Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: Introduction: The use of modern advances in medicine to investigate crimes has caused a number of problems that require scientific reflection. In particular, today there are quite acute questions: medical intervention without the persons consent; forced sampling of human biological materials; clinical methods, the use of which in the biological samples taking will not be regarded as violation of international standards of human rights protection; the correlation of the need for the formation of DNA profile databases and the right of the person to non-disclosure of medical information. The aim: The aim of this work is to identify and analyze the key points of the European Court of Human Rights (hereinafter referred to as the ECHR) regarding the peculiarities of retention and use of human biological material samples in the investigation of crimes, and the retention of such materials after the completion of the investigation and trial. Material and methods: In the preparation of the article, scientific works, the provisions of international normative acts regulating the use of human biological materials as well as the practice of the ECHR concerning the use of human biological materials in the investigation of crimes were used (8 decisions were analyzed in which the ECHR concerned the use of biological samples or related issues). In the research process to achieve the goal, a complex of general scientific and special methods of cognition was used, in particular, the comparative legal method, the system and structural method, the method of generalization, the method of analysis and synthesis, etc. Review: The positions of the ECHR concerning the following were distinguished and generalized: a) the criteria for the permissibility of compulsory medical intervention for taking of human biological material within the framework of the crime investigation; b) the possibilities of spreading the right not to incriminate oneself on the compulsory taking of human biological materials samples; c) the retention features of cell samples and DNA information in the context of respect for the right to non-interference in the persons private life. Conclusions: Obtaining and using the human material for the investigation of crimes are not a violation of the European Convention on Human Rights (hereinafter - the Convention), subject to the requirements stated in the practice of the ECHR. Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: Nowadays, active legislative reforms are being implemented in Ukraine, which are gradually introducing conceptual provisions on ensuring the right of the individual to information and aiming to effectively overcome the identified negative factors by introducing European standards in the field of the individual's right to information, however, to transform approaches to the right of the individual to information. in the context of European integration, attention is paid only fragmentarily, which in turn actualises the topic. The aim of this article is to investigate the transformation of approaches to the essence and content of a person's right to information in the context of Ukraine's European integration reforms. The outlined subject matter was explored through the approbation of the system of conceptual approaches and a set of general scientific and special scientific methods. Comparative analysis of the legal acts of Ukraine and the European Union in the research area displayed that it is now possible to refer to the imperfection of Ukrainian legal regulation in the field of securing, regulating and protecting the right of a person to information. Five urgent steps were proposed for the most prudent transformations of the person's right to information in Ukraine in the context of European integration.

Аннотация: Appealing to public authorities about any legal conflict leads to an overload of courts and administrative bodies. An alternative to improving access to justice and reducing the burden on the courts is to use other alternative means of resolving legal disputes, such as mediation. The article is devoted to the peculiarities of the application of the mediation procedure in administrative proceedings. Highlights the signs of administrative and legal dispute, as well as the peculiarities of the mediation procedure. The purpose of the study is to study domestic and foreign experience in the use of mediation in administrative proceedings, as well as to formulate proposals and recommendations for improving the current legislation in this area, based on the analysis of scientific papers, current legislation and law enforcement practice. The methodological basis of the study is a set of general scientific, philosophical, special methods of scientific knowledge, the use of which allowed to ensure the achievement of the stated goals and objectives of the study and comprehensive coverage of the research problem.

Аннотация: The protection of the environmental rights of citizens is an important issue for the domestic and foreign state policy of Ukraine. Although environmental rights are formally recognised and enshrined in law, they fail to be implemented in practice. This indicates the imbalance and lack of effective political and legal mechanisms for an appropriate system of measures to create conditions for exercising environmental rights and interests, their protection, and restoration, as well as to assure environmental awareness and culture. In light of these general considerations, this research article aims to examine the current issues concerning access to justice for protecting environmental rights through the lens of the state policy of Ukraine and its real application to ensuring such protection. Accordingly, the underlying tasks of the article are: to analyse how meaningful and comprehensive the provisions of approved strategic documents are; to analyse the cases of the ECtHR against Ukraine in environmental matters; to study the national case-law concerning access to justice on environmental rights protection and whether they correspond with the state policy areas of ensuring environmental human rights; to analyse how efficient the mechanism of their protection in Ukraine is and whether conditions for equal access to court in environmental cases are created; to find and illuminate the current state policy gaps that might threaten the effective observance and enforcement of environmental human rights; to formulate theoretical and practical suggestions for their further improvement.

