Аннотация: The problem of health is one of the global problems, the solution of which contributes to the further development of the state. The article is devoted to topical issues of medical reform implementation in Ukraine. The importance of making changes in the field of medicine is analyzed. The main problems and obstacles to the introduction of new principles of interaction are considered. The purpose of the study is to identify the most pressing problems of health care reform, to determine the essence of health care reform, to indicate its possible pros and cons. To achieve this goal, an analysis of the regulatory and legal framework for reforming the healthcare sector in Ukraine was carried out, the stages of reform that have already been completed to date and those that are still in the process of implementation, their positive and negative aspects were analyzed, methods were used: comparative legal, statistical, induction, analysis, synthesis. Based on the study, the authors concluded that the transition of the health care system from an administrative-command to a market model of medical services on an economic and legal basis is generally a positive step in choosing the direction of reform. The main fundamental principles envisaged by the reform are: the responsibility of the state, the availability and quality of medical services, the convenience of obtaining them, ensuring equal access to services and efforts to make the most efficient use of available resources.

Аннотация: The effectiveness of crime counteraction in modern conditions greatly de-pends on the functioning of the corresponding institutional mechanism, where the prosecutor’s office has an important part. Using the analysis of international docu-ments and the experience of a number of countries, the author shows that the com-mon international standard for the function of the prosecutor’s office in the criminal law sphere is to give it a priority role in suppressing crime, and to define this role in a more or less broad way at the national level. The author researches the Ukrainian model of the functions performed by the prosecutor’s office where this body is mainly involved in criminal proceedings, which makes it possible to identify crime counteraction as the key task of the prosecutor’s office. The author also examines the progress and the result of the prosecutor’s office reforms in Ukraine in view of the changes in the functions of this body in the sphere of crime counteraction. The functions of the prosecutor’s office are analyzed from the standpoint of their importance for suppressing crime based on the research of legislation, analytical and statistical data. The author shows that the key tasks (directions) of crime counteraction (identifying and eliminating the causes and conditions for committing crimes; identifying, suppressing and investigating crimes; prosecution of perpetrators; compensation of damage inflicted by crimes) fully correlate with the functions of the Ukrainian prosecutor’s office. The function of procedural supervision of the pre-trial investigation allows the prosecutor’s office to influence the identification, suppression and investigation of crimes; the function of the support of public prosecution in court makes it possible to criminally prosecute persons guilty of crimes; the function of representation allows the prosecutor’s office to compensate the state for the damage inflicted by crimes. Special attention is paid to the prosecutor’s coordination of the work of law enforcement bodies on counteracting corruption. Although it has lost its status as a separate function of the prosecutor’s office under Ukrainian legislation, it still has key importance for the work of different law enforcement bodies aimed at suppressing crimes in their different forms. The author conducts a comparative legal study of the regulation of coordination activities of the prosecutor’s office in Ukraine and in other coun-tries, as well as the prospects of establishing the European Prosecutor’s Office; based on this study, the author concludes that the definition of the prosecutor’s office as the coordination center of the system of criminal justice aimed at counteracting corruption is a widely recognized global trend. The author also presents suggestions on improving the effectiveness of the coordination activities of the prosecutor’s office and of its other functions aimed at counteracting crimes.

Аннотация: The aim of the article is a comprehensive analysis of the possibility of realizing the human right to health protection based on the practice of the European Court of Human Rights.; To achieve this goal, general scientific and special methods of cognition were used, chosen taking into account the purpose of the work. The epistemological method was used to study the general prerequisites, means and patterns of development of mechanisms for protecting the human right to health protection, including in the ECHR. The dialectical method - when searching for the right approaches to solving theoretical and legal problems that arise in the legal regulation of the human right to health protection. Using the method of legal analysis, the scope of medical human rights is determined. The statistical method was used to study the dynamics in the processes associated with the realization of the human right to health at the ECHR. The comparative legal method made it possible to compare the norms of the national legislation of Ukraine and other countries with the practice of the ECHR in the field of ensuring the human right to health protection. The structural method is used to study the types of medical human rights that are protected by the ECHR.; The article concludes that the right to health protection ensures the natural existence of an individual, is of great importance in the system of rights, and is an integral, natural achievement of mankind. It is emphasized that it is advisable for states to pay attention to the practice of the ECHR to ensure medical human rights in order to prevent violations of these rights and provide effective mechanisms for their implementation. The article notes that the ECHR does not recognize abortion and euthanasia as violations of the Convention. It is noted that the practice of the ECHR in dealing with cases of violation of the human right to health has become a guideline for health care reform in most countries of the European Union and has made it possible to achieve significant changes in the work of healthcare systems for the better. It has been determined that the main task of the ECHR and international organizations in resolving issues related to the protection of the human right to health care is the observance by the participating states of the Convention in this area.

Аннотация: The objective of this article is a comprehensive analysis and study of normative and legal acts regulating the reform of financing the health care system, the introduction of the programs of state guarantees for medical care of the population and determining the perspectives for implementing the programs of state guarantees for medical care of the population in Ukraine. The authors of the study have used theoretical (analysis, generalization, systematization, etc.) and empirical (observation, classification, comparison, etc.) methods.; The conducted analysis of international experience has established that countries such as Bulgaria, Georgia, Estonia, Lithuania, Moldova, Poland, Romania, Croatia and others had already gone through the process of introducing guarantees in the health care sector. It has been concluded that the main features of the term of "guaranteed package" should include: a clear definition of the rights to receive medical services; financing from the budget; consideration of the priority of various types of medical services.; The programs of medical guarantees of Ukraine during 2018-2020 have been analyzed. Specific features of their implementation have been determined; the tariff rates and correction factors have been analyzed. The main tariff rates for financing medical services have been distinguished: capitation rate; rate for the treated case or payment for diagnostically related groups; the rate on a medical service, where a separate service is the chargeable unit; global rate; rate on the results of the implementation of medical service contracts.

