic, methods of deduction and induction, etc. The content and features of the legal regulation of the safety and quality of meat and meat products in the current legislation of the European Union and Ukraine have been clarified. For the first time, the definition of the term 'cold chain' has been proposed by reference to it in author's editorial, which should influence its clearer scientific and practical understanding. It is determined that the temperature regimes of cold processing, storage and transportation of meat and meat products in Ukraine are regulated by a large number of legal acts, in particular: national standards of Ukraine (DSTU), technical regulations, technological instructions, rules of transportation, etc. It is found that national legal acts do not provide a systematic understanding of the particularities of cold chain legal regulation in the meat processing industry in order to ensure the safety and quality of meat and meat products. As a result of departmental inconsistency, the existing storage temperature parameters for the same product type in different legal acts differ from each other, which does not allow to determine the actual storage periods at different stages of the cold chain. In addition, current legal acts in Ukraine do not provide for constant monitoring of the temperature of cold-processed meat and meat products throughout all cold chain units and the hygienic condition of refrigerators throughout the shelf life. As a result, the cold chain is very difficult to be controlled and requires a large number of factors to be taken into account in order to bring safe and high-quality meat and meat products to the end consumer. According to the results of the research, proposals and recommendations are formulated to improve the national legislation of Ukraine governing the cold chain in the meat processing industry

Аннотация: OBJECTIVE: Introduction: The article reviews issues of legal regulation of patients' rights in Ukraine, analyzes the patient-doctor relationship, proposes the legislative approval of new patients' rights and the need of adoption of a single legislation of these rights. The aim of this work is to conduct a detailed study of legal regulation of patients' rights in Ukraine and the EU countries, to identify the areas for further improvement of the legislative regulation of patients 'rights in Ukraine, ways of harmonization of national legislation with international standards, which regulate patients' rights. PATIENTS AND METHODS: Materials and methods: we analyzed national and international regulation of patients' rights, case law of the European Court of Human Rights (ECHR), national court judgments. We also used historical, comparative-legal methods, and instruments of analytical research and empirical study. CONCLUSION: Conclusions: In Ukrainian law many patient rights are not defined, but are applied in medical practice, therefore, they require legal regulation. In particular, they include: the right to convene a consilium; the right to refuse medical interference; the right to terminate treatment, etc. In addition, with the development of medicine, scientific and technological progress, there are some issues, which arise and need to be legally defined, among them: the rights and responsibilities of the patient during transplantation, artificial insemination, medical research, etc. When making health policy, the concept of trust and respect for patients, their autonomy or constructive partnership with them should be taken into account. Doctors need to take a more active part in discussions and debates with patients. Independence of patients in decision making processes must be provided by law, and the rights and obligations of all parties must be clearly reflected in the relevant documents.

Аннотация: Research background:The paper accounts for the problem of assessing the factors of the formation of Ukraine’s technological competitiveness in the face of new challenges for the state in the process of developing relations with the EU. Purpose of the article: The aim of the report is to assess the level of technological competitiveness of the Ukrainian economy and determine the most important factors for its further development in the conditions of association with the EU. Methods: The article presents the scheme of research of technological competitiveness of Ukraine on the basis of qualitative and economic-statistical analysis, analysis of comparative advantages, cluster and correlation-regression analysis. Findings & Value added: The analysis of world rankings has shown that the technological competitiveness of Ukraine determines comparative factor advantages in coverage of higher education, availability of scientific staff, and quality of research institutions, but low state support, lack of stability, and problems in institutional development hamper the country’s innovative potential. The identification of competitive advantages in trade in high-tech products demonstrates that Ukraine remains an importer of high-tech products; relatively small comparative competitive advantages among the high-tech products of Ukraine has only products of the aerospace industry. Сluster analysis showed that Ukraine is in the same cluster as Poland. Bulgaria and Romania, which have not yet fully consistent with the level of technological competitiveness of EU leaders; among the strengths of Ukraine are the development of human resources and labour effect. The correlation analysis between the components of the Global Innovation Index and the factors of increasing Ukraine’s competitiveness indicates a moderate link between the development of clusters, the ratio of expenditures on R&D to GDP, and the export of ICT services. In order to increase the level of technological competitiveness of Ukraine: to increase both foreign investments and state financing; improvement of regulatory acts, reduction of corruption, institutional improvement; support of technologies through regional cluster programs or “smart specialisation”; integration into the European Research Area.

Аннотация: Purpose – the purpose of article should assess the main factors affecting the development of trade in high-tech products of Ukraine in the context of association with the EU and the spread of a new industrial revolution. Research methodology – the scheme of research of trade of high-tech products of Ukraine from the EU on the basis of qualitative and quantitative economic-statistical analysis, analysis of comparative advantages and correlation-regression analysis. Findings – the results of the analysis show that the main factors determining the low presence of Ukraine in the world market of high-tech products are the outdated structure of production, a low level of R&D costs, and a decrease in the innovative activity of Ukrainian enterprises. The article presents the author’s recommendations on improving the effectiveness of foreign trade in high-tech products of Ukraine in the EU market. Research limitations – the absence of a state development strategy for the production of hightech products does not make it possible to accurately determine indicators of scientific research of the potential of Ukraine. Practical implications – correlation-regression analysis results can be used in the private and state sectors of the economy of Ukraine. Originality/Value – the original combination of schemes and methods allowed us to identify new critical places for export development in the context of the association of Ukraine with the EU.