Аннотация: The article focuses on the right to be forgotten, which is at the center of changes in the concept of human rights in the digital age. The origins of the right to be forgotten in European legal doctrine and judicial practice, as well as its relationship with autonomy and identity, are analyzed. The article also examines the significance of the new understanding of "time" and "data" for the adoption of this right, considering the influence of two key cases of the Court of Justice of the European union, such as Google v. Spain [2014] and Google v. CNIL [2019] on the concept of the right to be forgotten. The place of this right, its connection with privacy and European data protection law is debated. The article focuses on jurisdictional issues, paying particular attention to both the right to be forgotten and the understanding of the relationship between privacy and freedom of expression in the European union and the united States, and possible jurisdictional disputes around the world. The article also addresses the issue of balancing rights and legitimate interests, as well as the proportionality for applying the right to be forgotten, both in the European and global contexts.

Аннотация: The authors researched the peculiarities of the legal protection of inventions in the field of biotechnologies based on the legislation of European countries and Ukraine. They determined the legal framework regarding the legal protection of biotechnologies at the international level. They identified the fundamentals related to the peculiarities of judicial control and protection of biotechnological inventions in the European countries (Germany, the United Kingdom, France, and Italy) and the resolution of these issues at the legislative level in Ukraine. Particular attention was put to the provisions of Directive 98/44/EC of the European Parliament and the Council on the legal protection of biotechnological inventions. One determined the content of the rules of the current patent legislation in Ukraine, which regulates the protection of biotechnological inventions, and highlighted the key aspects of the Agreement between Ukraine and the European Union in the context of the conducted research. The authors provided a systematic overview of the main requirements applied to the biotechnological innovations to determine their patentability. The main problematic aspects of the Directive 98/44/EC were highlighted based on the research findings. They lead to an ambiguous interpretation of the document's rules and the existence of considerable differences in the patent legislation available in the member countries of the European Union. ©

Аннотация: Purpose: The purpose of this paper is to examine the international regional system of the preservation of the right to health in the European human rights system through the work of the ECtHR, to analyse the case law of the ECHR based on the human right to health. This purpose determines the following tasks: to identify the features of the realization of the right to health in the European mechanism of human rights protection; to study the mechanism of realization of the right to health in the activity of the ECtHR; to describe the case law of the ECtHR in terms of the right to health. Design/methodology/approach: The “black letter” law methodology is used to focus attention on conducting research on the letter of the law and the desire to conduct a descriptive analysis of legal norms, based on primary sources. Findings: On the basis of the conducted researches, it is possible to draw a conclusion that the ECHR, albeit implicitly, refers to the right to health as well. Originality/value: The right to health is included in the catalogue of the most important universally recognized human rights and is most often considered as an integral part of socio-economic human rights, but there is no special universal or regional mechanism for protecting this category of rights.

Аннотация: The article addresses the impact of the ECHR and the case law of the ECtHR on civil procedure in Ukraine. In the context of the provisions of. national legislation and judicial practice, the authors analyse the areas of the harmonization of national legislation with the requirements of the ECHR and the practice of the ECtHR in light of the 2016 constitutional reform of justice and the new edition of the Civil Procedure Code of Ukraine. Special attention is paid to the embodiment of the rule of law principle during a trial inn civil cases and the implementation of international standards of the right to a fair trial (para. I Art. 6 of the ECHR). From the point of view of institutional interaction between the ECtHR and national courts, the procedures of pilot judgments, the review of the case in exceptional circumstances was analysed.
