Аннотация: The purpose of the article is to carry out a comparative analysis of common manifestations of corruption and corruption risks during public procurement of medicinal products in Ukraine and foreign countries in order to find effective ways to counteract to such cases. The materials of the research were the provisions of foreign legislation, national regulatory legal acts in the health care sector. Theoretical basis of the article is research focused on various aspects of combating corruption in the field of medicine, ways to prevent and minimize cases of corruption manifestations, improvement of anti-corruption measures during public procurement of medicinal products. The authors of the article have used comparative, comparative and legal, historical and legal, formal and legal methods, methods of formal logic, method of system analysis. It has been concluded that the problem of corruption is not new for public procurement area. However, corruption risks increase significantly during emergency situations. Public procurement of medicinal products is an extremely important and at the same time rather prone procedure to such risks. Threats of corruption manifestations during public procurement of medicinal products affect not only the country's economy, but also the indicators of the public health of the population, its working ability and vital function in the whole. The importance of the studied issue determines the need to strike a balance between the promptness of conducting the procurement of medicinal products, the preservation of anti-corruption measures and the effectiveness of response to emerging threats. Wide coverage of procedures of public procurement of medicinal products with the usage of electronic trading systems together with the demonstrativeness and accountability of such activities, can act as appropriate tools to prevent corruption manifestations. Taking into account the possible manifestations of corruption at each stage of public procurement is an important matter. It allows us to focus on counteraction measures and the proper response of the state to illegal actions.

Аннотация: Global processes touch on and affect of various spheres and braGlobal processes touch on and affect of various spheres and branches of human activity, including the health sector. Open borders facilitate the migration of people around the world. One of the goals of such migration is to obtain medical services. According to the World Health Organization, by 2022, the health and tourism sectors will jointly become one of the world's significant industries, which also will be facilitated by the global tendency of aging of the world's population. In recent years, medical tourism accounts for about 2% of world GDP. Development of the sphere of medical services gives rise to the practical need for the legal consolidation of the institution of medical tourism. Due to the fact that the number of people who want to combine rest and treatment is growing rapidly, this situation leads to the consideration of a fairly new sphere in the healthcare industry as medical tourism. The purpose of the study is to analyse the development of medical tourism in Ukraine, identify its problematic theoretical and practical aspects both in the tourist sphere of Ukraine and in the healthcare sector, as well as to search for scientifically-based ways to improve the regulatory and legal mechanism that regulates the activities of medical tourism in Ukraine. To achieve this goal have been investigated the medico-legal nature of medical tourism in Ukraine, an analysis of its implementation in the field of international medical tourism, the mechanisms of its implementation. In Ukraine, have been created public organizations to develop medical tourism as one of the most promising areas of health care, aimed at interacting with Ukrainian and international public and charitable organizations. At the same time, it should be noted that at the initial stage medical tourism needs both legal regulation and state financial support. It is necessary to highlight the subjects of such activities at the legislative level, paying special attention to medical providers, the mechanism of influence on them by the state, their functional responsibilities, which can be organization and support of the patient during travel, the search for clinics and the conclusion of contracts with them for the provision of medical services, conclusion of contracts for the provision of services for transportation, accommodation, insurance. Attracting investors and government funding will allow the restoration of unique medical resorts, clinics and hospitals in the development of reproductive health, spa and rehabilitation treatment; create more favourable conditions for attracting foreign patients

Аннотация: Purpose: The purpose of this paper is to examine the international regional system of the preservation of the right to health in the European human rights system through the work of the ECtHR, to analyse the case law of the ECHR based on the human right to health. This purpose determines the following tasks: to identify the features of the realization of the right to health in the European mechanism of human rights protection; to study the mechanism of realization of the right to health in the activity of the ECtHR; to describe the case law of the ECtHR in terms of the right to health. Design/methodology/approach: The “black letter” law methodology is used to focus attention on conducting research on the letter of the law and the desire to conduct a descriptive analysis of legal norms, based on primary sources. Findings: On the basis of the conducted researches, it is possible to draw a conclusion that the ECHR, albeit implicitly, refers to the right to health as well. Originality/value: The right to health is included in the catalogue of the most important universally recognized human rights and is most often considered as an integral part of socio-economic human rights, but there is no special universal or regional mechanism for protecting this category of rights.

