Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: The main objectives of the research were such: to define the concept of cold chain as an object of legal regulation; to find out the content and features of the EU legislation on the safety and quality of meat and meat products during cold chain and its use in Ukraine; to characterize the legal bases of the current legislation of Ukraine on ensuring the safety and quality of meat and meat products during cold chain, to formulate proposals and recommendations aimed at improving the national legislation of Ukraine by approximating it to the EU legislation, which sets requirements for the safety and quality of meat and meat products throughout cold chain. To achieve the abovementioned objectives, the following methods were used: comparative legal, analytical, systemic, dialectical, generalizing, specific-search, structural-functional, semantic, methods of deduction and induction, etc. The content and features of the legal regulation of the safety and quality of meat and meat products in the current legislation of the European Union and Ukraine have been clarified. For the first time, the definition of the term 'cold chain' has been proposed by reference to it in author's editorial, which should influence its clearer scientific and practical understanding. It is determined that the temperature regimes of cold processing, storage and transportation of meat and meat products in Ukraine are regulated by a large number of legal acts, in particular: national standards of Ukraine (DSTU), technical regulations, technological instructions, rules of transportation, etc. It is found that national legal acts do not provide a systematic understanding of the particularities of cold chain legal regulation in the meat processing industry in order to ensure the safety and quality of meat and meat products. As a result of departmental inconsistency, the existing storage temperature parameters for the same product type in different legal acts differ from each other, which does not allow to determine the actual storage periods at different stages of the cold chain. In addition, current legal acts in Ukraine do not provide for constant monitoring of the temperature of cold-processed meat and meat products throughout all cold chain units and the hygienic condition of refrigerators throughout the shelf life. As a result, the cold chain is very difficult to be controlled and requires a large number of factors to be taken into account in order to bring safe and high-quality meat and meat products to the end consumer. According to the results of the research, proposals and recommendations are formulated to improve the national legislation of Ukraine governing the cold chain in the meat processing industry

Аннотация: OBJECTIVE: Introduction: Practical implementation of the provision of appropriate medical assistance to detainees raises a number of problems that needs scientific reflection in order to come up with proposals for improving regulation in this sphere. To date, the issues of particular concern are: proper documentation of a detained person's health status; promptness and accuracy of diagnosis of a person; providing a comprehensive therapeutic strategy for his/her treatment; delay in providing medical care and its quality; continuation of treatment of a sick person in custody. The aim: of this paper is to highlight and analyze the key positions of the European Court of Human Rights (hereinafter - ECHR) on the criteria for recognizing appropriate medical care for detainees. PATIENTS AND METHODS: Materials and methods: Scientific articles, international regulations governing the provision of medical assistance to detaines, ECHR practice regarding the provision of medical assistance to detainees and criteria for recognition as appropriate (22 relevant decisions where ECHR addressed these issues were analyzed). To achieve this goal, we've used a set of general scientific and special methods of cognition, in particular, comparative-legal method, system-structural method, method of generalization, method of analysis and synthesis, etc. CONCLUSION: Conclusions: Medical assistance to detainees is adequate, subject to the criteria set out in the ECHR's practice, which in turn will ensure respect for the human rights and freedoms guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter - the Convention).

