Аннотация: The relevance of the article due to the fact that the insurance industry of Ukraine at the present stage is developing in the global financial, economic and CORONA crisis, which deepens a number of unresolved problems: increases the risk of insurance companies, reduces demand for insurance products; distrust of insurance on the part of potential insurers has increased, increasing competition between insurers for the sphere of influence and customers. The purpose of the articles is to prepare theoretical foundations and develop practical recommendations for the introduction and improvement of the use of modern insurance management in the activities of Ukrainian insurers. The result of this studying is deepening and improvement of modern theory in insurance marketing, and development of practical recommendations for improving the efficiency and competitiveness of Ukrainian insurers.

Аннотация: The article focuses on the fact that 2020 has become a new point in the history of mankind, irrevocably changing the ways of life accepted in society and forcing the entire population of the earth to live in a new way. If a person's health is threatened and / or worried about the thought of a terminal illness, it is difficult to focus on something else. Over the past year, many have experienced this reality for the first time. Effective January 30, 2020, the World Health Organization has declared the coronavirus outbreak a health emergency, causing international concern. The fact that some countries (New Zealand, Australia and South Korea) quickly contained the spread of the virus, but faced new, imported cases, leads to the conclusion that the victory over COVID-19 is possible only worldwide. And if in 2020 masks and social distancing were the methods of fighting the virus, then the main method of 2021 will be the vaccination of the inhabitants of the earth. However, here, too, the key factor is the scale of vaccination, which is one of the main factors in the effectiveness of the fight against any large-scale disease. Here, every person faces a moral and legal question: participation in vaccination is the right of every person as a bearer of human dignity, which implies the impossibility of taking any action on a person without his consent, or the duty of a member of society, which implies the need for vaccination as the question of the survival of the human race as a whole. The article draws attention to the refusal to vaccinate against measles in Ukraine and the consequences of such a choice. The reason for the lack of measles vaccination at the required epidemiological level in Ukraine is not the lack of the necessary vaccines, but the conscious choice of a negative model of behavior by the citizens of the country. The refusal to vaccinate children may be due to a psychological factor caused by the death of a student who was vaccinated against measles on the eve of death. At the same time, the media thirteen years after the event, conducting numerous medical examinations, provides fundamentally contradictory information about the causal relationship between the vaccination of a student against measles and his death. Based on the analysis, it was concluded that vaccination is the most effective way to prevent infection and severe outcomes caused by viruses. Despite this vaccination coverage against viral infections, seasonal influenza in many countries around the world remains low. Even if a vaccine is available to the citizens of a particular country, but educational programs are not carried out on the need and importance of vaccination, the potential for increasing vaccination rates against viruses will continually diminish. The most common explanation for the current upsurge in vaccine uncertainty is that the Internet enables vaccine deniers to reach out to a wide audience by publicizing their beliefs. Some activists only criticize some vaccines. Such a selective stance may indicate a communication strategy used to promote a particular vaccine. Attention should also be paid to the refusal to vaccinate due to the lack of acceptance by the human mind of traditional medicine, not belief in its effectiveness, the use of alternative, alternative medicine in the treatment of diseases. The reasons for not trusting the vaccination process are highlighted. These include: lack of trust in vaccine manufacturers who are economically motivated to make a profit; not trusting medical institutions that provide vaccinations and the conditions in which vaccines are stored; lack of confidence in government agencies involved in the procurement of vaccines, the possibility of corruption in case of abuse of their powers; fear of disease and side effects due to vaccination; distortion by the media of objective data on vaccination.

Аннотация: he formation of a competitive system in a country’s economy is always determined by the possibilities of using tools that stimulate development and form an independent picture for the external environment. In this regard, the study determines the efficiency of antimonopoly regulatory authorities in establishing the criteria and limits of regulation. At the same time, there are cases when antitrust regulation is understood primarily as a form of economic pressure on business entities. The novelty of the study lies in a new consideration of the limits of antitrust regulation. The authors demonstrate that antitrust regulation in its current capacity constitutes a form of limiting the growth of the company and is aimed primarily at reducing the dependence of the market on one stakeholder. The paper identifies the possibilities of additional consideration of the criteria for limiting antitrust regulation in the context of the formation of economic security of a business entity. The paper covers the aspects of determining the limits of state support of economic security of business entities. The practical significance of the study is determined by the need for a more practical harmonization of the legislation of the country with global business standards and a decrease in the level of regulation of the business environment, coupled with its protection from hostile takeovers. Аннотация: The article presents a brief analysis of the situation in Belarus and Ukraine with the spread of coronavirus COVID-19 and measures taken by employers to optimise labour and social security relations during 2020. A brief overview of the decisions taken by Presidents, Parliaments, Governments and Ministry of Healthcare of both countries aimed at containment of coronavirus infection is presented. The latest changes in the Labour Code of Belarus and Labour Code of Ukraine, which regulated remote work since 2020, were touched upon. Attention is paid to the concept of self-isolation under the legislation of Belarus and Ukraine, restrictive measures that must be observed when self-isolating citizens in connection with COVID-19 infection, as well as level 1st and 2nd contacts. The authors analyse the new legislative provisions governing home and remote work, introduced into the labour legislation in Belarus in 2020, in Ukraine in 2020 and 2021. The article presents the specific experience of Belarus, where the presidential decree extended the rights of employers to temporarily transfer employees without their consent, as well as to change essential working conditions, and without making changes to the Labour Code. The authors give an assessment of such legislative innovations. The article deals with some issues of social support for employees who find themselves in a situation of downtime due to the suspension of the activities of organisations that are idle, as well as self-isolation. At the end of the article, some suggestions and recommendations are made for further adaptation of labour and social security legislation in Belarus and Ukraine in the context of the COVID-19 pandemic.

