Аннотация: OBJECTIVE: The aim of the research is to study the peculiarities of the legislative consolidation of criminal and disciplinary liability for offenses of health care professionals in Ukraine and other states. PATIENTS AND METHODS: Materials and methods: Criminal legislation of Ukraine, international acts, decisions of the European Court of Human Rights (hereinafter - ECHR), data of the Integrated State Register of Judgments, as well as criminal legislation of Germany, the French Republic, the Kingdom of Denmark, the Republic of Belarus, Kazakhstan and many other countries. A set of general and special scientific methods of scientific knowledge was the methodological basis. The use of the comparative law method has become useful in the analysis of Ukrainian legislation and the legislation of other states. CONCLUSION: Conclusions: the article examined the features of the legislative consolidation of criminal and disciplinary liability for offenses of health care professionals in Ukraine and other countries. A comparative legal analysis of the legal enshrinement of the corpus delicti in the form of non-performance or misconduct of professional duties by a health care or pharmaceutical worker was carried out on the example of Ukraine and many other countries; types of penalties for medical crimes, which are established for this type of offense, were identified; sanctions for committing a disciplinary misconduct by a health care professional were determined on the example of the legislation of different countries.

Аннотация: OBJECTIVE: The aim: Is to analyze the development of the modern legal framework for child's health care, to clarify the benefits of a human rights-based approach, which is now is mainstreaming for understanding the right of children to health and means of its protection. PATIENTS AND METHODS: Materials and methods: To achieve this goal, as well as taking into account the specifics of the topic, the following research methods became relevant: the application of a dialectical approach and historical method made it possible to understand the patterns of formation and development of ideas of children's rights and health within the international community and national states; formal-legal method was used when studying legal texts (international law acts, both of universal and regional level, interpretation and clarification of human rights treaty bodies, expert reports and research, case law), and comparative-legal was used to compare different approaches on health protection in various international human rights mechanisms (US Supreme Court, Council of Europe). CONCLUSION: Conclusions: Today, perceptions of children's rights at the doctrinal and jurisprudential levels are quite developed due to a broad understanding and openness to progressive interpretation. In particular, the inclusion into the legal context such determinants as the inviolability of the dignity and private life of the child, proper understanding of the stages of adulthood, and an assessment of the child's developmental environment has made modern international law and national legal systems to become more viable in sense of protection of child's well-being in today's world.

Аннотация: OBJECTIVE: Introduction: Practical implementation of the provision of appropriate medical assistance to detainees raises a number of problems that needs scientific reflection in order to come up with proposals for improving regulation in this sphere. To date, the issues of particular concern are: proper documentation of a detained person's health status; promptness and accuracy of diagnosis of a person; providing a comprehensive therapeutic strategy for his/her treatment; delay in providing medical care and its quality; continuation of treatment of a sick person in custody. The aim: of this paper is to highlight and analyze the key positions of the European Court of Human Rights (hereinafter - ECHR) on the criteria for recognizing appropriate medical care for detainees. PATIENTS AND METHODS: Materials and methods: Scientific articles, international regulations governing the provision of medical assistance to detaines, ECHR practice regarding the provision of medical assistance to detainees and criteria for recognition as appropriate (22 relevant decisions where ECHR addressed these issues were analyzed). To achieve this goal, we've used a set of general scientific and special methods of cognition, in particular, comparative-legal method, system-structural method, method of generalization, method of analysis and synthesis, etc. CONCLUSION: Conclusions: Medical assistance to detainees is adequate, subject to the criteria set out in the ECHR's practice, which in turn will ensure respect for the human rights and freedoms guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter - the Convention).

Аннотация: In modern conditions Ukraine has a steady trend of high mortality rates caused by the low level of health care quality. In this regard, it becomes relevant to develop scientific approaches to improving the efficiency of administrative and legal regulation of the health service in the country. The article substantiates the main factors of the efficiency of the administrative and legal regulation of health care in Western Europe. The current state of the health service in Ukraine was analyzed. The key factors of the critical health care state in the country are identified. The expert evaluation technique was used to assess the efficiency of medical reform in Ukraine and to justify the main directions for improving the legal regulation of the health care service, taking into account the efficiency factors applied in Western Europe. A system of recommendations was developed for improving the legal framework of health care in Ukraine. The research results are practical in nature and will become the basis for the implementation of Ukraine's European desire to strengthen the health care system and its potential, increase its safety and protect public health as a prerequisite for sustainable development and economic growth.

