Аннотация: This article is devoted to the study of the problems of the delegation of state powers to local self-government bodies. The paper reveals the pluralism of approaches to the organization of models of such interaction in the countries where various doctrines of the organization and functioning of local self-government prevail (the state-oriented doctrine, the community-oriented doctrine, and the doctrine of municipal dualism). Using the example of various European states (grouped on the basis of the prevailing doctrines presented above for convenience), we reveal specific schemes for the legal regulation of interaction within such relations, their positive features, and drawbacks. The obtained data presented in a compressed form in the paper also features an in-depth analysis of the constitutional and legal regulation of the delegation of state powers to local governments in Ukraine. An important element of the novelty of the study was the projection of modern Ukrainian problems in the field of delegated powers through the prism of the existing European systems and relevant experience, thereby complementing this study with a comparative dimension. Conclusions made by the authors feature a set of recommendations based on the conducted comparative research and on formal and logical analysis of compliance of the domestic model of the delegation of powers with the provisions of the European Charter of Local Self-Government. Taking into account the fact that European standards in the sphere of the delegation of powers (depends on the adoption of amendments to the Constitution of Ukraine and the Law 'On delegation of separate powers of executive authorities to local self-government bodies) are not yet implemented in Ukraine, we believe that this research will not only be useful in the context of theoretical and scientific research of the issue but also has the potential to contribute to the development and implementation of relevant legislation.

Аннотация: OBJECTIVE: The aim: To investigate the theoretical and legal framework governing the relevant areas of food security, ensuring healthy, adequate and safe nutrition. To consider human rights to food security as a basis for health care, a basis for the realization of the right to health and life. PATIENTS AND METHODS: Materials and methods: The study analyzes and uses the normative legal acts of national legislation, international acts, data from international organizations and the results of scientific work of scientists. With the help of scientific methods, medical and legal point of view, the problems of ensuring food security are identified as a guarantee of the realization of the right to human health. CONCLUSION: Сonclusions: Food security and nutrition are central to the individual and fundamental factor to the whole of society in respect of human right to health. An adequate level of food security must be ensured by individual governments and the international community through the development, approval or implementation of an appropriate regulatory framework, as well as through the establishment of a political and institutional framework.

Аннотация: The hermeneutic logic of history, on the one part, resolves the essential gnosiological controversies, and on the other, it considers purely technical issues of history understanding. This research is based on the non-classical approach to the understanding of history from the perspective of hermeneutic logic. Since the scientific positivist interpretation methodology is regarded as irrelevant, a new original technology of the dynamic history interpretation is offered. It converts history into an open "space of free access". The dynamic textual model of history reproduction, which is based on the metonymic comparison of citations, sources and semantic paradoxes, serves as a way of establishing a special trans-communicative historic content. Despite a special ontological status of history as non-existent reality, historic events and phenomena undergo the dynamics of change in the presentation, substantive, virtual ad semantic aspects of its existence.

Аннотация: A key feature of modern legal relations in the healthcare sector is the widespread use of digital technologies. This study describes certain aspects of the legal regulation of the human right to virtual reality in the healthcare sector and the problems of law enforcement. The methodology of this work is based on an interdisciplinary approach using comparative legal, dialectical and systemic methods. The main objective of this article is to determine the forms and directions of the use of virtual reality in health care in the context of human rights. It is emphasized that the introduction of smart technologies, virtual reality in the healthcare sector is the main modern trend in the development of healthcare in order to improve the provision of healthcare services. The human right to use virtual reality in healthcare is to ensure the actions of virtual reality users within the framework of virtual information relations in the healthcare sector, which are governed by the relevant legal norms. The human right to use virtual reality in healthcare is a fourth generation of human rights. These rights include all rights that have arisen as a result of scientific progress, the development of morality, namely "somatic rights", as well as information rights. The use of virtual reality in the healthcare sector is possible in the following areas, namely: (1) medical training, (2) surgical modeling, (3) rehabilitation, (4) psychotherapy and psychology, (5) ophthalmology, (6) telemedicine, etc. It is stated that user safety, privacy, freedom of expression, ethics and copyright protection in the use of virtual reality in healthcare require legislative regulation, taking into account the European experience. The virtual space in the healthcare sector provides opportunities for the realization of human rights and freedoms regarding the preservation of their health, but can be used to carry out actions that contradict the norms of law and have illegal behavior. The latter requires an improvement in the regulatory framework when using the virtual space of the healthcare sector to protect the interests of the individual, society and the state using international standards.

