Аннотация: The purpose of the article is to study the positive experience of the most developed countries in the field of transplantation and implementation of activities related to transplantation in order to determine possible ways to improve legal regulation in this area in Ukraine. It has been concluded that the formation and implementation of the state policy in the researched area is influenced by the model of consent for organs, tissue and cells transplantation introduced in the state, for example, the model of presumed consent (Spain), the model of donation or deed of gift (USA, Korea). It has been indicated that an effective infrastructure in the field of transplantation was formed in foreign countries; state authorities were created to coordinate the activities and manage the distribution, expansion and transplantation of "imported" organs. It has been offered to introduce such a positive experience of implementing transplantation into other countries of the world as: the availability of donors registration (USA, Korea), the exchange of information about donors and recipients (USA), the culture of organs donation (Spain), the implementation of propaganda and advertising activities on organs donation regulated at the legislative level (Spain), continuous professional development of medical employees involved in transplantation activities (Spain), the courtesy program for donors and support for their families (Korea), legislative norms on the protection of the rights of living donors (Spain, Korea).

Аннотация: The purpose of the article is to carry out a comparative analysis of common manifestations of corruption and corruption risks during public procurement of medicinal products in Ukraine and foreign countries in order to find effective ways to counteract to such cases. The materials of the research were the provisions of foreign legislation, national regulatory legal acts in the health care sector. Theoretical basis of the article is research focused on various aspects of combating corruption in the field of medicine, ways to prevent and minimize cases of corruption manifestations, improvement of anti-corruption measures during public procurement of medicinal products. The authors of the article have used comparative, comparative and legal, historical and legal, formal and legal methods, methods of formal logic, method of system analysis. It has been concluded that the problem of corruption is not new for public procurement area. However, corruption risks increase significantly during emergency situations. Public procurement of medicinal products is an extremely important and at the same time rather prone procedure to such risks. Threats of corruption manifestations during public procurement of medicinal products affect not only the country's economy, but also the indicators of the public health of the population, its working ability and vital function in the whole. The importance of the studied issue determines the need to strike a balance between the promptness of conducting the procurement of medicinal products, the preservation of anti-corruption measures and the effectiveness of response to emerging threats. Wide coverage of procedures of public procurement of medicinal products with the usage of electronic trading systems together with the demonstrativeness and accountability of such activities, can act as appropriate tools to prevent corruption manifestations. Taking into account the possible manifestations of corruption at each stage of public procurement is an important matter. It allows us to focus on counteraction measures and the proper response of the state to illegal actions.

Аннотация: The problem of health is one of the global problems, the solution of which contributes to the further development of the state. The article is devoted to topical issues of medical reform implementation in Ukraine. The importance of making changes in the field of medicine is analyzed. The main problems and obstacles to the introduction of new principles of interaction are considered. The purpose of the study is to identify the most pressing problems of health care reform, to determine the essence of health care reform, to indicate its possible pros and cons. To achieve this goal, an analysis of the regulatory and legal framework for reforming the healthcare sector in Ukraine was carried out, the stages of reform that have already been completed to date and those that are still in the process of implementation, their positive and negative aspects were analyzed, methods were used: comparative legal, statistical, induction, analysis, synthesis. Based on the study, the authors concluded that the transition of the health care system from an administrative-command to a market model of medical services on an economic and legal basis is generally a positive step in choosing the direction of reform. The main fundamental principles envisaged by the reform are: the responsibility of the state, the availability and quality of medical services, the convenience of obtaining them, ensuring equal access to services and efforts to make the most efficient use of available resources.

Аннотация: The aim of the study was to substantiate the effectiveness and feasibility of the practical application of the multifactorial model of financing the prevention and treatment of dirofilariasis, its principles and methodological approaches. The basic principles of the multifactor model - an integrated approach, a combination of public and private financing, ensuring continuity of financing, discreteness of expenses; methodology for determining the effectiveness of the use of financial resources on the calculation of the return on costs for the prevention and treatment of dirofilariasis were justified. The effectiveness of local budget spending on the treatment of territories of the Kharkov region from mosquitoes on the base on the proposed principles and methodology was analyzed. As a result of the study, it has been proven the limited budgetary funds do not allow the implementation of long-term comprehensive programs for the prevention and treatment of dirofilariasis. The use of a multifactorial model of financing will allow overcoming budgetary constraints, significantly increasing the financial resources of the fight against dirofilariasis, optimizing the expenditures of state and local budgets, and ensuring targeted use of funds from the state, territorial communities, enterprises and the population.