Аннотация: Mass illegal felling of trees in Ukraine’s Carpathians is one of the most crucial and dangerous modern ecological issues raised by the author of this article. The scale of tree felling has been estimated according to official government sources as well as international nongovernmental organizations; there has also been studied the fact of minimizing the magnitude of the problem by central state bodies. The correlation between the increase of illegal lumbering and the growth of illegal employment among population in Zakarpattia region was established. Specific propositions have been presented with respect to this problem at many levels, including legislative, organizational and legal, as well as international.

Аннотация: OBJECTIVE: Introduction: The article is devoted to the research of topical issues of ensuring the rights of persons suffering from mental disorders and who are subject to criminal proceedings on the application of compulsory medical measures (hereinafter - CMM). The research was conducted in the context of international standards and interpretative practice of the European Court of Human Rights (hereinafter referred to as the ECHR or the Court). The aim: The aim of this study is to analyze international acts concerning the protection of the rights of mentally ill persons when applying compulsory medical measures; to highlight and analyze the ECHR's key positions in the context of respect for the right to liberty and security of person (Article 5 1 (e) of the European Convention on Human Rights (hereinafter referred to as the Convention)) and the right to a fair trial (Article 6 of the Convention) in criminal proceedings concerning the use of CMM; to analyse the law enforcement practice and activities of psychiatrist experts on compliance with European standards for the protection of the rights of persons with mental disorders who are subject to criminal proceedings. PATIENTS AND METHODS: Materials and methods: rescent scientific researches; provisions of international legal acts in the field of psychiatric care; the legal standpoint of the ECHR in respecting the rights of persons with mental disorders (15 decisions were analyzed in which the ECHR addressed these issues in the context of the requirements of Articles 5 and 6 of the Convention); criminal procedural legislation of foreign states (Belarus, Kazakhstan, Moldova, Russian Federation, Estonia, Uzbekistan, Germany); the results of the survey of 20 psychiatrists and experts conducted by the authors were used in this article To achieve this aim of research process a set of general scientific and special methods of cognition, including comparative and legal method, system and structural method, method of generalization, method of analysis and synthesis, method of sociological research, method of expert evaluation, etc. bein used. RESULTS: Results: summarized and generalized ECHR's standpoints concerning: a) minimum conditions without which a person cannot be considered as "mentally ill" and imprisoned; b) the aspects taken into account by the ECHR within each minimum condition in the context of ensuring the right to liberty and security of person (Article 5 1 (e) of the Convention); c) the peculiarities of the personal participation of an individual with a mental disorder in the judicial review of the application of CMM in terms of observing its right to a fair trial (Article 6 of the Convention). The degree of extrapolation of these standpoints to the activity of psychiatrists was identified and analyzed. CONCLUSION: Conclusions: the current practice of applying CMM in criminal proceedings does not fully comply with the international standards and legal positions of the ECHR in terms of providing a person with a mental disorder the right to liberty and security of person and the right to a fair trial (in particular, the minimum conditions without which a person cannot be considered as "mentally ill" and be imprisoned are not always met).

