Аннотация: The protection of the environmental rights of citizens is an important issue for the domestic and foreign state policy of Ukraine. Although environmental rights are formally recognised and enshrined in law, they fail to be implemented in practice. This indicates the imbalance and lack of effective political and legal mechanisms for an appropriate system of measures to create conditions for exercising environmental rights and interests, their protection, and restoration, as well as to assure environmental awareness and culture. In light of these general considerations, this research article aims to examine the current issues concerning access to justice for protecting environmental rights through the lens of the state policy of Ukraine and its real application to ensuring such protection. Accordingly, the underlying tasks of the article are: to analyse how meaningful and comprehensive the provisions of approved strategic documents are; to analyse the cases of the ECtHR against Ukraine in environmental matters; to study the national case-law concerning access to justice on environmental rights protection and whether they correspond with the state policy areas of ensuring environmental human rights; to analyse how efficient the mechanism of their protection in Ukraine is and whether conditions for equal access to court in environmental cases are created; to find and illuminate the current state policy gaps that might threaten the effective observance and enforcement of environmental human rights; to formulate theoretical and practical suggestions for their further improvement.

Аннотация: Introduction:Chronic alcoholism is a powerful catalyst for commission of many serious and particularly grave crimes - intentional homicide, bodily damage, robbery, plundering, traffic safety violations that led to fatalities. The vast majority of these offenders are sentenced to imprisonment. Although independent Ukraine refused their compulsory treatment, such experience, unfortunately, did not improve the situation. This will require finding new ways of solving the alcoholism problem that may be of interest to both post-Soviet countries and developed democracy countries. The aim of this research is to trace the evolution of chronic alcoholism treatment in Ukrainian penitentiary institutions, identify the causes of its poor effectiveness under the current approach, and suggest some ways to minimize the negative impact of this disease on a patient and society. Material and methods: The study is grounded in dialectical, historical, comparative, analytical, synthetic, statistical, monographic, sociological (interview) and criminological mapping research methods. The calculations and mapping were done using Microsoft Word 2016, Adobe Photoshop CS6 and Quick Map 2.2. According to the General Prosecutor’s Office of Ukraine, criminal intensity of perpetrators of alcohol intoxication was calculated, and due to the analysis of medical and technological documentation on standardization of medical assistance to alcoholics, the peculiarities of voluntary treatment principle of convicted persons were established. The study group consists of 50 medical professionals working in the medical units of penitentiary and civilian healthcare facilities. Results: According to 3/4 of the surveyed experts, about 50% of convicts need treatment for alcoholism. The factors that influence the increase in concentration of such persons in penitentiary institutions are: prevalence of alcoholism in the whole country; alcohol illegal use in penitentiary institutions; detaining of large mass of household alcoholics in penitentiary; exclusively voluntary treatment and medico-social rehabilitation; lack of alternative treatment methods for alcoholism and consolidation of the lasting effect of this treatment; etc. The consequences of the above are often further decay of alcohol; involvement in this pernicious habit of new unstable persons, especially young convicts; lack of qualified medical care, even in urgent cases that threaten person’s life; genetic addiction of subsequent generations; relapse and recurrence of criminal behavior; etc. Conclusions: There is a need for immediate monitoring of people with chronic alcoholism and alternative treatment modalities, such as substance abuse replacement therapy; allocation of material resources for implementation of specific measures aimed at reducing the alcoholism level of convicts; immediate receipt of licenses by medical units of penitentiary institutions that do not have them, etc.

Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: The article is devoted to the experience of the application of a concept of militant democracy in modern Ukraine. This concept is relevant due to the prolonged domination of the communist totalitarian regime until 1991, and also in view of the encroachment on the principle of territorial integrity in 2014. It is argued that Ukraine, formally consolidating separate instruments of militant democracy at the level of the Constitution of Ukraine, almost did not apply such instruments until 2014. The active process of decommunization started in 2014, after the Revolution of Dignity; it was realised, in particular, in the declaration of lustration, as well as the banning of the two communist parties, but the most influential Communist Party remains officially not banned up till now. Also, the two parties, accused of infringement on territorial integrity, were banned in 2014. The issue of differentiation between aggressive words and aggressive actions of parties is analysed. It is argued that representatives of the parties, who during the twenty years of Ukrainian independence openly denied one of the key values of the constitutional order of Ukraine, its territorial integrity, became active participants of the temporary occupation.

