Аннотация: This article considers relevant science and law enforcement practice issues of state intervention's legitimacy in the right to peaceful property enjoyment in criminal proceedings during property seizure. These issues are considered everywhere through international instruments' prism, particularly the Convention for the Protection of Human Rights (ECHR) and Fundamental Freedoms, Article 1 of Protocol No. 1 to the Convention and the ECtHR case-law. Based on the ECtHR case law, the authors analyze the conditions under which the state may interfere in exercising a protected right, often called criteria for intervention. Based on the fact restrictions are permissible if they are prescribed by law, necessary in a democratic society and pursue a legitimate goal, the authors consider these conditions through the lens of national law enforcement practices of Ukrainian criminal proceedings. The authors emphasize the relevance of these criteria of the legality of individual rights restriction in criminal proceedings since when applying for property seizure, the Ukrainian legislator requires investigating judges to consider reasonableness and restriction proportionality of property rights, and apply the least onerous seizure method, not suspend or excessively restrict a person's lawful business activities, or other consequences significantly affecting others' interests. Due to the amendment of the Ukrainian criminal procedure legislation, the practice is slowly approaching the European Court of Human Rights practice's European standards. However, proper systematic, logical and consistent court decisions limiting the human right to peaceful property possession remain critical. Based on the study, the authors offer a model of logical reasoning, following which the investigating judges can correctly formulate the motivational part of the decision to satisfy or deny the request for property seizure. Particular attention is paid to the reasonableness, suitability, necessity, and proportionality of the means of restricting the right to peaceful enjoyment of the property and describes each of them.

Аннотация: The paper investigates topical issues of application of precautionary measures against persons subject to criminal proceedings for the application of compulsory psychiatric care in the context of international standards and interpretative practice of the European Court of Human Rights (ECHR). The purpose of this paper is to identify and analyse the specific features of applying precautionary measures to a person suffering from a mental disorder based on the materials of generalization of domestic law enforcement practice in criminal proceedings regarding the application of compulsory psychiatric care. Research methods are selected with consideration of the purpose, objectives, and subject of research. General scientific and special methods of scientific cognition (dialectical, statistical, comparative law, analysis, synthesis, generalization) were used in the work. The integrated use of these methods has contributed to an objective and comprehensive scientific study. Based on the analysis of the current legislation and judicial practice, the specific features of application of preventive measures in criminal proceedings regarding compulsory psychiatric care are singled out, namely: a) they are applied to a person suffering from a mental disorder; b) are selected only in criminal proceedings concerning the application of compulsory psychiatric care; c) have a specific purpose conditioned by the presence of a mental disorder from which the person suffers. The specifics of the applying the measures envisaged by Art. 508 of the Criminal Procedure Code of Ukraine (hereinafter referred to as the CPC) allowed to question the legitimacy of the legislative approach as to their allocation to the institution of precautionary measures in criminal proceedings. In particular, it was concluded that in contrast to the general purpose of application of precautionary measures stipulated by Art. 177 of the CPC (concerning the suspect, the accused, the condemned), for the purpose of applying precautionary measures envisaged by Art. 508 of the CPC (concerning a person in respect of whom the application of compulsory psychiatric care is stipulated) are: 1) prevention of risks of their possible illegal behaviour; 2) provision of qualified psychiatric care to them; 3) ensuring the person’s safety and the safety of others. In this regard, it should be noted that the position of the domestic legislator on the possibility of applying precautionary measures to persons suffering from mental disorders is subject to reasonable criticism of the legal community. The main argument in this debatable issue is that these persons cannot be subjects to which precautionary measures are applied, as the latter, according to the general rules, can be applied to clearly defined subjects of criminal proceedings - suspects, accused, and convicts.

Ausgangspunkt sind Empfehlungen der Europäischen Union zur Kriminalitätsbekämpfung. Dazu verabschiedete der Rat der EU u. a. einen Rechtsakt zur „Schaffung eines einheitlichen europäischen kriminalistischen Raumes“. Im Beitrag wird am Beispiel kriminalistischer Organisationen in Litauen, der Ukraine und Deutschland diskutiert, wie öffentliche nichtstaatliche Organisationen durch wissenschaftlich-praktische Zusammenarbeit diesen Prozess fördern können. In einem „Palanga-Memorandum“ wurde die Gründung einer „Europäischen Föderation nationaler kriminalistischer Organisationen“ beschlossen und nationale europäische kriminalistische Organisationen/Vereine aufgerufen, darin mitzuwirken.

