Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: The fundamental and fundamental human right that is central to the system of non-proprietary rights aimed at ensuring the natural existence of an individual is the human right to life. The development of a civilized world leads to a new subjective perception of people about the origin of man, his place in the ecosystem and outer space in general and the scope of human rights and their transformation in particular. Complications of social life in the modern world leads not only to the transformation of social relations and the rapid renewal of the entire legal framework, but also to a significant acceleration and deepening of the formation of new branches of national law. In the current legal reality, it is separately necessary to separate medical law. The creation of medical law as a new branch of law is a necessity of our time, which will allow us to more effectively regulate legal relations in the medical field. The Institute of Euthanasia, in turn, should take its place precisely in the framework of medical law, and should be considered as a system of legal norms aimed at regulating social relations arising from the deliberate deprivation of life of a patient in order to alleviate his suffering, establishing the subjective composition and special methods of legal regulation. A look at the institution of euthanasia as an integral element of medical law will provide an effective and differentiated legal regulation of the procedure for its implementation.

Аннотация: In order to better protect the human right to life, to improve the implementation of Art. 2 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as the reduction of the number of judgments of the European Court of Human Rights against Ukraine, we propose avoid unjustifiably lengthy investigations into the causes of death of citizens and provide specialized resuscitation assistance to all who need it. Share Art. 52 of the Law of Ukraine "Fundamentals of the legislation of Ukraine on health care" the following wording: "Medical workers are allowed to euthanize - intentionally accelerating the death or death of a terminally ill patient in order to end his or her suffering, subject to his consent and the conclusion of the commission, which is not less than of three doctors on the incurability of a disease that causes significant physical pain (suffering) for the patient".

Аннотация: The purpose of the study is to determine the subject of "medical secrecy", to characterize the subjects who are obliged to keep secret information that is the subject of medical secrecy and, based on the results of this study, to make author's proposals to clarify the name for confidential medical information in legislation in the field of medicine in the field of medicine, criminal and criminal procedural legislation. The article explores issues related to the right of every person to the confidentiality of medical information, which is legally defined as "medical privacy". Based on the analysis of international legal acts, decisions of the European Court of Human Rights, the legislation of Ukraine and Georgia on the researched subject, using the foundations of the philosophy of law, carried out a comprehensive study of the concept of "medical confidentiality", defined entities following their professional and career responsibilities, must keep it. In the given article were used such scientific methods as logical, system-structural, comparative-legal, analysis, synthesis. Based on the research, the authors make several proposals for improving certain norms governing medical activities, namely, changes to the wording of Article 40 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Protection", Article 145 of the Criminal Code of Ukraine and Article 65 of the Criminal Procedure Code of Ukraine.

Аннотация: The article focuses on the fact that 2020 has become a new point in the history of mankind, irrevocably changing the ways of life accepted in society and forcing the entire population of the earth to live in a new way. If a person's health is threatened and / or worried about the thought of a terminal illness, it is difficult to focus on something else. Over the past year, many have experienced this reality for the first time. Effective January 30, 2020, the World Health Organization has declared the coronavirus outbreak a health emergency, causing international concern. The fact that some countries (New Zealand, Australia and South Korea) quickly contained the spread of the virus, but faced new, imported cases, leads to the conclusion that the victory over COVID-19 is possible only worldwide. And if in 2020 masks and social distancing were the methods of fighting the virus, then the main method of 2021 will be the vaccination of the inhabitants of the earth. However, here, too, the key factor is the scale of vaccination, which is one of the main factors in the effectiveness of the fight against any large-scale disease. Here, every person faces a moral and legal question: participation in vaccination is the right of every person as a bearer of human dignity, which implies the impossibility of taking any action on a person without his consent, or the duty of a member of society, which implies the need for vaccination as the question of the survival of the human race as a whole. The article draws attention to the refusal to vaccinate against measles in Ukraine and the consequences of such a choice. The reason for the lack of measles vaccination at the required epidemiological level in Ukraine is not the lack of the necessary vaccines, but the conscious choice of a negative model of behavior by the citizens of the country. The refusal to vaccinate children may be due to a psychological factor caused by the death of a student who was vaccinated against measles on the eve of death. At the same time, the media thirteen years after the event, conducting numerous medical examinations, provides fundamentally contradictory information about the causal relationship between the vaccination of a student against measles and his death. Based on the analysis, it was concluded that vaccination is the most effective way to prevent infection and severe outcomes caused by viruses. Despite this vaccination coverage against viral infections, seasonal influenza in many countries around the world remains low. Even if a vaccine is available to the citizens of a particular country, but educational programs are not carried out on the need and importance of vaccination, the potential for increasing vaccination rates against viruses will continually diminish. The most common explanation for the current upsurge in vaccine uncertainty is that the Internet enables vaccine deniers to reach out to a wide audience by publicizing their beliefs. Some activists only criticize some vaccines. Such a selective stance may indicate a communication strategy used to promote a particular vaccine. Attention should also be paid to the refusal to vaccinate due to the lack of acceptance by the human mind of traditional medicine, not belief in its effectiveness, the use of alternative, alternative medicine in the treatment of diseases. The reasons for not trusting the vaccination process are highlighted. These include: lack of trust in vaccine manufacturers who are economically motivated to make a profit; not trusting medical institutions that provide vaccinations and the conditions in which vaccines are stored; lack of confidence in government agencies involved in the procurement of vaccines, the possibility of corruption in case of abuse of their powers; fear of disease and side effects due to vaccination; distortion by the media of objective data on vaccination.

