Аннотация: Abstract INTRODUCTION: In Ukraine differentiated VAT rates is a matter of debate. Today the Cabinet approved a list of medical products that has been changed three times resulting in changed VAT rates for specific products. European Union provides another method of regulation of VAT rates on medical devices. The abovementioned demonstrates the relevance of this study. MATERIAL AND METHODS: Comparative analysis of Ukrainian and European Union legislation based on dialectical, comparative, analytic, synthetic and comprehensive research methods were used in this article. DISCUSSION: In Ukraine general rate of VAT for all business activities is 20 %. But for medical devices, Tax Code of Ukraine provides special rules. VAT rate of 7% for transactions supplies into Ukraine and imported into the customs territory of Ukraine of medical products on the list approved by the Cabinet. The list generated by the medical product name and nomenclature code that does not correspond to European experience and Council Directive 2006/112/EC. CONCLUSION: In our opinion, reduced VAT rates should to be established for all medical devices that are in a stream of commerce, have all necessary documents, that proved their quality and safety and fall under definition of medical devices.

Аннотация: Organized criminal groups continue to understate profits and export finished goods from Ukraine without paying taxes. Ukraine’s environment of economic transformation has provided organized criminal groups with ample opportunity to drain Ukraine’s resources. Organized crime groups took advantage of Ukraine’s period of economic reform to develop methods to drain Ukrainian currency and hide capital resources abroad. The preservation and expansion of Ukraine’s capital is an economic necessity. The methods used can be instructive in considering the detection and investigation tactics to combat them. Criminal penetration is endemic to Ukraine’s organizational, administrative, legal, and regulatory systems. In order to have successful investigation and prosecutions, a thorough understanding is required of the means by which these crimes are committed. The development of international business relations between Ukrainian and foreign businesses, as well as the development of international networks of Ukrainian emigrants, has provided another system by which Ukrainian businesses can conceal currency abroad. © 2001, 2004 by Taylor & Francis. Аннотация: In this paper the question on the content of the sovereign rights and their relation to sovereignty was not enough developed in legal science. These issues are in the focus of present paper. In the traditional legal doctrine sovereignty is the category which expresses the content and scope of competences of the state in the domestic and foreign policy. The appearance of a new state automatically means the presence of its sovereignty. The loss of sovereignty leads to the termination of its existence as a subject of international law. The states are forced to self-restriction of their sovereign rights in international (interstate) communication, but without losing the sovereignty. As the human rights, the sovereign rights of the state in a certain sense can be treated as natural. The sovereign rights associate with the existence of the state and don’t depend on other non-legal factors. Conception of the states’ legal equality results in the identity and equality in sovereign rights that states can use on their own. The meaning of the sovereign rights consist of the determination and guaranteeing and clearly defined boundaries of the freedom of the state. Can sovereign rights change in the process of historical development of the states? What is the “measure” of changes of the sovereign rights volume? This rights are inherent to the state and as long as sovereign stats play the major role in international law, their strength remains ultima ratio.

Аннотация: Abstract. With the changing global security situation, increase in external threats or emergence of new ones (cyberattacks, non-conventional warfare models, etc.), countries must feel concern regarding consolidation of their security. In this regard, both the Republic of Lithuania and Ukraine are taking measures to enhance and expand their military forces. One of the means to fortify military forces is attracting citizens to serve in the civilian national defence service. Authors of the article employ a comparative aspect to analyse the need for statutory servants serving in the civilian national defence service, as well as reveal the number and type of professionals to be required by the national defence system and explore benefits provided by such statutory servants as well as their purpose in the army. Additionally, in the article authors reveal administrational-legal status of civilian national defence services in both the Republic of Lithuania and Ukraine, its place in the system of other militarised or civil public administration institutions. Comparative aspect is also used to analyse administrative legal status of statutory servants of civilian national defence service, peculiarities of admission of statutory servants to the national defence system and their service therein, as well as possibilities for motivation and stimulation of citizens to exercise service in the civilian national defence service. Therefore, the article aims to answer the question of what could motivate citizens to carry out service in the civilian national defence service, what incentives (needs, interests, values, stimulus, realisation of importance of certain matters, remuneration, etc.) would result in motivation (attitude and interest in) to serve in the Lithuanian Armed Forces and to participate in international operations.

