Аннотация: OBJECTIVE: The aim: To identify the role of evidence-based medicine, its principles and approaches to patients' rights protection and the provision of medical service optimization, the skills of medical staff improvement, increasing the objectivity of court decisions in cases of non-providing quality care or death. PATIENTS AND METHODS: Materials and methods: The authors used the decisions by the European Court of Human Rights (ECtHR) on the statements of victims of unprofessional actions by doctors, international and domestic regulations on patients' rights, statistics on the results of criminal proceedings on violations of patients' rights over the past 5 years, case law of criminal and civil jurisdiction in this category of cases, the results of surveys of prosecutors, as well as the results of research by scientists in the field of medical law and criminalistics. The research is carried out on the basis of a harmonious combination of philosophical approaches, general scientific and special methods of scientific knowledge, the complex of which is chosen taking into account the goals and objectives, object and subject of research. CONCLUSION: Conclusions: In order to implement the patients' rights by legal means in accordance with the Convention for the Protection of Human Rights and Fundamental Freedoms, the European Charter of Patients' Rights and other international regulations in the field of medicine, the authors argue the need for greater implementation of evidence-based medicine into the practice of medical institutions as a means of improving the level of medical care and an obvious source of relevant information for litigation to protect the rights of patients and doctors. For patients' rights protection in the diagnosis and treatment of diseases, it is proposed to regulate a set of such measures: 1) to include in the educational programs of pharmacy and medicine such disciplines as «Evidence-Based Medicine» and «Rights of the patient and medical worker's rights»; 2) to oblige the doctor to explain to the patient or to his/her representative the differences of treatment protocols, to provide information to patients about official sources, which contain information on unified and updated treatment protocols and diagnosis of certain diseases, to obtain informed consent by the patient (his/her representative) on certain medical guideline; 3) to recognize medical guidelines as sources of law in criminal and civil proceedings as a kind of benchmarks for clarifying and assessing the facts of non-performance or improper performance of professional duties by a medical or pharmaceutical worker, violation of patients' rights, as well as means for doctors' legal protection and etc.

Аннотация: OBJECTIVE: The aim: To reveal the features of the epidemic safety and security legal regulation in Belarus, Kazakhstan, Moldova, Poland, Russia and Ukraine during the COVID-19 pandemic. PATIENTS AND METHODS: Materials and methods: This study is based on Belarusian, Kazakh, Moldavian, Polish, Russian and Ukrainian regulatory acts as well as national court judgments. Such methods as dialectical, comparative, analytic, synthetic, comprehensive, statistical and generalization approaches have been used in the article. CONCLUSION: Conclusions: the study confirmed that the direct impact on the spread and dynamics of morbidity during the COVID-19 pandemic in the countries to be analyzed is determined by: the presence of government agencies and special institutions involved in combating, preventing and monitoring the spread of infectious diseases and their readiness for effective measures in emergency situations caused, in particular, by epidemics; timeliness and duration of quarantine restrictions, their severity and scope; observance of these restrictions by the population; effectiveness of law enforcement responses to violations. The strengthening of administrative and/or criminal liability had no significant impact on the morbidity situation in the country.

Аннотация: OBJECTIVE: The aim: The aim of the study is to determine the state of legal regulation of surrogacy in Ukraine, Russian Federation and Belarus, to identify risks of human rights violations, to identify legal and medical mechanisms to combat the exploitation of women, and to outline a portrait of a surrogate mother. PATIENTS AND METHODS: Materials and methods: The empirical basis is the legislation of Ukraine, Russian Federation and Belarus, which regulates the service of surrogacy, information from the websites of agencies and clinics in this area, as well as personal stories of 41 surrogate mothers, set out in open sources. The following methods were used: dialectical, comparative, statistical, induction and deduction, questionnaire, analysis and synthesis, content analysis. CONCLUSION: Conclusions: The results of the study clarify both the common features of the legal regulation of surrogacy in the East Slavic countries, and the specifics of each of them; the main problems in the field of its application are outlined; the risks of violation of the rights of genetic parents, children and surrogate mothers are characterized. Legal and medical mechanisms for counteracting the exploitation of surrogate mothers have been identified.