Аннотация: Introduction: The use of modern advances in medicine to investigate crimes has caused a number of problems that require scientific reflection. In particular, today there are quite acute questions: medical intervention without the persons consent; forced sampling of human biological materials; clinical methods, the use of which in the biological samples taking will not be regarded as violation of international standards of human rights protection; the correlation of the need for the formation of DNA profile databases and the right of the person to non-disclosure of medical information. The aim: The aim of this work is to identify and analyze the key points of the European Court of Human Rights (hereinafter referred to as the ECHR) regarding the peculiarities of retention and use of human biological material samples in the investigation of crimes, and the retention of such materials after the completion of the investigation and trial. Material and methods: In the preparation of the article, scientific works, the provisions of international normative acts regulating the use of human biological materials as well as the practice of the ECHR concerning the use of human biological materials in the investigation of crimes were used (8 decisions were analyzed in which the ECHR concerned the use of biological samples or related issues). In the research process to achieve the goal, a complex of general scientific and special methods of cognition was used, in particular, the comparative legal method, the system and structural method, the method of generalization, the method of analysis and synthesis, etc. Review: The positions of the ECHR concerning the following were distinguished and generalized: a) the criteria for the permissibility of compulsory medical intervention for taking of human biological material within the framework of the crime investigation; b) the possibilities of spreading the right not to incriminate oneself on the compulsory taking of human biological materials samples; c) the retention features of cell samples and DNA information in the context of respect for the right to non-interference in the persons private life. Conclusions: Obtaining and using the human material for the investigation of crimes are not a violation of the European Convention on Human Rights (hereinafter - the Convention), subject to the requirements stated in the practice of the ECHR. Аннотация: The relevance of the study is conditioned by the necessity of establishing the degree of interaction of universal rights and freedoms of the individual in civil and international law, as well as the possibility of limiting state sovereignty in the implementation of international obligations to ensure and protect human rights. The purpose of the paper is to investigate the international experience of legal regulation of universal human rights in order to develop ideas for their implementation in the legal framework of countries in transformation, including Ukraine. The leading methods of the study included the analysis of international and European practices of consolidating universal human and civil rights, modelling of legal structures acceptable to Ukraine. As a result of the study, it was concluded that the restriction of state sovereignty is possible only in favour of the individual based on the priority of human rights. The research materials can be useful for lawyers and government officials performing draft law activities, teachers of law schools, as well as officials and public administration officials who seek to apply the standards and practices of international regulation of universal human and civil rights in individual management cases.

Аннотация: Nowadays, active legislative reforms are being implemented in Ukraine, which are gradually introducing conceptual provisions on ensuring the right of the individual to information and aiming to effectively overcome the identified negative factors by introducing European standards in the field of the individual's right to information, however, to transform approaches to the right of the individual to information. in the context of European integration, attention is paid only fragmentarily, which in turn actualises the topic. The aim of this article is to investigate the transformation of approaches to the essence and content of a person's right to information in the context of Ukraine's European integration reforms. The outlined subject matter was explored through the approbation of the system of conceptual approaches and a set of general scientific and special scientific methods. Comparative analysis of the legal acts of Ukraine and the European Union in the research area displayed that it is now possible to refer to the imperfection of Ukrainian legal regulation in the field of securing, regulating and protecting the right of a person to information. Five urgent steps were proposed for the most prudent transformations of the person's right to information in Ukraine in the context of European integration.

Аннотация: In this paper the question on the content of the sovereign rights and their relation to sovereignty was not enough developed in legal science. These issues are in the focus of present paper. In the traditional legal doctrine sovereignty is the category which expresses the content and scope of competences of the state in the domestic and foreign policy. The appearance of a new state automatically means the presence of its sovereignty. The loss of sovereignty leads to the termination of its existence as a subject of international law. The states are forced to self-restriction of their sovereign rights in international (interstate) communication, but without losing the sovereignty. As the human rights, the sovereign rights of the state in a certain sense can be treated as natural. The sovereign rights associate with the existence of the state and don’t depend on other non-legal factors. Conception of the states’ legal equality results in the identity and equality in sovereign rights that states can use on their own. The meaning of the sovereign rights consist of the determination and guaranteeing and clearly defined boundaries of the freedom of the state. Can sovereign rights change in the process of historical development of the states? What is the “measure” of changes of the sovereign rights volume? This rights are inherent to the state and as long as sovereign stats play the major role in international law, their strength remains ultima ratio.
