Ukraine in European human rights regime: Breaking path dependence from Russia [Text] / I. H. Barabash, O. V. Serdiuk, V. M. Steshenko // The EU in the 21st Century: Challenges and Opportunities for the European Integration Process. - 2020. - 6 March. - P. 247-270

Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: This article is devoted to the analysis of procedural time limits transformation under pandemic conditions implemented in the legislation of Ukraine during the coronavirus pandemic of 2020, as well as the practice of their application in national courts. It is stated that inaccuracy and incompleteness in resolving important issues related to the extension and renewal of procedural time for the administration of justice under the quarantine creates obstacles to the implementation of the main tasks of civil proceedings. Inaccuracy in the regulation by procedural legislation of certain procedural terms, the possibility of their renewal and extension can significantly affect the movement of all civil proceedings as well as significantly impede the achievement of its goals.

Аннотация: ABSTRACT The aim: To analyze law enforcement practice on the basis of the national legislation of foreign states to single out features of legal regulation of the right to euthanasia realization and to outline the Ukrainian prospects of euthanasia legalization. Materials and methods: The empirical basis of the research is the legislation of some European countries (Belgium, Spain, Italy, Portugal, and the Netherlands) and Canada; decisions of the European Court of Human Rights on the right to voluntary death and the obligations of states; the results of a survey of 750 respondents conducted by the authors. The methodological basis of the study were philosophical views on life, death, and the right to certainty, formal-logical method (analysis, synthesis, induction, deduction, etc.), comparative, analytical, statistical, sociological methods of cognition, as well as a synergetic approach. Conclusions: The issue of legal regulation of euthanasia is multifactorial, socially conditioned, and requires a positive action of the state both in terms of regulation and/or prohibition, and the proper provision of citizens with health care. Legislative support for the human right to a “dignified death” is dictated, to some extent, by society’s demand, which must be finally resulted in the draft law. As for Ukraine, the adoption of such a law is obviously premature. Although according to a survey of citizens on euthanasia and the feasibility of introducing such a law in Ukraine, 57% are positive about the experience of other countries, and 41% were in favor of adopting a law in Ukraine, it is not possible to assess their opinion due to ignorance of legislation where euthanasia is allowed.

The right on euthanasia: The experience of the world's developed countries and the prospects of its implementation in Ukraine [Text] / K. Horbachova, V. Dudaryov, Zarosylo V., Baranenko D., Us O. // Journal of Legal, Ethical and Regulatory Issues. - 2020. - Vol. 23, Iss. 1. - p. 1-6
Перевод заглавия: Право на эвтаназию: опыт развитых стран мира и перспективы его внедрения в Украине
ББК Х628.111.3

Аннотация: The article explores the right on euthanasia in developed countries of the world and the prospects for its implementation in Ukraine. The results of a number of sociological studies on the perception of euthanasia by the population, in particular in the Netherlands, Turkey, USA, Finland, also, special attention was paid to the gradual increasement in the percentage of people who support the idea of euthanasia. The concept of euthanasia and the conditions under which it can be carried out are revealed. The legislative provisions of the Netherlands and Belgium regulating euthanasia in these countries were stated. It has been found out that the shortage of consensus among European states on the question of a decent end to human life leads to the existence of a case law of the European Court of Human Rights on euthanasia cases. It is concluded that the introduction of euthanasia is not promising for Ukraine, as it is directly contrary to a number of national legislation acts, first of all the Constitution of Ukraine, also, to international acts, in particular the Convention for the Protection of Human Rights and the Founder of Freedoms. It is emphasized that a single position on euthanasia should be chosen at the level of the European Union by the Member States.

Аннотация: The authors researched the peculiarities of the legal protection of inventions in the field of biotechnologies based on the legislation of European countries and Ukraine. They determined the legal framework regarding the legal protection of biotechnologies at the international level. They identified the fundamentals related to the peculiarities of judicial control and protection of biotechnological inventions in the European countries (Germany, the United Kingdom, France, and Italy) and the resolution of these issues at the legislative level in Ukraine. Particular attention was put to the provisions of Directive 98/44/EC of the European Parliament and the Council on the legal protection of biotechnological inventions. One determined the content of the rules of the current patent legislation in Ukraine, which regulates the protection of biotechnological inventions, and highlighted the key aspects of the Agreement between Ukraine and the European Union in the context of the conducted research. The authors provided a systematic overview of the main requirements applied to the biotechnological innovations to determine their patentability. The main problematic aspects of the Directive 98/44/EC were highlighted based on the research findings. They lead to an ambiguous interpretation of the document's rules and the existence of considerable differences in the patent legislation available in the member countries of the European Union. ©

Аннотация: OBJECTIVE: The aim: To identify the spheres in which it is forbidden to patent the results of medical researches and as a consequence there is no legal protection of biotechnological inventions. PATIENTS AND METHODS: Materials and methods: The research material is a modern European regulatory framework that establishes the basic principles for patentability of biotechnological inventions. The methods of information retrieval, analysis, systematization, and generalization were used in this article. CONCLUSION: Conclusions: The Court of Justice has categorically stated that inventions that use human embryonic cells cannot be used for industrial or commercial purposes and therefore cannot be patented. In connection with this prohibition, the Court of Justice provided a unified definition of "embryo" and determined that it could be considered a dividing human egg, but only if it had a real ability to develop into a human. That is, the determining factor is not the beginning of the process of cell proliferation, but their real ability to become human. These decisions have become crucial for the development of research and the use of their results in therapeutic activities in the EU.

