Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: Appealing to public authorities about any legal conflict leads to an overload of courts and administrative bodies. An alternative to improving access to justice and reducing the burden on the courts is to use other alternative means of resolving legal disputes, such as mediation. The article is devoted to the peculiarities of the application of the mediation procedure in administrative proceedings. Highlights the signs of administrative and legal dispute, as well as the peculiarities of the mediation procedure. The purpose of the study is to study domestic and foreign experience in the use of mediation in administrative proceedings, as well as to formulate proposals and recommendations for improving the current legislation in this area, based on the analysis of scientific papers, current legislation and law enforcement practice. The methodological basis of the study is a set of general scientific, philosophical, special methods of scientific knowledge, the use of which allowed to ensure the achievement of the stated goals and objectives of the study and comprehensive coverage of the research problem.

Аннотация: Purpose: The purpose of this paper is to examine the international regional system of the preservation of the right to health in the European human rights system through the work of the ECtHR, to analyse the case law of the ECHR based on the human right to health. This purpose determines the following tasks: to identify the features of the realization of the right to health in the European mechanism of human rights protection; to study the mechanism of realization of the right to health in the activity of the ECtHR; to describe the case law of the ECtHR in terms of the right to health. Design/methodology/approach: The “black letter” law methodology is used to focus attention on conducting research on the letter of the law and the desire to conduct a descriptive analysis of legal norms, based on primary sources. Findings: On the basis of the conducted researches, it is possible to draw a conclusion that the ECHR, albeit implicitly, refers to the right to health as well. Originality/value: The right to health is included in the catalogue of the most important universally recognized human rights and is most often considered as an integral part of socio-economic human rights, but there is no special universal or regional mechanism for protecting this category of rights.

Аннотация: Today, the successful competition of any domestic enterprise in the market of goods and services is conditioned on the use of new technologies and production processes. Such activity is innovative and plays a leading role in its life. Exacerbation of competition and decrease of competitiveness of domestic enterprises necessitate their innovative development. Information, intelligence, knowledge and innovation, which are the backbone of the country's human resources, are of particular importance in this context today. Therefore, the driving factors in the way of formation of personnel component of innovative development of the state economy are the training of innovative personnel – skilled workers, capable of creative work, professional development, introduction of high-tech technologies on the basis of development of the system of lifelong learning. The issues of professional development of employees are becoming especially relevant in the context of globalization, as well as the European and innovative integration of Ukraine. The author investigates the peculiarities of transformations of modern theoretical and legal approaches to professional development of employees in the context of European integration, human-centered and innovative approaches to doing business, in particular, the following tasks are solved: (1) the essence of the concepts of ‘professional development’, ‘functions of professional development of employees’, ‘professional training’ as legal categories is revealed; (2) leading functions of professional development of employees are generalized; (3) the vectors for further reform of the legal regulation of professional development of employees are determined; (4) the prospects and problems of influence of professional development of employees on the innovative development of individual enterprise and Ukraine as a whole are established. The author substantiates that the professional development of employees produces its direct impact both on individual enterprises and on the state as a whole in the sphere of innovative transformations. Undoubtedly, the gradual introduction of European standards and requirements, the adaptation of foreign legal regulation to the domestic realities and features of the legal system will allow to increase the economic potential, innovative component and competitiveness of Ukraine in the world market, as well as to bring the prospects of gradual accession into the European Union.

Аннотация: In modern transformational Europe-oriented conditions of Ukraine development, the peculiarities of property civil law liability and material liability according to labor law as well as comprehensive comparative analysis are very topical in connection with the lack of a one unified approach to this issue, both among representatives of the doctrine and practices. The authors of this article conducted study involving: (1) the notion, content and features of property civil law liability of properties in corresponding legal relations have been analysed; (2) the authors’ definition of the notion “property civil law liability” has been proposed; (3) criteria of delineation between property civil law liability and material liability in labor relations have been disclosed and unified; (4) the characteristics of case law in the field of bringing to property civil liability have been analyzed, the substitution of labor civil liability, as well as prosecution without guilt have been emphasised; (5) a discussion position regarding the existence of professional responsibility as a form of civil liability has been considered, and (6) the necessity of specifying nature and characteristics of property civil liability, as well as the circumstances of exemption from it, at the legislative level, with subsequent detailing in the case-law of the Supreme Court of Ukraine state has been substantiated.

