Аннотация: В данном проекте предложены пути решения вопроса о внедрении на нормативном уровне проступка как отдельной правовой категории. Приведены соответствующие обо- снования целесообразности его внедрения, описана цель внедрения института проступка в правовую систему Украины, указано несколько направлений, по которым возможно реше- ние поставленных задач. Сделан вывод о том, что наиболее целесообразным представляется принятие отдельного нормативного акта – Закона (Кодекса) Украины о проступках. Разра- ботка данного нормативного акта создаст основания для формирования самостоятельного вида юридической ответственности, отличающегося как от административной, так и от уголовной. Предложены варианты наименований и общая структура нормативного акта, о котором идет речь. Описаны ожидаемые результаты внедрения концепции в Украине. Раскрыты основные концептуальные положения норм материального и процессуального права о проступке. Среди основных концептуальных положений норм материального права приведены задачи Закона (Кодекса) о проступках; основание ответственности за проступок; законодательство о проступках; действие Закона (Кодекса) о проступках во времени и пространстве; понятие проступка; стадии проступка; субъект проступка; субъективная сторона проступка; соучастие в проступке; множественность проступков; обстоятельства, исключающие ответственность за проступки; освобождение от ответственности за проступок и от применения судебного взыскания за него; судебные взыскания за проступки и их применение; особенности ответственности несовершеннолетних за проступки; критерии декриминализации, которые могут быть использованы для формирования Особенной части Закона (Кодекса) о проступках. Среди основных концептуальных положений норм процессуального права указаны особенности производства по делам о проступках.
This project proposes ways to address the issue of the implementation of the normative level offense as a separate legal category. The corresponding study the feasibility of its implementation, described the purpose of introducing the institution of misconduct in the legal system of Ukraine, there are multiple ways in which it may be problem solving. It is concluded that the most appropriate seems to adopt a specific regulation – Law (Code) of Ukraine on prostupkah. Razrabotka this regulation will create the basis for the formation of an independent type of legal liability, which differs from both the administrative and criminal. The variants of the names and the general structure of a normative act in question. Describes the expected results of the implementation of the concept in Ukraine. Reveals the basic conceptual provisions of substantive and procedural rights of the offense. Among the major conceptual provisions of substantive law are given the task of the Act (the Code) of misconduct; the basis of liability for wrongdoing; legislation of misconduct Act (the Code) of misconduct in space and time; the concept of the offense; stage of a misdemeanor; the subject of the offense; subjective aspect of the offense; complicity in the violation; multiplicity of misconduct; circumstances precluding responsibility for misconduct; exemption from liability for wrongdoing and from primeneniyasudebnogo penalty for him; legal penalties for offenses and their application; particular responsibility for juvenile offenses; decriminalization criteria that can be used to form the Special Part of the Act (the Code) of prostupkah. Sredi basic conceptual provisions of procedural rules specified features of cases of misconduct.

Аннотация: The article deals with the possible directions of the administrative-territorial reform in Ukraine in present conditions. The main objective of the study is to develop practical recommendations for carrying out an administrative-territorial reform in Ukraine based on the experience of Western European countries. In this paper the authors applied the method of legal modeling, the prognostic method, which enabled to give scientifically based forecasts on the prospects of the administrative-territorial reform in Ukraine and the implementation of efficient administrative and territorial management. Scientific novelty of the paper includes outlining the essence of the administrative and territorial reform in modern Ukraine, complex and hierarchical national conditions and reform factors. The article also states the necessity of broad decentralization and deconcentration of power, which would enable to stabilize the social situation in the country and to promote the democracy. The undertaken analysis allowed identifying a new form of government, which cannot be considered either unitary or federal. This form of government can be found in Western European countries and is characterized by the indivisibility of the state, which acknowledges local autonomies and implies the most extensive administrative decentralization. The authors propose to improve Ukraine’s control mechanisms according to this form of state structure and taking into account the status of the regions. The article makes a distinction between the concepts ‘the territorial structure of the state’ and ‘the administrative-territorial structure of the state’, the original author’s definitions provided. Practical conclusions and recommendations on carrying out the administrative-territorial reform in Ukraine and proposals for optimization of the control mechanism can be used by Western European countries facing administrative and territorial challenges.