Аннотация: Financial institutions are the centre of economic and legal interests of participants of the financial services market, which is itself characterised by a high level of conflict of interests of its participants. The purpose of the article is the scientific development of the legal structure of organisational and legal forms of financial institutions, in the market of financial services, as a legal mechanism for reconciling the economic and legal interests of the main participants of this market. The features of basic and modified legal forms of legal entities are elaborated in this article. It is determined that financial institutions are established and operate in 'modified' legal forms. Such forms emerge due to the supplementation of the structure of the main elements of the basic legal forms of legal entities. This refers to additional functional legal means that reflect special requirements for the relevant types of legal entities, depending on the economic and legal interests of their founders/participants.

Аннотация: OBJECTIVE: The aim of this article is to reveal the essential features of contracts providing medical services. The author also focused on the grounds for the invalidity of such contracts - entering into medical services contract without license or permission, prohibition of some medical services or methods of treatment, the imposing of unnecessary medical services, a contradiction to corporate regulations, fraud. A significant part of the work is devoted to the consequences of the invalidity of the contract - the restitution of the money received under the contract and compensation of harm. PATIENTS AND METHODS: Materials and methods: The study is based on the statutory acts of European Union countries, the USA, and others. The author also uses acts of international law in the field of medical services and cases of court practice. CONCLUSION: Conclusions: Although the invalidity of contracts in the field of medical services is not one of the most common ways to protect a patient's rights, it is in many cases essential to the reliable delivery of medical services. The patient has the right to initiate a legal dispute regarding the invalidity of the contract. The restitution of the money paid by the patient, as well as compensation for the harm caused, can be applied not only within the framework of tort law but also under the responsibility for the breach of the contract.

Severe pain and suffering as effects of torture: detection in medical and legal practice [Text] / Y. Tavolzhanska, S. Grynchak, V. Pcholkin, O. Fedosova // Georgian medical news. - 2020. - Iss. 307. - Р. 185-193
Перевод заглавия: Сильная боль и страдания в последствиях пыток: обнаружение в медицинской и юридической практике
РУБ PubMed: 33270602

Аннотация: The aim of the study is to identify the features and to determine the relationship between medical and legal (investigative & judicial) practice on detection of the torture effects. It is emphasized that the paper is a continuation of the thesis study on the criminal law problems of torture, which were prepared by the Department of Criminal Law No. 1, Yaroslav Mudryi National Law University, Kharkiv, Ukraine. During the preparation of this article, the following material were used: the publications issued by the centers for rehabilitation of torture victims, specialized medical journals, manuals for physicians, publications by the IASP and the Ukrainian Association for the Study of Pain, explanations by leading specialists of Bogomolets National Medical University, Kyiv, Ukraine, Danylo Halytsky Lviv National Medical University, Lviv, Ukraine, UN reports, OHCHR official explanations, international treaties on prohibition of torture, criminal codes of post-Soviet countries. The empirical basis of the study was provided by 41 final decisions of the court on torture cases of taken since 2014 till 2019. To achieve the aim of the study the analysis and induction methods, as well as statistical and systemic methods were applied. According to the results of the study, it is concluded that only the joint medical and legal detection of severe pain and suffering is the key to the correct solution of the issue of presence or absence of the torture effects. It is noted that neither medical nor law enforcement assessments are self-sufficient and require addition of the mutual contexts. Attention is drawn to the fact that development of the guidelines on the joint medical and legal detection of severe pain and suffering is one of the main tasks for the scientific community. It is proved that the peculiarity of medical practice on detecting the effects of torture consist of is the need to determine both statutory (severe pain and suffering) and "remote" (physical, psychosomatic and mental) effects of this crime. The reasonable arguments are put forward that the specificity of legal (investigative & judicial) practice in detection of severe pain and suffering (as effects of torture) is associated with the need to use a wide range of tools: scientific and legal methods used for determination of severe pain and suffering, medical reports on intensity of pain and suffering, medical documentation on fixation of "remote" effects of torture, reports on forensic, psychological and psychiatric examinations, testimonies and protocols of interrogation of the victim and witnesses, protocols of inspection of crime-committing scene, search, investigative experiment, inspection of material evidence, etc.

The absence of reasons for limiting the patient's right to receive palliative care, as such a right is a fundamental human right, is substantiated. An analysis of the understanding of the legal construction of "palliative care" in the scientific literature, national and international legal documents was carried out. It was revealed that the terms "hospice care", "end-of-life-care", "respite care" are components of a precise definition - "palliative care". Two groups of subjects that ensure the human right to this type of medical care are identified, their powers are indicated. In the course of the research it was established that palliative patients, more often than other patients, need medical care, including children. This category of patients faces the following problems: incomplete providing of high-quality free medical palliative care; insufficient number of palliative and hospice departments for such patients; palliative care does not meet international standards (logistical support for palliative departments, there are no specialists of a multidisciplinary team); there is no special training for medical personnel working with incurable patients; painkillers (non-narcotic and narcotic) drugs for relieving pain syndrome of such patients are not provided in full volume; there is no cooperation of state authorities in the field of palliative care with public and charitable organizations; palliative patients do not have access to free legal services (pensions, inheritance).

PATIENTS AND METHODS: Materials and methods: In carrying out the study, an interdisciplinary approach was applied to the analysis of the problem of protecting the rights of children born to surrogate mothers in the context of the COVID-19 pandemic. This approach includes dialectical, comparative-legal, statistical, and systemic methods. The research used scientific developments in the field of problems of protecting the rights of children born to surrogate mothers, international acts, legislation, statistical data. It has been established that although the understanding of surrogacy is the same for all states, there is a rather different approach to the possibility of its application. The issue of providing a child born to a surrogate mother with data on his genetic origin (in the absence of a genetic link with legal parents) should be resolved on the basis of this approach: maintaining a balance of interests between parents and the child, taking into account the principle of the best interests of the child. It is proposed to create a register of persons those wishing to apply the surrogacy procedure, as well as the register of children born from surrogate mothers in Ukraine.