Аннотация: The Covid-19 coronavirus pandemic forced the administrative staff of agricultural enterprises to work from home, thus raising the issue of remote workforce motivation. Whenever employees are working from home, their activity needs coordination and control over the fulfillment of job responsibilities. The study proposes that efficient functioning and motivation of remote workforce be achieved through the creation of team, which will fully use the potential of every employee and coordinate their joint efforts for the sake of attainment of company goals and objectives. The coaching method is suggested as the way to build a team. Such team will possess a relevant intellectual potential and troubleshooting flexibility. An efficient team is capable of raising labor productivity, which will improve the company’s position on the market and will generate additional revenue for financial motivation of employees.

Аннотация: OBJECTIVE: Introduction: The article reviews issues of legal regulation of patients' rights in Ukraine, analyzes the patient-doctor relationship, proposes the legislative approval of new patients' rights and the need of adoption of a single legislation of these rights. The aim of this work is to conduct a detailed study of legal regulation of patients' rights in Ukraine and the EU countries, to identify the areas for further improvement of the legislative regulation of patients 'rights in Ukraine, ways of harmonization of national legislation with international standards, which regulate patients' rights. PATIENTS AND METHODS: Materials and methods: we analyzed national and international regulation of patients' rights, case law of the European Court of Human Rights (ECHR), national court judgments. We also used historical, comparative-legal methods, and instruments of analytical research and empirical study. CONCLUSION: Conclusions: In Ukrainian law many patient rights are not defined, but are applied in medical practice, therefore, they require legal regulation. In particular, they include: the right to convene a consilium; the right to refuse medical interference; the right to terminate treatment, etc. In addition, with the development of medicine, scientific and technological progress, there are some issues, which arise and need to be legally defined, among them: the rights and responsibilities of the patient during transplantation, artificial insemination, medical research, etc. When making health policy, the concept of trust and respect for patients, their autonomy or constructive partnership with them should be taken into account. Doctors need to take a more active part in discussions and debates with patients. Independence of patients in decision making processes must be provided by law, and the rights and obligations of all parties must be clearly reflected in the relevant documents.

Аннотация: Today, ownership right is not only one of the main categories of legal and economic science but also the basis for the existence of the state and the private sector. The right to inviolability of private property is an inalienable right, the recognition of which indicates the level of democracy and the development of human and civil rights in the territory of a certain state. The particularities of this right and its essence taken together are recognized in the realities of today as a broad, multi-faceted and complex problem that requires its actualized development from both theoretical and practical law enforcement positions. In the context of European integration, qualitative restoration of the domestic legal system, as well as at the stage of initial reformation of Ukraine, for representatives of the doctrine and practitioners, the following issue appears to be more relevant: proper ensuring and improvement of the mechanism of ownership right protection. Besides, law enforcement practice, the variability of which is still not generalized, is considered to be an important factor in the modern updated perception of the essence of the ownership right protection. However, the introduction of so-called “model decisions” of the Supreme Court, use of the case law practice of the European Court of Human Rights by national courts and the particularities of modern legal relations in the field of ownership correct the legislative basis and the mechanism of enforcement of this right, given globalization processes and the challenges of our time. According to the results of the analysis of doctrinal approaches, legal regulation and law enforcement practice in the field under research in the publication: (1) modern essential content of the concepts “ownership right” and “ownership right protection” was revealed; (2) the tendencies of ownership right protection were analyzed; (3) particularities, admissibility and expediency of the civil claim in criminal proceeding were defined; (4) debating scientific positions on the justified restriction on the ownership right were investigated; (5) it is proposed to define the ways of protection of ownership right by the court as the statutory measures by which the court implements the protection of the violated, contested, subjective and unrecognized ownership right, freedom or interest by implementing the function of civil law in the sphere of protection, and (6) it is substantiated that with the appeal of the owner for the protection of his right, the main functions of civil law became more active (restoration, compensation, prevention) which are the key to the effective implementation of protection.