Аннотация: Background: This article is devoted to the study of the rules of notarial acts, the observance of which ensures the reasonableness of notarial acts as exemplified by Ukraine as a state belonging to the countries with Latin notaries. At the same time, the standardisation of Latin notary standards in Ukrainian legislation is associated with certain problems that do not fully reveal the potential of the notary and its functions as a body of undisputed civil jurisdiction. In this regard, the purpose of the work is to determine the components of the procedural mechanism to ensure the reasonableness of notarial acts, identify those shortcomings in their standardisation that lead to litigation, and formulate proposals for further improvement of notarial law on this basis. Methods: In the present research, we used the following methods: logical, systemic, specific sociological, hermeneutic, and modelling. It is established that the reasonableness of notarial acts is ensured by compliance with the rules on submission of evidence documents, requests for evidence documents by a notary, the signing of notarial documents, sending documents for examination, the compliance of documents submitted for notarial acts with statutory requests, and clarifying the will of the persons concerned. Results and Conclusions: It is proved that a notarial act issued based on the actual circumstances established within the notarial case, confirmed by the relevant evidence provided by the notarial legislation, should be considered reasonable. The grounds for exercising the powers of a notary to demand documents are determined, and the need to differentiate the order of recovery depending on the subjects in which such information is requested is emphasised. The content of the notary’s powers to request documents is clarified, and the conditions under which the exercise of such powers should be considered the notary’s duty are determined. The necessity of extending the duties of a notary to establish the will and real intentions of the persons concerned to all notarial acts and, in this regard, the standardisation of such a duty as a general rule of notarial acts is substantiated. It is concluded that the distinction between documents for which the originals are subject to preservation in the notarial file and those that are photocopied then returned to interested persons should be made, taking into account the loss or preservation of their validity and legal significance after said notarial action. The author determines the grounds and conditions for sending a document for examination, which is a procedural action of a notary that can be made only at the initiative or consent of the person who submitted the document. The proposals on the tendencies of standardisation of the content of the requirements of the validity of notarial acts and the consequences of their violation are formulated. © 2022 V Barankova.

Аннотация: The authors contribute to the national reform discussion to improve Ukrainian society's banking system confidence, approaching the European standards of financial services. Public confidence in banks focuses on performance, necessary for financial institutions, but negative feedback from the media, relatives, acquaintances regarding banks has bred significant mistrust. Among the root causes of an unflattering bank, image engenders the financial institution's inability to ensure customer information confidentiality regarding the banking secrecy. This article reviews the protection and illegal disclosure risks of banking secrecy, access to it within criminal proceedings, legal uncertainty of the Laws of Ukraine 'On Banks and Banking' and 'On Currency and Foreign Exchange Transactions, and proposed elimination method. Also provided are particular risks and recommendations for dealing with bank secrecy's apparent risks to continue improving adequate bank secrecy disclosure compliance with the FATCA Agreement.

Аннотация: OBJECTIVE: Introduction: It was identified that one of the priorities of medical reform in Ukraine is the establishment of an effective system of legal regulation of professional physician's obligations that meets European standards. However, the legal regulation of relations between actors in the field of health care lags behind the practice of their development. The aim to find out the status of legal regulation of the professional obligations of health workers, to identify the gaps in this regulation, to formulate proposals for improving the legal framework for the issue under investigation. PATIENTS AND METHODS: Materials and methods: Legislation of Ukraine and certain European countries, international declarations and conventions, scientific works, 28 judgments of the European Court of Human Rights, 96 sentences of the practice of the national courts of Ukraine. CONCLUSION: Conclusions: During the study, the stages of determining the professional physician's obligations were singled out, which would optimize the legislative process of regulation of obligations. One of the problems is the incorrect translation of protocols, which is assigned to a medical care institution. It was proposed to solve this problem by introducing a unified system of protocols and standards, the duty of translation and adaptation of which is entrusted to the central body of executive power in the field of health care. It is relevant to consolidate the duty of medical records management at the level of law, which will serve as a guarantee of ensuring the proper performance by the physician of a professional obligation to treat and diagnose a particular patient. In order to avoid cases of judgments, based on the results of the сommission's assessment of the actions of a physician and to eliminate the number of cases of unjustified attraction of physicians to liability, it is necessary to consolidate a clear list of general professional physician's obligations in a single regulatory act.