Аннотация: OBJECTIVE: The aim: To identify the role of evidence-based medicine, its principles and approaches to patients' rights protection and the provision of medical service optimization, the skills of medical staff improvement, increasing the objectivity of court decisions in cases of non-providing quality care or death. PATIENTS AND METHODS: Materials and methods: The authors used the decisions by the European Court of Human Rights (ECtHR) on the statements of victims of unprofessional actions by doctors, international and domestic regulations on patients' rights, statistics on the results of criminal proceedings on violations of patients' rights over the past 5 years, case law of criminal and civil jurisdiction in this category of cases, the results of surveys of prosecutors, as well as the results of research by scientists in the field of medical law and criminalistics. The research is carried out on the basis of a harmonious combination of philosophical approaches, general scientific and special methods of scientific knowledge, the complex of which is chosen taking into account the goals and objectives, object and subject of research. CONCLUSION: Conclusions: In order to implement the patients' rights by legal means in accordance with the Convention for the Protection of Human Rights and Fundamental Freedoms, the European Charter of Patients' Rights and other international regulations in the field of medicine, the authors argue the need for greater implementation of evidence-based medicine into the practice of medical institutions as a means of improving the level of medical care and an obvious source of relevant information for litigation to protect the rights of patients and doctors. For patients' rights protection in the diagnosis and treatment of diseases, it is proposed to regulate a set of such measures: 1) to include in the educational programs of pharmacy and medicine such disciplines as «Evidence-Based Medicine» and «Rights of the patient and medical worker's rights»; 2) to oblige the doctor to explain to the patient or to his/her representative the differences of treatment protocols, to provide information to patients about official sources, which contain information on unified and updated treatment protocols and diagnosis of certain diseases, to obtain informed consent by the patient (his/her representative) on certain medical guideline; 3) to recognize medical guidelines as sources of law in criminal and civil proceedings as a kind of benchmarks for clarifying and assessing the facts of non-performance or improper performance of professional duties by a medical or pharmaceutical worker, violation of patients' rights, as well as means for doctors' legal protection and etc.

Аннотация: The paper investigates topical issues of application of precautionary measures against persons subject to criminal proceedings for the application of compulsory psychiatric care in the context of international standards and interpretative practice of the European Court of Human Rights (ECHR). The purpose of this paper is to identify and analyse the specific features of applying precautionary measures to a person suffering from a mental disorder based on the materials of generalization of domestic law enforcement practice in criminal proceedings regarding the application of compulsory psychiatric care. Research methods are selected with consideration of the purpose, objectives, and subject of research. General scientific and special methods of scientific cognition (dialectical, statistical, comparative law, analysis, synthesis, generalization) were used in the work. The integrated use of these methods has contributed to an objective and comprehensive scientific study. Based on the analysis of the current legislation and judicial practice, the specific features of application of preventive measures in criminal proceedings regarding compulsory psychiatric care are singled out, namely: a) they are applied to a person suffering from a mental disorder; b) are selected only in criminal proceedings concerning the application of compulsory psychiatric care; c) have a specific purpose conditioned by the presence of a mental disorder from which the person suffers. The specifics of the applying the measures envisaged by Art. 508 of the Criminal Procedure Code of Ukraine (hereinafter referred to as the CPC) allowed to question the legitimacy of the legislative approach as to their allocation to the institution of precautionary measures in criminal proceedings. In particular, it was concluded that in contrast to the general purpose of application of precautionary measures stipulated by Art. 177 of the CPC (concerning the suspect, the accused, the condemned), for the purpose of applying precautionary measures envisaged by Art. 508 of the CPC (concerning a person in respect of whom the application of compulsory psychiatric care is stipulated) are: 1) prevention of risks of their possible illegal behaviour; 2) provision of qualified psychiatric care to them; 3) ensuring the person’s safety and the safety of others. In this regard, it should be noted that the position of the domestic legislator on the possibility of applying precautionary measures to persons suffering from mental disorders is subject to reasonable criticism of the legal community. The main argument in this debatable issue is that these persons cannot be subjects to which precautionary measures are applied, as the latter, according to the general rules, can be applied to clearly defined subjects of criminal proceedings - suspects, accused, and convicts.

Аннотация: This article studies specifics of Islamic understanding of freedom of expression and significant differences between Islamic and European understanding of that concept. Freedom of expression is recognized in Islam; however, it has significant and deeply-rooted peculiarities. In particular, Islam strictly prohibits imaging Prophet Muhammad, let alone making cartoons of him. For instance, from the perspective of Muslims, imaging Prophet Muhammad as a dog is extremely cynical, since a dog in Islam is an unclean animal inadvisable to contact with. Also, there is long-established perception of humour and its admissibility in Islam. For example, under Islamic law one shall not tell lies or scare another person; one shall not joke with an older person, a teacher, a scientist, a manager, a person who does not understand jokes, an unknown man or woman; a joke shall not be offensive or degrading a man or a family; one shall not joke about prohibited issues, tell dirty stories, disclose intimate details, resort to insults or slander. The article points out that Europeans perceive drawing cartoons of the Prophet as freedom of expression. However, in the eyes of Muslims such cartoons constitute violation of a number of prohibitions existing in Islam and therefore deeply insult their religious and cultural feelings. Such insults may cause religious conflicts with many victims, like the one that happened in the January of 2015 in the office of Charlie Hebdo French satirical weekly newspaper. To prevent similar and even more terrible tragedies in the future and release tension between Europeans and Muslims, primarily in Europe, the article explores the legal framework and conditions for restriction of freedom of expression set out in universal international law, the European Convention on Human Rights and relevant case-law of the ECHR. The set of the general and specific scientific methods of research were used by the authors according to the subject and scope of the study: sociological, statistical, dialectical, formal stylistic, axiological, hermeneutic, systemic, comparative legal method etc.