Аннотация: OBJECTIVE: Introduction: The problem of medical errors is always relevant in medical literature and law. Meanwhile, it is understood diametrically opposite by doctors, patients, and lawyers. This has a negative impact on patients' trust in medical professionals, and sometimes leads to criminal prosecution for a so-called "medical error", which in fact is conscientious deception, not a crime, and should exclude criminal liability. The aim: The aim of this work is the illustration of diametrically opposed approaches to understanding the essence of the concept of "medical error" from patients', doctors', and lawyers' views that are often generated by subjective approaches and results in distrust between doctors and patients, medical professionals and lawyers. The aim of the article is also to realize the ECHR's approach to understanding the essence of a medical error and distinguishing it from the negligence that should lead to liability of the medical professionals. PATIENTS AND METHODS: Materials and methods: In this research a legal doctrine, scientific works, provisions of international legal acts, in particular, the Convention for the Protection of Human Rights and Fundamental Freedoms were used, as well as the practice of the ECHR (12 relevant ECHR decisions), where the Court considered cases related to "medical errors" and formulated positive obligations of the state in the field of health care were analyzed. A complex set of general and special methods of cognition was used to achieve the aim, they are comparative legal method, systemic and structural method, methods of generalization, analysis and synthesis, sociological method, hermeneutical method, etc. RESULTS: Results: A survey of patients, medical professionals and lawyers conducted by the authors (300 persons), analysis of doctrinal approaches are illustrated the gap between the doctrinal approaches existing in the understanding of the essence of the "medical error" phenomenon and the perceptions of the medical services recipients, which indicates the need of understanding the essence of the phenomenon of medical error in order to increase the confidence in the medical profession, the inadmissibility of doctors liability for a medical error. CONCLUSION: Conclusions: The research gave the authors a reason to conclude that both medical and legal sciences are still far from the unity of views on the concept of "medical error". Medical errors significantly affect the authority of a medical institution, a particular doctor, or the state as a whole, and have severe consequences for patients. An analysis of the medical literature and ECHR practices has led to the conclusion that a medical error occurs when it is possible to completely exclude the guilt of medical professionals in the form of intent or negligence. In case of a medical error the criminal liability of the doctor is excluded.

Аннотация: This article studies specifics of Islamic understanding of freedom of expression and significant differences between Islamic and European understanding of that concept. Freedom of expression is recognized in Islam; however, it has significant and deeply-rooted peculiarities. In particular, Islam strictly prohibits imaging Prophet Muhammad, let alone making cartoons of him. For instance, from the perspective of Muslims, imaging Prophet Muhammad as a dog is extremely cynical, since a dog in Islam is an unclean animal inadvisable to contact with. Also, there is long-established perception of humour and its admissibility in Islam. For example, under Islamic law one shall not tell lies or scare another person; one shall not joke with an older person, a teacher, a scientist, a manager, a person who does not understand jokes, an unknown man or woman; a joke shall not be offensive or degrading a man or a family; one shall not joke about prohibited issues, tell dirty stories, disclose intimate details, resort to insults or slander. The article points out that Europeans perceive drawing cartoons of the Prophet as freedom of expression. However, in the eyes of Muslims such cartoons constitute violation of a number of prohibitions existing in Islam and therefore deeply insult their religious and cultural feelings. Such insults may cause religious conflicts with many victims, like the one that happened in the January of 2015 in the office of Charlie Hebdo French satirical weekly newspaper. To prevent similar and even more terrible tragedies in the future and release tension between Europeans and Muslims, primarily in Europe, the article explores the legal framework and conditions for restriction of freedom of expression set out in universal international law, the European Convention on Human Rights and relevant case-law of the ECHR. The set of the general and specific scientific methods of research were used by the authors according to the subject and scope of the study: sociological, statistical, dialectical, formal stylistic, axiological, hermeneutic, systemic, comparative legal method etc.