Аннотация: The article provides insights on the current mechanisms for regulating relations in the field of global health and international interaction in the world, holding the States of the world internationally responsible for internationally wrongful acts in the field of health, including consideration of the nature of the COVID-19 pandemic. Significant attention is paid to find the response to the question of what COVID-19 pandemic a health emergency is or bioterrorism. It analyses the current international norms governing the field of the production and use of biological weapons, with particular emphasis on standards of regulation and international responsibility in this field. The findings of this study suggest that biosafety worldwide is a key dimension of global security and ensuring world peace. This study also recommended the establishment of the strong global norm that would provide for verification of disarmament and compliance with the Biological Weapons Convention, the responsibility of States to develop, manufacture, and accumulate of biological weapons should be adapted to that end. Furthermore, it is noted that the world community should reconsider the position on the mechanism of investigations by the United Nations Security Council, as well as the procedure for the use of the veto of the five permanent members of the Security Council in any decision concerning the maintenance of international peace and security.

Аннотация: The unprecedented impact of the COVID-19 pandemic on the realization of human rights has disproportionately affected vulnerable groups and created a global gap injustice, a gap in human rights from discrimination and poverty in access to social protection and basic services, insufficient or no access to justice, lack of access to justice. Legal aid. This article deals with current issues of access to justice and legal aid for the vulnerable during thepandemic of COVID-19. It is concluded that no country will be able to ensure the implementation of goal 16.3 of the United Nations Sustainable Development Goals on 2030 on equal access to justice for all until has not focused on closing the global justice gap, increasing access to justice, providing legal aid to the most vulnerable groups. For the implementation of the policy of access to justice for vulnerable states must have a different approach to justice – a people-centered approach to justice that puts consideration of the individual at the heart of justice responses by providing access to information, programs and policies. Ensuring equal access to justice, access to legal aid, an increased level of legal awareness among vulnerable groups, and a vibrant strong civil society, that contribute to access to justice, are key criteria for ensuring access to justice for vulnerable people. Providing equal access to justice through access to legal aid is key to ensuring access to justice in any state. Today it is important to overcome barriers to access to justice, such as the digital barrier, barriers related to financial costs, complexity, lack of information and access to services, and lack of access to legal aid or representation. States should be effective, must guarantee credible commitment, support coordination, and promote cooperation. States, justice systems must collaborate with public organizations and civil society to address the root causes of disputes and avert violence, conflict, and human rights abuses.

Аннотация: The aim of the study is to identify the features and to determine the relationship between medical and legal (investigative & judicial) practice on detection of the torture effects. It is emphasized that the paper is a continuation of the thesis study on the criminal law problems of torture, which were prepared by the Department of Criminal Law No. 1, Yaroslav Mudryi National Law University, Kharkiv, Ukraine. During the preparation of this article, the following material were used: the publications issued by the centers for rehabilitation of torture victims, specialized medical journals, manuals for physicians, publications by the IASP and the Ukrainian Association for the Study of Pain, explanations by leading specialists of Bogomolets National Medical University, Kyiv, Ukraine, Danylo Halytsky Lviv National Medical University, Lviv, Ukraine, UN reports, OHCHR official explanations, international treaties on prohibition of torture, criminal codes of post-Soviet countries. The empirical basis of the study was provided by 41 final decisions of the court on torture cases of taken since 2014 till 2019. To achieve the aim of the study the analysis and induction methods, as well as statistical and systemic methods were applied. According to the results of the study, it is concluded that only the joint medical and legal detection of severe pain and suffering is the key to the correct solution of the issue of presence or absence of the torture effects. It is noted that neither medical nor law enforcement assessments are self-sufficient and require addition of the mutual contexts. Attention is drawn to the fact that development of the guidelines on the joint medical and legal detection of severe pain and suffering is one of the main tasks for the scientific community. It is proved that the peculiarity of medical practice on detecting the effects of torture consist of is the need to determine both statutory (severe pain and suffering) and "remote" (physical, psychosomatic and mental) effects of this crime. The reasonable arguments are put forward that the specificity of legal (investigative & judicial) practice in detection of severe pain and suffering (as effects of torture) is associated with the need to use a wide range of tools: scientific and legal methods used for determination of severe pain and suffering, medical reports on intensity of pain and suffering, medical documentation on fixation of "remote" effects of torture, reports on forensic, psychological and psychiatric examinations, testimonies and protocols of interrogation of the victim and witnesses, protocols of inspection of crime-committing scene, search, investigative experiment, inspection of material evidence, etc.