Аннотация: Given the insufficient level of regulation of the health insurance institute in Ukrainian legislation, the article attempts to investigate global experience in the context of this issue. In particular, a number of international documents were investigated, their content was characterized and the main provisions were highlighted. Based on collected and analyzed data, the authors outlined the areas of adaptation of Ukrainian legislation to the highest standards of the EU, made a proposal for the ratification of the conventions of the International Labor Organization. Supported a proposal for the development and adoption of a separate special law on general-compulsory state health insurance, which would regulate issues related to health insurance.

Аннотация: The aim is a comparative and legal study of liability in the health care sector in the EU countries and Ukraine. Materials of the research are the EU legislation, laws of the EU countries, Ukraine, statistical information. The authors of the study have used the systematization method, comparative and legal method, analysis and generalization of statistical data. Ensuring an adequate level of health care, providing affordable health care service and medical care to citizens is one of the main tasks of any country, including Ukraine. It is the reason why the state controls this sector through the institution of liability, which does not fully meet the standards of the present day existing in the EU Member States, and therefore needs to be improved. The authors of the article have summarized the experience of the EU countries and Ukraine in regard to liability in the health care sector and have determined some ways to improve Ukrainian legislation. The authors have established the necessity to borrow the experience of certain EU countries in regulating financial (France, Germany, Italy, Poland), civil (Italy), criminal (Germany), administrative liability (Latvia) in the health care sector

Аннотация: OBJECTIVE: Introduction: The Ukrainian state has an urgent necessity of rapid search for essentially new legal and organizational forms of the healthcare system, reform of the legal regulation of healthcare services provision. In the context of European integration, the advancement of the medical industry reform is closely related to consideration of international standards and norms of health care. The aim: To study the impact of international medical law on the Ukrainian health care legislation. PATIENTS AND METHODS: Materials and methods: International and Ukrainian regulations and documents on health care were used in the research. System and structural, functional and legal comparative methods as well as systematization, analysis and synthesis were determinative in the research process. RESULTS: Review: Systematization of international documents on health care was made. The major problems in the Ukrainian health care legislation were determined in terms of their conformity with the international legislative norms. The expediency of the Medical Code adoption was grounded and its structure was defined. CONCLUSION: Conclusions: Most health care international acts are ratified by Ukraine and their provisions are implemented in the legislation. Simultaneously, there is a row of problems, which hinder the Ukrainian health care development and place obstacles in the way of European integration. To remove these obstacles, it is expedient to create a codified act - the Medical Code, which would systematize the provisions of the current medical laws and regulations and fill in the existing gaps in the legal regulation of health care.

Аннотация: Introduction: The study of the international standards of compulsory medical measures’ (CMM) application to persons who have committed socially dangerous acts is relevant problematics of medical law. The aim: of the research is to define international standards for the implementation of CMM, as well as assessing the state of their implementation in Ukrainian law and medical practice. Materials and methods: The study is based on international acts, ECHR decisions, legislation of Ukraine and foreign countries, scientific articles in the fields of law and psychiatry as well as empirical materials that illustrate application of CMM in Ukraine. Dialectical, comparative-legal, statistical, induction and deduction, legal modeling, sociological research were used in this research. Conclusions: As a result of the research the concept of the international standards of CMM application is defined, their scope in the law-enforcement and medical practice of Ukraine is determined, the system and meaning of these standards are formulated.

