Аннотация: The article is devoted to the study of legislation aimed at regulating relations on the safe management of liquid radioactive waste in the EU, individual EU Member States, and Ukraine. This problem is relevant for the entire global community, as such waste can emit harmful ionizing radiation, which can not only lead to radiation sickness but also cause radiation pollution of the environment. Ukrainian legislation also deserves special attention, as in 1986, the Chornobyl Nuclear Power Plant accident occurred in Ukraine, which resulted in a large release of radioactive materials. Therefore, the approaches to the safe management of liquid radioactive waste implemented in Ukraine deserve special attention. The article focuses on a comparative analysis of Council Directive 2011/70/Euroatom with the national legislation of all EU Member States and Ukrainian legislation. The author draws a reasonable conclusion that all European Community States seek to protect their populations from the hazards that may arise because of ionizing radiation. A comparative analysis of the results of the implementation of this Directive has shown that the EU Member States face the greatest problems with the development of a national radioactive waste management program containing key performance indicators; timely informing the European Commission of new national programs and any significant changes to them; and the establishment of a regulatory body in the field of radioactive waste management safety that would be sufficiently independent of public authorities. Several proposals were made to bring Ukrainian legislation in line with Council Directive 2011/70/Euratom.

Аннотация: Digital Services Act (DSA) is one of the first and one of the most comprehensive legal acts in the world regulating relationships between digital platforms and their users. It sets fundamental principles on how platforms should act to combat illegal content while respecting human rights standards. However, it is disputable whether DSA can minimize all risks posed by various types of content usually shared by users on various platforms. These concerns become extremely apparent in times of sharp social conflicts and wars when disinformation, fakes and hate speech are used as a powerful weapon of information war. In this research these concerns are analyzed from substantive and procedural perspectives. For this purpose, both substantive and procedural provisions of the DSA are critically analyzed. Concerning substantive provisions, the authors discuss what types of content the DSA aims to combat and what instruments are used for this purpose. Procedural provisions are those which establish mechanisms for platform users to appeal against platform’s decisions. The authors analyze these provisions from access to justice and fair trial perspectives.

Аннотация: Purpose: The article analyses investigative and judicial practice aspects, recognising the admissibility of electronic (digital) evidence in criminal proceedings. Design/Methodology/Approach: During the work, a comprehensive study of electronic evidence's theoretical and applied aspects in criminal proceedings was conducted, highlighting their features and place in the procedural sources of evidence. Research Limitation/Implications: It has been established that the electronic format of evidence creates specific difficulties in the context of their establishment as evidence. Special attention in the research is given to proving based on electronic evidence. It is substantiated that information obtained from digital carriers can be used to construct investigative versions, identify criminal connections, and, in some cases, confirm the facts of a crime. It has been proven that information significant for criminal proceedings can be in electronic documents, photos, audio or video recordings, and arrays of informative data regarding databases, registry operations, telecommunication networks, etc. Social Implication: The process of proving forms the basis of pre-trial investigation, starting from entering information into the Unified Register of Pre-trial Investigations and up to the decision-making in criminal proceedings. Practical Implication: The article summarises contemporary scientific developments regarding the definition and essence of electronic evidence and examines the phenomenon of “electronic (digital) evidence” in criminal proceedings. It substantiates the norms of legal and legislative regulation of the process of using electronic evidence in criminal proceedings. Originality/Value: The research is dedicated to analysing the prospects for improving the work with evidence in electronic form in the criminal process of Ukraine.
