Аннотация: The question of recognition and enforcement of international commercial arbitration (ICA) decisions, as a prototype of a foreign court decision, finds radically opposite answers in different legal systems and in the doctrine of the ICA. Thus, in the Regulation of the Council (EU) 44/2001 of 22 December 2000 on the jurisdiction, recognition, and enforcement of judgments in civil and commercial matters, formerly the Brussels Convention of 1968 and the Lugano Convention of 1988, the notion of 'arbitration' was excluded from the sphere of execution and recognition of foreign court decisions. Methods: Nevertheless, the procedure for recognising and enforcing an ICA award has a unified approach in many countries around the world. Thus, national courts, when deciding on the recognition and enforcement of an ICA award, are increasingly faced with such problematic issues as the grounds for refusing to recognise and enforce such an award. This article reveals that these grounds for refusing to recognise and enforce the award of the ICA are a violation of public order of the country where the arbitral award is subject to recognition and enforcement. Particular attention is paid to the distinction between 'substantive' and 'procedural' public order and the practical approaches of national courts in some countries to this issue. Results and Conclusions: The authors state that the way to overcome this inconsistency is still a unified approach to understanding 'public order' in all member states of the New York Convention of 1958 and clearer international regulation of this issue.

Аннотация: The purpose of the study is to determine the subject of "medical secrecy", to characterize the subjects who are obliged to keep secret information that is the subject of medical secrecy and, based on the results of this study, to make author's proposals to clarify the name for confidential medical information in legislation in the field of medicine in the field of medicine, criminal and criminal procedural legislation. The article explores issues related to the right of every person to the confidentiality of medical information, which is legally defined as "medical privacy". Based on the analysis of international legal acts, decisions of the European Court of Human Rights, the legislation of Ukraine and Georgia on the researched subject, using the foundations of the philosophy of law, carried out a comprehensive study of the concept of "medical confidentiality", defined entities following their professional and career responsibilities, must keep it. In the given article were used such scientific methods as logical, system-structural, comparative-legal, analysis, synthesis. Based on the research, the authors make several proposals for improving certain norms governing medical activities, namely, changes to the wording of Article 40 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Protection", Article 145 of the Criminal Code of Ukraine and Article 65 of the Criminal Procedure Code of Ukraine.

Аннотация: The study presents the word translation into vectors of real numbers (word embeddings), one of the most important topics in natural language processing. Word2vec is the latest techniques developed by Tomas Mikolov to study high quality vectors. The majority of studies on clustering the word vectors were made in English. Dmitry Chaplinsky has already counted and published vectors for the Ukrainian language by using LexVec, Word2vec and GloVe techniques, obtained from fiction, newswire and ubercorpus texts, for VESUM dictionary and other related NLP tools for the Ukrainian language. There was no research done on the vectors by using Word2vec technique to create Ukrainian corpus, obtained from Wikipedia dump as the main source. The collection contains more than two hundred and sixty one million words. The dictionary of words (unique words) obtained from the corpus is more than seven hundred and nine thousand. The research using machine technology Word2vec is of great practical importance to computerise many areas of linguistic analysis. The open-source Python programming language was used to obtain word vectors with Word2vec techniques and to calculate the cosine proximity of the vectors. In order to do machine learning with Word2vec techniques on Python, a resource containing open source licensed software libraries called "Gensim" was used. Calculations regarding the cosine affinities of the obtained vectors were made using "Gensim" libraries. The research examining the clustering of the word vectors obtained from the Ukrainian corpus was made considering the two sub-branches of linguistics, semantics and morphology (language morphology). Firstly, it was investigated how accurately the vectors are obtained from the Ukrainian corpus and how the words represent the cluster they belong to. Secondly, it was investigated how word vectors are clustered and associated respectively to the morphological features of the suffixes of the Ukrainian language.