Аннотация: The legal regulation of relations about software (computer programs) is conducted mainly in two directions: copyright and patent law. But despite lengthy discussions in scientific circles in almost all countries, there is no final and single solution to this issue. Historically, the model of copyright protection of the object under study offers a cheaper and faster procedure than the model of protection of software by patent law. Patent protection requires a rather expensive and lengthy examination of software for world (absolute) novelty, during which the object itself may become obsolete and become unpopular with potential users. Therefore, the copyright regime for the protection of software has received preferential recognition. Accordingly, the article attempts to investigate the problems of the existing in the world copyright model of software protection and the possibility of patenting them.

Аннотация: OBJECTIVE: The aim: 1) To develop an informative model of the process of automated qualification of criminal offenses against human health for countries with a continental legal system; 2) on the basis of information model to create a decision support system in the form of a software product in terms of qualification of a criminal offense against human health. PATIENTS AND METHODS: Materials and methods: The information model of the process of automated qualification of a criminal offense against human health was developed using the BPMN method on the basis of European countries' legislation with a continental legal system. According to the information model, a decision support system was developed in the form of a software product. RESULTS: Results: 1. An information model of the process of automated qualification of criminal offenses against human health for countries with a continental legal system has been developed. 2. A system of decision support in the form of a software product as an element of law enforcement in terms of qualification of a criminal offense against human health. CONCLUSION: Conclusions: The proposed decision support system for automated qualification is a means of preventing unreasonable qualification of committed offenses as it minimizes the errors of this process. As a result, it will increase the preventive effect and the quality of law enforcement work to prevent crimes against human health.

Аннотация: Recommendations for the development of a state internal audit system in conditions of using digital technologies have been elaborated. It was established that the procedures of conducting state internal audits change under influence of digitization. Conformity of the stages of audit digitization and the applied digital technologies was established. Foreign experience in the digitization of the state internal audit was analyzed. It was also established that the active application of artificial intelligence technologies may be one of the probable scenarios of the development of the state internal audit system in foreign countries in the near future. Types of digital technologies were systematized depending on the field of state internal audit. It was found that the maximum effect from the use of digital technologies in the field of audit will take place in the case of their synergistic combination. Coordinated interaction between constituent elements of the state internal audit has been established. This has made it possible to present the process of development of the state internal audit system in conditions of digitization and determine its main objective: ensure greater transparency and efficiency of accounting for tangible assets by means of new digital technologies. Taking into account the above, a mechanism of development of the system of state internal audit in conditions of use of digital technologies was offered. It is based on corresponding directions and measures. It was established that to assess the efficiency of development of the state internal audit system in conditions of application of digital technologies, it is advisable to use the indicators reflecting overall results of measures taken in state financial control. The application of the proposed mechanism will make it possible to establish the effect of digital technologies on the development of the state internal audit.

Аннотация: Background. The jurisdictional immunity of a state means that the state cannot be involved as a defendant in a case considered by a foreign court. In Ukraine, the rule on the jurisdictional immunity of a foreign state is enshrined in Art. 79 of the Law of Ukraine ‘On Private International Law’. Until 14 April 2022, the Ukrainian Supreme Court rigidly applied the provisions of the said article and recognised the Russian Federation’s immunity with regard to claims brought by Ukrainian citizens seeking compensation for harm caused by the armed conflict that commenced in 2014. Yet shortly after 24 February 2022, when Russia’s aggression against Ukraine entered a new phase, i.e., the phase of full-scale war, the Supreme Court changed its mind. Methods. This note addresses the ruling of the Ukrainian Supreme Court of 14 April 2022 in case no. 308/9708/19, where the Court held that the Russian Federation could not plead immunity with regard to tort claims brought by the victims of the Russia-Ukraine war. In reaching this conclusion, the Court relied on the territorial tort exception enshrined in the European Convention on State Immunity (Basel, 16 May 1972) and the UN Convention on Jurisdictional Immunities of States and Their Property. Though neither of the two conventions has been ratified by either Ukraine or the Russian Federation, the Court found that these conventions indicate a general tendency in international customary law towards limiting the jurisdictional immunity of the states. T he reasoning of the Supreme Court is examined by scrutinising the authorities the Court adduced in support of its ruling, as well as by putting the ruling in the broader context of the jurisprudence of the International Court of Justice (ICJ) and European Court of Human Rights (ECtHR). Results and Conclusions. It is concluded that what the Supreme Court utilised is not the territorial tort exception but rather the ‘human rights/jus cogens’ exception. Further, the case before the Ukrainian Supreme Court is distinguishable from the ICJ and the ECtHR cases, where it was held that notwithstanding gross violations of human rights, the respondent state should nevertheless enjoy immunity. Unlike those cases, the Ukrainian case was tried amid the ongoing war, when no reparation agreements had been concluded, the legitimate aim of ‘promoting comity and good relations between states’ had been frustrated, and it was no longer possible to justify the restriction of the plaintiff’s right of access to a fair trial.

