Аннотация: The aim of this paper is to reveal and examine law-making elements in the jurisprudence of the Constitutional Court of Ukraine. It should be noted that the Constitutional Court has no direct powers to establish new legal norms under national legislation. However, in the process of constitutional interpretation, the case law of the Court demonstrates de facto the presence of law-making activity, that leads to the extension of its discretionary power on the formation of law. The paper will focus on the analysis of the practice of the Constitutional Court of Ukraine with regard to the ‘creative interpretation’ of law. A review of selected case law leads to a conclusion that the Constitutional Court often uses the dynamic interpretation of the Constitution. Moreover, the Court may change its own legal position in order to protect constitutional rights. Thus, the Constitutional Court of Ukraine has the right to ‘develop’ the law through evolutive interpretation of the Constitution. It can also be concluded that the Constitutional Court enjoys a wide ‘margin of appreciation’ in its interpreting of the Constitution.

Аннотация: The article is devoted to consideration main forms of threats to the inviolability of property rights during interstate military conflicts in context of evolution of legal approaches to appropriate problem. It is determined that throughout the evolution of mankind, the escalation of inter-state agreement relations was often accompanied by the emergence of threats to property rights as of the member states of relevant local conflicts, as well as of individuals and legal entities whose property was located in the territory of the conflicting states. The nature of these threats has changed during the development of our civilization and is often accompanied by direct encroachments on property owned by the state involved in the conflict or owned by private individuals who fall within its jurisdiction or legally residing in its territory. And only in some cases, during these conflicts, the recognition of the inviolability of private property was guaranteed, while limiting the legal grounds for acquiring the property of the enemy state with the creation of effective mechanisms for national and international protection of such rights. Considerable attention is paid in the article to each stage of evolution of the forms of threats to the inviolability of property rights during interstate military conflicts and their features are analyzed. The paper shows how proprerietary relationships between common citizens and juridical persons correlate with property relationships between states during military conflicts. © 2019, ASERS Publishing House. Аннотация: The fundamental and fundamental human right that is central to the system of non-proprietary rights aimed at ensuring the natural existence of an individual is the human right to life. The development of a civilized world leads to a new subjective perception of people about the origin of man, his place in the ecosystem and outer space in general and the scope of human rights and their transformation in particular. Complications of social life in the modern world leads not only to the transformation of social relations and the rapid renewal of the entire legal framework, but also to a significant acceleration and deepening of the formation of new branches of national law. In the current legal reality, it is separately necessary to separate medical law. The creation of medical law as a new branch of law is a necessity of our time, which will allow us to more effectively regulate legal relations in the medical field. The Institute of Euthanasia, in turn, should take its place precisely in the framework of medical law, and should be considered as a system of legal norms aimed at regulating social relations arising from the deliberate deprivation of life of a patient in order to alleviate his suffering, establishing the subjective composition and special methods of legal regulation. A look at the institution of euthanasia as an integral element of medical law will provide an effective and differentiated legal regulation of the procedure for its implementation.

Аннотация: OBJECTIVE: The aim of this article is to explore the ways of euthanasia regulation and to propose the most effective one. PATIENTS AND METHODS: Materials and methods: The authors of the article used the methods of analysis and synthesis, a comparative legal method. The scientific literature is evaluated and analyzed along with the experience of European countries, data of Ukrainian and international organizations and the results of scientific researches. CONCLUSION: Conclusions: the understanding of euthanasia should be reviewed in terms of the possibility in exceptional cases of its executing for terminally ill person. This is an inherent human right. However, it is established that the right to dispose of his life belongs exclusively to the bearer of this right and it cannot be delegated.

Аннотация: The article explores the impact of European legal acts on the evolution of Ukrainian legislation in the field of cross-border cooperation, as well as on the level of legislation and its implementation both in Europe and Ukraine. The paper applies methods of comparative and legal analysis to identify key factors of particular importance within the policy-making process in European trans-frontier cooperation. The peculiarity of such cooperation referes to actions of European Union as supranational entity that requires legal approximation at all levels (international, national and regional) in Europe. In Ukraine different actors provide institutional support to the implementation of the public regional policy at three basic levels-national, regional and local. Once can characterize each administrative level by the activities of actors within their own legal powers. The institutional development of cross-border cooperation bases on three pillars: first, the regulatory system, second, the regulation of mechanisms of interaction between authorities at different levels and third, the creation of a sufficient number in regard to effective institutions in order to promote cross-border cooperation and joint cross-border projects which involve enterprises, public organizations, non-state institutions, educational and science institutions, etc. The empirical analysis helped to improve the classification levels for implementation of cross-border cooperation in Europe and the legislation in Ukraine (1) acquis communautaire, 2) international legal agreement ratified by Ukraine, 3) intergovernmental agreements, 4) national legislation, 5) interregional agreements)