Аннотация: OBJECTIVE: The aim: To identify the role of evidence-based medicine, its principles and approaches to patients' rights protection and the provision of medical service optimization, the skills of medical staff improvement, increasing the objectivity of court decisions in cases of non-providing quality care or death. PATIENTS AND METHODS: Materials and methods: The authors used the decisions by the European Court of Human Rights (ECtHR) on the statements of victims of unprofessional actions by doctors, international and domestic regulations on patients' rights, statistics on the results of criminal proceedings on violations of patients' rights over the past 5 years, case law of criminal and civil jurisdiction in this category of cases, the results of surveys of prosecutors, as well as the results of research by scientists in the field of medical law and criminalistics. The research is carried out on the basis of a harmonious combination of philosophical approaches, general scientific and special methods of scientific knowledge, the complex of which is chosen taking into account the goals and objectives, object and subject of research. CONCLUSION: Conclusions: In order to implement the patients' rights by legal means in accordance with the Convention for the Protection of Human Rights and Fundamental Freedoms, the European Charter of Patients' Rights and other international regulations in the field of medicine, the authors argue the need for greater implementation of evidence-based medicine into the practice of medical institutions as a means of improving the level of medical care and an obvious source of relevant information for litigation to protect the rights of patients and doctors. For patients' rights protection in the diagnosis and treatment of diseases, it is proposed to regulate a set of such measures: 1) to include in the educational programs of pharmacy and medicine such disciplines as «Evidence-Based Medicine» and «Rights of the patient and medical worker's rights»; 2) to oblige the doctor to explain to the patient or to his/her representative the differences of treatment protocols, to provide information to patients about official sources, which contain information on unified and updated treatment protocols and diagnosis of certain diseases, to obtain informed consent by the patient (his/her representative) on certain medical guideline; 3) to recognize medical guidelines as sources of law in criminal and civil proceedings as a kind of benchmarks for clarifying and assessing the facts of non-performance or improper performance of professional duties by a medical or pharmaceutical worker, violation of patients' rights, as well as means for doctors' legal protection and etc.

Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: Purpose: The purpose of this paper is to examine the international regional system of the preservation of the right to health in the European human rights system through the work of the ECtHR, to analyse the case law of the ECHR based on the human right to health. This purpose determines the following tasks: to identify the features of the realization of the right to health in the European mechanism of human rights protection; to study the mechanism of realization of the right to health in the activity of the ECtHR; to describe the case law of the ECtHR in terms of the right to health. Design/methodology/approach: The “black letter” law methodology is used to focus attention on conducting research on the letter of the law and the desire to conduct a descriptive analysis of legal norms, based on primary sources. Findings: On the basis of the conducted researches, it is possible to draw a conclusion that the ECHR, albeit implicitly, refers to the right to health as well. Originality/value: The right to health is included in the catalogue of the most important universally recognized human rights and is most often considered as an integral part of socio-economic human rights, but there is no special universal or regional mechanism for protecting this category of rights.

Аннотация: Given the insufficient level of regulation of the health insurance institute in Ukrainian legislation, the article attempts to investigate global experience in the context of this issue. In particular, a number of international documents were investigated, their content was characterized and the main provisions were highlighted. Based on collected and analyzed data, the authors outlined the areas of adaptation of Ukrainian legislation to the highest standards of the EU, made a proposal for the ratification of the conventions of the International Labor Organization. Supported a proposal for the development and adoption of a separate special law on general-compulsory state health insurance, which would regulate issues related to health insurance.