Аннотация: The fundamental and fundamental human right that is central to the system of non-proprietary rights aimed at ensuring the natural existence of an individual is the human right to life. The development of a civilized world leads to a new subjective perception of people about the origin of man, his place in the ecosystem and outer space in general and the scope of human rights and their transformation in particular. Complications of social life in the modern world leads not only to the transformation of social relations and the rapid renewal of the entire legal framework, but also to a significant acceleration and deepening of the formation of new branches of national law. In the current legal reality, it is separately necessary to separate medical law. The creation of medical law as a new branch of law is a necessity of our time, which will allow us to more effectively regulate legal relations in the medical field. The Institute of Euthanasia, in turn, should take its place precisely in the framework of medical law, and should be considered as a system of legal norms aimed at regulating social relations arising from the deliberate deprivation of life of a patient in order to alleviate his suffering, establishing the subjective composition and special methods of legal regulation. A look at the institution of euthanasia as an integral element of medical law will provide an effective and differentiated legal regulation of the procedure for its implementation.

Аннотация: In order to better protect the human right to life, to improve the implementation of Art. 2 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as the reduction of the number of judgments of the European Court of Human Rights against Ukraine, we propose avoid unjustifiably lengthy investigations into the causes of death of citizens and provide specialized resuscitation assistance to all who need it. Share Art. 52 of the Law of Ukraine "Fundamentals of the legislation of Ukraine on health care" the following wording: "Medical workers are allowed to euthanize - intentionally accelerating the death or death of a terminally ill patient in order to end his or her suffering, subject to his consent and the conclusion of the commission, which is not less than of three doctors on the incurability of a disease that causes significant physical pain (suffering) for the patient".

Аннотация: Organ donation is one of the topical issues in the field of medicine around the world. Although the practice of transplantation exists in most countries of the world, there are still many unresolved issues. One of them is the issues related to postmortem organ transplantation in Ukraine. Despite the significant increase in the scale of transplantation of human organs, tissues and cells, today there is a need to improve the mechanism of organ transplantation from deceased persons, both at the legal level and in the provision of medical services. The purpose of the study is to consider problematic issues related to posthumous transplantation, in particular its legal support, ethical aspects, medical opportunities for improving the procedure for providing organs to the recipient, as well as looking for prospects for their resolution. To achieve this goal, an analysis of the existing regulatory framework in the field of transplantation was carried out, the experience of Ukraine and foreign countries on the issue under study was analyzed, the following methods were used: comparative legal, statistical, induction, analysis, synthesis. Based on the study, the authors conclude that the regulation of transplantation in Ukraine should be not only at a high legal level, but also implemented in practice into the Unified State Information System for Organ and Tissue Transplantation, which will allow timely and efficient provision of organs to the recipient.

Аннотация: The purpose of the study is to determine the subject of "medical secrecy", to characterize the subjects who are obliged to keep secret information that is the subject of medical secrecy and, based on the results of this study, to make author's proposals to clarify the name for confidential medical information in legislation in the field of medicine in the field of medicine, criminal and criminal procedural legislation. The article explores issues related to the right of every person to the confidentiality of medical information, which is legally defined as "medical privacy". Based on the analysis of international legal acts, decisions of the European Court of Human Rights, the legislation of Ukraine and Georgia on the researched subject, using the foundations of the philosophy of law, carried out a comprehensive study of the concept of "medical confidentiality", defined entities following their professional and career responsibilities, must keep it. In the given article were used such scientific methods as logical, system-structural, comparative-legal, analysis, synthesis. Based on the research, the authors make several proposals for improving certain norms governing medical activities, namely, changes to the wording of Article 40 of the Law of Ukraine "Fundamentals of Ukrainian Legislation on Health Protection", Article 145 of the Criminal Code of Ukraine and Article 65 of the Criminal Procedure Code of Ukraine.

Аннотация: The relevance of the study is conditioned by the necessity of establishing the degree of interaction of universal rights and freedoms of the individual in civil and international law, as well as the possibility of limiting state sovereignty in the implementation of international obligations to ensure and protect human rights. The purpose of the paper is to investigate the international experience of legal regulation of universal human rights in order to develop ideas for their implementation in the legal framework of countries in transformation, including Ukraine. The leading methods of the study included the analysis of international and European practices of consolidating universal human and civil rights, modelling of legal structures acceptable to Ukraine. As a result of the study, it was concluded that the restriction of state sovereignty is possible only in favour of the individual based on the priority of human rights. The research materials can be useful for lawyers and government officials performing draft law activities, teachers of law schools, as well as officials and public administration officials who seek to apply the standards and practices of international regulation of universal human and civil rights in individual management cases.

Аннотация: We obtain uniqueness criterion for integer solutions of implicit higher order difference equations which extends the result of Berestovskii and Nikonorov. This criterion is specified for an implicit third order difference equation. We also obtain existence and uniqueness theorems for a solution of an implicit higher order nonhomogeneous difference equation over the ring of p-adic integers and over the ring Z. The possibility to obtain this solution by using the Cramer’s rule is established. We also give the explicit form for this solution. These results generalize corresponding results for implicit first and second order nonhomogeneous difference equations.