System signs of statutory regulation of occupational health and safety in the republic of poland [Текст] = Системні ознаки нормативно-правового регулювання охорони праці у Республіці Польща / V. L. Yarotskiy, Y. D. Dreval, S. O. Zaika // Journal of the National Academy of Legal Sciences of Ukraine. - 2021. - Vol. 28, Iss. 3. - P. 238-247

Аннотация: The study analyses the question of the essence and structure of statutory regulation of occupational health and safety in the Republic of Poland. The relevance of the subject under study is primarily explained by the fact that in Poland, against the background of undoubted economic success, there is an intensive process of improving the legal and organisational foundations of the corresponding range of social and labour relations. The study of this issue is of paramount importance for those countries that had approximately the same “starting conditions” with Poland – the recurrence of state socialism, which devalued the principles of a market economy and the possibility of full protection of working people. The purpose of this study is to present and substantiate the systemic features of occupational health and safety in the Republic of Poland in difficult present-day conditions. The study is based on understanding the methodology as a complex integrated system of perception of reality and scientific cognition, and conducted based on the necessary scope of methods, namely: method of system analysis, historical legal method, structural-functional method, comparison method, special comparative legal method, and cross-temporal analysis. The authors of the present paper noted that the statutory regulation of occupational health and safety in the Republic of Poland has all the features of systemic nature. Most importantly, this is explained by the harmonious correlation of two components: purely statutory and legal support of the corresponding share of social and labour relations. Notably, the statutory regulation of occupational health and safety is undergoing continuous improvement depending on current challenges and threats. For countries that have been united with Poland in the recent past in the form of state socialism, the experience of establishing the work of tripartite participants in social dialogue (government agencies, employers' and workers' representatives) is also important. The scientific value of the present paper primarily lies in the necessity and feasibility of analysing the systemic features of statutory regulation of occupational health and safety. In this case, it is important to use both the method of system analysis and a clear distinction between the concepts “system research” and “research of systems” (the latter in this case appears both as a system of legal regulation of occupational health and safety and as a complex set of public authorities and other organisations involved in the important task of ensuring due occupational health and safety).

    Правовые и морально-философские проблемы эвтаназии [Текст] = [Legal, moral and philosophical problems of euthanasia] / Т. В. Корчева, Е. П. Невельская-Гордеева // Georgian medical news. - 2021. - No 9 (318). - P. 172-174
УДК

Аннотация: The purpose of this study is to discuss and present authors' vision of problems of euthanasia legal regulation in legislation with due consideration of human rights and liberties. The study was performed considering a set of disciplines: medicine, jurisprudence, religion, philosophy. A number of international documents were generalized, practice of European Court of Human Rights, Criminal Codes of Ukraine, Georgia and a number of other countries, relating to the question under study, views of scholars on moral and legal aspects, juridical and philosophical comprehension of this agenda. The following scientific methods were applied: systemic legal method, comparative legal method, philosophical legal method, logical method, as well as analysis and synthesis method. The authors developed proposals in solution of problems connected with this subject matter. Legalization of euthanasia is found to be possible by allowing its application to be reflected in Article 52, Law of Ukraine "Fundamentals of Ukrainian Legislation on Public Health". We determined that execution of euthanasia belongs to rights of physician, not his/her duties. In this we noted that this novelty will rule out any possibility of subsequent introduction of a special norm to Ukrainian Criminal Code stipulating criminal responsibility of physician for execution of euthanasia and, as a subsequence, will preclude any pre-trial and trial judicature (Articles 214, 215, Code of Criminal Procedure of Ukraine).