Аннотация: It has been emphasized that the norms of the Constitution of Ukraine and the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms are correlated in structure, form of action and features of application that allows determining the conceptual features for the formation of the mechanism of realizing and applying the Constitution of Ukraine as norms of direct effect. It has been emphasized that the central idea is the uneventful application of the norms of the Constitution of Ukraine and the Convention for the Protection of Human Rights and Fundamental Freedoms at the stages of realizing human rights and their protection due to the similar nature and legal structure of their norms. It has been noted that the use of such an approach creates an objective opportunity to establish whether there were violations of any requirements at the stages of: protecting such a right (existence and application of preventive measures), implementing the right (obstacles to achieving a certain good by a person) and protecting human right (taking sufficient and effective measures aimed at restoring the person’s status). It has been stated that the norms of the Constitution of Ukraine, given their legal properties, can be applied similarly to the way how the European Court applies the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms. Considering the provisions of the current procedural legislation of Ukraine on the powers of courts, it has been proved that human rights are realized and protected in out-of-court and judicial manner exclusively and directly on the basis of the norms of the Basic Law. It has been noted that the forms of applying the Convention for the Protection of Human Rights and Fundamental Freedoms should be understood as methods of applying the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms by the authorized subjects to certain legal relations that is expressed in the relevant acts, namely: literal application – carrying out law-enforcement activities on the basis of the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms without their interpretation; expanding application – the implementation of law-enforcement activities on the basis of the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms as a result of their interpretation.

Аннотация: In the work, we analyzed the relationship of indicators of psychometric intelligence and psychometric creativity with intellectual, creative and social achievements. On the other hand, we tried to identify the role of different intellectual abilities and different forms of creativity, taking into account the different measures of their conjugation with real achievements, and also to analyze the role of those personal properties that, related to the peculiarities of organizing different forms of individual mental (conceptual, metacognitive, intentional) experience, act as a condition for real creative achievements of employees. The main approaches to the study of intelligence and creativity in connection with various aspects of individual productivity were examined, the results of studies of the ratio of intellectual and creative abilities were analyzed, and ideas about the role of personal properties as a factor in the employee's real achievements were analyzed.

Аннотация: Purpose: The article is devoted to the research of the issue of the international cooperation between law enforcement agencies of the States and international organizations in the area of combating crime and characterization of directions, levels and forms of its implementation. Methodology: The research methodology is based on the results of scientific studies of national (Ukrainian), and European scientists on the issues of the international cooperation in the area of combating crime. The methodological basis of the study is a set of general and special methods of scientific knowledge, such as comparative, statistical, systems analysis, historical and legal, systemically and structural methods. Results: The study allowed determining the directions of international cooperation in the area of crime control, such as the enshrinement of international unlawfulness of crimes; formation of international standards of human rights and freedoms; conclusion of international treaties; investigation of manifestations of international crime; research activity. The levels of international cooperation in the area of crime control such as level of bilateral cooperation and cooperation at the regional and global levels are defined. The forms of international cooperation in the area of combating crime are: international legal assistance, extradition of a person suspected in committing a crime, adoption of criminal proceedings; transfer of convicted to imprisonment for the further execution of a punishment; international search; ensuring the rights and freedoms of citizens during criminal proceedings in another State; information exchange.

Аннотация: Purpose: This article is devoted to the search for effective solutions to modern legal problems of the realization of human rights, including children, for inclusive education in Ukraine. Methodology: The method of integral analysis of legal regulation in the field of inclusive education in Ukraine has allowed us to consider it in development and interconnection to reveal the existing directions and patterns as a whole. The comparative method has come in handy in the study of legislation governing the right of people to inclusive education. Modeling, analysis, and synthesis methods have revealed the advantages and disadvantages of legal regulation in the field of inclusive education. Main findings: The article discusses the features of legal problems of the implementation of rights to inclusive education of humans with limited opportunities in Ukraine. Possible ways of improving the legal regulation of the implementation of human rights to inclusive education are proposed. According to the authors, one of such methods is the passing of separate legislative, legal norms regarding the development of inclusive education for children with various functional disorders, the development of inclusive education at higher educational institutions. The authors substantiate the conclusion that the human right to inclusive education at the international level is a legal human right that has great practical value for students with disabilities and should exclude any form of discrimination. Implications: This article can be used in the practical activities of lawyers, students, and teachers of law higher education, and is also recommended for review by persons with disabilities. Novelty: This study examined the problems of legal support of human rights to inclusive education in Ukraine and suggested ways to solve them. © Shevchuk et al.