Аннотация: Background: The extraction and use of natural resources are reasons for environmental problems all over the world. The article examines one environmental right – the right to general water use, and its interrelation with the use of coastal protection strips (water fund lands), as well as specific problems of judicial practice in terms of protecting this right. There is a direct or indirect interrelation between utilised natural objects when confirming the environmental rights of citizens at the level of current national legislation, who are given the opportunity to use natural resources to meet their own needs and be in a harmonious state with the environment as much as possible. Such an interrelation is also reflected in cases of general water use, which is impossible without involving the use of water fund lands, namely coastal protective strips. Methods: With the help of scientific methods, the article uses and analyses international acts, data of international organizations, conclusions of scientists, and legal scientific literature. The legal regulation for using coastal protection strips as a prerequisite for exercising the right to general water use has been investigated within the framework of a systemic approach, as well as analysis and synthesis. Results and Conclusions: It is concluded that the lack of physical access to water bodies and non-compliance with the requirements regarding the proper water quality in water bodies, unfortunately, does not allow for the implementation of the right to general water use either properly or without harming the life and health of citizens. It is noted that in most instances, the result of court case consideration regarding protection of the right to general water use was the refusal to satisfy the claims due to the lack of reasoning and proper argumentation by the claimants, and to hold the decision against them. Claimants have to overcome a number of difficulties in order for their evidence to be recognised by the court as reliable and well-founded. The presence of certain deficiencies in the normative legal acts regarding the right to general water use plays a major role in this process. In order to solve the aforementioned problems and improve water legislation, appropriate proposals in the form of changes and additions to the general provisions of the Water Code of Ukraine have been argued and proposed.

Аннотация: This chapter reports on the past and most recent historical context of violence and the presence of intimate partner violence (IPV) in Ukraine. While research is just beginning to identify the effects of IPV on Ukrainian women and children, a number of cultural and demographic factors that place women and children at greater risk are identified. These include elements of Ukrainian culture, as well family, religious, and social values that sustain domestic violence. There is a further discussion of cultural and contextual issues that need to be addressed when considering programs for women and children exposed to IPV. The chapter ends with suggestions for strategies to overcome barriers to change in Ukraine

Аннотация: Objective: To assess the prevalence of intimate-partner violence (IPV) in a sample of Ukrainian mothers of schoolchildren, and to examine the relationship between IPV and family, parent, and child characteristics using multilevel models. Method: Mothers of children ages 9-16 (N = 278, 93.5% Ukrainians) answered the Revised Conflict Tactics Scale (CTS2; Straus, 1979; Straus, Hamby, Boney-McCoy, and Sugarman, 1996), an instrument that measures IPV. We also examined the relationship between IPV and maternal age, education, employment and marital status, family income, and rural or urban residence. Results: Most of the women (81%) reported psychological violence and 58% reported physical assault. On average, women reported 66 instances of IPV during the last year. Multilevel modeling revealed that lower maternal education, unemployment, not living with the husband or partner, and urban residency were associated with higher IPV victimization. Younger age and family income were not significantly related to IPV. Conclusion: We found IPV to be a significant social problem in the present sample of Ukrainian mothers of school-age children. Future policy and violence-prevention programming should focus on supporting academic and employment opportunities for women, particularly for those living in urban areas.

Аннотация: Certain aspects of the adaptation of regulatory legal acts of Ukraine in the field of drug trafficking control to EU legislation were studied. The basis of this study uses an interdisciplinary approach using comparative legal, dialectical and systemic methods. Emphasis is placed on the fact that the world community does not have a unanimous opinion on legal issues and areas of the modern drug control regime that would meet the needs of the social and legal society and the current state of the drug situation in the countries of the world, and health problems. It was established that the adaptation of the regulatory legal acts of Ukraine in the field of drug trafficking control, the fight against their use and treatment of drug addiction of patients should be based on the implementation of public health programs. n its areas, should include the prevention of disease, prolonging life and improving the health and well-being of the entire population, including drug-addicted patients, for whom the state has an inherent responsibility. Ukraine participates in Council of Europe conventions which establish common standards for this organization and the European Union, it is important for the legal regulation of drug control in the health field, but some norms of national legislation require consistency with the norms of UN Conventions, and it is important to use positive legislative experience of selected countries of the European Union. It is proposed to amend the regulatory legal acts that will improve legal ways to protect people's rights to health protection.