Аннотация: OBJECTIVE: The aim: This article aims to raise awareness and stimulate serious discussion about the dangers of illegal Internet pharmacies for patient safety and public health, the necessity to improve legal instruments, and unite the efforts of governments, professional organizations, and civil society for combating this activity. PATIENTS AND METHODS: Materials and methods: This study is based on the Medicrime Convention, empirical and analytical data of the WHO, Interpol, Europol, NABF, Directive 2011/62/EU of the European Parliament and of the Council of June 8, 2011, the regulatory acts and juridical practice of Ukraine, experts interview of pharmacy practicians, analysis of websites. Totally 18 laws and papers, 34 court judgments, 50 websites were analyzed, six experts were interviewed. Dialectical, comparative, analytic, synthetic, system analyses and sociological research methods were used. RESULTS: Results: Illegal Internet pharmacies are widespread in Europe, especially during the COVID-19 pandemic. This black market poses a severe threat to patient safety and public health as falsifying, substandard, and smuggled medicines are sold through these channels. Without any exception, all illegal pharmacies sell prescription drugs without any prescriptions. Regulatory and protective legal instruments at the national and international levels are insufficient to counter the Internet trade in medicines. CONCLUSION: Conclusions: The widespread proliferation of illegal Internet pharmacies in Europe requires European states to work together to protect patient safety and public health. A legal mechanism needs to be established to exchange information and combat illegal pharmaceutical activities on the Internet at the international level. At the national level, it is necessary to strengthen control over the wholesale of prescription medications to prevent them from entering the black market.

Human right to virtual reality in the healthcare: Legal issues and enforcement problems [Текст] / O. Shevchuk, O. Bululukov, O. Lysodyed, V. Mamonova, Y. Matat // Juridical Tribune. - 2021. - Vol. 11, Spec. Iss. - P. 302-315

Аннотация: A key feature of modern legal relations in the healthcare sector is the widespread use of digital technologies. This study describes certain aspects of the legal regulation of the human right to virtual reality in the healthcare sector and the problems of law enforcement. The methodology of this work is based on an interdisciplinary approach using comparative legal, dialectical and systemic methods. The main objective of this article is to determine the forms and directions of the use of virtual reality in health care in the context of human rights. It is emphasized that the introduction of smart technologies, virtual reality in the healthcare sector is the main modern trend in the development of healthcare in order to improve the provision of healthcare services. The human right to use virtual reality in healthcare is to ensure the actions of virtual reality users within the framework of virtual information relations in the healthcare sector, which are governed by the relevant legal norms. The human right to use virtual reality in healthcare is a fourth generation of human rights. These rights include all rights that have arisen as a result of scientific progress, the development of morality, namely "somatic rights", as well as information rights. The use of virtual reality in the healthcare sector is possible in the following areas, namely: (1) medical training, (2) surgical modeling, (3) rehabilitation, (4) psychotherapy and psychology, (5) ophthalmology, (6) telemedicine, etc. It is stated that user safety, privacy, freedom of expression, ethics and copyright protection in the use of virtual reality in healthcare require legislative regulation, taking into account the European experience. The virtual space in the healthcare sector provides opportunities for the realization of human rights and freedoms regarding the preservation of their health, but can be used to carry out actions that contradict the norms of law and have illegal behavior. The latter requires an improvement in the regulatory framework when using the virtual space of the healthcare sector to protect the interests of the individual, society and the state using international standards.

The findings of this study suggest that biosafety worldwide is a key dimension of global security and ensuring world peace. This study also recommended the establishment of the strong global norm that would provide for verification of disarmament and compliance with the Biological Weapons Convention, the responsibility of States to develop, manufacture, and accumulate of biological weapons should be adapted to that end. Furthermore, it is noted that the world community should reconsider the position on the mechanism of investigations by the United Nations Security Council, as well as the procedure for the use of the veto of the five permanent members of the Security Council in any decision concerning the maintenance of international peace and security.

Аннотация: OBJECTIVE: The aim: The article analyzes the impact of abortion on human rights and women's health in the light of medical and technological advances of the digital age. PATIENTS AND METHODS: Materials and methods: The methods of research were dialectic approach and general analysis of normative and scientific sources, analysis of the results of studies of women's mental health after abortions, analysis of judicial practice, especially decisions of the European Court of Human Rights, the results of author's own empirical studies, the formal legal method, the comparative legal method and the historical method. It has been established that there is no strong evidence that abortion negatively affects a woman's mental health, including no evidence that the emotional consequences aredeeply personal, or are rather the result of societal pressure. Arguments were refuted about extending the protection of human rights regarding abortion to unborn children and their fathers. CONCLUSION: Conclusions: The article emphasizes that the ethical burden on medical workers, especially in jurisdictions that require the approval of a doctor to legally terminate a pregnancy, increases significantly due to information flows and community expectations dictated by new medical advances.