Аннотация: Organized criminal groups continue to understate profits and export finished goods from Ukraine without paying taxes. Ukraine’s environment of economic transformation has provided organized criminal groups with ample opportunity to drain Ukraine’s resources. Organized crime groups took advantage of Ukraine’s period of economic reform to develop methods to drain Ukrainian currency and hide capital resources abroad. The preservation and expansion of Ukraine’s capital is an economic necessity. The methods used can be instructive in considering the detection and investigation tactics to combat them. Criminal penetration is endemic to Ukraine’s organizational, administrative, legal, and regulatory systems. In order to have successful investigation and prosecutions, a thorough understanding is required of the means by which these crimes are committed. The development of international business relations between Ukrainian and foreign businesses, as well as the development of international networks of Ukrainian emigrants, has provided another system by which Ukrainian businesses can conceal currency abroad. © 2001, 2004 by Taylor & Francis. Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: In this Article, we outline the concepts of international law that relate to cases of individual liability as well as to contradictions in the international legal system and provide the possibility to understand the legal aspects that emerge from certain conditions. Present international law is primarily based on the notion of independent international duty (majorly of governments and international organisations). This definition often does not provide a substantive or institutional tool for the distribution of responsibilities between a majority of participants in circumstances where contributions to negative results can not be applied on the basis of the particular cause of each person. The main tasks of the article is firstly to identify and define the main historical background and concepts that allow us to assess the law pertaining to individual responsibility and to conceptualize the relevant practice of the International Criminal court as well as to discuss the potentials and limits of the current framework of international responsibility in dealing with situations of both collective and individual responsibility.

Аннотация: Nowadays, active legislative reforms are being implemented in Ukraine, which are gradually introducing conceptual provisions on ensuring the right of the individual to information and aiming to effectively overcome the identified negative factors by introducing European standards in the field of the individual's right to information, however, to transform approaches to the right of the individual to information. in the context of European integration, attention is paid only fragmentarily, which in turn actualises the topic. The aim of this article is to investigate the transformation of approaches to the essence and content of a person's right to information in the context of Ukraine's European integration reforms. The outlined subject matter was explored through the approbation of the system of conceptual approaches and a set of general scientific and special scientific methods. Comparative analysis of the legal acts of Ukraine and the European Union in the research area displayed that it is now possible to refer to the imperfection of Ukrainian legal regulation in the field of securing, regulating and protecting the right of a person to information. Five urgent steps were proposed for the most prudent transformations of the person's right to information in Ukraine in the context of European integration.

Аннотация: This note is focused on the problems of ensuring the rights of national minorities and indigenous peoples in Ukraine. These issues are considered in accordance with theoretical approaches in the social sciences, as well as the practice of protecting the rights of national minorities and indigenous peoples in Ukraine. Court decisions on discrimination against the rights of these vulnerable groups are analysed. The research is aimed at the scientific search for ways to improve the legal regulation of national-ethnic relations to ensure the rights of national minorities and groups. In accordance with a comprehensive theoretical and practical approach, an analysis of Ukrainian legislation and case-law on the protection of the rights of national minorities and indigenous people is given. Problems of ensuring the rights of national minorities and indigenous peoples are revealed. Some promising legislative improvements are proposed to eliminate violations and ensure the rights of these groups.

Аннотация: The article presents a brief analysis of the situation in Belarus and Ukraine with the spread of coronavirus COVID-19 and measures taken by employers to optimise labour and social security relations during 2020. A brief overview of the decisions taken by Presidents, Parliaments, Governments and Ministry of Healthcare of both countries aimed at containment of coronavirus infection is presented. The latest changes in the Labour Code of Belarus and Labour Code of Ukraine, which regulated remote work since 2020, were touched upon. Attention is paid to the concept of self-isolation under the legislation of Belarus and Ukraine, restrictive measures that must be observed when self-isolating citizens in connection with COVID-19 infection, as well as level 1st and 2nd contacts. The authors analyse the new legislative provisions governing home and remote work, introduced into the labour legislation in Belarus in 2020, in Ukraine in 2020 and 2021. The article presents the specific experience of Belarus, where the presidential decree extended the rights of employers to temporarily transfer employees without their consent, as well as to change essential working conditions, and without making changes to the Labour Code. The authors give an assessment of such legislative innovations. The article deals with some issues of social support for employees who find themselves in a situation of downtime due to the suspension of the activities of organisations that are idle, as well as self-isolation. At the end of the article, some suggestions and recommendations are made for further adaptation of labour and social security legislation in Belarus and Ukraine in the context of the COVID-19 pandemic.

Аннотация: This article is a study of the Civil Code of Ukraine as the main regulator of civil relations in civil society. The history of adoption of the Civil Code of Ukraine and its conceptual foundations were reviewed. Particular attention is paid to the problem of dualism of private law in Ukraine. The structure and content of the Civil Code of Ukraine were analysed. Attention is also paid to the main novelties of the Civil Code of Ukraine. The principal rules for the regulation of legal entities were analysed. Novelties in defining the object composition of civil legal relations are considered. Particular attention is paid to the main directions of modern scientific research in the field of the civil law of Ukraine. The study confirms the urgent need for a thorough recodification of the Ukrainian civil law, with mandatory consideration of the experience of the implementation of modern recodifications in many European countries.