Аннотация: OBJECTIVE: The aim: The aim of this work is to identify the compliance level of modern practice of placement of a person in a medical institution in order to conduct the FPE to international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person; formulation of scientifically substantiated proposals on the synchronization directions of national practices with the specified international standards. PATIENTS AND METHODS: Materials and methods: During the preparation of the article the following was processed: scientific research on ensuring the rights of persons suffering from mental disorders in criminal proceedings; provisions of international agreements on the provision of psychiatric care; legal positions of the ECHR on the observance of persons' rights suffering from mental disorders (15 judgments on this topic); criminal procedural legislation of individual states; results of generalization of national law enforcement practice; the results of a survey conducted by the authors of 18 psychiatrists who practice in the field of forensic psychiatric examinations (psychiatrists working in state psychiatric clinics in Odesa, Poltava, Kharkiv were interviewed). In the process of research a set of general scientific and special methods of cognition was used (comparative-legal method, system-structural method, generalization method, method of analysis and synthesis, method of sociological research, method of expert assessments, etc.). RESULTS: Results: According to the research results: a) legal positions of the ECHR on the observance of the rights of persons suffering from mental disorders are identified and generalized; b) the compliance level of modern practice of placing a person in a medical institution in order to conduct the FPE with international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person ( 1 of Article 5 of the Convention); c) the degree of extrapolation of these positions to the activities of psychiatrists is analyzed; d) the optimal ways of solving the existing problems in the aspect of ensuring the rights of a person when placing them in a medical institution for an inpatient FPE are proposed. CONCLUSION: Conclusions: The current national practice of placing a person in a medical institution for an inpatient FPE does not fully comply with the legal positions of the ECHR in terms of ensuring the right to liberty and security of person (in particular, there are deviations from the positions of the ECHR on: determining the documentary basis for the appointment of an inpatient FPE; interaction of police and medical workers in the field of psychiatry during the detention of a person with a mental disorder). Аннотация: OBJECTIVE: The aim: Conduct a comparative legal analysis of the legislation of Ukraine and other countries on the use of assisted reproductive technologies (hereinafter - ART). PATIENTS AND METHODS: Materials and methods: The study used an interdisciplinary approach to the analysis of the problem of assisted reproductive technologies. This approach includes dialectical, comparative law, statistical and systemic methods. The study used scientific developments in the field of ART, international acts, legislation, statistics. Ukrainian legislation on surrogacy and other ARTs has been studied. The expediency of adopting a special law to regulate the use of ART in Ukraine is substantiated. According to the monitoring data, Denmark, Belgium, Iceland, Sweden, Slovenia, the Czech Republic, Estonia, and Serbia are the leaders in the use of ART among European countries. CONCLUSION: Conclusions: The study allows us to conclude that the legislation of the studied European countries and Ukraine on the use of assisted reproductive technologies are quite different. European countries, except the United Kingdom, are very limited in allowing embryo research. It is noted that, first, not all countries allow surrogacy; second, a different maximum age is set for women to use ART; thirdly, the different shelf life of cryopreserved embryos has been established. The issue of the possible maximum number of implanted embryos into the uterine cavity using ART requires clear legal regulation both in Ukraine and in the EU.

Аннотация: The relevance of the study is determined by the necessity to improve criminal and legal antitakeover measures in the current context. The article deals with the comparative analysis of asset-grabbing as a wide-spread phenomenon existing all over the world and mainly typical for the CIS countries. The authors also analyze the experience of the European Union in counteracting illegal takeover of businesses. The analysis has shown that the phenomenon of ‘asset-grabbing’ is absent in the countries with a developed economies. Special state structures should be created to regulate the merger and acquisition transactions in the stock market. The present study is unique as it generalizes a broad legislative experience and shows significant discrepancy between legislation aimed at protecting the interests of shareholders in the countries with developed market economies and in the CIS countries.

Аннотация: The author discusses the relationship between two legal orders: international law and European Union (EU) law. The main provisions of this relationship have been established through the precedential practice of the Court of Justice of the European Union – the EU’s main judicial body. This kind of research seems important because of the gap in the theory of international law caused by the immutable dogma of the supremacy of international law. However, modern legal practice demonstrates a certain fragmentation of the international legal order because of the impact of the existence and development of regional supranational legal orders. The EU legal order, with its own special nature (sui generis), is undoubtedly one of the most developed among them. The Court of Justice of the European Union performs a crucial role in the EU legal system concerning application and interpretation of EU law. It provides auniform interpretation of this law for the purposes of development of supranational integration. In this context the Court of Justice the European Union establishes the status of European law and its relationship with the national legal systems and international law. The Court acts as protector of the EU legal order against the influence of other legal orders. The Court’s precedential practice reveals EU law’s tendency towards its constitutionalization and the development of its autonomy. The latest practice indicates the Court’s powers to review the EU institutions’ acts in relation to the implementation of UN Security Council resolutions. This proves the Court’s ability to establish indirect control even over UN acts.

