Аннотация: The European Convention on Human Rights proclaims the right of everyone to privacy of information about their state of health, which is a particularly important issue during the COVID-19 pandemic. The aim of the study is to determine the essence of the ECtHR's activity as a guarantee of information culture, highlight the main elements of its activities in this aspect, and analyze the right to medical secrecy in the practice of the European Court of Human Rights. The formal-logical method was used to analyze the norms of the European Convention on Human Rights, determine the content of basic concepts, and systematize the material in order to obtain generalizing conclusions within the framework of the stated problem. The predictive method was used to determine the prospects for the development of legislation aimed at creating a system of effective legal provision for the confidentiality of patient information. The European Court of Human Rights has more than once drew attention to the enormous importance of protecting personal, in particular medical data, so that a person can enjoy his or her right to private and family life with satisfaction. That is why public authorities must ensure the confidentiality of information about the health of individuals. It should not be disclosed or processed without the prior informed consent of the person concerned. There are a lot of cases of unlawful disclosure of information about the patient's health and liability for unlawful disclosure.

Аннотация: As of 2020, 70 years have passed since the day of the adoption of the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), which Ukraine ratified in September 1997. It was from this date that the countdown to significant democratic transformations in Ukraine and the establishment of human and civil rights and freedoms began. In this article, the authors raise relevant issues of reforming the criminal process of Ukraine in the context of European standards. The old Code of Criminal Procedure of Ukraine was adopted in 1960 and was in force for almost half a century. During this time, it became obsolete and bore a significant imprint of the Soviet past, which was manifest in both the bodies that conducted the trial and had primarily repressive powers and the public interests that dominated the rights and legitimate interests of those involved in criminal justice. The conditions under which the first steps aimed at realising the importance of the Convention and the value of human rights enshrined in it took place were not easy. The path of reform processes in criminal proceedings was associated with the confrontation of the Soviet past with modern transformation. It was difficult to realise the need to harmonise national legislation with European standards of human rights and freedoms and consolidate their perception as one of the necessary conditions for Ukraine's integration into the European legal space, as well as the need for a conceptually new worldview for both the people of Ukraine and law enforcement bodies - officers, judges, and prosecutors.

Аннотация: Today, the successful competition of any domestic enterprise in the market of goods and services is conditioned on the use of new technologies and production processes. Such activity is innovative and plays a leading role in its life. Exacerbation of competition and decrease of competitiveness of domestic enterprises necessitate their innovative development. Information, intelligence, knowledge and innovation, which are the backbone of the country's human resources, are of particular importance in this context today. Therefore, the driving factors in the way of formation of personnel component of innovative development of the state economy are the training of innovative personnel – skilled workers, capable of creative work, professional development, introduction of high-tech technologies on the basis of development of the system of lifelong learning. The issues of professional development of employees are becoming especially relevant in the context of globalization, as well as the European and innovative integration of Ukraine. The author investigates the peculiarities of transformations of modern theoretical and legal approaches to professional development of employees in the context of European integration, human-centered and innovative approaches to doing business, in particular, the following tasks are solved: (1) the essence of the concepts of ‘professional development’, ‘functions of professional development of employees’, ‘professional training’ as legal categories is revealed; (2) leading functions of professional development of employees are generalized; (3) the vectors for further reform of the legal regulation of professional development of employees are determined; (4) the prospects and problems of influence of professional development of employees on the innovative development of individual enterprise and Ukraine as a whole are established. The author substantiates that the professional development of employees produces its direct impact both on individual enterprises and on the state as a whole in the sphere of innovative transformations. Undoubtedly, the gradual introduction of European standards and requirements, the adaptation of foreign legal regulation to the domestic realities and features of the legal system will allow to increase the economic potential, innovative component and competitiveness of Ukraine in the world market, as well as to bring the prospects of gradual accession into the European Union.

Аннотация: Nowadays, active legislative reforms are being implemented in Ukraine, which are gradually introducing conceptual provisions on ensuring the right of the individual to information and aiming to effectively overcome the identified negative factors by introducing European standards in the field of the individual's right to information, however, to transform approaches to the right of the individual to information. in the context of European integration, attention is paid only fragmentarily, which in turn actualises the topic. The aim of this article is to investigate the transformation of approaches to the essence and content of a person's right to information in the context of Ukraine's European integration reforms. The outlined subject matter was explored through the approbation of the system of conceptual approaches and a set of general scientific and special scientific methods. Comparative analysis of the legal acts of Ukraine and the European Union in the research area displayed that it is now possible to refer to the imperfection of Ukrainian legal regulation in the field of securing, regulating and protecting the right of a person to information. Five urgent steps were proposed for the most prudent transformations of the person's right to information in Ukraine in the context of European integration.

Аннотация: In this article, we use the notion of "path dependence" to explain, on the one hand, Ukraine's continuing dependence on Russia stemming from the hundreds of years that the Ukrainians were governed by the Russian Empire and later the USSR. Among other things, this dependence led to some parts of Southern and Eastern Ukraine being populated by Russian-born settlers and their descendants, which is still manifested in their historical and sociocultural orientation toward a closer integration with Russia. On the other hand, the notion of 'path dependence' implies significant differences between Ukraine and Russia, especially due to many Ukrainians self-identifying as a European nation. The European self-identification of Ukrainians is apparent in the desire of the vast majority to overcome dependence on Russia through integration into the European political, legal, cultural, and economic system. We firmly believe that, to successfully overcome dependence on Russia, Ukraine and Ukrainians first need a fundamental recognition of European standards of human rights and the European human rights protection model in general. The success of the 2014-2018 democratic reforms in Ukraine is obvious, but no less obvious is the fact that the positive changes in Ukraine are far from irreversible. At present, the biggest threat to Ukraine is the "force field" of the "Russian World", and it is in being able to efficiently resist this threat that Ukraine needs Europe's support the most.

Аннотация: The European Convention on Human Rights and the case-law of the European Court of Human Rights have a significant impact not only on national legal order but also on international criminal courts. The article is dedicated to analyzing that impact in the context of the right to legal assistance. We ascertain the purpose of the establishment of international criminal courts, the specificity of the right to legal assistance in the European system of human rights protection, the impact of the European Convention on Human Rights on the drafting of statutes of the international criminal courts and influence of the European Convention on Human Rights and case-law of the European Court of Human Rights on the interpretation of the right to legal assistance in the international criminal courts. Also the primacy of the right to legal assistance is proved, which is provided in the ECHR to the statutes of international criminal courts. At the same time, the international criminal courts, taking into account the purpose of their establishment and jurisdiction, give additional guarantees of the right to legal assistance.