Аннотация: The article analyses the problems of Ukraine fulfilling its obligations under the Convention on the Civil Aspects of International Child Abduction in the context of the COVID-19 pandemic. It was found out that the Convention on the Civil Aspects of International Child Abduction is an important international tool that imposes clear requirements on the state that has joined it, to protect the rights and interests of the child, guarantee his safety and prevent illegal movement. The article examines the procedure for Ukraine to perform tasks within the framework of the Convention on the Civil Aspects of International Child Abduction, in particular by the Ministry of Justice of Ukraine. The article analyses the approaches of the European Court of human rights to protect rights in cases of international child abduction and their application by the Supreme Court and other courts in Ukraine.

Аннотация: Objective: The article is aimed at studying certain issues of legal regulation of compensation for moral (non-pecuniary) damage. Methods: The methodological basis of the research on the indicated topic is a set of used general scientific and special legal methods. These methods complement each other taking into account the research topic, which in turn contributes to objective analysis. Among the methods of research on the topic of this article, it is worth highlighting dialectical and semantic methods, the method of system analysis, and the method of analogy, comparative legal and historical methods. Results: Is to study and analyse the current legislation to identify the possibility of compensation for moral (non-pecuniary) damage to an individual who has suffered from a criminal offence at the expense of the State Budget of Ukraine, with further formulation of possible conditions and procedure for compensation for moral (non-pecuniary) damage to an individual caused by a criminal offence at the expense of the State Budget of Ukraine. Conclusion: The article is devoted to the investigation of the possibility of compensation (compensation) of moral (non-property) damage to an individual who suffered from a criminal offense at the expense of the State Budget of Ukraine. The definition of the concept of moral (non-property) damage caused to an individual by a criminal offense is formulated. The content of moral (non-property) damage and the conditions for its reimbursement are analyzed.

Аннотация: The status of Ukraine as a candidate country for the European Union membership reinforces the need for comparative analysis between Ukrainian regulations and law of other EU Member States as well as European regulations. One ofthe fields of comparative law is a development of mediation for disputes covered by administrative law. It has already been a subject of interest and promotion to both - The EU and the Council of Europe, since European standards of democracy provide for state cooperate with citizens individuals. The aim of this article is, to examine the main provisions, recommendations and best practices of the CoE member states, and to analyse the current practice and existing gaps in Ukraine in order to develop a proposal for effective implementation in the light of the most recent CEPEJ Guidelines promoting mediation to resolve administrative disputes. A comparative overview of this type of mediation regulations may be considered as novum. As for methodology, the paper is dominated by the logical-linguistic and comparative method. So far-though Ukrainian legal system is quite compatibile with the examined CEPEJ gudelines and provide for inter-branch solutions - the development of administrative and court-administrative mediation is quite resilient and there is still much to be done not solely with legal regulations, but also.mediation culture'' in such field.

Аннотация: This Special Issue denotes the first comprehensive attempt to place business and human rights-related (BHR) developments in the Central and Eastern Europe (CEE) region on the map of global discussions in BHR. CEE is a geographical area historically, politically, socio-economically, geo-strategically and culturally distinct from other regions, including Western Europe. Hence, this Special Issue explores the region's specific elements and factors and how they affect and influence the implementation and embedding of human rights in the practice of business enterprises in the region. The 'Scholarly Articles' and 'Developments in the Field' pieces collected in this issue highlight promising and not-so-promising developments and practices of state institutions, business enterprises, and other actors. It documents the current situation in the region and outlines ideas and prospects for addressing the identified challenges over the next decade. Introducing the Special Issue, this editorial outlines the region's leading trends and prospects in BHR. It reflects on persisting challenges and notes the region's progress in BHR awareness, knowledge and capacity in recent decades.

Аннотация: The article describes the experience of Great Britain, Canada, Australia, and New Zealand in the field of criminological protection of justice. A combination of philosophical, general scientific and specific scientific research methods was used in the preparation of this article to find out which special actors are authorized to carry out such criminological activities, to analyze the powers and guarantees for their exercise to fulfill their tasks. The article reveals the peculiarities of interaction of special actors of ensuring the security of justice with other actors in the system of combating offenses and crimes against justice. The author emphasizes the role of the sheriff, police, and private security companies in ensuring security during the judicial process. The experience of these Commonwealth countries in identifying and counteracting possible threats to the security of justice is analyzed. The purpose of this work was to single out positive foreign experience that may be promising for implementation into the national legislation with the aim of improving activities of the Court Security Service, which is a special subject performing implementation of the function of criminological protection of justice in Ukraine. In particular, firstly, to find out which special entities are authorized to carry out the specified criminological function in certain countries of the British Commonwealth and what powers they have; secondly, what other law enforcement agencies are involved in the mechanism of ensuring criminological protection of justice and what are the features of their interaction with special subjects; thirdly, what measures they take to detect and counter possible threats to the security of justice.