Аннотация: The purpose of the article is to identify and evaluate the main measures of migration policy and legal regulation in the field of combating the effects of the economic crisis, effective ways to regulate the situation on the labor market and employment and measures to address the economic crisis in the country of destination and origin. Methods of analysis and synthesis, theoretical generalization, historical, scientific-analytical, systematization and classification were used to identify scientific and theoretical bases of labor migration. The practical significance of the obtained results lies in the possibility of using the results of the study to overcome the socio-economic consequences of the coronary crisis by countries; to improve the activities of migration services.

Аннотация: Appealing to public authorities about any legal conflict leads to an overload of courts and administrative bodies. An alternative to improving access to justice and reducing the burden on the courts is to use other alternative means of resolving legal disputes, such as mediation. The article is devoted to the peculiarities of the application of the mediation procedure in administrative proceedings. Highlights the signs of administrative and legal dispute, as well as the peculiarities of the mediation procedure. The purpose of the study is to study domestic and foreign experience in the use of mediation in administrative proceedings, as well as to formulate proposals and recommendations for improving the current legislation in this area, based on the analysis of scientific papers, current legislation and law enforcement practice. The methodological basis of the study is a set of general scientific, philosophical, special methods of scientific knowledge, the use of which allowed to ensure the achievement of the stated goals and objectives of the study and comprehensive coverage of the research problem.

Аннотация: The COVID-19 coronavirus pandemic, which has spread to all countries of the world, has posed new challenges in terms of legal, socio-economic, political, and social development. The pandemic produced a need for a mechanism of legal regulation of a special organization of the remote work, working hours, workplace, working conditions, etc. The study aims to analyze and compare the legal regulation of remote work under the introduction of restrictive measures caused by the spread of COVID-19 in Ukraine and the EU. The leading method was the method of comparative analysis. It helped to compare the specifics of the practice of EU member states in the field of legal regulation of remote work under the above conditions in Ukraine and the EU, identify how these issues are regulated in other EU countries. In Ukraine, it is necessary to improve the rules for regulating the responsibilities of the employer to compensate for the costs of a remote worker, enshrining in law the obligation of the employer to provide the employee with computer equipment, means of communication. The experience of European countries proves it is necessary to implement “right to disconnect” in Ukraine. Information and knowledge gained from the experience of different EU countries can be used as a basis for the adaptation and development of new relevant provisions in Ukraine.

Аннотация: Purpose: The purpose of this paper is to examine the international regional system of the preservation of the right to health in the European human rights system through the work of the ECtHR, to analyse the case law of the ECHR based on the human right to health. This purpose determines the following tasks: to identify the features of the realization of the right to health in the European mechanism of human rights protection; to study the mechanism of realization of the right to health in the activity of the ECtHR; to describe the case law of the ECtHR in terms of the right to health. Design/methodology/approach: The “black letter” law methodology is used to focus attention on conducting research on the letter of the law and the desire to conduct a descriptive analysis of legal norms, based on primary sources. Findings: On the basis of the conducted researches, it is possible to draw a conclusion that the ECHR, albeit implicitly, refers to the right to health as well. Originality/value: The right to health is included in the catalogue of the most important universally recognized human rights and is most often considered as an integral part of socio-economic human rights, but there is no special universal or regional mechanism for protecting this category of rights.

Аннотация: The relevance of the study is based on the development of scientific and technological progress and the expansion of the labor market, including in the framework of international cooperation. Moreover, the introduction of quarantine due to the spread of Covid-19 has led to increased attention to remote work. The aim of the study is to analyze the legal aspects of remote work in accordance with the labor legislation of Ukraine and the European Union, focusing on the concept of remote work, the rights and obligations of remote workers. In our study, we determined that in the European Union, the key points in relation to the rights granted to teleworkers, which the countries parties to the agreement have undertaken to incorporate into their national legislation and collective agreements, are data protection; the voluntary nature of telecommuting; equipment; organization of working time; privacy. The originality of the study is based on more effective ways to improve labor productivity in Ukraine, labor discipline, compliance with labor guarantees for remote work. It is necessary to revise and legislatively regulate the key principles of compliance by employees with labor discipline, providing the employee with proper working conditions, supporting the employer in search of new opportunities to provide employees with work, improving the technical aspects of ensuring the relationship between business and government, responsibility for results and the labor process.

Аннотация: Ensuring equal rights and opportunities in modern society allows us to ensure its development without involving additional regulatory functions of the state. In this regard, it is relevant to determine the limits of discrimination, to isolate them from personal rights and to identify potential state regulation in this area. The authors of the article consider the issue not only as the basis for building mandatory functions in the field of social security, but also as a tool for the uniform distribution of social security factors. For this, an analysis was performed, which uses the mechanism of the initial analysis of equality and on this basis the limits that require legislative consolidation are determined for the use of restrictive mechanisms. The article discusses the definition of equality and, accordingly, the restriction of rights in the generic concept and highlights the foundations of regulation and the restriction of inequality at the level of fundamental documents of the state. Social protection is presented as a component of a developed society that can provide its members with basic needs, starting with material basic benefits and ending with the ability to freely achieve well-being. The authors also consider compensation mechanisms. Practical significance is determined by the fact that mechanisms for ensuring equal opportunities are identified and principles for regulating the sufficiency of social security are formed for citizens who experience discriminatory influence both from the state and from individual citizens.