Аннотация: Abstract Background/Objectives: This articles deals with research of international expertise in administrative legal support of national security aiming at its complex and comprehensive analysis. Methods: Methods of restructuring ideas and theories, system and structural and functional, formal legal analysis and forecasting were applied throughout this research to the very phenomena of national security and activity of subjects shaping and maintaining such phenomenon, based on the methodological position. Their application logics relies on an attempt to integrate methodological approaches of various disciplines into the research of national security, and support forms and methods. Findings: This article concludes that the national security is a complex phenomenon and thus a system of interacting components. This system comprises a certain set of concepts and provisions, social and political and legal institutions and establishments, certain means, methods and forms that prevent or ensure an adequate response to any arising dangers and threats. Comparative legal analysis of international expertise in Western European countries and the USA allowed determining new lines of improvement of the administrative legal regulation in the following areas: counteraction of extremist activity; counteraction of illegal migration; combating human trafficking. This article suggests dividing national security into the following types: foreign policy threats to national security, public security, economic security, foreign economic security, military security, information security, environmental and demographic security. National security doctrine in any country is the original conceptual model of stating and resolving a common integrated set of standardized tasks and problems associated with providing protection of national interests. Applications/Improvements: Academic novelty of this research is in an attempt of fundamental theoretical analysis of the phenomenon of 'national security' as a governmental legal phenomenon with strengthening perspectives in Ukraine, establishing equilibrium of public and personal interests, providing sound protection of individual rights and legal interests.

Аннотация: Regulatory acts of the European Union play a significant role in regulating land relations in the EU member states. Thus, according to the draft Treaty on the Introduction of the Constitution for Europe (2003/C169/01), adopted by the consensus of the European Convention on June 13 and July 10, 2003, the Council of Ministers unanimously adopts European laws, European framework laws, implements land use measures, excluding the organization of waste collection and disposal (Sulyagina, 2012; Kokanovska, 2016). According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States of June 14, 1994, Ukraine has undertaken to take measures to gradually bring national legislation into line with the legislation of the European Community, that is, to adapt national legislation to the EU legislation requirements. Among the spheres of adaptation there is, in particular, the institution of legal responsibility as an important way of protecting the environment, including lands, as follows from the provisions of the Law of Ukraine "On the State Program for Adaptation of Ukrainian Legislation to the Legislation of the European Union" of March 18, 2004. The implementation of the course on the European integration necessitates the adaptation of the national land legislation to the EU requirements. According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States (Agreement on partnership and cooperation between Ukraine and the European Communities…, 1994) an important condition for strengthening economic ties between Ukraine and the Community is the convergence of the existing and future legislation of Ukraine with Community legislation. Ukraine will take measures to ensure the gradual harmonization of legislation with the legislation of the Community. Adaptation of land legislation is the process of bringing the laws of Ukraine and other regulatory legal acts that are sources of land law of Ukraine, as well as the step-by-step adoption and implementation of Ukrainian regulations, developed in accordance with EU legislation, conformably with the acquis communautaire. Acquis communautaire (acquis) the legal system of the European Union, which includes, but is not limited to, acts of European Union legislation adopted within the framework of the European Community, the Common Foreign and Security Policy and the Co-operation in the Field of Justice and Home Affairs. At the same time, it is necessary to take into account that in the EU operates the principle of the EU rule of law over national law, which found its confirmation in the decisions of the Court of Justice of the EU. Thus, in the judgments of the Court of Justice of the European Communities in case 26/62, Algemene Transporten Expeditie Ondernemingvan Gend v. Nederlandse Administratieder Belastingen, in case 6/64, Flaminio Costa v. ENEL and in case Variola v. S. P. Administatione Italianadelle Finanze there is entrenched: • The principle of priority of EU law over the national law of member states (Supremacy of European law principle). • The principle of direct application of EU law (the principle of direct application of EU law). The scale of the influence of EU law is evidenced by the fact that approximately 80% of laws and other legal acts in the economic and social spheres that in the past belonged to the competence of states are produced by Union bodies and are unified for all its members (Magnovsky, 2005). The purpose of adapting the land legislation of Ukraine to the EU legislation is to achieve compliance with the legal system of the country acquis communautaire, taking into account the criteria set by the European Union to the states that intend to join it. The development of Ukrainian legislation in the direction of its approximation to the legislation of the European Union is a priority component of the process of Ukraine's integration to the European Union, which in turn is a priority direction of Ukrainian foreign policy.