Аннотация: OBJECTIVE: The aim: The aim of this work is to identify the compliance level of modern practice of placement of a person in a medical institution in order to conduct the FPE to international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person; formulation of scientifically substantiated proposals on the synchronization directions of national practices with the specified international standards. PATIENTS AND METHODS: Materials and methods: During the preparation of the article the following was processed: scientific research on ensuring the rights of persons suffering from mental disorders in criminal proceedings; provisions of international agreements on the provision of psychiatric care; legal positions of the ECHR on the observance of persons' rights suffering from mental disorders (15 judgments on this topic); criminal procedural legislation of individual states; results of generalization of national law enforcement practice; the results of a survey conducted by the authors of 18 psychiatrists who practice in the field of forensic psychiatric examinations (psychiatrists working in state psychiatric clinics in Odesa, Poltava, Kharkiv were interviewed). In the process of research a set of general scientific and special methods of cognition was used (comparative-legal method, system-structural method, generalization method, method of analysis and synthesis, method of sociological research, method of expert assessments, etc.). RESULTS: Results: According to the research results: a) legal positions of the ECHR on the observance of the rights of persons suffering from mental disorders are identified and generalized; b) the compliance level of modern practice of placing a person in a medical institution in order to conduct the FPE with international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person ( 1 of Article 5 of the Convention); c) the degree of extrapolation of these positions to the activities of psychiatrists is analyzed; d) the optimal ways of solving the existing problems in the aspect of ensuring the rights of a person when placing them in a medical institution for an inpatient FPE are proposed. CONCLUSION: Conclusions: The current national practice of placing a person in a medical institution for an inpatient FPE does not fully comply with the legal positions of the ECHR in terms of ensuring the right to liberty and security of person (in particular, there are deviations from the positions of the ECHR on: determining the documentary basis for the appointment of an inpatient FPE; interaction of police and medical workers in the field of psychiatry during the detention of a person with a mental disorder). Besides, in the research process to achieve the goal, a complex of general scientific and special methods of cognition was used, in particular, the comparative legal method, the system and structural method, the method of generalization, the method of analysis and synthesis. CONCLUSION: Conclusions: Response measures taken by countries during the Covid-19 period, which cause changes in the legal regulation of public relations, their validity and focus on achieving the goal of protection, must be based on democratic principles, human rights restrictions must be appropriate to the threat and must be justified the limits of intervention.

Аннотация: The aim of the study is to analyze individual legal problems of the implementation of the human right to palliative care. To achieve this goal, statistical data on the number of palliative patients, their access to medical services were analyzed. The absence of reasons for limiting the patient's right to receive palliative care, as such a right is a fundamental human right, is substantiated. An analysis of the understanding of the legal construction of "palliative care" in the scientific literature, national and international legal documents was carried out. It was revealed that the terms "hospice care", "end-of-life-care", "respite care" are components of a precise definition - "palliative care". Two groups of subjects that ensure the human right to this type of medical care are identified, their powers are indicated. In the course of the research it was established that palliative patients, more often than other patients, need medical care, including children. This category of patients faces the following problems: incomplete providing of high-quality free medical palliative care; insufficient number of palliative and hospice departments for such patients; palliative care does not meet international standards (logistical support for palliative departments, there are no specialists of a multidisciplinary team); there is no special training for medical personnel working with incurable patients; painkillers (non-narcotic and narcotic) drugs for relieving pain syndrome of such patients are not provided in full volume; there is no cooperation of state authorities in the field of palliative care with public and charitable organizations; palliative patients do not have access to free legal services (pensions, inheritance).