Аннотация: Nowadays, one of the reasons for the ineffective fight against corruption in the budget system is certain discrepancies and inconsistencies between the legal components of the mechanism for countering this anti-social phenomenon. The lack of a clear definition of the limits of competence of participants in the budget process, discretionary powers in the distribution and expenditure of budget funds, conflicts in budget legislation, and the lack of real competition in the field of public procurement clearly form the main corruption risks for all participants in these legal relations. The purpose of the study was to analyse the international legal mechanisms for combating corruption and find ways to implement them in Ukrainian legislation. The development of the national anti-corruption policy of Ukraine in the public sector as a subject of international anti-corruption law is determined by a number of the following national and external factors: 1) Ukraine's accession to the universal and regional conventions on combating corruption, compliance with which constitutes the main prerequisite for Ukraine's entry into the global space; 2) Ukraine's implementation in national legislation of anti-corruption international standards developed by international intergovernmental and non-governmental organisations; 3) adaptation of national legislation to European standards within the framework of the signed association agreement between Ukraine and the EU of 2014; 4) cooperation of Ukraine with international organisations, within which the international anti-corruption policy is developed and formed; 5) activities in the field of combating corruption of international non-governmental organisations, among which Transparency International constitutes an important element of the legal mechanism of the international anti-corruption legal order; 6) Ukraine’s international anti-corruption obligations to international financial institutions; 7) Ukraine's participation in international conferences and summits on anti-corruption issues; 8) Ukraine's cooperation with other states in providing relevant bodies of foreign states and receiving information on preventing and combating corruption; 9) national historical and political factors.