Аннотация: The paper investigates topical issues of application of precautionary measures against persons subject to criminal proceedings for the application of compulsory psychiatric care in the context of international standards and interpretative practice of the European Court of Human Rights (ECHR). The purpose of this paper is to identify and analyse the specific features of applying precautionary measures to a person suffering from a mental disorder based on the materials of generalization of domestic law enforcement practice in criminal proceedings regarding the application of compulsory psychiatric care. Research methods are selected with consideration of the purpose, objectives, and subject of research. General scientific and special methods of scientific cognition (dialectical, statistical, comparative law, analysis, synthesis, generalization) were used in the work. The integrated use of these methods has contributed to an objective and comprehensive scientific study. Based on the analysis of the current legislation and judicial practice, the specific features of application of preventive measures in criminal proceedings regarding compulsory psychiatric care are singled out, namely: a) they are applied to a person suffering from a mental disorder; b) are selected only in criminal proceedings concerning the application of compulsory psychiatric care; c) have a specific purpose conditioned by the presence of a mental disorder from which the person suffers. The specifics of the applying the measures envisaged by Art. 508 of the Criminal Procedure Code of Ukraine (hereinafter referred to as the CPC) allowed to question the legitimacy of the legislative approach as to their allocation to the institution of precautionary measures in criminal proceedings. In particular, it was concluded that in contrast to the general purpose of application of precautionary measures stipulated by Art. 177 of the CPC (concerning the suspect, the accused, the condemned), for the purpose of applying precautionary measures envisaged by Art. 508 of the CPC (concerning a person in respect of whom the application of compulsory psychiatric care is stipulated) are: 1) prevention of risks of their possible illegal behaviour; 2) provision of qualified psychiatric care to them; 3) ensuring the person’s safety and the safety of others. In this regard, it should be noted that the position of the domestic legislator on the possibility of applying precautionary measures to persons suffering from mental disorders is subject to reasonable criticism of the legal community. The main argument in this debatable issue is that these persons cannot be subjects to which precautionary measures are applied, as the latter, according to the general rules, can be applied to clearly defined subjects of criminal proceedings - suspects, accused, and convicts.

Аннотация: OBJECTIVE: Introduction: The article is devoted to the research of topical issues of ensuring the rights of persons suffering from mental disorders and who are subject to criminal proceedings on the application of compulsory medical measures (hereinafter - CMM). The research was conducted in the context of international standards and interpretative practice of the European Court of Human Rights (hereinafter referred to as the ECHR or the Court). The aim: The aim of this study is to analyze international acts concerning the protection of the rights of mentally ill persons when applying compulsory medical measures; to highlight and analyze the ECHR's key positions in the context of respect for the right to liberty and security of person (Article 5 1 (e) of the European Convention on Human Rights (hereinafter referred to as the Convention)) and the right to a fair trial (Article 6 of the Convention) in criminal proceedings concerning the use of CMM; to analyse the law enforcement practice and activities of psychiatrist experts on compliance with European standards for the protection of the rights of persons with mental disorders who are subject to criminal proceedings. PATIENTS AND METHODS: Materials and methods: rescent scientific researches; provisions of international legal acts in the field of psychiatric care; the legal standpoint of the ECHR in respecting the rights of persons with mental disorders (15 decisions were analyzed in which the ECHR addressed these issues in the context of the requirements of Articles 5 and 6 of the Convention); criminal procedural legislation of foreign states (Belarus, Kazakhstan, Moldova, Russian Federation, Estonia, Uzbekistan, Germany); the results of the survey of 20 psychiatrists and experts conducted by the authors were used in this article To achieve this aim of research process a set of general scientific and special methods of cognition, including comparative and legal method, system and structural method, method of generalization, method of analysis and synthesis, method of sociological research, method of expert evaluation, etc. bein used. RESULTS: Results: summarized and generalized ECHR's standpoints concerning: a) minimum conditions without which a person cannot be considered as "mentally ill" and imprisoned; b) the aspects taken into account by the ECHR within each minimum condition in the context of ensuring the right to liberty and security of person (Article 5 1 (e) of the Convention); c) the peculiarities of the personal participation of an individual with a mental disorder in the judicial review of the application of CMM in terms of observing its right to a fair trial (Article 6 of the Convention). The degree of extrapolation of these standpoints to the activity of psychiatrists was identified and analyzed. CONCLUSION: Conclusions: the current practice of applying CMM in criminal proceedings does not fully comply with the international standards and legal positions of the ECHR in terms of providing a person with a mental disorder the right to liberty and security of person and the right to a fair trial (in particular, the minimum conditions without which a person cannot be considered as "mentally ill" and be imprisoned are not always met).