Аннотация: International commercial arbitration (ICA) is an alternative way to resolve foreign economic disputes. Initially, arbitration itself was seen as a neutral court in which the parties to the dispute were independent of national courts. Arbitration agreements and decisions must be recognised by national courts without any complications or review procedures. Although granting commercial parties some independence to agree that their dispute will be considered by independent arbitrators is a key principle in ICA, the struggle for supremacy between national laws and national courts on the one hand and the autonomy of the parties and the independence of the international arbitration system on the other continue. Over the years, national laws have sought to control, regulate, interfere with, or support ICA in various ways. To counter attempts to ‘localise’ ICA and promote equality in this area, private, professional institutions and international and intergovernmental organisations have developed a significant body of law designed to ensure self-government and dispute settlement procedures in ICA. Nevertheless, international commercial arbitration cannot exist independently of national jurisdictions. Examining the activities of ICA, it can be seen that the importance and impact of national arbitration laws and national judicial supervision are significantly reduced, but the lex fori still plays an important role in arbitration. Thus, the reform of the normative regulation of international arbitration also affected Ukraine. The article analyses the radical changes proposed by the legislator regarding the procedure for establishing institutional arbitrations, expanding the arbitrability of disputes.

Аннотация: Improving the activities of pre-trial investigation and judicial review largely depends on the increased use of special knowledge in forensic investigative practice and, above all, the involvement of an expert and their analysis. The relevance of the subject matter is explained by the need to introduce new forms and approaches to evaluating the reliability of expert opinions, in particular with the involvement of independent specialists of the corresponding speciality. The purpose of this study was to provide arguments regarding the expediency of attracting knowledgeable persons as reviewers to evaluate the objectivity and completeness of forensic analysis, the correctness of the methods and techniques applied by the expert, and the validity of the opinion. To achieve this purpose, the following general scientific and special research methods were used: Aristotelian, comparative legal, functional, sociological, statistical, system and formal legal analysis, legal modelling, and forecasting. It was established that in the vast majority of countries of the world, except Ukraine, an independent, knowledgeable person with special knowledge in the corresponding field is involved to help evaluate the reliability of an expert opinion. It was proved that contacting knowledgeable persons to evaluate the objectivity, validity, completeness of expert research helps establish the causality between the identified features of the object of analysis and the fact that is subject to establishment, and also gives grounds for determining the affiliation, admissibility, reliability, and sufficiency of the expert opinion. At the same time, a specialist's review cannot serve as a source of evidence, but only has an auxiliary (advisory, technical) nature and can serve as a basis for appointing a second (additional) forensic analysis or a cross-examination of the expert and the reviewer. To exercise the rights of individuals to fair justice, it is proposed to introduce this procedure for evaluating the reliability of expert opinions in Ukraine, with the necessary changes in the current procedural legislation of Ukraine to provide an opportunity for participants in criminal proceedings and the victim to attract knowledgeable persons as reviewers of expert opinions.

Аннотация: The features of the use of information and communication technologies in the election process have been examined in the article. In particular, the essence and features of electronic voting as a promising direction of modern information and communication technologies are determined. The foreign experience of using information and communication technologies is studied, namely, the normative-legal and organizational components of application of electronic voting and electronic counting of votes are determined. Based on the results of studying the experience of introducing e-voting on the example of the USA, Estonia, Switzerland, Germany, and Ireland, it has been concluded that it had not only positive consequences but also a negative result. Among the countries considered, in which electronic voting is currently used in elections, it has been found that Estonia has achieved the greatest success in this area, and which not only has a secure and reliable e-voting system but also a nationally mandated body, the National Electoral Committee, to manage the online voting system to ensure trust in the system. It has been found that in Ukraine the use of electronic voting in the election process is only at the stage of active discussion, experience in the use of this latest technology in the country is still lacking, and therefore its introduction remains an urgent need.

Аннотация: In order to better protect the human right to life, to improve the implementation of Art. 2 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as the reduction of the number of judgments of the European Court of Human Rights against Ukraine, we propose avoid unjustifiably lengthy investigations into the causes of death of citizens and provide specialized resuscitation assistance to all who need it. Share Art. 52 of the Law of Ukraine "Fundamentals of the legislation of Ukraine on health care" the following wording: "Medical workers are allowed to euthanize - intentionally accelerating the death or death of a terminally ill patient in order to end his or her suffering, subject to his consent and the conclusion of the commission, which is not less than of three doctors on the incurability of a disease that causes significant physical pain (suffering) for the patient".