Аннотация: OBJECTIVE: The aim of this work is to identify and analyze the key positions of the ECHR in the context of respect for the right to a fair trial (Article 6 of the European Convention on Human Rights (hereinafter - the Convention)) of a person suffering from mental disorders in criminal proceedings concerning the application of compulsory medical measures (hereinafter referred to as CMM); formulation of scientifically substantiated proposals for determining the restriction legality criteria of the right of a person suffering from a mental disorder to personal participation in the trial. PATIENTS AND METHODS: Materials and methods: During the preparation of the article, the following was processed: scientific research on ensuring the rights of persons suffering from mental disorders in criminal proceedings; provisions of international agreements on the provision of psychiatric care; the legal position of the ECHR on the observance of the right to a fair trial of persons suffering from mental disorders (6 decisions were analyzed in which the ECHR addressed these issues in the context of the requirements of Article 6 of the Convention); criminal procedural legislation of individual states; the results of a survey conducted by the authors of 88 judges (judges of local courts of Ukraine) on key issues of ensuring the participation of a person suffering from a mental disorder in a court hearing. In the process of research a set of general scientific and special methods of cognition was used (comparative-legal method, systemic-structural method, generalization method, method of analysis and synthesis, method of sociological research, method of expert assessments, etc.). RESULTS: Results: According to the results of the research: a) the legal positions of the ECHR to ensure the right of a person suffering from a mental disorder to a fair trial are identified and generalized (Article 6 of the Convention); b) criteria for the legality of restricting the right of a person suffering from a mental disorder to personal participation in the trial are proposed. CONCLUSION: Conclusions: An analysis of the ECHR's key positions led to the conclusion that there was a violation of a person's right to a fair trial in national case law (Article 6 of theConvention), due in part to the lack of clear criteria for legally restricting a person's right to a trial.

Аннотация: OBJECTIVE: Introduction: In accordance with Resolution on Cancer Control WHA58.22 Cancer prevention and control The Fifty-eighth World Health Assembly it is obvious technology for diagnosis and treatment of cancer is mature, and that many cases of cancer may be cured, especially if detected earlier Some key points on concept of legal regulation of abovementioned sphere is a base of this study. However, the problems of using an effective mechanism for protecting the rights of patients in certain types of disease, in particular cancer patients, by providing early diagnosis, are not fully developed by medical law specialists. The aim of the article is to determine the means of ensuring the right to health and life of cancer patients in particular through early diagnosis. PATIENTS AND METHODS: Material and Methods: This study is based on regulation acts, World health report (2013), The Fifty-eighth World Health Assembly, WHA58.22 Cancer prevention and control, Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, International Covenant on Economic, Social and Cultural Rights, European Convention for the Protection of Human Rights and Fundamental Freedoms, Charter of Fundamental Rights of the European Union, research papers and views of progressive-minded people in this sphere. Article is grounded on dialectical, comparative, analytic, synthetic and comprehensive research methods. RESULTS: Review: Most countries have declared a compliance of their national legislation with international standards regarding the right to life and health. The analysis of the abovementioned international acts in context of protection of the rights of patients with cancer leads to the conclusion that countries that have undertaken international legal obligations to protect the right to life are required to take the necessary measures to ensure the effective treatment of cancer patients. Taking into account that the lack of such treatment due to the specificity of the disease entails the death of the patient, the state inaction in this area should be regarded as a violation of a human right for life. Absence of state's policy in terms of early detection of cancer brings a huge problem of human rights violation and providing the standards of fundamentally different approach of the European Union countries could become a great solution. CONCLUSION: Conclusions: Individual states do not pay sufficient attention to the need of effective public health policy. In today's world, there are objective prerequisites for changing the system of protection of patients' rights and, consequently, for changing views on health protection in general, especially in the part of functioning of diagnostic procedures system. Formation of a state policy on ensuring the rights of citizens to health and life, taking into account the various consequences of such a policy, cannot be narrowed down only to the proclamation of such rights, but also requires planning and development of relevant state programs. Failure by the state to provide the proper organization of health care through the establishment of early diagnosis for cancer patients, considering wide incidence and mortal danger of cancer in case of late diagnosis, should be considered as a violation of human rights. It also does not conform to ECHR practice in terms of provisions of Articles 2, 3 and 8 of European Convention.

