Аннотация: The purpose of the article is to study the positive experience of the most developed countries in the field of transplantation and implementation of activities related to transplantation in order to determine possible ways to improve legal regulation in this area in Ukraine. It has been concluded that the formation and implementation of the state policy in the researched area is influenced by the model of consent for organs, tissue and cells transplantation introduced in the state, for example, the model of presumed consent (Spain), the model of donation or deed of gift (USA, Korea). It has been indicated that an effective infrastructure in the field of transplantation was formed in foreign countries; state authorities were created to coordinate the activities and manage the distribution, expansion and transplantation of "imported" organs. It has been offered to introduce such a positive experience of implementing transplantation into other countries of the world as: the availability of donors registration (USA, Korea), the exchange of information about donors and recipients (USA), the culture of organs donation (Spain), the implementation of propaganda and advertising activities on organs donation regulated at the legislative level (Spain), continuous professional development of medical employees involved in transplantation activities (Spain), the courtesy program for donors and support for their families (Korea), legislative norms on the protection of the rights of living donors (Spain, Korea).

Аннотация: The purpose of the article is to identify and evaluate the main measures of migration policy and legal regulation in the field of combating the effects of the economic crisis, effective ways to regulate the situation on the labor market and employment and measures to address the economic crisis in the country of destination and origin. Methods of analysis and synthesis, theoretical generalization, historical, scientific-analytical, systematization and classification were used to identify scientific and theoretical bases of labor migration. The practical significance of the obtained results lies in the possibility of using the results of the study to overcome the socio-economic consequences of the coronary crisis by countries; to improve the activities of migration services.

Аннотация: Given the insufficient level of regulation of the health insurance institute in Ukrainian legislation, the article attempts to investigate global experience in the context of this issue. In particular, a number of international documents were investigated, their content was characterized and the main provisions were highlighted. Based on collected and analyzed data, the authors outlined the areas of adaptation of Ukrainian legislation to the highest standards of the EU, made a proposal for the ratification of the conventions of the International Labor Organization. Supported a proposal for the development and adoption of a separate special law on general-compulsory state health insurance, which would regulate issues related to health insurance.

Аннотация: Nowadays, one of the reasons for the ineffective fight against corruption in the budget system is certain discrepancies and inconsistencies between the legal components of the mechanism for countering this anti-social phenomenon. The lack of a clear definition of the limits of competence of participants in the budget process, discretionary powers in the distribution and expenditure of budget funds, conflicts in budget legislation, and the lack of real competition in the field of public procurement clearly form the main corruption risks for all participants in these legal relations. The purpose of the study was to analyse the international legal mechanisms for combating corruption and find ways to implement them in Ukrainian legislation. The development of the national anti-corruption policy of Ukraine in the public sector as a subject of international anti-corruption law is determined by a number of the following national and external factors: 1) Ukraine's accession to the universal and regional conventions on combating corruption, compliance with which constitutes the main prerequisite for Ukraine's entry into the global space; 2) Ukraine's implementation in national legislation of anti-corruption international standards developed by international intergovernmental and non-governmental organisations; 3) adaptation of national legislation to European standards within the framework of the signed association agreement between Ukraine and the EU of 2014; 4) cooperation of Ukraine with international organisations, within which the international anti-corruption policy is developed and formed; 5) activities in the field of combating corruption of international non-governmental organisations, among which Transparency International constitutes an important element of the legal mechanism of the international anti-corruption legal order; 6) Ukraine’s international anti-corruption obligations to international financial institutions; 7) Ukraine's participation in international conferences and summits on anti-corruption issues; 8) Ukraine's cooperation with other states in providing relevant bodies of foreign states and receiving information on preventing and combating corruption; 9) national historical and political factors.