Аннотация: INTRODUCTION: the current state of patenting legal regulation of medical treatment in Ukraine and in the world is analyzed, the directions for the further development are determined. The author defines "non-industrial medical" and socio-ethical theories in the field of medical treatment patent protection. The existence of exclusively formal "monopoly" of the patent owner is noted, as well as the inapplicability of the majority of the patented achievements in this field in Ukraine. AIM: the purpose of this article is to investigate the current state of patenting legal regulation of medical treatment in Ukraine and in the world, to analyze the limitation of patent protection basic conception in the medical field and to determine the tendencies and perspectives of the legal protection mechanism of further development in this field in Ukraine, considering the European and world regulation experience. MATERIAL AND METHODS: this study is based on Ukrainian regulation acts, The European Patent Convention, The Code of Laws of the United States of America, judgments, scientific works and opinions of progressive-minded people in this sphere. Such methods as dialectical, comparative, analytic, synthetic and comprehensive are used in the article. CONCLUSION: The experience analysis of the medical treatment patenting regulation in EU and in other countries of the word made it possible to substantiate the tendencies of development the patenting legal regulation of treatment methods mechanism, based on the needs of creation conditions for the availability of the recent treatment developments and technics for citizens, without increasing the cost of such treatment through license fees.

Аннотация: Regulatory acts of the European Union play a significant role in regulating land relations in the EU member states. Thus, according to the draft Treaty on the Introduction of the Constitution for Europe (2003/C169/01), adopted by the consensus of the European Convention on June 13 and July 10, 2003, the Council of Ministers unanimously adopts European laws, European framework laws, implements land use measures, excluding the organization of waste collection and disposal (Sulyagina, 2012; Kokanovska, 2016). According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States of June 14, 1994, Ukraine has undertaken to take measures to gradually bring national legislation into line with the legislation of the European Community, that is, to adapt national legislation to the EU legislation requirements. Among the spheres of adaptation there is, in particular, the institution of legal responsibility as an important way of protecting the environment, including lands, as follows from the provisions of the Law of Ukraine "On the State Program for Adaptation of Ukrainian Legislation to the Legislation of the European Union" of March 18, 2004. The implementation of the course on the European integration necessitates the adaptation of the national land legislation to the EU requirements. According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States (Agreement on partnership and cooperation between Ukraine and the European Communities…, 1994) an important condition for strengthening economic ties between Ukraine and the Community is the convergence of the existing and future legislation of Ukraine with Community legislation. Ukraine will take measures to ensure the gradual harmonization of legislation with the legislation of the Community. Adaptation of land legislation is the process of bringing the laws of Ukraine and other regulatory legal acts that are sources of land law of Ukraine, as well as the step-by-step adoption and implementation of Ukrainian regulations, developed in accordance with EU legislation, conformably with the acquis communautaire. Acquis communautaire (acquis) the legal system of the European Union, which includes, but is not limited to, acts of European Union legislation adopted within the framework of the European Community, the Common Foreign and Security Policy and the Co-operation in the Field of Justice and Home Affairs. At the same time, it is necessary to take into account that in the EU operates the principle of the EU rule of law over national law, which found its confirmation in the decisions of the Court of Justice of the EU. Thus, in the judgments of the Court of Justice of the European Communities in case 26/62, Algemene Transporten Expeditie Ondernemingvan Gend v. Nederlandse Administratieder Belastingen, in case 6/64, Flaminio Costa v. ENEL and in case Variola v. S. P. Administatione Italianadelle Finanze there is entrenched: • The principle of priority of EU law over the national law of member states (Supremacy of European law principle). • The principle of direct application of EU law (the principle of direct application of EU law). The scale of the influence of EU law is evidenced by the fact that approximately 80% of laws and other legal acts in the economic and social spheres that in the past belonged to the competence of states are produced by Union bodies and are unified for all its members (Magnovsky, 2005). The purpose of adapting the land legislation of Ukraine to the EU legislation is to achieve compliance with the legal system of the country acquis communautaire, taking into account the criteria set by the European Union to the states that intend to join it. The development of Ukrainian legislation in the direction of its approximation to the legislation of the European Union is a priority component of the process of Ukraine's integration to the European Union, which in turn is a priority direction of Ukrainian foreign policy.