Аннотация: The relevance of the study is determined by the necessity to improve criminal and legal antitakeover measures in the current context. The article deals with the comparative analysis of asset-grabbing as a wide-spread phenomenon existing all over the world and mainly typical for the CIS countries. The authors also analyze the experience of the European Union in counteracting illegal takeover of businesses. The analysis has shown that the phenomenon of ‘asset-grabbing’ is absent in the countries with a developed economies. Special state structures should be created to regulate the merger and acquisition transactions in the stock market. The present study is unique as it generalizes a broad legislative experience and shows significant discrepancy between legislation aimed at protecting the interests of shareholders in the countries with developed market economies and in the CIS countries.

Аннотация: INTRODUCTION: the current state of patenting legal regulation of medical treatment in Ukraine and in the world is analyzed, the directions for the further development are determined. The author defines "non-industrial medical" and socio-ethical theories in the field of medical treatment patent protection. The existence of exclusively formal "monopoly" of the patent owner is noted, as well as the inapplicability of the majority of the patented achievements in this field in Ukraine. AIM: the purpose of this article is to investigate the current state of patenting legal regulation of medical treatment in Ukraine and in the world, to analyze the limitation of patent protection basic conception in the medical field and to determine the tendencies and perspectives of the legal protection mechanism of further development in this field in Ukraine, considering the European and world regulation experience. MATERIAL AND METHODS: this study is based on Ukrainian regulation acts, The European Patent Convention, The Code of Laws of the United States of America, judgments, scientific works and opinions of progressive-minded people in this sphere. Such methods as dialectical, comparative, analytic, synthetic and comprehensive are used in the article. CONCLUSION: The experience analysis of the medical treatment patenting regulation in EU and in other countries of the word made it possible to substantiate the tendencies of development the patenting legal regulation of treatment methods mechanism, based on the needs of creation conditions for the availability of the recent treatment developments and technics for citizens, without increasing the cost of such treatment through license fees.

Аннотация: The author discusses the relationship between two legal orders: international law and European Union (EU) law. The main provisions of this relationship have been established through the precedential practice of the Court of Justice of the European Union – the EU’s main judicial body. This kind of research seems important because of the gap in the theory of international law caused by the immutable dogma of the supremacy of international law. However, modern legal practice demonstrates a certain fragmentation of the international legal order because of the impact of the existence and development of regional supranational legal orders. The EU legal order, with its own special nature (sui generis), is undoubtedly one of the most developed among them. The Court of Justice of the European Union performs a crucial role in the EU legal system concerning application and interpretation of EU law. It provides auniform interpretation of this law for the purposes of development of supranational integration. In this context the Court of Justice the European Union establishes the status of European law and its relationship with the national legal systems and international law. The Court acts as protector of the EU legal order against the influence of other legal orders. The Court’s precedential practice reveals EU law’s tendency towards its constitutionalization and the development of its autonomy. The latest practice indicates the Court’s powers to review the EU institutions’ acts in relation to the implementation of UN Security Council resolutions. This proves the Court’s ability to establish indirect control even over UN acts.

Аннотация: Introduction: Among all categories of patients children (minors) must be protected first. It is caused so by the specificity of the treatment, their vulnerability, the need of further protection and supervision. Providing of medical care services for children are often connected with the risks of the process of treatment, and of the drug usage. The aim: To identify the problems associated with the protection of the rights of minors and, on the basis of this, the basic guarantees of their rights, as well as mark the trends in the practice of ECHR. Materials and Methods: The study is based on its own theoretical and empirical basis. The theoretical basis include scientific articles, expert reviews of legislation and communications of non-governmental organisations, and empirical – decisions of the ECHR, international legal acts and directives of the EU. Results: The main violations of the rights of minor children include the following: – legal representatives of children do not take to the account their interests (refusal of medical intervention or the choice of certain method of interference); – medical intervention under the influence of coercion; – providing of unwarranted medical care without the corresponding testimony; – providing of inadequate medical care: when the patient was only examined and ineffective treatment was prescribed, and others. As for mentally ill children, the following rights are usually violated: for life, for a fair trial. It has been proved that defects in the provision of health care are often predetermined by the poor state logistics of hospitals, lack of financing and appropriate pediatric medicines, outdated methods of treatment, and incompetence of some doctors. Conclusions: From the point of view of protecting the rights of minors, the rights of children in medicine can be classified into universal and special. The rights correspond not only to the corresponding duties of medical staff, but also of their parents (legal representatives). Violations of their rights are usually related to improper representation of the interests of children and disadvantages of providing medical services (defects in their provision), in particular, regarding the treatment of mentally ill, as well as in clinical trials. It has been proven that the practice of the ECHR on the protection of the rights of the child in the field of health is of particular importance.