Аннотация: Abstract INTRODUCTION: In Ukraine differentiated VAT rates is a matter of debate. Today the Cabinet approved a list of medical products that has been changed three times resulting in changed VAT rates for specific products. European Union provides another method of regulation of VAT rates on medical devices. The abovementioned demonstrates the relevance of this study. MATERIAL AND METHODS: Comparative analysis of Ukrainian and European Union legislation based on dialectical, comparative, analytic, synthetic and comprehensive research methods were used in this article. DISCUSSION: In Ukraine general rate of VAT for all business activities is 20 %. But for medical devices, Tax Code of Ukraine provides special rules. VAT rate of 7% for transactions supplies into Ukraine and imported into the customs territory of Ukraine of medical products on the list approved by the Cabinet. The list generated by the medical product name and nomenclature code that does not correspond to European experience and Council Directive 2006/112/EC. CONCLUSION: In our opinion, reduced VAT rates should to be established for all medical devices that are in a stream of commerce, have all necessary documents, that proved their quality and safety and fall under definition of medical devices.

Аннотация: Organized criminal groups continue to understate profits and export finished goods from Ukraine without paying taxes. Ukraine’s environment of economic transformation has provided organized criminal groups with ample opportunity to drain Ukraine’s resources. Organized crime groups took advantage of Ukraine’s period of economic reform to develop methods to drain Ukrainian currency and hide capital resources abroad. The preservation and expansion of Ukraine’s capital is an economic necessity. The methods used can be instructive in considering the detection and investigation tactics to combat them. Criminal penetration is endemic to Ukraine’s organizational, administrative, legal, and regulatory systems. In order to have successful investigation and prosecutions, a thorough understanding is required of the means by which these crimes are committed. The development of international business relations between Ukrainian and foreign businesses, as well as the development of international networks of Ukrainian emigrants, has provided another system by which Ukrainian businesses can conceal currency abroad. © 2001, 2004 by Taylor & Francis. With the changing global security situation, increase in external threats or emergence of new ones (cyberattacks, non-conventional warfare models, etc.), countries must feel concern regarding consolidation of their security. In this regard, both the Republic of Lithuania and Ukraine are taking measures to enhance and expand their military forces. One of the means to fortify military forces is attracting citizens to serve in the civilian national defence service. Authors of the article employ a comparative aspect to analyse the need for statutory servants serving in the civilian national defence service, as well as reveal the number and type of professionals to be required by the national defence system and explore benefits provided by such statutory servants as well as their purpose in the army. Additionally, in the article authors reveal administrational-legal status of civilian national defence services in both the Republic of Lithuania and Ukraine, its place in the system of other militarised or civil public administration institutions. Comparative aspect is also used to analyse administrative legal status of statutory servants of civilian national defence service, peculiarities of admission of statutory servants to the national defence system and their service therein, as well as possibilities for motivation and stimulation of citizens to exercise service in the civilian national defence service. Therefore, the article aims to answer the question of what could motivate citizens to carry out service in the civilian national defence service, what incentives (needs, interests, values, stimulus, realisation of importance of certain matters, remuneration, etc.) would result in motivation (attitude and interest in) to serve in the Lithuanian Armed Forces and to participate in international operations.