Аннотация: Introduction: The use of modern advances in medicine to investigate crimes has caused a number of problems that require scientific reflection. In particular, today there are quite acute questions: medical intervention without the persons consent; forced sampling of human biological materials; clinical methods, the use of which in the biological samples taking will not be regarded as violation of international standards of human rights protection; the correlation of the need for the formation of DNA profile databases and the right of the person to non-disclosure of medical information. The aim: The aim of this work is to identify and analyze the key points of the European Court of Human Rights (hereinafter referred to as the ECHR) regarding the peculiarities of retention and use of human biological material samples in the investigation of crimes, and the retention of such materials after the completion of the investigation and trial. Material and methods: In the preparation of the article, scientific works, the provisions of international normative acts regulating the use of human biological materials as well as the practice of the ECHR concerning the use of human biological materials in the investigation of crimes were used (8 decisions were analyzed in which the ECHR concerned the use of biological samples or related issues). In the research process to achieve the goal, a complex of general scientific and special methods of cognition was used, in particular, the comparative legal method, the system and structural method, the method of generalization, the method of analysis and synthesis, etc. Review: The positions of the ECHR concerning the following were distinguished and generalized: a) the criteria for the permissibility of compulsory medical intervention for taking of human biological material within the framework of the crime investigation; b) the possibilities of spreading the right not to incriminate oneself on the compulsory taking of human biological materials samples; c) the retention features of cell samples and DNA information in the context of respect for the right to non-interference in the persons private life. Conclusions: Obtaining and using the human material for the investigation of crimes are not a violation of the European Convention on Human Rights (hereinafter - the Convention), subject to the requirements stated in the practice of the ECHR. Аннотация: In this article, the authors, collaboratively and based on their experience of related research (normative-legal activity of local self-government (Petryshyna, 2011), general theoretical problems of lawmaking and norm-making (Didych, 2018), problems of reception of foreign experience of reforming local self-government (Petryshyn, 2014), and pressing problems of decentralization reform (Hyliaka, 2015)) investigate the features and the shortcomings of the system of normative-legal acts of local self-government of Ukraine. These include: the problems of the legal status and the nature of the modern system of normative legal acts of local self-government, its normative-legal consolidation; the issues of practical law-making by bodies and officials of local self-government through the prism of the heritage of the Soviet system of local self-government; the shortcomings in the reforms undertaken since independence; the ongoing decentralization and associated reforms as well as existing concepts and plans aimed at the integration of Ukraine into European legal space and the European Union in particular. The result of the study was the identification of a number of substantiated features of the system and general recommendations aimed at the improvement of the overall state of local self-government and its law-making activity in the context of the current and future related reforms in Ukraine.

Аннотация: When there is a lack of energy resources in the EU and it has to look for suppliers from other countries, Russia provides the world with most of the oil and gas. Diversification of energy resources is one of the objectives for the EU. The majority of international participants are interested in discovering the potential of the sea. However, the development of the region’s resources still faces many obstacles, such as lack of export pipelines, difficulties due to security of supply considerations, transit complications, political and legal considerations and market uncertainties. This study focuses on the countries of the former Soviet Union such as Uzbekistan, Kazakhstan and Turkmenistan in Central Asia, and Azerbaijan in Transcaucasia. One of the six priority areas of the EU in the energy infrastructure of - the Southern Energy Corridor (SEC), the purpose of which is to link the Caspian basin and potentially Middle Eastern gas to Europe.