Аннотация: The article provides insights on the current mechanisms for regulating relations in the field of global health and international interaction in the world, holding the States of the world internationally responsible for internationally wrongful acts in the field of health, including consideration of the nature of the COVID-19 pandemic. Significant attention is paid to find the response to the question of what COVID-19 pandemic a health emergency is or bioterrorism. It analyses the current international norms governing the field of the production and use of biological weapons, with particular emphasis on standards of regulation and international responsibility in this field. The findings of this study suggest that biosafety worldwide is a key dimension of global security and ensuring world peace. This study also recommended the establishment of the strong global norm that would provide for verification of disarmament and compliance with the Biological Weapons Convention, the responsibility of States to develop, manufacture, and accumulate of biological weapons should be adapted to that end. Furthermore, it is noted that the world community should reconsider the position on the mechanism of investigations by the United Nations Security Council, as well as the procedure for the use of the veto of the five permanent members of the Security Council in any decision concerning the maintenance of international peace and security.

Аннотация: The paper deals with the conceptual approaches to the credit guarantee system as an effective mechanism of state support for agriculture. The importance of introducing a credit guarantee system in Ukraine and creating the Fund for Partial Credit Guarantee in Agriculture, a specialized non-banking financial institution, is emphasized. This will help to overcome obstacles to crediting small and medium agricultural enterprises. The authors have analyzed global credit guarantee schemes. The purpose of this paper is to develop proposals for amendments to the Draft Law «On the Fund for Partial Credit Guarantee in Agriculture», in particular a need to provide legal grounds for non-banking financial institutions, the form of business entities, their mission, criteria for agricultural subjects eligible for partial credit guarantees, financing of the relevant institutions and defining the related management bodies, as well as bodies of state regulation and supervision. The problem statement is attributable to the fact that the effectiveness of institutions providing credit guarantees for small and medium enterprises in agriculture plays an important role in the national economies of most countries. The authors have proposed an approximate financial model of the Fund for Partial Credit Guarantee in Agriculture and made the required economic calculations. Thus, with an initial authorized capital of EUR 10 million, the Fund for Partial Credit Guarantee in Agriculture, with 50% coverage, is able to provide guarantees for the purchase of 25 thousand hectares of arable land by small and medium enterprises at an average cost of EUR 820/ha, taking into account the average normative monetary assessment of agricultural land by regions. Consequently, credit enforcement will allow banking institutions not only to balance credit risk, but also to open access to small and medium agricultural enterprises to bank crediting to the extent necessary for the purchase of agricultural land and investments in production.
У статті проаналізовано концептуальні підходи до системи кредитних гарантій як ефективного механізму державної підтримки сільського господарства. Наголошено на важливості впроваження в Україні системи кредитних гарантій та створення спеціалізованої небанківської фінансової установи – Фонду часткового гарантування кредитів у сільському господарстві, оскільки це сприятиме подоланню бар’єрів на шляху кредитування малих та середніх сільськогосподарських товаровиробників. Метою статті є розробка пропозицій щодо внесення змін до законопроекту «Про Фонд часткового гарантування кредитів у сільському господарстві». Наголошено на необхідності передбачити на законодавчому рівні правовий статус небанківської фінансової установи; організаційно-правову форму; мету діяльності, критерії для суб’єктів сільського господарства, які мають право на часткове гарантування кредитів; фінансування установи; органи управління, державного регулювання та нагляду. Актуальність дослідження обумовлена тим, що світова практика свідчить про ефективність інституту системи кредитних гарантій у сільському господарстві для малих та середніх підприємств, які відіграють важливу роль у національних економіках більшості держав. Отже, забезпечення виконання кредитних зобов’язань дозволить банківським установам не лише збалансувати кредитний ризик, але й відкриє доступ малим і середнім сільськогосподарським товаровиробникам до банківського кредитування в необхідних обсягах для купівлі земель сільськогосподарського призначення та інвестицій у виробництво.