Аннотация: The purpose of this article is to analyze the main medical, legal, and ethical issues and challenges of euthanasia in the digital age. The methods that were used in this study are historical, logical, empirical, as well as comparative legal method for comparison of laws and practices of the EU and post-Soviet countries, including Ukraine. This choice determined by the fact that both groups of countries have common features and relations, while the features of their development affect approaches to regulating such sensitive and potentially open to abuse problems as euthanasia. There is no final legal answer as to whether to legalize, decriminalize or prohibit euthanasia in any of its forms. The features and legal terms of active and passive, voluntary and non-voluntary euthanasia and assisted suicide, especially for psychiatric and minor patients were researched, as well as conflicting arguments, which include individual autonomy, right to choose, the opportunity to get rid of suffering, as well as undermining the practice of palliative care, abuse in cases of vulnerable and dependent patients, moral burden on the doctors. The issue of control of the practice of euthanasia is complicated, given the extent to which it is possible to obtain informed consent, establish criteria for suffering and hopelessness, check the persistence, conviction and validity of requests for euthanasia, especially in the digital era. The potential legislation and judicial practice should provide for strict and effective guarantees, respect for the beliefs of each person and the right not to participate in any contentious practices, the balance of human rights and social values.

Аннотация: The article explores the right on euthanasia in developed countries of the world and the prospects for its implementation in Ukraine. The results of a number of sociological studies on the perception of euthanasia by the population, in particular in the Netherlands, Turkey, USA, Finland, also, special attention was paid to the gradual increasement in the percentage of people who support the idea of euthanasia. The concept of euthanasia and the conditions under which it can be carried out are revealed. The legislative provisions of the Netherlands and Belgium regulating euthanasia in these countries were stated. It has been found out that the shortage of consensus among European states on the question of a decent end to human life leads to the existence of a case law of the European Court of Human Rights on euthanasia cases. It is concluded that the introduction of euthanasia is not promising for Ukraine, as it is directly contrary to a number of national legislation acts, first of all the Constitution of Ukraine, also, to international acts, in particular the Convention for the Protection of Human Rights and the Founder of Freedoms. It is emphasized that a single position on euthanasia should be chosen at the level of the European Union by the Member States.

Аннотация: In order to better protect the human right to life, to improve the implementation of Art. 2 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as the reduction of the number of judgments of the European Court of Human Rights against Ukraine, we propose avoid unjustifiably lengthy investigations into the causes of death of citizens and provide specialized resuscitation assistance to all who need it. Share Art. 52 of the Law of Ukraine "Fundamentals of the legislation of Ukraine on health care" the following wording: "Medical workers are allowed to euthanize - intentionally accelerating the death or death of a terminally ill patient in order to end his or her suffering, subject to his consent and the conclusion of the commission, which is not less than of three doctors on the incurability of a disease that causes significant physical pain (suffering) for the patient".

Аннотация: ABSTRACT The aim: To analyze law enforcement practice on the basis of the national legislation of foreign states to single out features of legal regulation of the right to euthanasia realization and to outline the Ukrainian prospects of euthanasia legalization. Materials and methods: The empirical basis of the research is the legislation of some European countries (Belgium, Spain, Italy, Portugal, and the Netherlands) and Canada; decisions of the European Court of Human Rights on the right to voluntary death and the obligations of states; the results of a survey of 750 respondents conducted by the authors. The methodological basis of the study were philosophical views on life, death, and the right to certainty, formal-logical method (analysis, synthesis, induction, deduction, etc.), comparative, analytical, statistical, sociological methods of cognition, as well as a synergetic approach. Conclusions: The issue of legal regulation of euthanasia is multifactorial, socially conditioned, and requires a positive action of the state both in terms of regulation and/or prohibition, and the proper provision of citizens with health care. Legislative support for the human right to a “dignified death” is dictated, to some extent, by society’s demand, which must be finally resulted in the draft law. As for Ukraine, the adoption of such a law is obviously premature. Although according to a survey of citizens on euthanasia and the feasibility of introducing such a law in Ukraine, 57% are positive about the experience of other countries, and 41% were in favor of adopting a law in Ukraine, it is not possible to assess their opinion due to ignorance of legislation where euthanasia is allowed.

Аннотация: The purpose of this study is to discuss and present authors' vision of problems of euthanasia legal regulation in legislation with due consideration of human rights and liberties. The study was performed considering a set of disciplines: medicine, jurisprudence, religion, philosophy. A number of international documents were generalized, practice of European Court of Human Rights, Criminal Codes of Ukraine, Georgia and a number of other countries, relating to the question under study, views of scholars on moral and legal aspects, juridical and philosophical comprehension of this agenda. The following scientific methods were applied: systemic legal method, comparative legal method, philosophical legal method, logical method, as well as analysis and synthesis method. The authors developed proposals in solution of problems connected with this subject matter. Legalization of euthanasia is found to be possible by allowing its application to be reflected in Article 52, Law of Ukraine "Fundamentals of Ukrainian Legislation on Public Health". We determined that execution of euthanasia belongs to rights of physician, not his/her duties. In this we noted that this novelty will rule out any possibility of subsequent introduction of a special norm to Ukrainian Criminal Code stipulating criminal responsibility of physician for execution of euthanasia and, as a subsequence, will preclude any pre-trial and trial judicature (Articles 214, 215, Code of Criminal Procedure of Ukraine).