Аннотация: A discipline of public servants within an organization requires four characteristics: a number of disciplinary offences, proportionate punishments clearly linked to the disciplinary offences, oversight and appeals from disciplinary decisions, and independence from politicians. This paper examines public sector legislation in Ukraine, Poland, the Czech Republic, and Bulgaria to show the peculiarities of legal regulation of each of these criteria. We argue – a claim that creation of arbitrary powers to punish or dismiss staff is unjust if the legislation does not fully inform staff of what a breach of discipline constitutes, if it does not guarantee proportionate punishments to offences, and/or allow the disciplinary process to be used as a tool to coerce staff to perform in a politicized or otherwise unethical manner. In the article all four criteria are disclosed by comparative analysis with certain EU members (Poland, Bulgaria, Czech Republic). Intermediate and key conclusion about the peculiarities of bringing civil servants to disciplinary liability in Ukraine, Poland, Bulgaria and the Czech Republic and some recommendations are made on the basis of the comparative study.

Аннотация: INTRODUCTION: Some countries have already tried and tested mechanisms of regulating distance sales as form of distribution of medicines that have been used more or less effectively for a fairly long time. Herewith, so far, the approach of the competent authorities of some countries including Ukraine can be called prevailing in quantitative terms under which the official prohibition on distance sales of medicines is set. AIM: The aim of this study is a detailed examination of the nature of the prohibition of the medicines distance selling in Ukraine, namely the an analysis of advantages and disadvantages of this form of distribution of medicines and identification of appropriate ways for gradual repeal of the prohibition in terms of regulatory reform in Ukraine in the sphere of circulation of medicines due to the process of adaptation of statutory regulation in this area to the EU legislation. MATERIAL AND METHODS: This study is based on Ukrainian regulation acts, Council Directives 97/7/EC, 2000/31/EC, 2001/83/EC, scientific works and opinions of progressiveminded people in this sphere. Such methods as dialectical, comparative, analytic, synthetic and comprehensive have been used in the article. CONCLUSION: Reception of the described experience of regulation in EU will allow a further review of the principles of regulation in Ukraine in the sphere of medicines with a shift in the main emphasis in the direction of ensuring adequate consumer rights in this area and preventing the risks of patients' and public health.

Аннотация: INTRODUCTION: The need for effective legal regulation of production and sale of medical products in Ukraine due to its social effect is obvious and requires a high level of clarity. The experience of more advanced countries in this area, given the way chosen by Ukraine to harmonize our laws with EU legislation, is certainly could be a useful source of information. The urgency of issues need further intensification of national legal reforms. Some key points on concept of legal regulation of abovementioned sphere is a base of this study. MATERIAL AND METHODS: Legislation of Ukraine, European Union, United States of America, Guidelines, developed by European Commission & Food and Drug Administration's (FDA), recommendations represented by international voluntary group and scientific works. This article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. DISCUSSION: This study provide a possibility to state that main difference of regulatory systems in EU and US is that the legal framework of the EU is more flexible. This flexibility is grounded on main principle that only basic quality requirements for medical devices is defined by legislative acts however more detailed requirements are defined in standards, technical regulations, specifications, which are discretionary in nature. Contractors are free to choose any technical solution that provides compliance with the essential requirements, they can choose among different conformity assessment procedures and between accredited conformity assessment bodies to which they want to apply. The contractors themselves is interested to pass the conformity assessment procedure and have the right to put a conformity mark on their medical device because it will give them a real competitive advantage. In contrast, US State regulatory system provides strict control over business entities and law act establishes the quality requirements of medical products. The only body that can authorize the introduction of medical products and perform post-market monitoring is Food and Drug Administration (FDA), which has almost unlimited competence in this sphere. CONCLUSION: Taking into account further deepening of the European integration process of Ukraine, establishing of the regulatory system as much similar to that of the EU as possible is a main goal of legal reforms in abovementioned sphere. On the one hand, such system allows to implement effective control of contractors in the sphere of production and sale of medical products and provide safety of medical devices that are introduced, on the other hand, it does not afflict contractors with excessive and total control, allowing them to choose behavior that is most acceptable, understandable and user-specific. However, US's experience also has some positive characteristics, which could be taken into account. Therefore, such complex symbiosis of approaches from our point of view will balance controversial interest of manufacturers, sellers and consumers of medical devices.