Аннотация: Introduction: World health develops by huge progressive tempos. Each separate state has features of health-care system. Despite this, there are only few general models of health care all over the world. Scientific summarizing of main legal and organizational and economic aspects of functioning of each of general models of health care system should has a place periodically including its topical changes. This is the purpose of our review. Materials and Methods: We used empirical methods (data collection, study, and comparison), methods of comparative analysis, and generalization of statistical data. It has been used regulatory legal acts regulating the functioning of health systems, reports from the World Health Organization (WHO), Bloomberg analytical agency, and Foundation for Public Welfare (published in English on the site) also. Results and Discussion: Shot comparative characteristic of the functioning of the main models of health-care systems and analysis of the indexes of the efficiency of functioning of the health-care models including all available disadvantages allows us to conclude about slightly higher efficiency of the one model compared to others (the state system and the Beveridge system). Conclusion: Assessment of the approaches for describing the effectiveness of the functioning of health-care systems allows us to describe two mechanisms of calculation of the health-care effectiveness index - the Bloomberg and The Commonwealth Fund. The obtained results allow claiming that the most effective model of health-care system is system of public health financing. Given study shows the features and predicted benefits of actual models of health-care systems. Given results may be used in the process of reforming of health-care system for the developing and developed countries.

Аннотация: OBJECTIVE: The aim: Is to conduct a comparative legal analysis of the use of natural resources for health and recreation purposes in Ukraine, the European Union, and other countries to improve the scientific theoretical basis of the legal regulation for the use, protection, and conservation of such natural resources. PATIENTS AND METHODS: Materials and methods: The national and international legal instruments regulating the rights to health and the right to use natural resources for health and recreational purposes were examined by analyzing practices of foreign states in the field of these legal relations, in particular, the comparative-legal, complex, formal, and logical, structural and functional methods along with analytical and empirical research tools. CONCLUSION: Conclusions: The legislation of Ukraine does not fully disclose the concepts, features, classification of natural healing and recreational resources, and therefore many aspects of their use, protection, and conservation remain uncertain and unsecured provisions of regulations. The article features approaches to improving the current ecological legislation promoting proper legal regulation of using natural resources for health and recreational purposes, thereby creating the necessary conditions to ensure the right to health care.

Аннотация: The relevance of the research is the contract provisions for private medical services have been thoroughly developed in scientific-legal doctrine; many studies analyze their content, classification, application. The legal essence of contracts on State (public) medical services in the current legislation of Ukraine, is not sufficiently researched that makes the issue in this area relevant. The purpose of the study is aimed at defining the concept and legal nature of contract provision for public medical services; generalization and critical understanding of the legislator's approaches to determining the role and significance of public medical service contracts in the system of contracts in Ukraine. The research main methods are dialectical, formal-logical, systemic. In particular, the systemic method was used to determine the place of the contract in the contract system as a whole. Special mention should be made of the specific scientific methods (comparative-legal, formal-legal) which were utilized to find out the legal nature of the public medical service contracts. The relevance of the research: the provisions on contract for provision private medical services are thoroughly developed in scientific-legal doctrine; many studies analyze their content, classification, application. The legal essence of the contract on public medical services in the current legislation of Ukraine, has not been sufficiently researched that that requires further examination. The research results are based on the analysis of regulatory material. It is concluded that there is no single agreed approach regarding the procedure for concluding these contracts, determining their legal nature and contract conditions in Ukraine. The authors emphasize on the recognition of the health of an individual as the highest social value of the European community, necessity of effective mechanisms for regulating health care relationships in order to achieve the highest level of health standards for all human beings, and improvement of the quality of life in general and health care in particular. The authors note that further expansion of public-private partnerships in the medical field is useful and necessary for all countries in the world. The medical services provision by public health institutions may be provided on the basis of private civil contracts. Practical significance is evident from the analysis of the normative material. The authors outline the main problematic issues regarding the legislative regulation of state medical contract and make specific proposals for improvement of the existing legislation in the medical service field. The worldwide pandemic COVID-19 has shown that effective mechanisms to regulate health care delivery relations in order to achieve the highest standard of health for all humanity and improve the quality of life in general, and health care in particular is a pressing issue for both developed countries and those seeking it. The conclusions and suggestions made can be used in the research sphere for further elaboration of problems of contract law, in the sphere of practical activity, in particular to develop contract forms.