Аннотация: OBJECTIVE: The aim: The aim of this work is to identify the compliance level of modern practice of placement of a person in a medical institution in order to conduct the FPE to international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person; formulation of scientifically substantiated proposals on the synchronization directions of national practices with the specified international standards. PATIENTS AND METHODS: Materials and methods: During the preparation of the article the following was processed: scientific research on ensuring the rights of persons suffering from mental disorders in criminal proceedings; provisions of international agreements on the provision of psychiatric care; legal positions of the ECHR on the observance of persons' rights suffering from mental disorders (15 judgments on this topic); criminal procedural legislation of individual states; results of generalization of national law enforcement practice; the results of a survey conducted by the authors of 18 psychiatrists who practice in the field of forensic psychiatric examinations (psychiatrists working in state psychiatric clinics in Odesa, Poltava, Kharkiv were interviewed). In the process of research a set of general scientific and special methods of cognition was used (comparative-legal method, system-structural method, generalization method, method of analysis and synthesis, method of sociological research, method of expert assessments, etc.). RESULTS: Results: According to the research results: a) legal positions of the ECHR on the observance of the rights of persons suffering from mental disorders are identified and generalized; b) the compliance level of modern practice of placing a person in a medical institution in order to conduct the FPE with international standards and legal positions of the ECHR in terms of ensuring the right to liberty and security of person ( 1 of Article 5 of the Convention); c) the degree of extrapolation of these positions to the activities of psychiatrists is analyzed; d) the optimal ways of solving the existing problems in the aspect of ensuring the rights of a person when placing them in a medical institution for an inpatient FPE are proposed. CONCLUSION: Conclusions: The current national practice of placing a person in a medical institution for an inpatient FPE does not fully comply with the legal positions of the ECHR in terms of ensuring the right to liberty and security of person (in particular, there are deviations from the positions of the ECHR on: determining the documentary basis for the appointment of an inpatient FPE; interaction of police and medical workers in the field of psychiatry during the detention of a person with a mental disorder). Аннотация: OBJECTIVE: Introduction: The article is devoted to the research of topical issues of ensuring the rights of persons suffering from mental disorders and who are subject to criminal proceedings on the application of compulsory medical measures (hereinafter - CMM). The research was conducted in the context of international standards and interpretative practice of the European Court of Human Rights (hereinafter referred to as the ECHR or the Court). The aim: The aim of this study is to analyze international acts concerning the protection of the rights of mentally ill persons when applying compulsory medical measures; to highlight and analyze the ECHR's key positions in the context of respect for the right to liberty and security of person (Article 5 1 (e) of the European Convention on Human Rights (hereinafter referred to as the Convention)) and the right to a fair trial (Article 6 of the Convention) in criminal proceedings concerning the use of CMM; to analyse the law enforcement practice and activities of psychiatrist experts on compliance with European standards for the protection of the rights of persons with mental disorders who are subject to criminal proceedings. PATIENTS AND METHODS: Materials and methods: rescent scientific researches; provisions of international legal acts in the field of psychiatric care; the legal standpoint of the ECHR in respecting the rights of persons with mental disorders (15 decisions were analyzed in which the ECHR addressed these issues in the context of the requirements of Articles 5 and 6 of the Convention); criminal procedural legislation of foreign states (Belarus, Kazakhstan, Moldova, Russian Federation, Estonia, Uzbekistan, Germany); the results of the survey of 20 psychiatrists and experts conducted by the authors were used in this article To achieve this aim of research process a set of general scientific and special methods of cognition, including comparative and legal method, system and structural method, method of generalization, method of analysis and synthesis, method of sociological research, method of expert evaluation, etc. bein used. RESULTS: Results: summarized and generalized ECHR's standpoints concerning: a) minimum conditions without which a person cannot be considered as "mentally ill" and imprisoned; b) the aspects taken into account by the ECHR within each minimum condition in the context of ensuring the right to liberty and security of person (Article 5 1 (e) of the Convention); c) the peculiarities of the personal participation of an individual with a mental disorder in the judicial review of the application of CMM in terms of observing its right to a fair trial (Article 6 of the Convention). The degree of extrapolation of these standpoints to the activity of psychiatrists was identified and analyzed. CONCLUSION: Conclusions: the current practice of applying CMM in criminal proceedings does not fully comply with the international standards and legal positions of the ECHR in terms of providing a person with a mental disorder the right to liberty and security of person and the right to a fair trial (in particular, the minimum conditions without which a person cannot be considered as "mentally ill" and be imprisoned are not always met).

Аннотация: The authors of the article continue the scientific discourse on the role and significance of bicameralism for building a modern democratic legal state. The main arguments of supporters and opponents of bicameralism have been analysed, given the complicated development of Ukrainian institutional framework and discussions over the European Committee of Regions evolution. The authors of the article attempt to supplement the list of arguments that exist in modern legal literature in favor of Ukraine's transition to bicameralism. The challenges of European integration for Ukrainian parliament as a unitary actor have been highlighted. The authors substantiate the thesis that the formation of the second (upper) chamber does not threaten the Ukrainian unitarianism, but will contribute to further diversification of state power and at the same time increase the stability of the government in terms of a consensual, pluralistic democracy and semi-presidential government.

Аннотация: Ukraine is one of the largest countries in Europe and there is a significant Muslim minority here, among which there are several Shia communities. Aspects of the life and activities of the Shia community in Ukraine are almost unexplored. Although at the same time a number of studies were devoted to the Shiite minorities of Western European countries, therefore in this paper, we examined the characteristics of the life of the Shia community in Ukraine and compared it with the characteristics of the Shia communities in Western Europe. Special attention was paid to the peculiarities of the mentality of the indigenous Shiites, represented by Azerbaijanis. The features of the institutionalization of the Shia communities of Ukraine, the features of conducting divine services and mourning events of Ashura were considered. After analyzing the above problems, we came to the conclusion that the Shiites of Ukraine are more passive, so we tried to identify the reasons for such passivity, among which the most important are the Soviet "atheistic" past; cultural, national and linguistic diversity of representatives of the Shiite minority of Ukraine, which prevents larger gatherings of Shiites from being held. We consider the article as a basis for further research in this region, therefore, the purpose of the study was to highlight all possible problematic aspects of the life of Shiite minorities in Ukraine.