Аннотация: INTRODUCTION: the current state of patenting legal regulation of medical treatment in Ukraine and in the world is analyzed, the directions for the further development are determined. The author defines "non-industrial medical" and socio-ethical theories in the field of medical treatment patent protection. The existence of exclusively formal "monopoly" of the patent owner is noted, as well as the inapplicability of the majority of the patented achievements in this field in Ukraine. AIM: the purpose of this article is to investigate the current state of patenting legal regulation of medical treatment in Ukraine and in the world, to analyze the limitation of patent protection basic conception in the medical field and to determine the tendencies and perspectives of the legal protection mechanism of further development in this field in Ukraine, considering the European and world regulation experience. MATERIAL AND METHODS: this study is based on Ukrainian regulation acts, The European Patent Convention, The Code of Laws of the United States of America, judgments, scientific works and opinions of progressive-minded people in this sphere. Such methods as dialectical, comparative, analytic, synthetic and comprehensive are used in the article. CONCLUSION: The experience analysis of the medical treatment patenting regulation in EU and in other countries of the word made it possible to substantiate the tendencies of development the patenting legal regulation of treatment methods mechanism, based on the needs of creation conditions for the availability of the recent treatment developments and technics for citizens, without increasing the cost of such treatment through license fees.

Аннотация: INTRODUCTION: Chosen European foreign policy vector for Ukraine establishes its obligation to enforce the process of adaptation of the EU law regulations in the internal legal policy. The approximation of Ukrainian law to the European Union (EU) "acquis communautaire" is not only the instrument for deepening our economic cooperation with the European Union, but also the important measure to enhance further development of Ukraine in general. National legislation, which regulate advertising and promotion of medical devices (MD), is not an exception. Some key points on legal regulation of abovementioned sphere is a base of this study. MATERIALS AND METHODS: Ukrainian legislation, European Union`s Law Acts, EU's member-states law, WHO Acts and Recommendations, European Medical Technology Industry Association (EUCOMED) Acts. Article is based on dialectical, comparative, analytic, synthetic and comprehensive research methods. DISCUSSION: In accordance with Ukrainian legislation, there is no special law that concerns advertising on MD in Ukraine, this sphere is regulated by general law that named ≪About advertisement≫, but it doesn't take into account even main characteristics of such a special object as medical devices (MD). Moreover, the law ≪About advertisement≫ contain discrepancies in terms that are used, these contradictions, in our opinion, must be eliminated by appropriate law reforms. CONCLUSION: The advertising and promotion of MD in EU is regulated by a combination of EU and national legislation of EU Member States, national advertising and promotion of MD are not harmonized with the EU MDD for now, resulting in a fragmented legal landscape that differs from one EU Member State to the other. Practice of adopting different codes and guides that regulate advertising, including advertising of MD, is widespread in EU and EU Member States and thus must be used in Ukraine with appropriate reformation of national law.

Аннотация: The article examines the influence of the external environment on the logistics activities of retail trade enterprises of Ukraine. External factors of logistics activities of retail trade enterprises, substantiated indexes of their evaluation were determined. The volume and composition of consumer demand, the development of the market of logistics services, efficiency of logistics activities and the state of competition in the retail market were analysed. Diagnosed the decrease in the efficiency of logistics activities of retail trade enterprises and the high level of its dependence on the factors of environment. The prospect of future research in this direction was formulated.