Аннотация: The application of forensic science and expertise is a necessary prerequisite for the investigation of crimes at the local and national level. Without the use of forensic science and expertise, an investigation within the framework of a criminal process becomes dead and unsubstantiated. But with the globalisation of world processes, the development of technologies, the speed of information transmission, the formation of crime outside the borders of one state and its entry into the international level has become an urgent problem, which has become a challenge in countering such crime and the need to steer forensic science and expertise towards assisting law enforcement activities. A special feature of countering the investigation of crimes was the creation of international cooperation between forensic specialists and expert witnesses even prior to the establishment of practical institutions that could counteract them in practice. Therewith, some representatives of such international unions and associations have taken serious steps in creating mechanisms for real counteraction to crimes at the international level (R.A. Reiss, G. Soderman, M.Sh. Bassiuni). Coverage of the problem of international cooperation in the investigation of crimes through the definition of the role of forensic science and expertise allowed focusing on the following blocks: 1) international associations of forensic specialists for combating crime in the historical context; 2) international criminal police organisations in combating crime; 3) international cooperation in the field of conducting forensic examinations; 4) the use of forensic and special knowledge in the activities of the International Criminal Court. Thus, a combination of theory and practice in the fight against crime is demonstrated. Historically, this is associated with the role of forensic science and expertise in recording traces of crimes, analysing them, and forming legal, forensic, and expert witness opinions. The purpose of the study is to establish the decisive role of forensic science and expertise in international cooperation in the investigation of crimes. For this, the authors turned to forensic science and expertise, historical processes that served to create substantial international organisations created to counter international crime.

Аннотация: International commercial arbitration (ICA) is an alternative way to resolve foreign economic disputes. Initially, arbitration itself was seen as a neutral court in which the parties to the dispute were independent of national courts. Arbitration agreements and decisions must be recognised by national courts without any complications or review procedures. Although granting commercial parties some independence to agree that their dispute will be considered by independent arbitrators is a key principle in ICA, the struggle for supremacy between national laws and national courts on the one hand and the autonomy of the parties and the independence of the international arbitration system on the other continue. Over the years, national laws have sought to control, regulate, interfere with, or support ICA in various ways. To counter attempts to ‘localise’ ICA and promote equality in this area, private, professional institutions and international and intergovernmental organisations have developed a significant body of law designed to ensure self-government and dispute settlement procedures in ICA. Nevertheless, international commercial arbitration cannot exist independently of national jurisdictions. Examining the activities of ICA, it can be seen that the importance and impact of national arbitration laws and national judicial supervision are significantly reduced, but the lex fori still plays an important role in arbitration. Thus, the reform of the normative regulation of international arbitration also affected Ukraine. The article analyses the radical changes proposed by the legislator regarding the procedure for establishing institutional arbitrations, expanding the arbitrability of disputes.

The global leadership of construction trans-national corporations is ensured by the constant generation of innovative approaches and strategic paradigms with the formation of network intelligent corporate ecosystems with global information platforms in the digital and social and ecologic business environment. Among the directions and options of digital transformation of the construction business, the highest competitive potential has the Building Information Model (BIM) – digital dynamic description of the full construction cycle – from the development of conceptual design to the disposal of the object.

Аннотация: OBJECTIVE: The aim: The purpose of this article is to analyze the state policy of several states in creating an effective mechanism in which persons entering into marriage will be able to obtain the necessary information about the state of each other's health and thereby make an informed decision about registering a marriage, protecting the health of each other and future offspring. PATIENTS AND METHODS: Materials and methods: In the course of the study, a comparative analysis of the legal means used by some states in the field of biological protection of marriage was carried out. First of all, a study was carried out of the family legislation of states with different approaches to the system of premarital medical examination of persons entering into marriage. In addition, the scientific works of scientists from different countries were used, the object of study of which was the problems associated with the biological protection of marriage. The work also used the results of surveys that were conducted in some countries and highlighted in published scientific works. CONCLUSION: Conclusions: Health information is essential when deciding whether to marry. Hiding such information can seriously harm the partner's health and children born in such a union. The task of the state is to find a middle ground, in which the balance of interests of the person, whose medical examination revealed health problems (the right to medical secrecy), on the one hand, and the person with whom it is planned to register a marriage (the right to health protection; the right on the voluntariness of marriage).At the same time, the emphasis in state policy on the biological protection of the family should be placed on preventive measures, including non-legal means of information.