Аннотация: OBJECTIVE: The aim of this article is to reveal the essential features of contracts providing medical services. The author also focused on the grounds for the invalidity of such contracts - entering into medical services contract without license or permission, prohibition of some medical services or methods of treatment, the imposing of unnecessary medical services, a contradiction to corporate regulations, fraud. A significant part of the work is devoted to the consequences of the invalidity of the contract - the restitution of the money received under the contract and compensation of harm. PATIENTS AND METHODS: Materials and methods: The study is based on the statutory acts of European Union countries, the USA, and others. The author also uses acts of international law in the field of medical services and cases of court practice. CONCLUSION: Conclusions: Although the invalidity of contracts in the field of medical services is not one of the most common ways to protect a patient's rights, it is in many cases essential to the reliable delivery of medical services. The patient has the right to initiate a legal dispute regarding the invalidity of the contract. The restitution of the money paid by the patient, as well as compensation for the harm caused, can be applied not only within the framework of tort law but also under the responsibility for the breach of the contract.

Аннотация: ABSTRACT The aim: To study an impact of the epidemiological situation on enforcement of the rights and freedoms in global informational space at international, regional, and national levels (by the example of the Republic of Poland and Ukraine). Materials andmethods: This research isbasedon empiricalandanalyticaldataofWHO, conventional normson protection of rightsandfreedoms, anti-epidemic legislation of Ukraine andthe Republic of Poland, reports of European and international institutions on human rights. Over 100 sources of information have been discovered, including regulatory legal acts, academic papers. Dialectical, comparative, analytical, synthesis, system analysis methods have been applied. Conclusion: The priority of human rights and freedoms over the public interest in the fight against the previously unknown and rapidly spreading coronavirus while delivering medical care – is a paradigm that seems to be reconsidered under “syndemic” conditions in connection with “infodemic”. Epidemiological situation and human rights are interdependent in a globalized world. Channels of formal and informal informing, as well as objective, current, full enough information content, make a “person–state” communication effective. Аннотация: OBJECTIVE: Introduction: The state policy in the field of medicinal products supply and import adjustment is aimed at steady assurance of quality throughout all stages of medicinal products circulation, starting with production and import to the stage of their medical application. The aim:of the article is to study the existing permitting and restrictive legal mechanisms of importing medicinal products at international, regional and national levels. PATIENTS AND METHODS: Materials and methods: This research is based on empirical and analytical data from the WHO, EU, EU customs and medical legislation, national legislation of Ukraine and Republic of Poland, Eurostat statistics, European Court of Justice (hereinafter referred to as ECJ) rulings. CONCLUSION: Conclusions: Customs regime prohibitions and restrictions are of particular importance when it comes to importing medicinal products. That specificity is in the procedures of licensing, certification, quality control, packaging, marking etc. A proper mechanism for carrying out such procedures requires standardization at international and regional levels. At the level of regional cooperation the issue of parallel import of medicinal products is urgent. Associated risks should be minimized by means of the instruments of international, European law through the adaptation of the national licensing procedures of medicinal products import to the EU requirements, including those defined in the Association Agreements.

Аннотация: The article discusses certain aspects of legal regulation of patients' rights to innovations in healthcare sector. The subject of the study is the legislative acts on human rights in healthcare field, forms and types of human rights and directions for their implementation. Attention is focused on such types of patients' rights to innovations in healthcare field: (1) right to biomedical experiments; (2) right to reproductive technology; (3) right to donation; (4) right to transplant organs and anatomical materials; (5) right to therapeutic cloning; (6) right to change gender; (7) right to virtual reality. Essence of "innovation in medicine" is revealed, classification of human rights is given. The purpose of the article is to disclose the features of legal regulation of implementation of the patients rights to innovations in healthcare field. The methodology of this work is based on a set of research methods. The comparative method was used to elucidate the legal aspects of the patients rights to innovations in healthcare sector. Using the method of theoretical analysis, systemic and analytical methods, the term "patients' rights to innovations in healthcare field" was established, their varieties were characterized. Introduction of effective innovative models in health sector in context of patient rights will improve the availability and quality of provision of medical services to the population. It has been established that an important element in the implementation of innovative technologies in healthcare sector is the regulatory framework, which must comply with international standards.