Аннотация: Background: Maintaining prosecution in criminal cases in court is a specific function of the prosecutor, which is enshrined in both the Constitution of Ukraine and the provisions of the Criminal Procedure Code of Ukraine. This function should meet not only the objectives of criminal justice but also international standards in the field of criminal justice. Criminal proceedings are divided into public and private, depending on the type of socially dangerous act. And depending on the type of accusation, the functions of the prosecutor in the exercise of their powers are different. Thus, in cases of private prosecution, the participation of the victim is crucial, and his/her refusal to prosecute may be grounds for closing the criminal proceedings. This note related to the study of the innovative approach of the Supreme Court's law enforcement practice shows the active role of the prosecutor in considering these categories of criminal cases in court. Methods: We thoroughly analysed the case-law of the Supreme Court of Ukraine, as well as the provisions of the Criminal Procedure Code of Ukraine and other legislative acts. We also generalised and studied the case-law of Ukrainian courts, as well as recommendations of the CoE and the doctrine of the criminal procedural law of Ukraine. Results and Conclusions: The authors drew several conclusions about various forms of private prosecution with their own specifics, which are manifested in the aspects mentioned in this note.

Аннотация: The article researches the phenomenon of constituent power as a theoretical concept and the practice of its implementation in Ukraine. Constituent power is associated with the process of adopting a constitution and making amendments to it. A distinction is made between primary and institutional constituent powers. The constituent nature of the Constitution of Ukraine in the interpretation of the Constitutional Court of Ukraine is analyzed. The reasons why the Law “On an All-Ukrainian Referendum” was held invalid with regard to the constituent power of the people is considered. There is an inconsistency in the primary and institutional constituent powers’ interpretation of amendments to the Constitution of Ukraine. The constitutional reform of 2004, the interference with this reform by the Constitutional Court of Ukraine in 2010 and its return by the parliament in 2014 are examined from the standpoint of the constituent power concept. It is concluded that a new constitutional reform, which would provide a clean slate, could be an acceptable solution in Ukraine. In the future, the text of the reformed Constitution should provide for clear mechanisms for amending the Constitution of Ukraine and the adoption of a new Constitution, which would necessarily include procedures for popular legitimacy

Аннотация: The article identifies trends in the development of and access to constitutional justice in Ukraine at the current stage. It is alleged that on the one hand, there are attacks on the judicial status of the Constitutional Court of Ukraine, which intensified after the 2016 constitutional reform and the position of the Supreme Court. On the other hand, the effectiveness of a constitutional complaint as a human rights mechanism, i.e. for the formulation of the rights and responsibilities of the individual, is still insignificant. This is due both to the model of the constitutional complaint itself (being exclusively normative) and to the practice that is being formed. The reason for inefficiency can also be called doctrinal unpreparedness for the implementation of a constitutional complaint, because, in fact, despite the large number of studies on the subject, the practical aspect was not well thought out. Both the institutional component and the regulatory framework of the Constitutional Court of Ukraine itself need to be significantly improved. We refer specifically to the Law ‘On the Constitutional Court of Ukraine’ in terms of the interim provisional and protective measure, the implementation of decisions of the Constitutional Court of Ukraine, their actions in time, and specific mechanisms for the restoration of individual rights. In pursuance of the Constitution of Ukraine, a legislative mechanism for compensation for damage caused by unconstitutional acts of public authorities needs to be developed. The provisions of procedural law regarding the review of court decisions in exceptional circumstances as a result of declaring laws unconstitutional need to be adjusted.