Аннотация: OBJECTIVE: Introduction: The problem of medical errors is always relevant in medical literature and law. Meanwhile, it is understood diametrically opposite by doctors, patients, and lawyers. This has a negative impact on patients' trust in medical professionals, and sometimes leads to criminal prosecution for a so-called "medical error", which in fact is conscientious deception, not a crime, and should exclude criminal liability. The aim: The aim of this work is the illustration of diametrically opposed approaches to understanding the essence of the concept of "medical error" from patients', doctors', and lawyers' views that are often generated by subjective approaches and results in distrust between doctors and patients, medical professionals and lawyers. The aim of the article is also to realize the ECHR's approach to understanding the essence of a medical error and distinguishing it from the negligence that should lead to liability of the medical professionals. PATIENTS AND METHODS: Materials and methods: In this research a legal doctrine, scientific works, provisions of international legal acts, in particular, the Convention for the Protection of Human Rights and Fundamental Freedoms were used, as well as the practice of the ECHR (12 relevant ECHR decisions), where the Court considered cases related to "medical errors" and formulated positive obligations of the state in the field of health care were analyzed. A complex set of general and special methods of cognition was used to achieve the aim, they are comparative legal method, systemic and structural method, methods of generalization, analysis and synthesis, sociological method, hermeneutical method, etc. RESULTS: Results: A survey of patients, medical professionals and lawyers conducted by the authors (300 persons), analysis of doctrinal approaches are illustrated the gap between the doctrinal approaches existing in the understanding of the essence of the "medical error" phenomenon and the perceptions of the medical services recipients, which indicates the need of understanding the essence of the phenomenon of medical error in order to increase the confidence in the medical profession, the inadmissibility of doctors liability for a medical error. CONCLUSION: Conclusions: The research gave the authors a reason to conclude that both medical and legal sciences are still far from the unity of views on the concept of "medical error". Medical errors significantly affect the authority of a medical institution, a particular doctor, or the state as a whole, and have severe consequences for patients. An analysis of the medical literature and ECHR practices has led to the conclusion that a medical error occurs when it is possible to completely exclude the guilt of medical professionals in the form of intent or negligence. In case of a medical error the criminal liability of the doctor is excluded.

Аннотация: OBJECTIVE: The aim of this article is to explore the ways of euthanasia regulation and to propose the most effective one. PATIENTS AND METHODS: Materials and methods: The authors of the article used the methods of analysis and synthesis, a comparative legal method. The scientific literature is evaluated and analyzed along with the experience of European countries, data of Ukrainian and international organizations and the results of scientific researches. CONCLUSION: Conclusions: the understanding of euthanasia should be reviewed in terms of the possibility in exceptional cases of its executing for terminally ill person. This is an inherent human right. However, it is established that the right to dispose of his life belongs exclusively to the bearer of this right and it cannot be delegated.

Аннотация: Introduction: Among all categories of patients children (minors) must be protected first. It is caused so by the specificity of the treatment, their vulnerability, the need of further protection and supervision. Providing of medical care services for children are often connected with the risks of the process of treatment, and of the drug usage. The aim: To identify the problems associated with the protection of the rights of minors and, on the basis of this, the basic guarantees of their rights, as well as mark the trends in the practice of ECHR. Materials and Methods: The study is based on its own theoretical and empirical basis. The theoretical basis include scientific articles, expert reviews of legislation and communications of non-governmental organisations, and empirical – decisions of the ECHR, international legal acts and directives of the EU. Results: The main violations of the rights of minor children include the following: – legal representatives of children do not take to the account their interests (refusal of medical intervention or the choice of certain method of interference); – medical intervention under the influence of coercion; – providing of unwarranted medical care without the corresponding testimony; – providing of inadequate medical care: when the patient was only examined and ineffective treatment was prescribed, and others. As for mentally ill children, the following rights are usually violated: for life, for a fair trial. It has been proved that defects in the provision of health care are often predetermined by the poor state logistics of hospitals, lack of financing and appropriate pediatric medicines, outdated methods of treatment, and incompetence of some doctors. Conclusions: From the point of view of protecting the rights of minors, the rights of children in medicine can be classified into universal and special. The rights correspond not only to the corresponding duties of medical staff, but also of their parents (legal representatives). Violations of their rights are usually related to improper representation of the interests of children and disadvantages of providing medical services (defects in their provision), in particular, regarding the treatment of mentally ill, as well as in clinical trials. It has been proven that the practice of the ECHR on the protection of the rights of the child in the field of health is of particular importance.