Аннотация: INTRODUCTION: the article analyzes the state of protection of intellectual property rights of original medicine producers, its accordance with international standards. Attention is focused on the importance of exclusivity of medicine market. AIM: the analysis of protection of intellectual property rights of medicine producers in Ukraine and determination of its conformity or non-conformity to the international standards. MATERIAL AND METHODS: the experience of certain countries is analyzed in the research. Additionally, we used statistical data of international organizations, conclusions of experts. RESULTS: there are numerous cases of state registration of generic medicinal products using the registration information of original medicinal products and delict of the rights of patent holders. CONCLUSIONS: an effective mechanism of judicial protection of the original medicine producers` intellectual property rights from disorders that affect the profit was elaborated in Ukraine

Аннотация: Regulatory acts of the European Union play a significant role in regulating land relations in the EU member states. Thus, according to the draft Treaty on the Introduction of the Constitution for Europe (2003/C169/01), adopted by the consensus of the European Convention on June 13 and July 10, 2003, the Council of Ministers unanimously adopts European laws, European framework laws, implements land use measures, excluding the organization of waste collection and disposal (Sulyagina, 2012; Kokanovska, 2016). According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States of June 14, 1994, Ukraine has undertaken to take measures to gradually bring national legislation into line with the legislation of the European Community, that is, to adapt national legislation to the EU legislation requirements. Among the spheres of adaptation there is, in particular, the institution of legal responsibility as an important way of protecting the environment, including lands, as follows from the provisions of the Law of Ukraine "On the State Program for Adaptation of Ukrainian Legislation to the Legislation of the European Union" of March 18, 2004. The implementation of the course on the European integration necessitates the adaptation of the national land legislation to the EU requirements. According to Art. 51 of the Agreement on Partnership and Cooperation between Ukraine and the European Union (EU) and Member States (Agreement on partnership and cooperation between Ukraine and the European Communities…, 1994) an important condition for strengthening economic ties between Ukraine and the Community is the convergence of the existing and future legislation of Ukraine with Community legislation. Ukraine will take measures to ensure the gradual harmonization of legislation with the legislation of the Community. Adaptation of land legislation is the process of bringing the laws of Ukraine and other regulatory legal acts that are sources of land law of Ukraine, as well as the step-by-step adoption and implementation of Ukrainian regulations, developed in accordance with EU legislation, conformably with the acquis communautaire. Acquis communautaire (acquis) the legal system of the European Union, which includes, but is not limited to, acts of European Union legislation adopted within the framework of the European Community, the Common Foreign and Security Policy and the Co-operation in the Field of Justice and Home Affairs. At the same time, it is necessary to take into account that in the EU operates the principle of the EU rule of law over national law, which found its confirmation in the decisions of the Court of Justice of the EU. Thus, in the judgments of the Court of Justice of the European Communities in case 26/62, Algemene Transporten Expeditie Ondernemingvan Gend v. Nederlandse Administratieder Belastingen, in case 6/64, Flaminio Costa v. ENEL and in case Variola v. S. P. Administatione Italianadelle Finanze there is entrenched: • The principle of priority of EU law over the national law of member states (Supremacy of European law principle). • The principle of direct application of EU law (the principle of direct application of EU law). The scale of the influence of EU law is evidenced by the fact that approximately 80% of laws and other legal acts in the economic and social spheres that in the past belonged to the competence of states are produced by Union bodies and are unified for all its members (Magnovsky, 2005). The purpose of adapting the land legislation of Ukraine to the EU legislation is to achieve compliance with the legal system of the country acquis communautaire, taking into account the criteria set by the European Union to the states that intend to join it. The development of Ukrainian legislation in the direction of its approximation to the legislation of the European Union is a priority component of the process of Ukraine's integration to the European Union, which in turn is a priority direction of Ukrainian foreign policy.