Аннотация: The aim of the study is to analyze individual legal problems of the implementation of the human right to palliative care. To achieve this goal, statistical data on the number of palliative patients, their access to medical services were analyzed. The absence of reasons for limiting the patient's right to receive palliative care, as such a right is a fundamental human right, is substantiated. An analysis of the understanding of the legal construction of "palliative care" in the scientific literature, national and international legal documents was carried out. It was revealed that the terms "hospice care", "end-of-life-care", "respite care" are components of a precise definition - "palliative care". Two groups of subjects that ensure the human right to this type of medical care are identified, their powers are indicated. In the course of the research it was established that palliative patients, more often than other patients, need medical care, including children. This category of patients faces the following problems: incomplete providing of high-quality free medical palliative care; insufficient number of palliative and hospice departments for such patients; palliative care does not meet international standards (logistical support for palliative departments, there are no specialists of a multidisciplinary team); there is no special training for medical personnel working with incurable patients; painkillers (non-narcotic and narcotic) drugs for relieving pain syndrome of such patients are not provided in full volume; there is no cooperation of state authorities in the field of palliative care with public and charitable organizations; palliative patients do not have access to free legal services (pensions, inheritance).

Аннотация: The article reviews standards of state policies in terms of the national security of the European Union countries. The authors provide a comprehensive analysis of the theory and practice of providing national security in the EU countries. In addition to that, the article provides for a deep analysis of the major methodological approaches in regards to establishing national security in the EU. The authors make a systematic review of the development and implementation of the EU security doctrines. The aim of this research article is to analyze the development of the idea of developing a European defense policy to find an effective way of incorporating our state into European security structures. Also, the research question may be posed as discussion on the way the national security is guaranteed in the EU countries. The novelty of the study is in the way how the past, current and future national security setup is implemented in the EU countries and what may the ways of its development. Materials and methods used in studying this problem, researches and publications of such domestic and foreign researchers were used. At the same time, processes of global and European security need constant analysis and study. The results showed that the problem of the formation of the European security and defense system that emerged shortly after the end of the Second World War prompted European countries to work more closely together, particularly in the defense sector. After the Cold War and the emergence of new challenges for stability on the continent, the EU has embarked on a path towards greater consolidation and greater awareness of own defense and security interests. Conclusion of the article is that an analysis of the approaches to the national security in the EU convincingly demonstrates that the level of security depends on many factors. The successful provision of national security strategy and approach depends on the sustainability and strength of their national economies. Only a strong economy allows successfully defending national interests in growing global competition and world economic disparities. Therefore, a country shall not only develop a national security concept, relying on world experience, but, above all, to reform its domestic and foreign policies with a view to protecting all actors.

Аннотация: The problems of the correlation of private and public interests while implementing the freedom of will of the parties to the employment contract in Ukraine in terms of the COVID-19 pandemic have been studied in the article; and propositions for their solution have been substantiated. Having studied the statistic data that demonstrates the negative consequences from the COVID-19 pandemic in the world for the realization of labor rights, the authors have characterized the potential threats to the labor rights of employees and employers in Ukraine and indicate the ways of their origin. The authors have substantiated the opinion that the legislation of Ukraine was not ready for effective regulation of labor rights and their implementation in these conditions. It has been concluded that: the parties to the employment contract have become dependent on government measures to curb the spread of the pandemic; the social dialogue in the context of the COVID-19 pandemic is the legal construction that is able to balance private and public interests, to find a point of their intersection that would suit both the state and a particular entity on the legal regulation of relations in the field of hired labor.

Аннотация: The article is devoted to the content of legal instruments in terms of tourism business, namely the problem of amending the terms of the contract for tourism services. Attention has been drawn to the existence of the relationship between the activities of the tourism business and the existing legal framework, as well as the key provisions of the legal plane that regulates the rules, conditions, and level of responsibility in the provision of tourist services have been highlighted. The consequences of the negative impact on the activities of modern representatives of the tourism industry have been determined, and the need to revise the policy of providing tourist services in a pandemic caused by COVID-19 has been substantiated. Authors’ proposals for improving the legislative regulation of the tourism business in the context of the coronavirus have been provided, and a legal act that can positively influence the solution of existing problems has been proposed. The authors’ vision of the content of the package of measures that can positively influence not only the development of the tourism industry in general but primarily to help to identify those legal segments that need improvement in the future.
